1 SUBJECT: MANAGING HEALTH AND SAFETY IN CONSTRUCTION - CDM REGULATIONS INTRODUCTION This dcument is written t prvide guidance n the Cnstructin (Design and Management) Regulatins 2007 (CDM 2007). CDM 2007 replaces CDM 1994 and the Cnstructin (Health Safety and Welfare) Regulatins The key aim f CDM 2007 is t integrate health and safety int the management and planning f any prjects and cnstructin wrks. Everyne invlved shuld be encuraged t wrk tgether t; a) Imprve the planning and management f prjects frm the very start b) Identify hazards early n, s that they can be eliminated r reduced at the design and specificatin stage and the remaining risks can be prperly managed. c) Discurage unnecessary paperwrk. The Regulatins place fcus n the actins necessary t reduce and manage risks. Any paperwrk prduced shuld help with cmmunicatin and risk management. Frm the CDM Apprved Cde f Practice; Paperwrk which adds little t the management f risk is a waste f effrt, and can be a dangerus distractin frm the real business f risk reductin and management. Time and thught invested at the start f the planning stage f the prject will pay dividends nt nly in imprved health and safety, but als in; a) Reduced delays b) Mre reliable cstings and cmpletin dates c) Imprved c-peratin and cmmunicatin between Cntractrs and the University. Imprved planning and management f health and safety will lead t a reductin in accidents and ill health during planned prjects and cnstructin wrks. 2.0 SCOPE This Prcedure cntains specific health and safety guidance n: prjects, cnstructin and ANY demlitin wrk, irrespective f duratin f wrk r numbers f man days wrked. CDM 2007, and therefre this guidance, will als apply t nn ntifiable prjects (see Definitins). This guidance is fr use by the University f Glamrgan Grup, althugh it may be distributed t thse ther parties invlved. Hwever, the Cntractrs emplyed by the Owner: Ian Pugh OHSS /12 Page 1 f 17

4 5.1 Summary f Duties under the Regulatins The Client must fr all cnstructin prjects; Check cmpetence and resurces f all appintees; Ensure that there are suitable management arrangements fr the prject, including welfare facilities; Allw sufficient time and resurces fr all stages; Prvide pre-cnstructin infrmatin t Cntractrs The Client must fr all ntifiable cnstructin prjects; Appint CDM C-rdinatr; Appint Principal Cntractr (PC); Make sure that the cnstructin phase des nt start unless there is/are suitable; welfare facilities, and cnstructin phase plan in place Retain and prvide access t the health and safety file; Ensure there is a CDM C-rdinatr and PC until the end f the cnstructin phase The CDM C-rdinatr must; Advise and assist the Client with their duties. (In practice this wn t apply if C-rdinatr and client are the same entity). Recrds f decisins made must be available; Ntify HSE f prject, using frm F10; C-rdinate H&S aspects f any design wrk and c-perate with thers invlved with the prject; Facilitate gd cmmunicatin between client, designers and cntractrs; Liaise with principle cntractr regarding n ging design; Identify, cllect and pass n pre-cnstructin infrmatin; Prepare / update the H&S file; The CDM C-rdinatr can be an individual r a cmpany/team under the regulatins and can cmbine rles within the prject fr example prject manager, designer r principle cntractr Designers must fr all cnstructin prjects; Eliminate hazards and reduce risks during any design; Owner: Ian Pugh OHSS /12 Page 4 f 17

5 Prvide infrmatin abut the remaining risks Designers must fr all ntifiable cnstructin prjects; Check client is aware f duties and CDM C-rdinatr has been appinted; Prvide any infrmatin needed fr the health and safety file The Principal Cntractr must fr all cnstructin prjects (including ntifiable); Plan, manage and mnitr cnstructin phase in liaisn with Cntractrs; Prepare, develp and implement a written cnstructin phase plan and site rules. (Initial plan cmpleted befre cnstructin phase begins); Give Cntractrs relevant parts f the plan; Make sure suitable welfare facilities are prvided frm the start and maintained thrughut the cnstructin phase; Check cmpetence f all appintees; Ensure all wrkers have site inductins and any further infrmatin and training required fr the wrk; Cnsult with the wrkers; Liaise with the CDM C-rdinatr regarding n ging design; Secure