3 SECTION NOTICE INVITING PROPOSALS RECEIPT OF PROPOSALS: Sealed Proposals will be received at the office of the South Valley Water Reclamation Facility, hereafter "OWNER", located at 7495 South 1300 West, West Jordan, Utah 84084, until 2:00 PM, on May 2, 2017, for the project entitled Supply of Belt Filter Press Rebuilding Services. DESCRIPTION OF WORK: The work is described as follows: The work includes cleaning, removal, transportation to the rebuilder s facility, rebuilding four belt filter presses, transportation to the Owner s facility, reinstallation, commissioning, startup and training of operations staff for four 2-meter Ashbrook Simon-Hartley Winklepress units, one press at a time in consecutive order until services for all machines are completed and accepted. Three belt filter presses shall remain installed and operable at all times. The Owner s staff will perform all electrical and control related work. SITE OF WORK: The site of the Work is the South Valley Water Reclamation Facility located at 7495 South 1300 West, West Jordan, Utah DELIVERY SCHEDULE: The schedule to complete the work required under these Proposal Documents shall be provided by the Proposer and will be considered by the Owner as one of the selection criteria for award of the purchase order. In no case shall completion of the Work extend beyond Dec. 31, OPENING OF PROPOSALS: The Proposals will be publicly opened and read by the Owner and Engineer shortly following the 2:00 PM deadline on May 2, Opening of Proposals will be performed at the above-mentioned office of the Owner. PROPOSAL SECURITY: Each Proposal shall be accompanied by a certified check, cashier s check or Proposal Bond in the amount of 5 percent of the Total Bid Price payable to the OWNER as a guarantee that the Proposer, if its Proposal is accepted, will promptly accept the Purchase Order. A proposal will not be considered unless one of the forms of Proposer s security is enclosed with it. OBTAINING PROPOSAL DOCUMENTS: The Proposal Documents, entitled Supply of Belt Filter Press Rebuilding Services may be obtained electronically from the OWNER starting April 17, ADDRESS AND MARKING OF PROPOSAL: The envelope enclosing the Proposal shall be sealed and addressed to the South Valley Water Reclamation Facility and delivered or mailed to 7495 South 1300 West, West Jordan, Utah The envelope shall be plainly marked in the upper left-hand corner with the name and address of the Proposer and shall bear the words Supply of Belt Filter Press Rebuilding Services, followed by the date and hour of opening of Proposals. 5 SECTION INSTRUCTIONS TO PROPOSERS FORM OF PROPOSAL: The Proposal shall be made on the Proposal schedule included herein. The Proposal schedule along with the requested supporting information shall be enclosed in a sealed envelope bearing the name of the Proposer and the name of the project. DELIVERY OF PROPOSAL: The Proposal shall be delivered by the time and to the place stipulated in the Notice Inviting Proposals. OPENING OF PROPOSALS: The Proposals will be publicly opened and read shortly after the closing time stipulated in the Notice Inviting Proposals. The Proposals will be opened by the Owner s staff at the Owner s office. PROPOSAL SECURITY, BONDS AND INSURANCE: Each Proposal shall be accompanied by a certified, cashier s check or approved Bid Bond in the amount stated in the Notice Inviting Proposals. Said check or bond shall be made payable to the OWNER and shall be given as a guarantee that the Proposer, if awarded the WORK, will accept the OWNER'S purchase order, and will furnish the necessary insurance certificates, and a Payment Bond for 100 percent of the Purchase Order price. In case of refusal or failure to accept the OWNER S purchase order, the check or Proposal Bond, as the case may be, shall be forfeited to the OWNER. If the Proposer elects to furnish a Proposal Bond as its Bid security, the Proposer shall use the Proposal Bond form bound herein, or one conforming substantially to it in form. DISCREPANCIES IN PROPOSALS: In the event there are unit price Proposal items in a Proposal schedule and the amount indicated for a unit price Proposal item does not equal the product of the unit price and quantity, the unit price shall govern and the amount will be corrected accordingly, and the Proposer shall be bound by said corrections. PROPOSER S EXAMINATION OF PROPOSAL DOCUMENTS AND SITE It is the responsibility of each Proposer before submitting a Proposal, to: 1. Examine the Proposal Documents thoroughly. 2. Visit the site to become familiar with local conditions that may affect cost, progress, and performance of furnishing the equipment. 