1 (Unofficial translation) LAW OF THE REPUBLIC OF TAJIKISTAN ABOUT BEEKEEPING This Law governs the relations in the field of production of products of beekeeping, protection, use and reproduction of bees, their effective application for pollination of crops and all pollinated flora, creation of conditions for increase of productivity of beekeeping, and also plant growing, providing guarantees of observance of the rights and interests the physical persons and legal entities which are going in for beekeeping. CHAPTER I. GENERAL PROVISIONS Article 1. Basic concepts In this Law the following basic concepts are used: - beekeeping - cultivation, protection and the maintenance of the honey bees used for pollination of entomophilies plants, increase of their productivity and product receipt of honey bees; - the beekeeper - the physical person or legal entity which is going in for beekeeping; - bee family - the biological community consisting of the working bees, drones and a queen bee living in one beehive or a nest; - queen bee - the female of bees providing reproduction of bee families; - bee swarm - the new bee family created in the main bee family and which independently took off from it at natural swarming; - population of honey bees - the set of bee families within breed of honey bees created in a certain territory and possessing the general gene pool; - beehive - a box for the maintenance of a bee family; - apiary - a certain place with the beehives established on it with bee families and necessary property for occupation by beekeeping; - stationary Nasik - the place where beehives are established with bee families constantly within a year; - nomadic Nasik - the place where beehives with bee families by means of transportation to medosbor sources are established; - honey - the natural product developed by a honey bee from nectar of plants; - wax - the product developed by a working bee and removed through the wax glands; - pollen - the product collected by a working bee from flowers of plants; - propolis - the product collected by a working bee from nectar of plants; - uterine milk - the product allocated from upper glands; - bee sting - the product allocated by a working bee from a sting; - wax - Artificially manufactured thin wax sheets with the bases of cells of the appropriate size pressed onto them; - the veterinary and sanitary passport of an apiary - the document in which are specified the temporary or permanent location of an apiary, quantity of bee families, their breed, terms and nature of the carried-out veterinary processing s for the purpose of prevention, diagnostics and treatments of diseases of bees; - entomophilous plants - the plants pollinated by insects; - Sources of honey - plants which form nectar and pollen are for honey bees sources of natural forage and provide honey; - breeding farms - the accounting entities certified by authorized state body in the field of beekeeping, enabling cultivation and the realization of breeding bee families and the breeding impregnated uterus of bees of a certain breed; - authorized state body in the field of beekeeping - the state body performing within the powers conferred to it state regulation in the field of beekeeping. Article 2. Legislation of the Republic of Tajikistan on beekeeping

2 The legislation of the Republic of Tajikistan on beekeeping is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by CHAPTER 2. ACTIVITY IN THE FIELD OF BEEKEEPINGS Article 3. Activity of physical persons and legal entities in the field of beekeeping 1. Physical persons and legal entities have the right to perform business activity in the field of beekeeping. 2. Natural persons, not being the individual entrepreneurs having the right to perform activity in the field of beekeeping for satisfaction of personal needs. 3. Beekeepers have the right to create beekeeping associations according to the legislation of the Republic of 4. Physical persons and legal entities have the right to request the data concerning beekeeping at Article 4. Quantity of bee families 1. The quantity of bee families at physical persons and legal entities is not limited, except as specified, provided by parts 2 and 3 of this article. 2. Local executive bodies of the government have the right to establish quantity of bee families of physical persons and legal entities within borders of residential and green suburbs, proceeding from conditions of keeping of honey bees and according to veterinary sanitary standards and rules. 