the site The Cntractrs must fr all cnstructin prjects; Plan, manage and mnitr their, wn wrk; Check cmpetence f all their appintees and wrkers; Train their, wn emplyees; Prvide infrmatin t their wrkers; Cmply with the specific requirements in part 4 f the regulatins; Ensure there are adequate welfare facilities fr their wrkers The Cntractrs must fr all ntifiable cnstructin prjects; Everyne must; Check client is aware f duties and a CDM C-rdinatr has been appinted and the HSE ntified befre starting wrk; C-perate with the Principal Cntractr in planning and managing wrk, including reasnable directins and site rules; Prvide details t the PC f any Cntractr whm they engage in cnnectin with carrying ut the wrk; Prvide any infrmatin needed fr the H&S file; Infrm the PC f any prblems with the plan; Infrm the PC f reprtable accidents, diseases, and dangerus ccurrences. 6 Cmply with the requirements f schedule 3 and part 4 f the regulatins fr any wrk under their cntrl; Take accunt and apply the general principles f preventin when carrying ut duties. Nte The CDM ACOP states that it is acceptable t cmbine the rles f Principle Cntractr with CDM C-rdinatr. When this apprach is adpted then the respnsibilities f the Client, CDM C-rdinatr and Principal Cntractr shuld be agreed frmally at the planning stage and recrded. 5.2 Further Detail On the Respnsibilities f the Duty Hlders The Client The University must ensure that; Where mre than ne client exists, an agreement must be made in writing detailing which client is t perfrm the duties f the client, under the regulatins. The Client shall take reasnable steps t ensure that arrangements made fr managing the prject including sufficient time and ther resurces are suitable t: Ensure that wrk can be carried ut, as far as is reasnably practicable, safely and withut risk t health. Arrangements have been made fr suitable welfare facilities, t be prvided frm the start and thrughut the cnstructin phase. Relevant infrmatin likely t be needed by the Cntractrs t plan and manage their wrk is passed t them, e.g. specificatin f wrk, preferred wrking methds. Any structure designed fr use as a wrkplace, has been designed taking int accunt the prvisins f the Wrkplace (Health, Safety and Welfare) Regulatins 1992 which relate t the design f, and materials used in the structure C-peratin, c-rdinatin, timeliness and resurces. C-peratin between the client and the cntractrs is key t the successful management f any prject health and safety. Cperatin and c-rdinatin can nly be meaningful if the client and cntractr staff are in place early enugh t allw them t cntribute t risk reductin. This is particularly imprtant during the design stage when bth clients and cntractrs shuld cntribute t discussins n buildability, usability and maintainability f the finished structure. 7 Management Arrangements The client must cnsider the resurces, equipment and, particularly, time needed t plan and d the wrk prperly. The client shuld give the Cntractrs sufficient time after their appintment t allw them t plan the wrk and mbilise the necessary equipment, facilities and staff t allw the wrk t prceed safely and withut risk t health. BEFORE WORK BEGINS, the Client will need t ensure that arrangements are in place t ensure; There is clarity as t the rles, functins and respnsibilities f members f the prject team. Thse with duties under the Regulatins have sufficient time and resurce t cmply with their duties There is gd cmmunicatin, c-peratin and c-rdinatin between members f the prject team (fr example between different Cntractrs). Designers are able t cnfirm that their designs (and any changes) have taken accunt f regulatin 11 and that the different design elements will wrk tgether in a way which des nt create risk t the health and safety t thse cnstructing, using r maintaining the structure. That the Cntractrs are prvided with pre cnstructin infrmatin Cntractrs are able t cnfirm that health and safety standards will be cntrlled and mnitred and that welfare facilities will be prvided by the cntractr frm the start f the cnstructin phase thrugh t handver and cmpletin. That the cnstructin phase plan is prject specific, aviding generalities where apprpriate. That the cnstructin phase plan is issued as sn as pssible s that cntractrs preparing t tender r preparing fr wrk can decide n what resurces they will need. DURING WORK, The Client shuld carry ut checks t ensure that; There is adequate prtectin fr cntractrs and any ther visitrs t the prject site r facility. The welfare facilities remain in place. There is gd c peratin and cmmunicatin between designers and cntractrs. The Cntractrs cnfirm that the arrangements that they agreed t make have been implemented Pre-cnstructin infrmatin (see Appendix 2 f the Regulatins) The University shuld prvide the Cntractrs with specific health, safety and envirnmental infrmatin that may affect hazard and risks. 