I also want any EPA (Environmental Protection Agency) approved outdoor GE experiments or field trials PROHIBITED as well as all GMO releases PROHIBITED in Northland and preferably nationwide. Genetically modified organisms can be harmful to life, health and the enviroment. Many severe human illnesses have been linked to the consumption of GMO foods. Contamination from GMO crops is nearly impossible to avoid and no field trial should be allowed. This is an important issue and for our health and the health of our children we need to strongly oppose the growing, selling and distributing of GMO foods and plant products. Whilst there may not be immediate signs of direct danger to humans or animals, it makes no sense to conduct GE experiments if there can be no guarantee of contamination to standard crops or farms, nor does it make sense to release GMO into our environment. If in the near or distant future GE experiments or GMO releases are proven to be detrimental to humans, animals or the environment we live in, how do we counteract that? How do we get rid of it? Will anyone at the councils (the public paid representatives) who would be involved in the possible approval process take responsibility for their decisions? The elected council members should not be making approval for businesses conducting GE experiments or using GMO without 100% approval of the public. IF IN DOUBT, THROW IT OUT!!! Allan W. We support our members by writing submissions, providing information to the members and the public concerning Genetic Engineering on a local, national and international level. Description and expectations 1.2 Eligibility rules 1.3 Notification Proposed Plan Change 131: Genetically Modified Organisms (GMO) GE Free New Zealand in Food and Environment fully support the development of Objectives (GMO 2.1), Policies (GMO 2.2) and Rules (GMO1.2) that have been outlined in GMO.1. We specifically support plan change GMO 1.2 point 6 Eligibility Rules where food related or non-food related GMO Releases are prohibited activities. We support the public notification of GM laboratory applications but would like see Council strengthen rules around all EPA approved GE developments outdoors and field tests by making them a Prohibited Activity. Every field test and outdoor experiment has breached its consent conditions, for example: the GE tamarillo site, the GE onion, the GE animal, the GE brassica and GE pine tree trial sites. The breaches were serious enough to close a majority of the trial sites down and raised a high level of community concern over the broken trust around compliance conditions. So until all adverse effects can be identified and addressed in enclosed laboratory structures, the outdoor GM testing in any kind of facility must be prohibited.

13 The precautionary approach to the use of GMO s in the region regarding the land use controls is comprehensive and compliments the EPA decisions under HSNO. The EPA decisions are too generic for the specific land use issues related to councils and their communities. GMO 2.4 -We suggest that in GMO.2.4 General Development & Performance Standards Site design, Construction and Management, the Biosecurity Containment guidelines are specified - for outdoor containment facilities -MAF Biosecurity Authority /EPA Standard and laboratory containment facilities -Australia New Zealand Standard AS/NZS :2010. ( all standards follow quality management system and procedures based on the principles of AS/NZS ISO 9001 We also ask that the Council consider that they receive a comprehensive annual report on all GM activities, including breaches related, to the trial as required by the EPA. MONITORING: We do not agree that a member of the trial should be a test site monitor, however there needs to be an independent inspector to avoid conflicts of interest. We note that the MPI inspectors are delegated to monitor Field Tests (proposed Discretionary Activity) on a regular basis and EPA controls require the consent holder to be fully cogniscent of all their GMO activities. Our members are highly concerned as to the effects on their business and farming should GMOs be introduced into their community at this time. Evidence from overseas, where GM crops have been grown for 15 years, has found an increasing level of pesticide use on crops, deleterious health effects from those working with and living near GM crops and an ever growing weed and insect resistance problem that is forcing other pesticide measures to be used with an increased battle for market dominance of their particular patented proprietary chemical. This is causing farmers and the environment to suffer as well as consumers of these GM crops. There is also potential for unexpected and unknown medium-term and long-term impacts on soil biota, waterways and the natural environment generally arising from GMOs outside containment. As is specified in the Hazardous Substances and New Organisms Act (HSNO) the Chief Executive is charged with ensuring that the provisions of a new organism are enforced (HSNO 97(h)). Whangarei District Councils excellent Chapter 4 on GMO s will ensure that enforcement officers can be appointed as district hazardous substances officers (HSNO sec: 100(4)). These Policy, Rules and objectives mean that people can be fully trained and warranted in advance of any GM application that might be lodged, and having a trained expert would save ratepayers the expense of HSNO Authority exercising and performing any function needed (HSNO 101). We applaud Whangarei Council integrated approach with it s neighbouring councils and at this time believe they have proposed through their plan a win - win solution for protection of tangata whenua, community wellbeing, social cohesion and quality farming. 22 2 REASONS (4) SHANZ support PC131 for the following reasons: The Law 4.1 SHANZ was a party to the NZ Forest Research Institute Ltd v Bay of Plenty Regional Council That decision makes provision for genetically modified organisms (GMO) as an emerging issue under the Bay of Plenty Regional Policy Statement. 4.3 SHANZ considers that the decision indicates that there is jurisdiction to make provision for objectives, policies, rules and other planning tools in relation to GMOs under PC18. Integrated Management 4.4 GMO proposals require approval from the Environmental Protection Authority (EPA) under the Hazardous Substances and New Organisms Act 1996 (HSNO Act). 4.5 The HASNO Act consenting process gives particular attention to the technical aspects of managing individual proposals. However, it does not involve: (a) (b) (c) (d) consideration of the geographic distribution of GMO projects; consideration of the need to geographically protect areas of particular value from GMO activities, such as sensitive farming practices (e.g. organic farming); consideration of the preferences of a community; or integration of the management of natural and physical resources, and the effects of GMO activities on natural and physical resources, on a geographic basis. 1 [2013] NZEnvC 298; [2014] NZRMA 181.

