I. SCOPE Art. 1 The present tariff specifies the rates, conditions and prices of the services, provided by Port Fleet Bourgas Ltd. to the ships, sailing internationally and coastally and all additional services, related to the activities of the company. Art. 2 The rates of charges hereinafter are shown and payable in EURO / /. The amount payable is calculated in BG Leva by using the central exchange rate of the BNB (Bulgarian National Bank) for the day of invoicing. II. SERVICES PROVIDED TO INTERNATIONALLY SAILING SHIPS Mooring and unmooring Art. 3 /1/ The charges, listed in column 7 Table 1 are payable for each mooring and unmooring of the vessel. /2/ Mooring and unmooring of vessels over 100 GT is compulsory according regulations of the Maritime Administration. /3/ The charges under item /1/ cover up to 5 bow and stern mooring lines. For each additional mooring line will be applied. /4/ The charges of item /1/ shall be reduced by 50% in case shifting of the vessel alongside quay is carried out at a distance, shorter than her maximum length (LOA). Towage and other services Art. 4 /1/ The charges of columns 2, 3, 4, 5 and 6 of Table 1 shall be applied for towage of ships in, out and shifting within the Port area where moored. /2/ The charges due under the previous item are to be paid according to the GT of the vessel. The reduced GT /for Tankers featuring isolated ballast tanks/ is NOT to be considered as a base for calculations. The number of tugs employed is determined by the Port regulations or Port customs, TABLE 2. /3/ The charges of column 6, Table 1 are to be applied for employment of each additional tug, provided at Captain s request. /4/ Towage is compulsory for vessels over 1,000 GT and shall be perform in accordance with the Mandatory Rules of the Maritime Administration Bourgas.

2 Towage for vessels, carrying dangerous cargoes on board and tankers without a Gas Free Certificate is compulsory, regardless of their GT. If so instructed by the Maritime Administration-Bourgas, the towage is mandatory for vessels under 1,000 GT as well. Art. 5 The towage charges, under item 1 of Art. 4 are to be increased: /1/ by 50% when assisting a vessel featuring main engines out of order. Berth 20A belongs to the Port area East. /2/ by 50% of column 6, Table 1 when lightening operations take place off-shore stations. Art. 6 /1/ The employment of a mooring boat is mandatory for vessels over 100 GT and it is performed in accordance with the Port regulations. /2/ The charges for usage of a mooring boat excluding berth No.20-A are as follows: Vessels up to 10,000 GT Vessels up to 20,000 GT Vessels over 20,000 GT /3/ Cost for using a mooring boat at berth No.20-A is due according TABLE 3. /4/ Discount of a 50% is to be applied for towage services only for Passengers & Naval Ships, which call at Port of Bourgas & Port of Nessebar basis following conditions: - 24 Hours Notice to be provided to the duty officer - Advanced payment done. /5/ Using of a mooring boat and mooring men for Passengers & Naval ships is charged as per Art.6 /2/ for mooring boat and TABLE 1, column 7 for mooring men. Fire fighting duty services for tankers and other ships (stand-by safety tug) Art. 7 The charges due for on-duty services of a tug, furnished with fire-fighting equipment at Port Rossenets and Berth 20A at Port area Bourgas East is /fifty Euro/ per tug, per commenced hour, starting from the moment, when the vessel is moored /all ropes secured/ until completion of unmooring the tanker /all ropes aboard ship/. III. SERVICES, PROVIDED TO SHIPS, SAILING COASTALLY AND HIRE OF SEA VESSELS Art. 8 The charges for employment of other vessels are due for each commenced hour as follows: 1. Tugs with main engines horsepower: up to 750 bhp up to 1,200 bhp up to 2,400 bhp up to 4,200 bhp Service motorboat /launch-boat/ Mooring boat Art. 9 /1/ Rental of sea vessels is effected on the grounds of a written contract signed beforehand and a written request provided at least 4 /four/ hours in advance. /2/ In cases of renting sea vessels for period less than 48 /forty eight/ hours, the accepted