8 infrmatin shuld be prvided early enugh s that time and resurces can be allcated by the Cntractrs t reduce risk. This may include drawings, plans, diagrams, service details and any ther necessary infrmatin The Health and Safety File The CDM C-rdinatr is respnsible fr preparing and updating the Health and Safety File. The CDM C-rdinatr is als respnsible fr handing the file t the Client at cmpletin. This file must be available fr inspectin and the University as the Client must check this, and ensure the file is stred fr future reference. The H&S infrmatin within the file will be useful t infrm decisin making and reduce risk and csts in future prjects, including cleaning, maintenance, alteratins, refurbishment and demlitin. The file can be paper r electrnic. Cntractrs and designers must prvide prmpt infrmatin t g in the file where necessary and as required Mnitring f Cntractrs The frequency as a minimum must be at least nce per day The CDM C-rdinatr Fr all ntifiable prjects the Client must appint a cmpetent adequately resurced CDM C-rdinatr. The appintment must be made as sn as practicable after initial design wrk r ther preparatins fr cnstructin wrk have begun. The main purpse f CDM C-rdinatr is t help the Client carry ut their duties; t crdinate health and safety aspects f the design wrk and t prepare the health & safety file. The CDM C-rdinatr can be an individual r a cmpany. Individuals may be appinted internally r externally and may als have anther rle in the team. Where the rle is cmbined it is crucial that the CDM C-rdinatr has sufficient independence t carry ut the task effectively. If a CDM C-rdinatr has nt been appinted and a prject is ntifiable then the client assumes the duties f the CDM C-rdinatr. See regulatin 14 (4) a What the CDM C-rdinatr, must d; (In additin t the general respnsibilities n page 8): Prvide suitable and sufficient advice t Clients particularly n their duty t appint cmpetent designers and cntractrs; Cllate all the pre-cnstructin infrmatin and advise the Client if any additinal surveys need t the undertaken; Manage the flw f H&S infrmatin between Clients, designers and Cntractrs; Owner: Ian Pugh OHSS /12 Page 8 f 17

9 Advise the Client n the suitability f the cnstructin phase plan and ensure welfare facilities are n site; Managing infrmatin flw. The CDM C-rdinatr, needs t decide in the planning stages hw H&S infrmatin will be cmmunicated between prject parties, by ensuring that there are apprpriate systems in place t encurage cmmunicatin and the sharing f relevant infrmatin. The CDM C-rdinatr shuld arrange fr special meetings if nt satisfied with c-peratin between any team members Ensuring Adequacy f management arrangements. The CDM C-rdinatr shuld ensure that; All necessary appintments have been made fr the prject; The prject team meet regularly and are clear abut their rles and respnsibilities; Any design wrk assciated t mdificatin t existing plant and/r systems is c-rdinated and reviewed in line with H&S requirements; Arrangements are in place fr c-rdinating and reviewing design wrk, als t deal with late design changes, ensuring the c-peratin f Cntractrs, s that prblems are shared; The cnstructin phase plan can be changed t accmmdate any risks that arise as the prject cmmences; They specify the infrmatin required in the H&S file, and hw the required infrmatin gets int the file; The PC Cntractrs cnsult prperly with, and adequately train and supervise, their staff C-rdinating Design Wrk: Design Reviews The CDM C-rdinatr CDM legal respnsibility in respect f design wrk nly extends t health and safety aspects f the design, checking that the requirements f regulatin 11 have been met and that the different design elements wrk tgether withut causing danger. This is best achieved thrugh design reviews where these issues can be addressed tgether with cst and practicality in a wider review f the designs buildability, maintainability and usability Unusual r cmplex design structures must have a safe methd f cnstructin. CDM C-rdinatr must ensure that this is s and that the designs include clear and cncise safety infrmatin needed by ther designers and cntractrs allwing them t wrk safely and withut risk t health CDM C-rdinatr wh identify imprtant health & safety issues that have nt been addressed in the design, must draw them t the attentin f the designer. 