3. Consider federal, state and local laws and regulations that may affect cost, progress, performance or furnishing of the work. 4. Study and carefully correlate the Proposer s observations with the Proposal Document. 5. Notify the Owner of all conflicts, errors, or discrepancies in the Proposal Documents. QUANTITIES OF WORK: The Owner reserves the right, before or after Award of the Purchase Order, to delete any Proposal item in its entirety, or to add additional Proposal items as deemed expedient and as negotiated prior to an Award of Purchase Order. DISQUALIFICATION OF PROPOSERS: If there is reason for believing that collusion exists among the Proposers, all Proposals will be rejected. 6 AWARD OF PURCHASE ORDER: The award will be made to a responsive and responsible Proposer who s Proposal complies with all the requirements prescribed, or with such changes as negotiated and approved by the Owner. Any such award will be made by written notice and within 30 calendar days after opening of the Proposals, unless a longer waiting period is expressly allowed in the Notice Inviting Proposals. The Proposer shall guarantee the Proposal Price for a period of 60 calendar days from the date the Proposals are opened. RETURN OF PROPOSAL SECURITY: Within 14 days after award of the Purchase Order, the OWNER will, if requested, return the Proposal securities accompanying such Proposals that are not being considered in making the award. All other Proposal securities will be held until the Purchase Order has been finally executed. They will then be returned, if requested, to the respective Proposers whose Proposals they accompany. EXECUTION OF PURCHASE ORDER: The Proposer to whom award is made shall accept the OWNER S Purchase Order in writing on the form of agreement provided, shall secure all insurance, and shall furnish all certificates and bonds required by the Proposal Documents within 14 calendar days after receipt of the Purchase Order forms from the OWNER. Failure or refusal to accept the OWNER S Purchase Order as herein provided or to conform to any of the stipulated requirements in connection therewith shall be just cause for annulment of the award and forfeiture of the Proposal security. If the lowest responsive, responsible Proposer refuses or fails to accept the OWNERS Purchase Order, the OWNER may award to the second lowest responsive, responsible Proposer. If the second lowest responsive, responsible Proposer refuses or fails to accept the OWNER S Purchase Order, the OWNER may award to the third lowest responsive, responsible Proposer. On the failure or refusal of such second or third lowest Proposer to accept the OWNER S Purchase Order, each such Proposer s Proposal securities shall be likewise forfeited to the OWNER. SUPPORTING INFORMATION: The Proposer shall include with his Proposal, technical information verifying the conformance with Technical Specifications contained herein. This information shall be sufficiently detailed to allow thorough review and evaluation of the proposed services, and shall serve as one of the criteria for evaluation of the Proposer s Proposal. Failure to comply with this requirement may render the Proposal non-responsive and subject to rejection. 7 SECTION PROPOSAL PROPOSAL TO: The undersigned Proposer hereby proposes to furnish all plant machinery, labor, services, materials, equipment, tools, supplies, transportation, utilities, and all other items and facilities necessary to perform all work required under the Proposal Schedule of the Owner s Proposal Documents entitled Supply Of Belt Filter Press Rebuilding Services in accordance with the intent of the Proposal Documents including the specifications, drawings and all addenda issued by said Owner prior to opening of the Proposals. Rebuild services shall be performed on four belt filter presses in calendar year All four belt filter presses shall be rebuilt, reinstalled, commissioned and fully operating by or before December 31, PROPOSAL SCHEDULE Furnish the following parts, services, materials, components, supplies as required to yield four fully refurbished, like new and completely operational AS-H Type 84 2M Winklepress belt filter presses at the South Valley Water Reclamation Facility in West Jordan, Utah. The requirement is to replace all wear and corrosion parts, plastics, rubber, seals, bearings, rolls, and other related elements as indicated or otherwise necessary in order to achieve equipment that is in suitable condition to provide continuous service for 20 years of normal use, with typical wear and tear, service and maintenance. Values provided shall include all labor, materials, supplies, equipment, tools, shipping and transportation, fees, taxes, overhead and profit and any other elements that make up the costs to perform the work as indicated or otherwise required. All the work will be sourced to a single firm or entity which shall be responsible for every element and activity as specified or otherwise required. 