3. Quantity of beehives in the non-profit collective gardening and market-gardening organizations decide on bee families by general meeting of this organization. Article 5. Registration and accounting of bee families Registration and accounting of bee families is performed in the order established by the Government of the Republic of Article 6. Placement of beehives with bee families 1. Physical persons and legal entities place beehives with bee families on the land plots used by it at observance zoo technical and veterinary sanitary standards and rules of maintenance of honey bees. 2. The beekeeper places beehives with bee families at such distance from educational institutions, healthcare institutions, culture and rest which ensures safety of people. The order of regulation of safe placement of beehives with bee families is approved with local executive bodies of the government. 3. Beehives with bee families are placed on the land plot at distance not less than five meters from border of the land plot and height not less than two meters or than two meters separate from the next land plot the building, a structure, a construction, a solid fence or a dense bush height not less. Article 7. Allocation of the land plots for implementation of activity in the field of beekeeping 1. The land plots for implementation of activity in the field of beekeeping are allocated for physical persons and legal entities according to regulatory legal acts of the Republic of 2. Users of the land plots most convenient for placement of beehives with the bee families having the right to provide such sites to the physical persons and legal entities which are going in for beekeeping according to regulatory legal acts of the Republic of Tajikistan for placement of beehives with bee families for blossoming of sources of a honey, irrespective of places of registration of bee families. 3. Nomadic apiaries are placed at honey sources at such distance at which the productive maintenance of bee families and effective pollination of agricultural entomophilies plants are provided. 4. Nomadic apiaries at sources of a honey have to be placed at distance not less than one and a half kilometers from each other and three kilometers from a stationary apiary. 5. Placement of nomadic apiaries on the way of summer of bees from other earlier placed apiary is not allowed to honey sources. 6. Beekeepers after placement of a nomadic apiary are obliged to report data on it and to show the veterinary and sanitary passport of an apiary in local executive bodies of the government. 7. On apiaries bees only of the breeds zoned in this or that district according to the plan of their pedigree

3 division into districts approved by authorized state body in the field of beekeeping have to contain. Article 8. Use of bee families for pollination of entomophilies plants The physical persons and legal entities performing activities for cultivation of entomophilies plants for the purpose of increase of their productivity can use the bee families which are in property of other persons with fee on the organization of pollination of entomophilies plants on the basis of agreements according to the Civil code of the Republic of Article 9. Products of beekeeping 1. Products of beekeeping are formed thanks to collective and physiological properties of honey bees. 2. Main product of beekeeping is honey; minor products are wax, pollen, propolis, a uterine milk and bee sting. CHAPTER 3. PROPERTY QUESTIONS IN THE FIELD OF BEEKEEPING Article 10. Object of property in the field of beekeeping Object of property in the field of beekeeping is the bee family, a bee swarm and another, necessary for implementation of activity in the field of beekeeping, property. Article 11. The right to return of the departed bee swarm The physical person or legal entity which missed a bee swarm has the right to its return. In this case the physical person or legal entity which missed a bee swarm has the right to bring together him if the bee swarm took root in others territory or lodged in others empty beehive. Article 12. The right to cost recovery of the departed bee swarm 1. The physical persons and legal entities which missed a bee swarm in case of its continuous search have the right to cost recovery of the departed bee swarm if the bee swarm flew in a beehive with the bees that are in property of other physical person or legal entity. 2. Cost recovery of the departed bee swarm is performed according to the legislation of the Republic of Article 13. Ownerless bee swarm 1. The bee swarm which is not pursued by physical person or legal entity or bee swarm of an unknown origin is considered ownerless. 