10 Design ften cntinues thrugh the cnstructin phase. The CDM Crdinatr must ensure that all designers c-perate with each ther and that designs cmply with the regulatins. The CDM C-rdinatr must liaise with the PC cncerning any design changes r decisins that have significant health & safety implicatins CDM C-rdinatr must take reasnable steps t ensure c-peratin between permanent and temprary wrks designers, in particular t ensure that arrangements are in place t ensure that designs are cmpatible and that permanent wrks can supprt the ladings frm temprary wrks. 5.3 Duties f Designers Designers are thse wh have a trade r a business which invlves them in: Preparing designs fr cnstructin wrk, including variatins. This includes preparing drawings, design details, specificatins, bills f quantities and the specificatin (r prhibitin) f articles and substances as well as the related calculatins and preparatry wrk; r Arranging fr their emplyees r ther peple under their cntrl t prepare designs relating t a structure r part f a structure. Designs d nt have t be recrded; they may be just an ral cmmunicatin Designers may therefre include: Architects, civil and structural engineers, building surveyrs, landscape architects, ther cnsultants, manufacturers and design practices (f whatever discipline) cntributing t, r having verall respnsibility fr, any part f the design, fr example, drainage engineers designing the drainage fr a new develpment; anyne wh specifies r alters a design r specifies the use f a particular methd f wrk r material, such as a design manager, quantity surveyr wh insists n specific material r a client wh stipulates a particular layut fr a new building; building service designers, engineering practices r thers designing plant which frms part f the permanent structure (including lifts, heating, ventilatin and electrical systems), fr example a specialist prvider f permanent fire extinguisher installatins; thse purchasing materials where the chice has been left pen, fr example thse purchasing building blcks and s deciding the weights that bricklayers must handle; cntractrs carrying ut design wrk as part f their cntributin t a prject, such as an engineering cntractr prviding design, prcurement and cnstructin management services; temprary wrks engineers, including thse designing auxiliary structures, such as frmwrk, falsewrk façade retentin schemes, scafflding and sheet piling; Owner: Ian Pugh OHSS /12 Page 10 f 17

11 5.3.3 Requirements n Designers Interir designers, including shpfitters wh als develp the design; Thse determining hw buildings and structures are altered, fr example during refurbishment, where this has the ptential fr partial r cmplete cllapse Designers must ensure that: Preparing a design: the Client is aware f the Clients duties prir t cmmencing any design wrk they are cmpetent and adequately resurced t adequately address the health and safety issues likely t be invlved in the prject specify r alter designs, materials r wrking methds. when carrying ut design wrk they avid freseeable risks t thse carrying ut cnstructin wrk and wh may be affected by cnstructin wrk. Als thse maintaining the fixtures and fittings f a structure and using the structure as a wrkplace. they eliminate hazards where pssible and then reduce the risks frm thse that remain. they design any structure that is t be used as a wrkplace in accrdance with the Wrkplace (Health, Safety and Welfare) Regulatins 1992 that clients, ther designers and cntractrs have sufficient infrmatin relating t their designs t enable them t cmply with their wn duties under the regulatins. The Regulatins allw Designers, t weigh safety cncerns against ther design cnsideratins, such