Chapter 24: Liability! Becoming Certified Federal Pesticide Regulations Chapter 3 FIFRA Federal Insecticide, Fungicide and Rodenticide Act! FIFRA Federal Insecticide, Fungicide, and Rodenticide Act! Worker Protection Standard! FFDCA Federal Food, Drug and Cosmetic Act! All pesticides must be registered with the EPA.! EPA considered all economic, social and environmental costs and benefits when registering pesticides.! Based on data provided by product registrants:! Toxicity studies (human, fish, wildlife)! Environmental fate studies (residues, solubility)! Studies on potential to cause cancer or mutations FIFRA! Pesticides classified as General Use or Restricted Use.! Users of Restricted Use pesticides must be certified or work under the direct supervision of a certified applicator.! Provides penalties for use inconsistent with the labeling of a pesticide. Label = Law! Permits states to have primary enforcement authority and to administer a certification and training program. Worker Protection Standard! Applies to pesticides that are used in the production of agricultural plants on farms, forests, nurseries and greenhouses.! Aimed at protecting employees and workers from occupational exposure to agricultural pesticides.! Covers people working in areas that have been treated with pesticides, and employees that handle pesticides for use (i.e. mix, load, apply) 1

2 Worker Protection Standard Worker Protection Standard! Users of ag pesticides and/or employers of ag workers or pesticide handlers, must provide employees with:! Information on exposure to pesticides;! Protection against exposure to pesticides; and,! Ways to mitigate exposure to pesticides.! Restricted Entry Interval REI! The time immediately following the application of a pesticide when unprotected workers may not enter the treated area.! Workers wearing appropriate personal protective equipment (PPE) may re-enter before the REI has expired.! When no REI is specified on the label, treated areas may be re-entered when the spray has dried or the dust has settled. WPS Label Statement! AGRICULTURAL USE REQUIREMENTS - Use this product only in accordance with its labeling and with the Worker Protection Standard, 40 CFR, Part 170. FFDCA Federal Food, Drug & Cosmetic Act! Administered by the FDA! Governs pesticide residue levels in food or feed crops. FFDCA Important Definitions Pesticide Tolerances! Residue = the amount of pesticide that remains on a plant or animal surface after treatment.! The more persistent the pesticide, the longer the residue remains.! Tolerance = the maximum amount of residue that may legally remain on a harvested crop! Tolerance is set by the EPA and enforced by the FDA! Harvest Interval = the amount of time that must elapse between pesticide application and harvesting of the crop.! A tolerance must be set for every crop listed on the label.! If the residue at harvest exceeds the set tolerance the crop may not be marketed or sold. It is subject to seizure/condemnation.! NEVER apply a pesticide to a site or crop that is not listed on the label = illegal use of product and adulterated crop. 2

3 VT Regulations for the Control of Pesticides Chapter 2! Administered by the Plant Industry Division of the Vermont Agency of Agriculture.! Gives the Secretary of Agriculture authority to regulate pesticide use, registration and sales in Vermont.! Pesticide applicators are responsible for being fully familiar with the regulations. Pesticide! Any substance produced, distributed or used:! for preventing, destroying, or repelling any insects, rodents, nematodes, fungi, weeds, or other forms of plant or animal life; or,! as a plant regulator, defoliant or desiccant. VT Pesticide Classification! Class A Restricted Use and By-Permit Only Can be purchased and used only by certified applicators or under direct supervision of a certified applicator! Restricted by EPA Restricted Use Statement found on label.! Restricted by State based on toxicology, environmental impacts, potential for misuse, application method, etc.! By-Permit Only must have a permit from the Agency of Agriculture or DEC (Aquatic use, bird control, mercury containing products) Listed in Appendix A(2) of the Regulations. VT Pesticide Classification! Class B Controlled Sale! General use products for use outside of the home, with greater than 3% active ingredient.! Includes all turf products (except products containing Bt or potassium fatty acids).! Class C Homeowner / Specialty! General use products used in and around the home with less than 3% active ingredient.! Exceptions: antimicrobial products, aerosols, pool treatments, insect repellents can have unlimited % active ingredient. Applicator Certification Chapter 1! Certified Private Applicator! Any person who uses, or supervises the use of, a restricted use pesticide on land they own or rent for the production of an agricultural commodity.! Certified Commercial Applicator! Any person who uses, or supervises the use of, any class of pesticide on the lands or homes of others for pay.! Certified Non-commercial Applicator! Any person who occasionally uses, or supervises the use of, a Class A or B pesticide in the course of their employment. Direct Supervision! Regulatory definition on-site supervision of pesticide applications by a certified applicator who is capable of:! Equipment calibration;! Pesticide selection;! Calculating volumes of pesticides to be applied; and,! Dealing with emergencies which might occur. 3

