STATEMENT 1.1 This East f England Ambulance Service Agreement dcuments the temprary arrangements which have been cllectively agreed with the Trust s recgnised trade unin, Unisn that will apply during identified perids f majr rganisatinal change. 1.2 The aim f this Agreement is t maximise the cntinuance f services during perids f majr rganisatinal change as defined by the Trust Executive Leadership Team (ELT). 1.3 The Trust will seek, where pssible, t cntinue t perate within its existing emplyment principles during perids f majr rganisatinal change. Hwever, it is envisaged that temprary mdificatins t ur current emplyment plicies, prcedures and practices will be necessary. 1.4 This Agreement aims t address sme key issues that will present a challenge t the Trust during majr rganisatinal change and t set ut what has been jintly agreed in rder t address these. 1.5 The cntents f this Agreement have been entered int n behalf f all staff fllwing cnsultatin with the Trust s recgnised trade unin, Unisn as agreed by the Trust s Staff Partnership Frum (SPF). The cntents f this Agreement will be implemented fllwing its frmal apprval by the ELT. It is imprtant t nte that all and any decisins permitted under this Agreement can, and will be, revked and a return t nrmal practice will ccur as apprpriate under the directin f the Trust Bard r ELT in liaisn with the Trust s SPF. 1.6 This Agreement has been develped and written in partnership by management and staff side. SCOPE 2.1 This Agreement applies t all staff emplyed by the Trust. 2.2 This Agreement des nt deal with the rganisatin r prvisin f trust services, ther than thse relating t human resurce plicies r emplyment matters. 3. ACCESS TO THE AGREEMENT 3.1 All emplyees are entitled t access t this agreement which is lcated n the trust s Intranet. If yu require this Agreement in any ther frmat please seek guidance frm the Human Resurces Department, yur line management r trade unin representative. 3.2 Emplyees and Managers may als wish t cnsult the Change Management, Redundancy and Redeplyment Plicy. 4. ROLES AND RESPONSIBILITIES 4.1 The Human Resurces Department is respnsible fr keeping the prvisins within this agreement in line with emplyment legislatin and best practice peple management principles, where pssible. 4.2 Managers, HR staff and trade unin representatives are respnsible fr prviding advice and guidance t emplyees n the applicatin f this Agreement. 4.3 Management and trade unin representatives are respnsible fr bringing any mutually beneficial imprvements t this Agreement t the attentin f the Trust. 5. IMPLICATIONS OF MAJOR ORGANISATION CHANGE FOR THE TRUST 5.1 In determining the scale f the implicatins required, the Trust will be guided by: The advice given by the ELT; The advice given by the AD f HR; The advice f the Staff Partnership Frum. 5.2 During Majr Organisatinal Change, all HR plicies will remain in place. If it has nt been pssible t cmplete the scheduled review f a plicy SPF will autmatically rll ver the date fr review. Hwever, the practical ability t adhere t all aspects within thse plicies will be reviewed in accrdance with any effect n the delivery f services in which case the mdificatins listed in the table belw will autmatically apply. 5.3 Where statutry timescales are specified within plicies every effrt will be made t meet these, althugh it is expected that sme deadlines may be extended where physical resurces make it impssible t meet these. 4 EAST f ENGLAND AMBULANCE SERVICE NHS TRUST nn-statutry timescales r functins are described, these may be pstpned fr the duratin f the Majr Organisatinal Change. 5.4 During Majr Organisatinal Change, the fllwing will apply and supersede the respective elements f trust emplyment plicies, practices and/r prcedures as fllws: POLICY* VARIATIONS DURING MAJOR ORGANISATIONAL CHANGE Annual Leave (fr staff grups as defined by SPF) Requests fr annual leave will be made and apprved in the usual way and n sner than 12 mnths in advance. Decisins t apprve annual leave will be dependent n sustaining satisfactry service levels during Majr Organisatinal Change. Where annual leave has already been bked and apprved, this will be hnred (see Annual Leave Plicy). During Majr Organisatinal Change, shuld an urgent need arise, members f staff may be apprached by the Trust n either a staff-wide (EEAST) basis r n an individual basis and asked if they are willing t wrk their annual leave. Where a member f staff agrees t wrk their annual leave, they will attract payment at vertime rate (in this exceptinal Agreement, vertime rate will apply t bth full-time and part-time staff wh wrk their bked perid f annual leave). It shuld be nted hwever, that staff can nly wrk annual leave ver the 28 statutry days they are required t take under the Wrking Time Regulatins. As a means f prviding additinal flexibility t maximize staff ability t take leave, staff with a persnal leave year ending during the