as cst, fitness fr purpse, maintainability and buildability. This can als be stated as; C-peratin: Designers are required t avid freseeable risks s far as is reasnably practicable, taking due accunt f ther relevant design cnsideratins. The greater the risk, the greater the weight that must be given t eliminating r reducing it. The Designers must nt specify a jb that cannt be cmpleted in reasnable safety Designers must c-perate with the client, and ther designers and cntractrs including thse designing temprary wrks. This is t ensure that incmpatibilities between designs are identified and reslved as early as pssible, and that the right infrmatin is prvided in the pre-cnstructin infrmatin. 12 Fr smaller prjects where mst f the wrk is dne by a single designer, this can be achieved very easily. Fr larger prjects r thse invlving significant risks, a mre managed apprach will be necessary C-peratin can be encuraged by: Setting up an integrated team invlving designers, PC and ther relevant cntractrs The appintment f a lead designer, where many designers are invlved Agreeing a cmmn apprach t risk reductin during design Regular meetings f all the design team (including the CDM Crdinatr) with cntractrs and thers Regular review f develping designs Site visits, thrugh which designers can gain a direct insight int hw the risks are managed in practice What Designers d nt have t d: Designers are nt legally required t keep recrds f the prcess thrugh which they achieve a safe design, but it can be useful t recrd why certain decisins were made. These recrds shuld be available if there is a new Designer in pst, s that imprtant decisins are nt reversed withut understanding the implicatins The 2007 CDM Regulatins stress that t much paper wrk is as bad as t little, because the useless hides the necessary. Large vlumes f paperwrk listing generic hazards already well knwn t cmpetent cntractrs are psitively harmful and shuld be avided. 5.4 Duties f the Principal Cntractr (PC) The key duty f the PC is t prperly plan, manage and c-rdinate wrk during the cnstructin phase in rder t ensure that the risks are prperly cntrlled What the Principal Cntractr, must d: Satisfy themselves that Clients are aware f their duties; Make sure that they are cmpetent t address the health and safety issues likely t be invlved in the management f the cnstructin phase; Ensure that the cnstructin phase is prperly planned, managed and mnitred, with adequately resurced, cmpetent site management; Ensure that any Cntractrs invlved n the prject are infrmed f the minimum amunt f time which they will be allwed fr planning and preparatin befre they begin wrk n site; Owner: Ian Pugh OHSS /12 Page 12 f 17

13 Ensure that all Cntractrs are prvided with the infrmatin abut the prject that they need t enable them t carry ut their wrk safely and withut risk t health. Requests frm Cntractrs fr infrmatin shuld be met prmptly; Ensure safe wrking and c-peratin between Cntractrs; Ensure that a suitable cnstructin phase plan (the plan) is; Prepared befre wrk begins Develped in discussin with, and cmmunicated t, Cntractrs affected by it. Implemented, and Kept up t date as the prject prgresses. Satisfy themselves that the Cntractrs that they engage are cmpetent and adequately resurced; Ensure that suitable welfare facilities are prvided frm the start f the cnstructin phase; Take reasnable steps t prevent unauthrised access t the site; Prepare and enfrce any site rules; Prvide relevant parts f the cnstructin phase plan t Cntractrs with enugh time fr them t plan their wrk; Liaise with the CDM C-rdinatr n design wrk carried ut during the cnstructin phase, including any design by specialist cntractrs, and its implicatins fr the plan; Prvide the CDM C-rdinatr prmptly with any infrmatin relevant t the Health & Safety file; Ensure that all wrkers have been prvided with suitable health and safety inductin, infrmatin and training; Ensure that the wrkfrce is cnsulted abut health and safety matters; Display the prject ntificatin C-peratin and c-rdinatin The PC shuld take the lead and actively encurage c-peratin and crdinatin between Cntractrs frm an early stage. A team apprach invlving the Client, designers, cntractrs and even manufacturers wh wrk clsely tgether will ften prduce the best results Mnitring the cnstructin phase plan The purpse f mnitring is t ensure that the precautins described in the cnstructin phase plan are fllwed in practice. Where cntractrs d nt wrk safely r cmply with the plan, PC must take apprpriate actin t deal with the risk. (They can give reasnable directins t any cntractr and cntractrs have t apply, whether they have been appinted by the PC r nt) The PC is respnsible fr ensuring the health & safety f everyne n site. Everyne n site (including the Client, anyne wrking fr the client and Owner: Ian Pugh OHSS /12 Page 13 f 17