4 Direct Supervision! In practical terms! Certified and non-certified applicators must be working closely enough so that they can communicate verbally, or through hand signals, that assistance is needed. Licenses! Licenses! Company Licenses issued to all companies in the business of applying pesticides.! Dealer Licenses issued to people who sell pesticides; type of license depends on class(es) of pesticides sold. Pesticide Application Standards of Operation! All pesticides must be applied consistent with their labeling:! May apply at a rate or frequency LESS than that specified on label.! May apply against any pest not on label, PROVIDED that the crop, animal, or site being treated is on the label. Standards of Operation! Applicators must:! minimize the drift of pesticides off-target;! use methods and materials which ensure safe & efficient pesticide application;! apply pesticides only when climatic, pest and other conditions are proper for pest control; and,! when drawing or pumping water, use antisiphoning devices to prevent backflow of pesticide into water sources. Standards of Operation! Commercial applicators must supply their customers with a written bill/invoice which contains:! Product name;! Product EPA registration number;! Amount of product used;! Pests treated for; and,! Name & signature of applicator. Emergency Actions and Accident Reporting! Accident any release of a pesticide or pesticide mix from its container or application equipment which is contrary to label instructions, or which violates pesticide regulations. 4

5 Emergency Actions and Accident Reporting! Emergency Action: When a pesticide accident occurs, you must take immediate action to protect human health and the environment.! Emergency containment measures:! Control the Spill and Contain it! Keep it from spreading minimize the contaminated area.! Notification Notification! Accident Reporting All pesticide accidents must be reported immediately by telephone to either the Department of Agriculture or the Department of Public Safety. Clean Up Spill! Be prepared!! Have written plan outlining steps to take in the event of a spill.! Have spill kit and decontamination kit handy.! Follow any specific guidance provided by pesticide authorities.!!!never hose down spills with water!! Record Keeping Requirements for Certified Private Applicators Chap 23! For all Restricted Use Pesticides, Private Applicators shall record at the time of application:! 1. Product Name! 2. EPA Registration Number! 3. Amount Used! 4. Date of Application! 5. Location of Application (Farm)! 6. Pests treated for During each Year! This information is to be held for TWO (2) YEARS and shall be given to the Department upon request. Record Keeping Requirements for Certified Commercial & Non-Commercial Applicators! Routine Operational Records Must be maintained for all pesticides used; information must be recorded at time of application and held for a period of 2 years! 1. Product Name! 2. EPA Registration Number! 3. Amount Used! 4. Date of Application! 5. Location of Application! 6. Pests treated for During each Year Record Keeping Requirements for Certified Commercial & Non-Commercial Applicators! Annual Use Reports = summary of routine operational records submitted at end of year with certification renewals:! 1. Product Name! 2. EPA Registration Number! 3. Amount Used! 4. General Purpose for Use! 5. County in which it was used! Annual Usage report must be submitted even if no pesticides were applied. 5

