1 Pest Management Update Gary King Pesticide Enforcement Specialist Pesticide and Plant Pest Management Division What is Required by Law? Act Notice of Pesticide Applications at School (1) A person shall not apply a pesticide in a school unless the school has an integrated pest management (IPM) program in place for the building. 1
2 What is Required by Law (2) Annual notification that parents will receive advanced notification of the application of pesticides in the school. Be in written, 30 days in advance of school. (3) 2 methods, 48 hours before the pesticide application: First, posting at entrances to the school. Second, posting in public/common area, E mail, Phone (direct contact/automated system). Written notice to student. Website. What is Required by Law (3) Parents are entitled to receive the notice by first class mail three days in advance, if they so request. Parents may review the school IPM program and any pesticide application records upon request and the contact information of the person responsible for pesticide application procedures in the school. 2
3 What is Required by Law (4) An advance notice of application of a pesticide, other than a bait or gel formulation, shall contain all of the following information: (a) A statement that a pesticide is expected to be applied. (b) The target pest or pests. (c) The approximate location of the application. (d) The date of the application. (e) The name, telephone number, and, if available, e mail address of a contact person at the school responsible for maintaining records with specific information on pest infestation and actual pesticide application as required by rules. (f) A toll free telephone number for a national pesticide information center recognized by the department and a telephone number for pesticide information from the department. What is Required by Law (5) In an emergency, a School may apply a pesticide Without providing advance notice to parents. Promptly after the emergency pesticide application, the school shall give parents notice of the emergency pesticide application. 3
4 What is Required by Law (6) Liquid spray or aerosol insecticide applications shall not be made in a room of a school building or day care center building unless the room will be unoccupied by students for not less than 4 hours after the application or unless the product label requires a longer reentry period. The building manager shall be notified of the reentry restrictions by the applicator. IPM in Schools Inspection Effort Michigan Department of Agriculture and Rural Development conducted 33 school IPM inspections in FY 14. The inspections included: Applicators applying pesticides inside school buildings to be trained in all IPM program elements. The implementation of all IPM requirements including site evaluation and description, inspection, and monitoring. 4
5 IPM in Schools Inspection Effort Consideration of the relationship between pest biology and pest management methods. Consideration of all available pest management methods, including population reduction techniques, such as mechanical, biological, and chemical techniques and pest prevention techniques, such as habitat modification. Pest control method selection, including consideration of the impact on human health and the environment. Notification requirements to parents/guardians that pesticide applications are made at the school. IPM in Schools Inspection Effort The results of the inspections conducted found: Only nine schools were in full compliance with all IPM requirements. The other 24 schools received stop prohibited conduct orders and in some cases warning letters requiring a written response related to one or more of the following violations: 4 schools were using applicators that did not have IPM training. 5
6 IPM in Schools Inspection Effort 18 schools were not in compliance with parent/guardian notification requirements. 12 schools were either missing some element of the required IPM program or had no IPM program in place. Don t click here 6