14 wrkers fr utility cmpanies) must c-perate with the PC and enable them t cmply with their duties The plan needs t be rutinely reviewed, revised, and refined by the PC as the prject develps. Mnitring may shw that the plan has shrtcmings and needs mdificatin. Any significant changes t the plan shuld be brught t the attentin f all thse affected Site Rules PC shuld include any site rules (which thers n site have t fllw) in the cnstructin phase plan. These may cver issues such as restricted areas, permit-t-wrk systems, ht wrk, envirnmental management and emergency plans. Crss referencing these details in the plan is preferred. Site rules shuld be: Set ut in writing; Understandable t thse wh have t fllw them; Brught t the attentin f everyne wh has t fllw them; Enfrced; Displayed n site in a place where they can be seen by thse wh wrk there Cntrlling Access nt Sites PC must take reasnable steps t prevent access by unauthrised persns t the cnstructin site. Only peple wh are explicitly authrised by the PC shuld be allwed access. Authrised peple shuld have the relevant site rules explained t them and undertake any necessary site inductin, and shuld cmply with site rules and c-perate with the PC. Sme authrised visitrs may need t be supervised r accmpanied while n site r visiting specific areas Hw access is cntrlled depends n the nature f the prject, the risks and lcatin. The site bundary shuld be physically defined, where necessary, by suitable fencing. The type f fencing shuld reflect the nature f the site and its surrundings. Special cnsideratin is needed where: Rights f way crss sites; Sites are in r next t ther wrk areas The site is part ccupied There are children r ther vulnerable peple nearby The effectiveness f the arrangements needs t be reviewed in the light f experience. 15 5.5 Duties f Cntractrs Cntractrs and thse actually ding the cnstructin wrk are at mst risk f injury and ill health. They have a key rle t play, in cperatin with the PC, in planning and managing the wrk t ensure that risks are prperly cntrlled. All cntractrs (including utilities, specialist cntractrs, cntractrs nminated by the client and the self emplyed) have a part t play in ensuring that the site is a safe and healthy place t wrk. The key t this is the prper c-rdinatin f the wrk, underpinned by gd cmmunicatin and c-peratin between thse invlved. The duties n Cntractrs apply whether the wrkers are emplyees, self emplyed r agency wrkers What Cntractrs must d n all prjects; Check that the clients are aware f their duties Satisfy themselves that they and anybdy they emply r engage are cmpetent and adequately resurced. Plan, manage and mnitr their wn wrk t make sure that wrkers under their cntrl are safer frm the start f their wrk n site. Ensure that any cntractr wh they appint r engage t wrk n the prject is infrmed f the minimum amunt f time which will be allwed fr them t plan and prepare befre starting wrk n site. Prvide wrkers under their cntrl with any infrmatin, including abut relevant aspects f ther Cntractrs wrk, and site inductin (where nt prvided by the PC) which they need t wrk safely t reprt prblems and t respnd apprpriately in an emergency. Ensure that any design wrk they d cmplies with regulatin 11; Cmply with the detailed Welfare and Cnstructin requirements included within Part 4 and Schedule 2 f the CDM Regulatins. C-perate with thers and c-rdinate their wrk with thers wrking n the prject Ensure that the wrkfrce is prperly cnsulted n matters affecting their health and safety. 17 5.5.3 Reprting incidents (RIDDOR) The Reprting f Injuries, Diseases and Dangerus Occurrences Regulatins 1995 (RIDDOR) require the respnsible persn t ntify any death, reprtable injury, disease r dangerus ccurrence t the relevant enfrcing authrity (i.e. HSE).