6 Benefits of Record Keeping! Compliance with regulations! Document your legal use of pesticides.! Provide necessary information in a medical emergency.! Evaluate the effectiveness of your controls and resolve pesticide failures.! Buy the right amount of pesticide.! Provide buyers with required records of pesticide use.! Improve crop rotation decisions. Transportation of Pesticides Regulatory Requirements! Once pesticides are in your possession, YOU are legally responsible for transporting them safely!! Pesticides must be secured during transportation to prevent spillage.! All spills in or from the vehicle must be cleaned up immediately and authorities notified.! Vehicles use for transporting pesticides should be placarded in accordance with state and federal transportation regulations. Transportation of Pesticides! All pesticide containers should have intact, undamaged and readable labels.! Safest method of transport in back of truck NEVER transport pesticides inside your vehicle!! Never leave your vehicle unattended when pesticides are in an unlocked compartment or open bed truck.! Never transport pesticides near children, livestock or food. Storage of Pesticides Chap 23 Regulatory Requirements! During storage of pesticides, applicators must not leave pesticides or containers in any area which is readily accessible to unauthorized persons, wildlife, or livestock.! Legible labels must be maintained on stored pesticides at all times.! Read the Label! Storage requirements for each product will be listed on the label and must be followed. Pesticide Storage Areas! Storage areas should be:! LOCKED!!;! Posted with weatherproof signs that say Danger Pesticides Unauthorized Persons Keep Out! ;! Fenced, with locked gate (if a separate building);! Well ventilated and dry;! Well lit; and,! Temperature controlled. Storage of Pesticides! Store herbicides apart from other pesticides, fertilizers and seeds cross contamination.! Flammable pesticides should be stored separately from non-flammables preferably in a fire-proof cabinet.! Store liquid formulations below dry formulations.! Never store with food, feed, seed or veterinary supplies.! Keep spill kit and decontamination kits in area.! Keep list of pesticides in 2 locations. 6

7 Disposal of Pesticide Containers Regulatory Requirements Chap 21! Follow the label instructions for disposal! It is illegal to burn or bury pesticide containers in VT! Liquid Pesticide Containers Triple rinse and puncture top and bottom to prevent re-use.! Dry Formulations Containers empty completely and open both end to prevent re-use.! Properly processed containers can be disposed of in licensed sanitary landfills Disposal of Pesticides Regulatory Requirements! Surplus and Waste Pesticides = Hazardous Waste and must be disposed of as hazardous waste! Take surplus or waste pesticides to pesticide drop-off sites sponsored by VT Solid Waste Districts and the Agency of Agriculture. (See website for schedule) Disposal of Pesticide Containers! If holding properly processed pesticide containers for disposal at a future date they should be labeled as properly rinsed or emptied and kept in a locked storage area.! Pesticide Dealers may accept clean & empty containers for recycling check first!! REMEMBER be able to account for every pesticide container used on the job! Disposal of Pesticides! Cut down on surplus buy only what you need.! Always check out the job before you mix the pesticide AND mix only what you ll need for the job.! Apply leftover pesticide mix to sites labeled for use & add rinsewater to the tank mix.! Factory-sealed containers may be returned to the manufacturer. Liability Issues Chap 24! Drift movement of pesticide off-target! Target Site injury or pesticide failure! Personal Injury! Wrong Site Double check address or farm field! Honeybees death caused by drift or misapplication! VT Regs applicators must notify apiculturists that have hives on the premises! Attractive Nuisance don t leave application equipment & pesticides unattended! Cross-Contamination tank residues, herbicide vapors. Liability! Protect yourself and your business:! Make all pesticide applications in accordance with the regulations and the label directions.! Keep accurate and thorough records. 7

8 Taking the Certification Exam Commercial & Non-commercial Certification Categories! Private Applicators:! Private Core Exam! Non-commercial and Commercial Applicators:! Commercial Core exam AND at least one or more category exams.! Call Agency of Ag if you have questions about which category exam to take! 1a Agriculture plant! 1b Agriculture animal! 2 Forest! 3a Ornamental & Shade Tree! 3b Turf! 4 Seed Treatment! 5 Aquatic! 6 Right-of-Way! 7a Structural & Rodent! 7b Mosquito & Biting Fly! 7c Food Processing! 7d Wood Preservation! 7e Cooling Towers & Antimicrobials! 8 Public Health! 9 Regulatory! 10 Research & Demonstration! 11 -Aerial Taking the Exam(s)! All exams are closed book.! Passing score = 75%.! Three (3) chances to earn a passing score within 12 months.! WHERE?! Every Wednesday in Montpelier.! Once a month in St. Albans, St. Johnsbury, Rutland, Brattleboro, and Newport.! Call in advance to schedule exam. Following the Exam! Exams valid for 5 years.! Recertification credits must be earned to recertify after 5 years:! Private 8 credits! Commercial/non-commercial 16 credits! Courses offered by UVM, Agency of Ag. and others!