23 3 4.6 The HASNO Act does not, therefore, provide a planning framework through which GMOs can be geographically / spatially managed in an integrated manner. 4.7 The Resource Management Act 1991 (RMA) establishes a regime whereby local authorities are called upon to prepare policy and plans to implement sustainable management on a geographic basis through the use of integrated management of natural and physical resources at a regional level, and integrated management of effects on the environment at a district level. 4.8 Consideration of the location and distribution of proposals involving GMOs on a district basis, together with protection of rural resources for organic or biodynamic farming, are important resource management matters for consideration by territorial authorities in carrying out their functions under the RMA. Potential Adverse Effects 4.9 The release and/or use of GMOs in the environment has a potential for significant adverse effects on the environment. Adverse effects could include (inter alia): (a) (b) biological or ecosystem harm; harm to other existing or potential forms of land use including: (i) (ii) organic farming (including organic certification and the requirement to be GMO free); and agricultural activities dependent on an uncontaminated environmental brand GMOs have the potential to adversely affect ecological, economic, and resource management values, and the well-being of people and communities sensitive to GMO activities.

24 Application of integrated management and a precautionary approach to GMOs under the RMA is the best available technique for managing the potential adverse effects posed by GMOs to other land uses within the district. Sustainable Management and Part II 4.12 It is consistent with the sustainable management purpose and Part II of the RMA to establish district plan provisions (e.g. issues, objectives, policies, rules and methods) that manage the release, location and management of GMOs where they have the potential to adversely affect other land use activities. DECISION SOUGHT (5) SHANZ seek the following decision from the Council: 5.1 The existing provisions of PC131 as notified are retained; 5.2 The following provisions are added to PC131: (a) GMO 1.1 Description and Expectations - following 4 add the following result: Integrated management of effects on the environment including an integrated approach to all GMO proposals in relation to the effects of those activities on natural and physical resources. (b) GMO 2.2 Policies - add the following new policies: To ensure that the location of a proposed GMO activity does not have potential to adversely affect existing or potential organic farming activities including market recognition and public perception of an area as GMO free. To ensure that potential adverse effects on areas of significant ecological value and/or sensitivity are avoided.

25 5 (c) GMO 2.3 Information Requirements - add the following to the fourth bullet point: This research is to include (but not be limited to) identification of the location and vulnerability of existing and potential organic farming activities and areas potentially significant for the development of organic farming which lie within the geographical range of potential harmful effects from the proposed GMO activity. (d) GMO 2.5 Particular Matters - add the following: In addition to any other potential effect on the environment, consideration of the effects of a GMO proposal can take into account: Geographic distribution and extent of existing organic farming and the geographic extent and distribution of areas with significant potential for the development of organic farming within the district; Relationship of a proposed GMO site to areas of significant ecological value and/or vulnerability; The economic, physical and regulatory vulnerability of organic farming to proximity and/or exposure to potential adverse effects of GMO activities; Community perceptions and preferences in relation to the location and extent of GMO activities. 5.3 Without derogation to the relief in 5.1 and 5.2, such other and/or consequential relief that will appropriately provide for the matters raised in this submission.
