6 Nutrient Management Act The legislation provides authority to establish provincewide standards for two purposes: The management of materials containing nutrients in ways that will enhance the protection of the natural environment, and Provide a sustainable future for agricultural operations and rural development 6

7 Nutrient Management Act The legislation sets out requirements and responsibilities for farmers, municipalities and others in the business of managing land-applied nutrients. Province to set and enforce standards Provincial regulations supersede municipal by-laws that deal with the same subject matter.

9 History of the Nutrient Management Act and Regulation Nutrient Management Act Received Royal Assent on June 27, 2002 Proclaimed July 1, 2003 Regulation 267/03 to implement Nutrient Management Act Filed June 30, 2003 Came into force September 30, 2003 Amended 9 times 2011 Amendment brought the application of Non-Agricultural Source Material (example bio-soilds) to agricultural land under the regulation Disposal of Dead Farm Animals Regulation added 2009 Greenhouse Nutrient Feedwater Regulation Proposed for 2015

10 Phase-In When a farm is required to have a nutrient management strategy, we refer to it as a phased-in farm. Phase-in depends primarily on size or on new construction. Right now, not all farms in Ontario are phased-in. The Regulation requires phased-in farms to produce either a Nutrient Management STRATEGY or PLAN or both. 1-10

11 Nutrient Management Strategies and Plans The Regulation addresses production, storage and utilization of materials containing nutrients that can be applied to land. Farms phased into the regulation are required to ensure that materials generated in the course of the operation are managed in accordance with a nutrient management strategy (NMS). Large livestock farms are required to follow a nutrient management plan (NMP) for all nutrients applied to land on their farm unit.

12 Key requirements for farms A Nutrient Management Strategy (NMS) implements limits / restrictions on: Storage Acceptable destinations of nutrients A Nutrient Management Plan (NMP) implements limits / restrictions on: Application Rates Distances Ensuring adequate land base for application And other parameters NM Strategy and Plan prepared by certified person, kept on farm and subject to inspection 12

13 Key requirements for farms Any new manure storages must have 2 levels of protection for the groundwater Other areas of specific regulatory requirements: Land application standards Sampling and Analysis Anaerobic digesters Vegetated filter strips Milking centre wash water Outdoor confinement areas Certification and Licenses 13

16 Requirements for Consultant Certification Courses:» Introduction to Nutrient Management,» Regulations & Protocols, and» How to Prepare a Nutrient Management Strategy and Plan Using NMAN Practicum:» Complete and submit 2 fictitious NMS and NMP using NMAN or NMS/P Preparation Workbook Pass exam:» 75% is a passing grade Real NMS/P:» Complete one real NMS/P, a site visit may take place Recommended:» Carry errors and omissions insurance» Take Professionalism and Ethics course» Keep up to date with NM legislation (may involve more courses)» Maintain performance guidelines 5-16
