ADVERTISING AND SPONSORSHIPS Information to be Provided to District-Affiliated Groups Attachment A Policy Highlights as produced by the District s Policy Committee dated February 28, 2012, as updated from time-to-time shall be made available to District-Affiliated Groups in order to facilitate their compliance with the accompanying Policy and this Regulation. Required Conditions to be Contained in Sponsorship Agreements In addition to the prohibitions set forth in Policy 913.1, the following conditions shall be included in all Sponsorship Agreements: 1. Advertising will not be displayed inside classrooms, in areas where students in class may view the advertisements, or in any other area that may be disruptive to student learning. For purposes of this policy, the term classroom is not intended to include any school building s auditorium, gymnasium, library, performing arts center or athletic fields/facilities. 2. No Sponsorship Agreements shall require or contemplate that students would be required to listen to, read or be subjected to commercial advertising in the classroom or as part of their curricular instruction. 3. Advertisements shall not be disruptive or jeopardize the safety of students, staff and/or public by their content or physical properties. 4. No student or staff information (e.g., names, addresses, telephone numbers or addresses), regardless of whether permitted under federal or state law or not, shall be made available to sponsors as part of any Sponsorship Agreement for purposes of distribution or dissemination of advertising.

All proposed advertisements are subject to any applicable license, consent, condition or similar approval which may be required by any governmental authority as well as all applicable statutes, regulations, ordinances and case law as may be currently or hereafter in effect. 6. No sponsor shall be permitted to use the District s intellectual property (e.g. team names, slogans, logos, or designs constituting trademark or services marks whether or not registered) unless such use is identified in an approved Sponsorship Agreement or approved in writing by the School District. 7. Advertising signs should not be construed as an endorsement by the District of the product or service being advertised. 8. The District shall provide no personally identifiable data about a student to the sponsor of a commercial activity. Students shall not be required to complete any survey or questionnaire that is designed to provide marketing information to a vendor or business about their interests and preferences for a particular vendor, business, or product. 9. The sponsor shall represent that its activities and trademarks do not violate the trademark, patent, copyright, trade secret, or any other intellectual property rights of any person or entity, and sponsor will defend the District and hold it harmless in any litigation for misappropriation of trade secrets, unfair competition and trademark, patent, copyright infringement, or any other intellectual property claim which may arise out of sponsor s advertisement. Exclusive Rights Contracts The following conditions apply to whether the District will agree to an Exclusive Sponsorship Agreements: 1. There are no other current or expected advertising presence of a competing sponsor. 2. It is the expectation that Exclusivity Rights will be sold on a three (3) year agreement basis, but if requested the term may be negotiated for a shorter duration. 3. Sponsors who want to renew their Exclusivity Rights agreements will need to provide the District or its agent with its intent to renew 90 days prior to end of their existing agreement. Joint Contracts with Other Educational Entities For purposes of Joint Contracts with Other Educational Entities, the term Educational Entities means, public school districts, private schools, charter schools, intermediate units and career and technical centers. 4 Advertising & Sponsorship Policy #913.1 Produced by: Radnor Township School District-School Board Policy Committee, February 28, 2012 Policy Highlights This at a glance guide highlights key points in the RTSD Advertising and Sponsorship Policy (#913.1 ). This guide is intended as a reference for all RTSD-affiliated groups who participate in advertising and sponsorship activities as part of fundraising efforts or special event activities on behalf of RTSD. Purpose It is important to note that RTSD Policy #913.1 is designed to permit limited revenue-generating advertising and sponsorship while protecting students and parents/guardians from undue exploitation and to reduce the risk of commercial activities interfering with the RTSD educational program. RTSD Policy #913.1 allows for selected commercial advertisements, activities, or sponsorships when there is an economic benefit to the students and or educational program. This policy does not pertain to publications coming from the school district. Applicable Groups (not limited to) RTSD staff Radnor Educational Foundation Radnor High School Scholarship Fund Radnor Alumni Council and member groups PTO groups (IES, RES, RMS & WES) RHS PTSA RHS sports and academic booster clubs RTSD-approved clubs or activities, including supporting parent groups RHS class councils Definitions (for purpose of Policy #913.1 ) Advertising It is unacceptable advertising if a message promotes or markets any company, service, facility or product. Examples include: The message comments on quality or service (I.e. XX company offers superior service ) The message refers to price, savings, value, or monetary motives (I.e. You can save by choosing XX company ) The message is a call to action (I.e. Call X company now! ) The message uses a satisfied customer to promote a service/product The message induces someone to buy, sell, rent, or lease a product or service It is acceptable advertising if a message identifies, but does not promote, a sponsor or services. Examples include: The message logos and slogans that do not contain comparative or qualitative descriptions The message is a listing of the sponsor s address, internet address, or telephone number The message includes value-neutral descriptions of sponsor s product or service

5 The message includes brand or trade names The message includes product and service listings Sponsorship A payment of money or other economic benefit to a school or to the district in exchange for recognition; includes use of logos or slogans. Sponsorships may not specify quantity of exposure to be received (I.e. X company will allow for sponsorship of X amount if a certain number of people attend the event). Advertising & Sponsorship DO s & DON Ts Students shall not be required to listen to, read, or be subjected to commercial advertising in the classroom or in school-provided materials used for instruction (unless otherwise noted) Anyone wishing to use RTSD facilities for advertising must submit a written application to the Superintendent for approval in consultation with the Facilities Department if needed. Organizations approved for advertising on RTSD property are responsible for construction, installation and maintenance. No advertising may be placed in (but not limited to): vehicles used to transport students (buses, vans, etc.); classrooms; bathrooms; cafeterias. A list of student names, addresses, or telephone numbers may not be released to an advertiser or sponsor. Sponsors can be acknowledged in school district publications but this acknowledgement may not be more prominent than the name of the RTSD group they are supporting. Businesses may sponsor activities but school officials/group will maintain control and management of the activity. Advertising cannot: o Encourage sale or use of tobacco, alcohol, illegal drugs, gambling, or weapons; o Use vulgar, offensive, obscene or sexually explicit language; o Advocate violation of law or policy; o Advance or endorse religious or political organizations, party, or candidate for elected office; o Associate with a company or individual in violation of the law; o Promote hostility, disorder or violence; o Disparage ethnic, racial, and/or religious groups; o Include libelous material; o Violate the rights of others; o Disrupt the functioning of the school. Advertising signage must receive RTSD approval; if outside must meet Township s sign code. No school group, student, club, or RTSD can received a financial gift or other prize from an advertiser for generating revenue. Conclusion Prior to agreeing to any RTSD-affiliated group agreeing to any advertising/sponsorship opportunity, it is advisable to seek approval from school or district administration.