3 written request shall be assumed to have the legal effect of a contract. Art. 10 All damages caused to the sea vessels through the fault of the renter, as well as the repairs needed shall be to the renter s account and rent for the time of repair is due according art. 8. Art. 11 /1/ The rental period commence with the un-mooring the vessel and her placing at the renter s disposal as the exact time is logged in the vessel s log book. Should taking-over be delayed through the fault of the renter, the former is due to pay rental, starting from the hour logged in the vessel s logbook. /2/ Rental period completes with the act of mooring the vessel at her permanent homesite berth or with the act of her renting to another renter. /3/ In case of renting or transferring the rented sea vessels to a third party without consent of the Management of Port Fleet Bourgas Ltd., the primary renter is liable to pay to Port Fleet Bourgas Ltd. the rent due for the total period of re-renting or transferring the equipment to a third party, increased by 100%. /4/ Retaining the equipment for a period longer than stipulated in the contract through the renter s fault shall result in his being liable to pay the rental increased by 100% for the time overdue. Art. 12 In estimating the rental period, each commenced hour shall be paid as a full one. IV. OTHER SERVICES Art. 13 For all services, which are not mentioned in the tariff /in necessity of personnel or technical equipment use/, belonging to Port Fleet Bourgas Ltd. the client/s/ shall pay to Port Fleet Bourgas Ltd. a charge of for every commenced hour of work plus the value of the materials used. V. OBLIGATIONS FOR PAYMENT FOR THE SERVICES Art. 14 The services described in present tariff are payable to Port Fleet of Bourgas Ltd. on behalf of its clients or their forwarding agents, with which a contract has been signed or other written agreement was duly negotiated (fax, telex, letter). Art. 15 Payments between Port Fleet Bourgas Ltd. and its clients shall be made in accordance with the relevant law by-laws. Art. 16 Port Fleet Bourgas Ltd. is entitled to require an advance payment for its services. Art. 17 The final settlement of the actual balance due between Port Fleet Bourgas Ltd. and the client or his forwarding agent shall be performed after completion of the service/s/. Art. 18 In case no other special preliminary signed agreement, covering the payment terms for the services, the client or his forwarding agent is obliged to settle up the payments due within 10 /ten/ working days after the invoice is issued and handed over to the beneficiary. Art. 19 After expiration of time period, stipulated in Art. 18 and the failure of the client to pay by bank transfer, the client owes to Port Fleet Bourgas Ltd. a redress of the amount in three months libber of BNB, increased by 10%. Art. 20 In case of client being in failure to pay on time, depending of type of the charge he defaults upon, Port Fleet Bourgas Ltd. has right to: /1/ File a request the ship to be detained in accordance with the Bulgarian Merchant Shipping Code. /2/ Refuse the maneuver or operation, being required for.

4 Art. 21 In case the client places a claim for an invoice for the services provided by Port Fleet Bourgas Ltd., the client is obliged to pay up promptly the whole amount of the invoice, being in dispute. The client shall under the established procedure duly and in writing challenge the part of the invoice on which payment is questioned. VI. GENERAL ITEMS Art. 22 As a client - according to the tariff, is considered the ship owner, ship s agent, the forwarder of the cargo or any other legal party, to which have been provided any of the services. Art. 23 All services shall be paid for at the respective rates given in the present tariff with a mark up of 50% when provided on national and official holidays. Art. 24 In cases when maneuver of the ship exceeds the duration specified in the Remarks for reasons due to the ship, the basic charges for the service will be marked up with 25 % for every half hour. Art. 25 The term day shall be considered as time span between and 24.00h. Art. 26 /1/ Should Port Fleet Bourgas Ltd. deems it economically viable, might offer more favorable terms of payment for services under the present tariff. Force majeure shall in no circumstances warrant an increase of any of the rates of this tariff. /2/ The charges due for the services provided under the present tariff may be subject to mark-up or reduction if so negotiated between Port Fleet Bourgas Ltd. and the client. Where two or more mark-up or rebates apply the total mark-up/rebates is arrived at as their sum or difference. The charges thus derived shall be rounded up to next Euro or BG Leva. /3/ The charges for services provided by Port Fleet Bourgas Ltd., which are not mentioned in the present tariff, shall be subject to further negotiations between the parties and to be paid separately. Art. 27 The charges of the present tariff shall be paid on the grounds of the data provided by Captain s declaration and Pilot s bill, or by the Harbor Master in Bourgas. Art. 28 Claims, that charges have been collected in excess of what was actually due to be made within one month of the date of invoicing. Present tariff comes in force as from 01 February 2015.
