6 Nutrient Application Timing Winter Application December 16 - February 28 EMERGENCY PROVISIONS On-farm generated liquid manure (operations w/ 50 AU s) Solid manure must be stacked Request for Emergency Waiver direct to NMP by calling or contact Regional NM Specialist Application shall be made to existing vegetative cover maintained as such until March 1 No application within 100 of surface waters No applications on slopes > 7% Rate per acre cannot exceed the 1-year P crop removal rate or 50 lbs PAN/Ac for the next harvested crop. No application when soil is saturated, ground is snow covered > 1, or ground is hard-frozen > 2
7 Nutrient Application Timing Winter Application Dec 16 - Feb 28 EMERGENCY PROVISIONS Make plans for adequate(non-stackable) storage as of July 1, 2016 and, for operations with 50 AU s - Feb 28, 2020, to eliminate need for winter application Monitor MDA press releases for any announcements of fall application or late winter application allowances
8 Nutrient Application Timing Winter Application Dec 16 - Feb 28 All Nutrient Sources No restrictions for: K, liming materials, or manure deposited directly by livestock Certain nutrients for greenhouse production, certain vegetable crops, small fruit crops, small grain crops, and cool season grass sod production listed in the Maryland Nutrient Management Manual Section I-B
9 TEMPORARY FIELD STOCKPILING FOR ORGANIC NUTRIENT SOURCES General Provisions (Abbreviated Version) Provides greater environmental protection than applying nutrients far in advance of crop nutrient uptake. Existing storage utilized at capacity prior to stockpiling. Stockpile at least 6 feet high and peaked to minimize precipitation soaking into the pile. Any sources staged shall be land applied the following spring season (temporary).
10 Temporary Field Stockpiling Location Guidance No vegetated buffer: 100 from any surface water, irrigation or treatment ditches Vegetated buffer: 35 from any surface water 100 from wells, springs, and wetlands 300 from a well down gradient from the stockpile 200 from any residence outside the operator's property Outside flood prone areas and areas subject to ponding 150 or less from the top of the slope if grade slope is more than 3% and no diversion installed
11 SETBACKS FOR NUTRIENT APPLICATION "Nutrient Application Setback" means: A vegetated area of a prescribed width where nutrient containing material may not be applied. as measured from the edge of surface water, including perennial and intermittent streams, ponds, and wetlands.
12 SETBACKS FOR NUTRIENT APPLICATION Definitions Perennial Contains water all the time Influenced primarily by groundwater flow Intermittent Contains water or flows seasonally Below the local water table for part of the year Influenced by both groundwater & surface runoff Ephemeral Contains water or flows only as a result of precipitation events
13 SETBACKS FOR NUTRIENT APPLICATION Effective January 1, 2014, a person who uses nutrients shall implement the following nutrient application setback requirements: An application using a broadcast method (e.g., spinners, splashers) either with or without incorporation requires a 35-foot setback. A directed spray application or injection of crop nutrients requires a I0- foot setback. Excepting perennial forage crops grown for hay or pasture, vegetation in the I0-foot setback area may not include plants that would be considered part of the crop grown in the field. Pastures and hayfields are subject to a 10-foot setback.

15 SETBACKS FOR NUTRIENT APPLICATION Nutrients may not be applied mechanically within the setback. Except as provided in subsection II.B.6, livestock shall be excluded from the setback to prevent direct deposition of nutrients within the setback. As an alternative to fencing livestock from the setback area, a person shall work with the soil conservation district to develop and implement a Soil Conservation and Water Quality Plan with Best Management Practices such as stream crossings, alternative watering facilities, pasture management or other MDA-approved BMPs. As an alternative to a nutrient application setback, MDA may approve other BMPs that it finds equally protective of water quality and stream health. USDA-NRCS practice standards, University of Maryland or other land grant university research establishing the effectiveness of these practices. Sacrifice lots ( 75% grass or grass legume mix) shall maintain a 35-foot setback.

19 Phosphorus Management Tool Overview of How it Works MANAGEMENT PMT changes management requirements for farms that are required to use the tool Sub-surface drainage primary driver Most effects management on the Eastern Shore Coincides with poultry operations and high soil P levels Distance to surface water Affects farms in other parts of the state Build in incremental change Especially for operations now scoring HIGH (>100) in the PMT calculations
20 PMT Tier Group Not all operations will transition to the PMT at the same time Timing of transition is determined by an individual operator s average soil P-FIV P-FIV for all fields above 150 is added and then divided by the number of those fields(not a weighted average) The average P-FIV having been computed, a Tier Group A, B, or C is assigned to the operation Tier Group assignment is done once and listed in the NMP Transition timing to the PMT is dependent on Tier Group category

28 Implementation Concerns General Guidance Keep the nutrient management plan current Entire scope/activities of operation must be communicated to the consultant and addressed in the plan All nutrient/land applied sources are addressed in plan: Chemical fertilizers, animal/poultry manures, biosolids, processing wastes/residuals, wash/wastewater, other organic-based nutrient sources. Appropriate detectable analyses used to generate fertility recs Crop fertility recommendations must be based on University of Maryland recommendations and not recommendations from independent soil testing laboratories
29 Implementation Concerns General Guidance Broadcast and direct application, livestock, and sacrifice lots setbacks are implemented based on the streams, ponds, or wetlands addressed in your plan Tier group category is included in plan(if applicable) Manure disposal & negligence on property water quality issues Calibrate manure spreading equipment and document Keep records, documentation Plan issues cited on a MDA implementation review contact your consultant immediately for resolution
30 Annual Reporting 2018 Annual Implementation Report (AIR) Reports mailed the first week of January 2019 Operators who have already filed a plan to MDA Complete the sections applicable to your operation Certain Regional Office/county designations have changed; Carroll & Anne Arundel operators will return their AIR s to the Frederick Regional Office, Prince George s operators will return their AIR s to the St. Mary s Regional Office March 1, 2019 deadline Fully completed and returned forms to MDA are recorded as compliant upon review MACS verifies AIR filing for cost shared projects such as cover crop Combined MDA/MDE report mailed to CAFO/MAFO
