Credit card numbers will be discarded once full payment is made and will not be stored in any way.

6 Terms and Conditions GUIDELINES The design of the picture for your ad is your responsibility. Sizes and dimensions are enforced for everyone s mutual benefit. We do not allow animation on any ads. TERMS OF AGREEMENT Content Review We reserve the right to approve all ads and to reject any advertiser for any reason. The display will be submitted for review no later than 1 days prior to the first date it is to be screened. Advertiser shall be free to provide additional or substitute displays during the term. Rates All rates are subject to change. You may guarantee the price of ads by booking and paying in advance. Payment Payment for display and specialty ads is due prior to ad creation and/or content review via PayPal, invoice, check, or another payment method both parties agree upon. Prices advertised for these ads do not include service fees imposed by PayPal or any others. Campaigns totaling less than $1,000 must be paid in full no less than one week prior to commencement of ad campaign. Campaigns totaling over $1,000 are subject to a payment plan at buyer s request. Liability Advertiser assumes all risk and agrees to indemnify and hold daily-beat.com and its properties harmless for any and all suits, claims, liabilities of any kind and damages that arise from the advertisement and any additional marketing and promotions. The Advertiser will indemnify and hold harmless Daily Beat and its affiliates, stockholders, directors, officers, employees, members and controlling persons against all losses, claims, damages, expenses and liabilities, as the same are incurred (including the reasonable fees and expenses of counsel), relating to or arising out of its activities hereunder pursuant to any advertisement run by Daily Beat for such Advertiser.

7 Terms and Conditions Warranty No Warranty. Daily Beat makes no warranty as to the number of viewers in any audience to which the advertising will be displayed. Cancellation One week (7 day) contracts cannot be canceled by Advertiser. Cancellation of multiple weeks before expiration of contract will result in a cancellation fee equal to that of the cost of space for one week. If Advertising campaign is cancelled less than one week before said campaign begins, the aforementioned cancellation fee of cost of space for one week also applies. Daily Beat reserves the right to cancel the contract without reason or notice. Competition Advertiser is aware that Daily Beat will be displaying advertising materials for other advertisers. It is possible or likely that these materials may advertise products or businesses in competition with Advertiser. Advertiser agrees and consents to such competing advertisements. Default Payment In the event Advertiser fails to pay a weekly installment, the full balance owing for all weeks shall immediately accelerate and be due and owing. Daily Beat shall be entitled to suspend advertising display and to proceed to collect the accelerated balance by all lawful means. If Daily Beat fails to display advertising content in accordance with this contract or if such advertising contains errors and/or omissions, Advertiser s sole remedy shall terminate the contract and recover any unearned, paid amounts, pro-rated to reflect actual units displayed, Daily Beat shall have no liability whatsoever to the Advertiser for any damages, claims and/or liabilities whatsoever for its failure to run and/or Daily Beat ceasing to run any advertising for the Advertiser. Failure to display due to technical difficulties shall not be a default. Nondiscrimination Policy Daily Beat does not discriminate in advertising contracts on the basis of race, ethnicity or gender. Any provision in any order or contract for advertising that purports to discriminate on the bases of race, ethnicity, geographic location or gender, even if handwritten, typed or otherwise made a part of a particular contract is hereby rejected.