2. The property right to an ownerless bee swarm is defined according to the Civil code of the Republic of CHAPTER 4. PUBLIC ADMINISTRATION IN THE FIELD OF BEEKEEPING Article 14. Competence of the Government of the Republic of Tajikistan in the field of beekeeping In the field of beekeeping are carried to competence of the Government of the Republic of Tajikistan: - approval of republican target development programs of beekeeping and appropriate regional programs; - statement of regulations and rules of beekeeping; - determination of authorized state body in the field of beekeeping; - economic incentives of the beekeeping industry; - assistance to international cooperation of the Republic of Tajikistan in the field of beekeeping; - coordination of activities for education of specialists and their occupational retraining in the field of beekeeping; - implementation of other powers according to the legislation of the Republic of Article 15. Powers of authorized state body in the field of beekeeping In the field of beekeeping is included into power of authorized state body: - implementation of industry development programs of beekeeping; - development and the approval of regulations in the field of beekeeping within the conferred powers;

4 ensuring control of observance zoo technical, veterinary sanitary standards and rules of maintenance of honey bees and their products; - ensuring implementation of measures for the prevention of diseases of honey bees, to their treatment, on fight against insects, harmful to bee families, and the prevention of poisoning of honey bees with pesticides and other chemicals; - control over the activities of breeding farms, zones and breeding apiaries; - coordination of selection and breeding work in the field of beekeeping, assistance to development of breeding loud-speakers (selection apiaries) and wildlife areas of honey bees; - international cooperation in the field of beekeeping; - the organization of carrying out the scientific researches directed to protection and cultivation of bees. Article 16. Powers of local executive bodies of the government In the field of beekeeping is included into power of local executive bodies of the government: - control of development and protection of beekeeping in the respective territory; - coordination of activities for preparation and retraining of specialists in the field of beekeeping. Article 17. Measures of the state support in the field of beekeeping 1. The purpose of the state support in the field of beekeeping is ensuring requirements of the population of the country with beekeeping products due to their production by domestic producers. 2. The state support in the field of beekeeping is performed in the way: - allocations of public funds; - granting soft credits; - applications of measures of economic incentives; - investments into the beekeeping industry. CHAPTER 5. PROTECTION OF HONEY BEES Article 18. The organization of protection of honey bees, zoo technical and veterinary health control in the field of beekeeping 1. The organization of protection of honey bees is performed by the relevant state bodies of the Republic of Tajikistan, local executive bodies of the government of the Republic of 2. Control of observance zoo technical and Veterinary - sanitary standards and rules of maintenance of honey bees is performed according to the legislation of the Republic of Article 19. Main requirements to protection of honey bees The main requirements to protection of honey bees are: ensuring evidence-based zoo maintenance, use and cultivation of honey bees; - protection of a native habitat of honey bees, movements and ways of migration of honey bees; - ensuring veterinary and sanitary service of honey bees. Article 20. Ensuring protection of honey bees Protection of honey bees is provided by means of: observance by physical persons and legal entities zoo technical and veterinary sanitary standards and rules of maintenance of honey bees and placement of beehives with bee families at honey sources; - accomplishment by physical persons and legal entities of requirements of environmental protection, movements and ways of migration of honey bees; protection of beehives with bee families from ruin, prevention of poisoning of honey bees with pesticides and other chemicals; - protection of bee families on places of seasonal movements from birds and other insects destroying them; - preventions of diseases of honey bees, their treatment, fight against wreckers of bee families; - assistance to free transportation of bee families; - the organizations of carrying out scientific researches in the field of protection of honey bees; - advertizing of beekeeping in mass media; - education in citizens of careful attitude to bees, and also encouragement of their activity in this industry.