9 LIQUIDATED DAMAGES: The REBUILDER agrees to credit the Owner five hundred dollars ($500 US) for each day beyond the specified time to provide the reinstalled and fully functioning rebuilt belt filter presses. OWNERS RIGHTS RESERVED: The undersigned Proposer understands that the Owner reserves the right to reject any or all Proposals or waive any informality or technicality in any Proposal in the interest of the Owner. 10 SECTON PROPOSAL BOND KNOW ALL MEN BY THESE PRESENTS, That as Principal, and held and firmly bound unto the South Valley Water Reclamation Facility hereinafter called as Surety, are "OWNER," in the sum of dollars, for the payment of which sum, well and truly to be made, Surety jointly and severally binds itself, its heirs, executors, administrators, successors, and assigns firmly by these presents. WHEREAS, said Principal has submitted a Proposal to said OWNER to perform the WORK required under the bidding schedule(s) of the OWNER's Contract Documents entitled Supply of Belt Filter Press Rebuilding Services. NOW THEREFORE, if said Principal is awarded a purchase order by said OWNER and, within the time and in the manner required in the "Notice Inviting Proposals" and the "Instructions to Proposers" enters into a written Agreement on the form of agreement bound with said Proposal Documents, furnishes the required certificates of insurance, and furnishes the required Performance Bond, and performs in all other respects the agreement created by this proposal, then this obligation shall be null and void, otherwise it shall remain in full force and effect. The Surety stipulates and agrees that the obligation of said Surety shall in no way be impaired or affected by an extension of the time within which the OWNER may accept such proposal and Surety further waives notice of any such extension. In the event suit is brought upon this bond by said OWNER and OWNER prevails, said Principal and Surety shall pay all costs incurred by said OWNER in such suit, including reasonable attorney's fees and costs to be fixed by the court. 11 SECTION PURCHASE ORDER AGREEMENT This Purchase Order Agreement is dated as of the day of May in the year 2017, by and between the South Valley Water Reclamation Facility Joint Administrative Board (hereinafter called OWNER) and (hereinafter called REBUILDER). OWNER and REBUILDER, in consideration of the mutual covenants hereinafter set forth, agree as follows: 1.01 EQUIPMENT AND SERVICES REBUILDER shall provide the belt filter press rebuilding services, etc. as specified or indicated in the Proposal Documents and/or as modified by the subsequent communication and agreement. The services to be furnished are generally described as follows: 1. Clean, remove, transport, rebuild, transport, reinstall and fully commission (4) four each 2-meter belt filter presses in Provide progress photos as specified. 3. Provide spare parts as specified. 4. Provide performance bond as specified. 5. Provide insurance certificate(s) for coverages specified. 6. Provide written warranty(ies) as specified. 7. Provide performance testing as specified. 8. Conduct can operation and maintenance training session for the Owner s staff following installation and commissioning of the first rebuilt belt filter press as specified. 9. Provide updated and complete operation and maintenance literature as specified POINT OF DELIVERY The rebuilt belt filter presses shall be delivered to the South Valley Water Reclamation Facility located at 7495 South 1300 West, West Jordan, Utah 84084, and reinstalled, re-commissioned and operated DELIVERY TIME The rebuilt belt filter presses shall be returned, reinstalled, commissioned and put into full operation at the Owner s facility according to the specified and/or agreed upon schedule. All work shall be completed no later than December 31, LIQUIDATED DAMAGES PURCHASE ORDER AGREEMENT BELT FILTER PRESS REHABILITATION PROJECT PAGE