perid f Majr Organisatinal Change may be permitted t: a) Delay the taking f any utstanding annual leave until after the perid f Majr Organisatinal Change where this wuld nt take their cmbined yearly annual leave and public hliday leave t less than 28 days in either f the applicable years. b) Cnsider bringing frward up t ne week f annual leave frm the next leave year t be taken befre the end f their persnal leave year where this wuld nt take their cmbined yearly annual leave and public hliday leave t less than 28 days in either f the applicable years. Cnsideratin may be given t increasing the vlume f leave available during ther parts f the year (where fr example, there is a predetermined/knwn perid f Majr Organisatinal Change, i.e. as was the case in Jint Cllective Agreement: HR Respnse t Majr Organisatinal Change - 2 Aug 2013 Page: 4 f 8

PDR It is anticipated that PDRs may be delayed during the perid f Majr Organisatinal Change. Recruitment and Selectin As far as reasnably pssible nrmal recruitment activity will cntinue fr thse rles fr which recruitment has been authrised. Secndment All secndments in place befre the cmmencement f a perid f Majr Organisatinal Change may be reviewed. This may result in these: a) being extended fr this perid where these supprt service delivery requirements. If s, the secndee will cntinue t attract the apprpriate pay; r b) these being brught t a necessary end Sickness Absence Management Return t wrk interviews will be carried ut where pssible as per existing prcess. Any changes t absence reprting prcedures necessary during the perid f Majr Organisatinal Change will be cmmunicated t staff and managers via nrmal cmmunicatin mechanisms. Special Leave Emplyees asking t take time ff fr public duties leave as set ut in the plicy may have this leave declined during the perid f Majr Organisatinal Change. Where emplyees are ntified f Jury Service, the Trust may request them t ask that this be deferred wherever pssible; the Trust will prvide supprting evidence if necessary; The Trust may request that attendance at any prfessinal/regulatry bdies will be deferred wherever pssible. Standards f Business Cnduct, Cnflicts f Interest and Secndary Emplyment Variatins in Clinical Practice Flexible Wrking Requests Emplyees are reminded that where their emplyment with EEAST is their primary emplyment, this must take precedent ver any secndary emplyment. During the perid f Majr Organisatinal Change, the Trust will be guided, with advice frm the Directr respnsible fr the prvisin f clinical care, as t whether it is practical t meet any statutry/nnstatutry timescales t investigate/hear Clinical Variatin issues r whether they need t be pstpned fr a defined perid. Hwever, if it is fund that ther plicies are affected these will be added t the table abve and nce signed ff by SPF, this plicy dcument will be published in its amended frm). 5.5 The advice, guidance and plicies cntained within the natinal NHS Terms and Cnditins f Service Handbk remain relevant and in frce during the perid f Majr Organisatinal Change. 6. ADDITIONAL FLEXIBILITY OF STAFF / RESOURCES 6.1 Shuld staff resurces be unexpectedly depleted in any particular department during the perid f Majr Organisatinal Change, the Trust may draw n a range f staff t ffset any impact due t absence and may ask staff t wrk flexibly and/r take n new rles where this is reasnably practical (any such rle wuld be within their abilities/training/experience etc). The Trust will seek t fcus nly n essential wrk in rder t maximise the number f staff available. Staff may need t be redeplyed t ther wrk, lcatins r functins. This may vary by lcatin depending n the lcalised effects. 6.2 Part-time staff may be asked t increase their hurs, where practicable, fr a temprary perid. Any decisin t d s will be n a temprary basis at the discretin f the emplyee. 6.3 A temprary review may be made f emplyees wrking patterns/hurs/lcatins/shifts; balancing the need t sustain services with the pressures that will fall n emplyees wh have childcare and ther caring respnsibilities (including pssible hme-wrking and wrking frm ther Trust/NHS sites where this is viable). 7. WORKING TIME DIRECTIVE PROVISIONS 7.1 In rder t enable the Trust t maintain service delivery during the perid f Majr Organisatinal Change, staff may be asked t increase their hurs. T ensure cmpliance with the wrking time directive, the reference perid fr the calculatin f wrking hurs will be extended frm 17 t 52 weeks. This extensin will be reviewed by SPF, in line with paragraph Staff have been ffered the pprtunity t vluntarily pt ut f the 48 hur wrking week, if cnsidered necessary. The management f cmpensatry rest perids will be managed lcally and mnitring f this and verall hurs wrking will cntinue t take place. 7.3 It shuld be nted that the SPF will be mnitring the wrking hurs f staff during the perid f Majr Organisatinal Change t ensure the well-being and safety f staff. 8.
