2 Changes in Workplace Health and Safety Regulations, Guidelines, Standards have seen heightened COR (Chain of Responsibility) obligations with increased enforcement of penalties. It is acknowledged that Safety Engineering Control Technologies can mitigate or eliminate associated workplace injuries and fatalities and so such technology is being recommended-(in some cases), mandated. When an OH&S incident occurs, Industry is perceived at fault and subsequently require evidence that proves every endeavour has been implemented to mitigate risk of such incidents. Workplace OH&S Compliance / Penalties OH&S expectations for ensuring compliance, elimination of risk, enforcement of penalties has changed dramatically over the past few years, with a few significant influences: Increase in Industrial incidents. Mandatory reporting of all workplace incidents. Statistical monitoring data and reports- publicly available. Public / workers awareness and demands for reduction of risk, identify accountability and enforcement of penalties. Increased civil litigation for compensation- especially where a ruling has been determined by respective Industry Authorities / Regulators. Mandatory Incident reporting / statistics depict that OH&S incidents are on the rise, Regulators and Authorities are under pressure to satisfy the public demand for proactive / preventative solution and the enforcement of penalties. The Safe work WHS Act (March 2016) provides for a nationally harmonised work health and safety laws that act as an umbrella over all other OH&S regulations. A few points of significance are: Definition of a PCBU (Person Conducting a Business or Undertaking) which includes all duty holders as the equipment designer, manufacturer, importer, supplier, installer, management, etc- and of course operator of equipment. The PCBU s are representative of the COR (Chain of Responsibility) laws and therefore are all equally obligated to ensure best practice for the health and safety of workers and prevention of incidents. There are 3 x Categories of offences with penalties for PCBU s ranging between $50,000 for Individuals, $3.0 million for businesses and / or 5 years jail for both. COR laws are being extended and the writer knows of cases where sentences of incarceration have been enforcedwithout suspension. When a determination is made, civil action may follow that entails even more cost-which can far exceed the enforcement penalties under the WHS Act. Proof of Causes, Effectiveness / Compliance / Management OH&S regulators and authorities, workers and the public are now more aware of available mitigation engineering controls that can substantially reduce the risk and / or eliminate incidents. However, when implementing a Safety Control, one also needs to also ensure that users are trained / educated in its use and that it is maintained and continues to function correctly. Also Processes and Procedures need to be established and reviewed should the safety control fail or need attention. Another aspect is complacency where operators, user s and managers may make errors, not take timely corrective action (egg ignore alarms) or there is blatant sabotage of the technology. In any case, if an incident occurs, one needs to have evidence in such situations and the fault for the incident determined with corrective action implemented. So, whilst the first step is to implement the safety engineering control technology, the next is to ensure proof of compliance, effectiveness and on- going management of the technology by recording condition data with live alerting, analysis, reporting, etc to ensure mitigation of potential incidents and qualification of causes if they do occur.

5 Live View of Alerts / Events A Live Event View provides immediate information as to the types of events / alerts as and when they occur.