12 The REBUILDER agrees to credit the OWNER five hundred dollars ($500.00) for each day beyond the specified time to complete the work PURCHASE ORDER AGREEMENT PRICE OWNER shall pay REBUILDER in current funds for furnishing the Equipment and Services and for performing other services in accordance with the Proposal Documents or as modified by any subsequent documentation the amount of $ PAYMENT PROCEDURES REBUILDER shall submit Applications for Payment and they will be processed by the OWNER in accordance with the following schedule: 1. 20% of the Total Amount after successful delivery, installation and commissioning of each rebuilt belt filter press and successful inspection to verify completeness and compliance with specifications % of the Total Amount after successful completion of optimization of all (4) four rebuilt belt filter presses and operator training. 3. 5% of the Total Amount after delivery of all spare parts and operation and maintenance literature PERFORMANCE BOND The REBUILDER shall furnish a Performance Bond for 100% of the value of the Total Amount. By reference hereto, the Performance Bond shall become part of the Purchase Order Agreement INSURANCE The REBUILDER shall furnish insurance coverages and certificates as specified in S REBUILDER S REPRESENTATIONS The REBUILDER makes the following representations regarding this Purchase Order Agreement. 1. REBUILDER has familiarized himself with the nature and extent of the Proposal Documents and has given the OWNER written notice of all conflicts, errors or discrepancies that he has discovered in the Proposal Documents and the written resolution thereof by the OWNER is acceptable to the REBUILDER. 2. REBUILDER has familiarized himself with all local conditions and federal, state, and local laws, ordinances, rules and regulations that in any PURCHASE ORDER AGREEMENT BELT FILTER PRESS REHABILITATION PROJECT PAGE

13 manner may affect the supply of belt filter press rebuilding services in connection therewith. 3. REBUILDER does not require additional information from OWNER to enable him to provide belt filter press rebuilding services at the Purchase Order Agreement Price, within the Delivery Time in accordance with the other terms and conditions of the Proposal Documents, but subject to REBUILDER s right to request interpretations and clarifications. 4. REBUILDER has correlated the results of all such examinations, investigations, and resolutions with the terms and conditions of the Proposal Documents DOCUMENTS The Documents which comprise the entire agreement between OWNER and REBUILDER are attached to, or accompany, this Purchase Order Agreement, made a part hereof, and consist of the following: 1. Notice Inviting Proposals 2. Proposal 3. Addenda Numbers to, inclusive 4. Purchase Order Agreement 5. Performance Bond 6. Insurance Certificate(s) 7. Technical Specifications, inclusive 8. Any modification, including change orders or other suitable documentation duly delivered after execution of this Purchase Order Agreement 1.11 MISCELLANEOUS Terms used in this Purchase Order Agreement are defined in the Proposal Documents. No assignment by a party hereto of any rights under or interest in the Proposal Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically but without limitations, moneys that may become due and moneys that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment. No assignment will release or discharge the assignor from duty or responsibility under the Proposal Documents OWNER and REBUILDER each binds himself, his partners, successors, assigns and legal representatives to the other party hereto, his partners, successors, assigns and legal representatives in respect to all covenants, agreements and obligations contained in the Proposal Documents This Purchase Order Agreement shall be interpreted in accordance with the laws of the state of Utah. 14 1.14 The parties each agree that should they default in any of the covenants or agreements contained herein, the defaulting party shall pay all costs and expenses, including a reasonable attorney s fee, which may arise or accrue from enforcing this Purchase Order Agreement, or in obtaining possession of the premises covered hereby, or in pursuing any remedy provided hereunder or by the statues or other law of the state of Utah, whether such remedy is pursued by filling suit or otherwise, and whether such costs and expenses are incurred with or without suit or before or after judgment. IN WITNESS WHEREOF, the parties hereto have signed this Purchase Order Agreement in duplicate. One counterpart each has been delivered to OWNER, and REBUILDER. All portions of the Proposal Documents have been signed or identified by OWNER and REBUILDER. 