5 Article 21. Prevention of poisoning of honey bees with pesticides and other chemicals 1. Use of pesticides and other chemicals is performed according to the legislation of the Republic of 2. The list of remedies of plants, the chemical and other substances applied to processing of plants approves to the special representative by state body on management of the agricultural industry of the Republic of 3. Use of pesticides and other chemicals for processing of fields, meadows, the woods, protective forest strips and plantings during blossoming of sources of a honey is performed as it should be, stipulated in Clause 26 these Laws. Article 22. Protection of honey bees at forest exploitation implementation 1. The actions directed to increase of productivity of the woods are performed taking into account the requirements providing effective implementation of activity in the field of beekeeping. 2. The cabin of trees and bushes - honey sources is not allowed, in the territories located at distance improvements of a sanitary condition of the woods and conditions of their reproduction are closer than three kilometers from locations of stationary apiaries, except as specified. Article 23. Protection of honey bees in the conditions of natural environment of their dwelling 1. Activities for use of useful properties of honey bees to collecting of bee products in the conditions of natural environment of their dwelling are performed according to the legislation of the Republic of 2. The prevention of diseases of honey bees, their treatment, fight against wreckers of bee families 1. For the purpose of accounting of apiaries and carrying out veterinary actions veterinary and sanitary passports of apiaries are issued to apiaries. Physical persons and legal entities are obliged to have veterinary and sanitary passports of apiaries. 2. The form of the veterinary and sanitary passport of apiaries and order of its issue are established by 3. The prevention of diseases of honey bees, their treatment, and fight against wreckers of bee families is carried out according to the veterinary legislation of the Republic of 4. Physical persons and legal entities are obliged to perform actions for the prevention of diseases of honey bees, their treatment, and fight against wreckers of bee families. 5. Physical persons and legal entities for implementation of measures for the prevention of diseases of honey bees, to their treatment, fight against wreckers of bee families can involve specialists of the veterinary industry. 6. At detection of infectious diseases physical persons and legal entities are obliged to report about it in Article 25. Cultivation and use of the most valuable populations and breeds of honey bees 1. Activities of physical persons and legal entities for cultivation and use of the most valuable populations and breeds of honey bees, and also for improvement of populations and breeds of honey bees are performed according to the legislation of the Republic of 2. For the purpose of providing physical persons and legal entities with valuable populations and breeds of honey bees, and also improvements of breeding value of populations and breeds of honey bees in certain territories (areas of their natural dwelling) are created breeding farms and breeding loud-speakers (selection apiaries). 3. Around breeding farms and breeding loud-speakers (selection apiaries) protective sites with a radius not less than fifteen - twenty kilometers in the territory of which import of bee families or queen bees of other populations and breeds of honey bees, and also bee families or queen bees of an unknown origin is forbidden are

6 established. Article 26. The notification of physical persons and legal entities about the situations constituting danger to honey bees 1. Physical persons and legal entities according to the legislation of the Republic of Tajikistan have the right to timely, complete and reliable information about a condition of surrounding environment, and also about the situations constituting danger to honey bees. The notification of physical persons and legal entities about a state of environment, and also about the situations constituting danger to honey bees it is performed through mass media. 2. The physical persons and legal entities applying pesticides and other chemicals to processing of agricultural and forest plants are obliged not later than three days prior to such processing personally in writing or through mass media to warn the physical persons and legal entities having the apiaries which are at distance less than five kilometers from the processed agricultural and forest plants. At the same time date of processing of agricultural and forest plants, the method of their processing, level of toxicity of the applied pesticides and (or) chemicals are specified. Article 27. Assistance to transportation a beehive with bee families 1. Beehive with bee families it has to be transported along the routes approved with authorized state body by means of trailers, platforms, pavilions and mobile boxes relating to the processing agricultural equipment. 2. For prevention of death of bee families from an overheat of a beehive and sharp increase of humidity of air in a beehive the delay of the vehicles transporting a beehive bee families by the relevant authorized bodies for the term of more than 15 minutes is not allowed if this delay is not connected with monitoring procedure of observance of rules of transportation and (or) technical condition of vehicles. 3. If necessary authorized state body the beehive with bee families renders assistance in free transportation. Article 28. International cooperation of the Republic of Tajikistan in the field of beekeeping 1. The Republic of Tajikistan promotes development of international cooperation in the field of beekeeping. 2. International cooperation of the Republic of Tajikistan in the field of beekeeping is performed according to the international legal acts recognized by CHAPTER 6. FINAL PROVISIONS Article 29. Responsibility for violation of requirements of this Law The physical persons and legal entities which allowed violation of requirements of this Law are made responsible according to the legislation of the Republic of Article 30. About recognition invalid the Law of the Republic of Tajikistan "About beekeeping" To recognize invalid the Law of the Republic of Tajikistan dated December 8, 2003 "About beekeeping" (Akhbori Majlisi Oli of the Republic of Tajikistan, 2003, No. 12, Art. 679; 2008, No. 12 of the p 2 of Art. 1003).
