4 Central Level Progress Status v Documents relate to GI registration (application, manual, etc.) has been drafted and pending finalized. v Ministerial decision to set up National GI Committee (August 2014), members composed of related ministries and private organization. The mandate of the committee is being drafted. v Ministerial decision to set up National GI Committee (August 2014) to supervise the Lao GI development, members composed of related ministries and private organization (Lao Chamber of Industry and Commerce). v 19 local specialty products have been considered as potential for Geographical Indications Registration. Two products, e.g coffee and special sticky rice, will be the pilot products for GI registration. 4

5 Local Level Progress Status Cont v Feasibility has been conducted for five local specialty products (coffee, sticky rice, silk, tea and river algae). v Only organization of producers groups/association of coffee have been established to focus on commercial production, while the others producers groups focus more on learning and exchange when receiving agricultural extension service. v Organization of producers groups/association have been established (e.g Boloven plateau coffee). v 2 GI products were selected as priority pilot GI registration: Boloven plateau coffee from Champasak province; small chicken rice (special sticky rice) from Xiengkhouang and Huaphanh provinces. 5

6 Legal mean to protect GI Ø Law on Intellectual Property (2012): GI is a branch of industrial property Patents, Petty patents, Industrial design, Trademarks, Layout-design of integrated circuits, Geographical indications Trade secrets. Geographical indication symbol will be used as a sign to indicate a good as originating in the territory of a country or region or locality in that territory, where a given quality and reputation or other characteristic of the good is essentially attributable to its geographical origin. Ø The ministerial decision on implementation of the IP Law relating to GIs was issued in late 2012 (13 sections and 80 articles). The Objective of the Decision is to implement the Law on Intellectual Property and provides procedures relating to geographical indications in the Lao People's Democratic Republic. The purpose of the Decision is to provide uniform criteria for use in all proceedings relating to geographical indications, including registration procedures, appeals, suspension and cancellation proceedings, and legal actions for infringement or misuse, dispute settlement, and the enforcement of rights under the Intellectual Property Law throughout the Lao People s Democratic Republic. 6

16 GI Contribution Expected to Local development Laos is in early stage of GI development, therefore GI contribution to local development is not yet realized. Experienced worldwide has shown that GI plays a significance role in local development. Thus, once registered, Lao GI would contribute to local development as follow: Ø Ø Ø In view of protection: protection of a national and economic heritage, area of production, means of production, producers of GI area and protection of image of GI products In view of rural development: prevention of rural migration, creation of new jobs, allow better redistribution of added value in the production chain, maintaining the products as part of the cultural heritage of the GI area. In view of economic development: bring value to the land of origin, stimulates investment in the production area. 16
