31 Holiday Pay Case law affecting holiday pay rates Guaranteed and normal non-guaranteed overtime should be considered when calculating a worker's statutory holiday pay entitlement but there is currently no definitive case law that suggests voluntary overtime needs to be taken into account. Source: ACAS

32 Holiday Pay If guaranteed or non guaranteed overtime is offered: Overtime pay rate should be included in the holiday pay rate Only applicable to the 4 weeks annual leave entitlement rather than the full 5.6 weeks Anybody making a claim for underpayment will only apply for any holiday taken within 3 months of lodging an employment tribunal claim.
