1 Farmland Preservation protecting water resources & soil productivity Working Lands Initiative started July 1, 2009 for WI farmers to decrease income tax due or increase tax refund in exchange for keeping land in AG use and complying with soil and water conservation requirements using Schedule FC-A $7.50/acre in a Certified farmland preservation zoning district $5.00/acre if farmland preservation agreement in Agricultural Enterprise Area AEA (15 year agreements) $10.00/acre if agreement in AEA and zoning Counties review compliance of the entire farm [Ch.91] under common ownership, owned by the same entity, even if the land in an adjoining jurisdiction is not eligible. 1

2 WI Agricultural Water Quality Performance Standards NR151 & ATCP 50 Wis. Admin. Codes Meet tolerable soil loss (T) on fields that will include pastures Follow 590 NM plan technical standard that will include the Phosphorus Index with a tillage setback from surface water Prevent direct runoff from feedlots or stored manure to waters of the state Limit livestock access along waters to maintain vegetative cover Maintain manure storage structures to prevent leaking and overflow Follow manure storage technical standards for constructing and abandoning Near surface water or areas susceptible to groundwater contamination Do not stack manure in an unconfined pile Divert clean water away from feedlots, manure storage, and barnyards

4 New NR 151 Performance Standards ATCP 50 will become effective May 2014 Counties will help farmers add new practices to those they are currently implementing by 2016 for the Farmland Preservation Program participants Phosphorus Index (PI) an average rotational PI of 6 or less and an annual PI of less than 12 Prohibits tillage 5 feet up to 20 (setback) from perennial surface water to protect bank integrity.

5 ATCP 50 clarifies PI on pastures Include a pasture in a NM Plans if: It receives mechanical applications of nutrients, then soil test It is stocked at more than 1 animal unit per acre, then soil test or use 150 ppm P and 6% OM to meet NR 151 A pasture does not need to be in a NM Plan if: It is a feedlot, then must comply with applicable NR 151 It only receives manure from grazing animals & is stocked at 1 animal unit per acre or less during the grazing season, not the winter Calculate the PI in SnapPlus more pasture crop options & stocking rates more user-friendly grazing manure application rate calculator see PI of 6 across the rotation or PI of 12 annually in the Compliance Check

10 2013 County Responses in 39 Counties Having 50 or more Farmland Preservation Claimants ~ 14,000 Landowners Question Total Issues Do you have a complete claimant list? Do you require landowners self certify compliance? Do you track field soil erosion? Will all landowners be in full compliance by the 2016 deadline? 23 yes 16 no 29 yes 9 no 35 yes 4 no 15 yes 19 no We need the DOR list. Claimants may not be known to the county. The last list was from a decade ago from zoning certificates. Most counties use annual letters, post cards, or require the NM Plan Checklist for landowners to certify they are in compliance. Yes. Many counties use SnapPlus, GIS, and Checklists. GIS is used in 22 counties of these 39. Farm inspections are conducted every 4 years in 31 of 39 counties. Practices are scheduled but many counties think the landowners will not achieve full compliance by Limited cost share for structural practices also delays compliance. Staff funding is not sufficient to provide the assistance needed in 25 counties.

12 Big Increases in Southern WI Almost 12,000 of the 15,000 total 2011 claimants had land in FP Zoned areas. Counties with more than 500 participants increased their NMP acreage by an average of 16,000 acres, with the largest increase of nearly 80,000 acres seen in Jefferson County.