15 KNOW ALL MEN BY THESE PRESENTS, That and SECTION PERFORMANCE BOND as REBUILDER, as Surety, are held and firmly bound unto South Valley Water Reclamation Facility hereinafter called "OWNER," in the sum of dollars, for the payment of which sum, well and truly to be made, we bind ourselves, our heirs, executors, administrators, successors, and assigns, jointly and severally, firmly by these presents. THE CONDITIONS OF THIS OBLIGATION ARE SUCH, that said REBUILDER has been awarded and is about to enter into the Purchase Order Agreement with said OWNER to perform the WORK as specified or indicated in the Proposal Documents Supply Of Belt Filter Press Rebuilding Services. NOW THEREFORE, if said REBUILDER shall perform all the requirements of said Proposal Documents required to be performed on its part, at the times and in the manner specified therein, then this obligation shall be null and void, otherwise it shall remain in full force and effect. PROVIDED, that any alterations in the WORK to be done or the materials to be furnished, or changes in the time of completion, which may be made pursuant to the terms of said Proposal Documents, shall not in any way release said REBUILDER or said Surety hereunder, nor shall any extensions of time granted under the provisions of said Proposal Documents, release either said REBUILDER or said Surety, and notice of such alterations or extensions of the Agreement is hereby waived by said Surety. 16 SECTION SUMMARY OF WORK PART 1 -- GENERAL 1.1 GENERAL A. The SUPPLIER shall furnish all equipment, tools, supplies, labor and materials required for Supply of Belt Filter Press Rebuilding Services specified for the OWNER s water reclamation facility located at 7495 South 1300 West, West Jordan City, Salt Lake County, Utah. 1.2 WORK COVERED BY PROPOSAL DOCUMENTS A. The WORK includes the rebuilding of four 2-meter Belt Filter Presses originally installed in the OWNER S water reclamation facility in 1986, submittals and installation certification. The Belt Filter Presses are size 3V, Type 84 Winklepresses originally manufactured by Ashbrook Simon-Hartley. B. The work includes cleaning, removal, transportation to the rebuilder s facility, rebuilding four belt filter presses including service, parts, materials, components and systems,, transportation to the Owner s facility, reinstallation, commissioning, startup and training of operations staff, one belt filter press at a time in consecutive order until services for all machines are completed and accepted. Three belt filter presses shall remain installed and operable at all times. Operation and maintenance literature, bonds, warranties, insurance and other information and documentation shall be provided as indicated. The Owner s staff will perform all electrical and control related work. C. Equipment rebuilders desiring to have their services considered for this project shall submit complete specifications and descriptive literature with their proposal. D. In the event that the OWNER selects the REBUILDER S proposal, only those exceptions to the specifications herein as clearly described in the information submitted with the REBUILDER S proposal will be considered. The services shall conform in all other respects. The OWNER reserves the right to require such conformance with these specifications not otherwise excepted as provided for, and the REBUILDER shall not be allowed to an increase in compensation by virtue of any required changes. E. The REBUILDER shall be responsible for: 1. Complete services in accordance with the intent of these Technical Specifications. 2. Coordinating the details of the services that affect the work covered under these Technical Specifications. 3. Furnishing all incidental items not actually shown or specified, but which are required by good practice to provide completely renovated machines. 1.3 CONTRACT METHOD SUMMARY OF WORK BELT FILTER PRESS REHABILITATION PROJECT PAGE

17 A. The WORK, hereunder will be acquired by the OWNER through issuance of a Purchase Order. 1.4 INSURANCE A. Property Insurance: REBUILDER shall assume all risk of loss or damage to the Equipment prior to acceptance of by the OWNER of the fully installed, commissioned and operating equipment. REBUILDER shall purchase and maintain insurance on the belt filter presses during the entire work period. REBUILDER S policy shall include extended coverage all risk insurance for physical loss and damage including theft, vandalism and malicious mischief, collapse, fire, water damage and other such perils as appropriate. The REBUILDER shall furnish an insurance certificate to the OWNER verifying conformance to these requirements. B. Other Insurance: The following coverages shall be provided as indicated, and an insurance certificate(s) provided to the Owner verifying conformance to these requirements. 1. Workers' Compensation: a. State: Statutory b. Applicable Federal (e.g. USHL&H): Statutory c. Employer s Liability: $1,000, Comprehensive or Commercial General Liability, Combined Single Limit: a. Premises/operations $ 1,000,000 Each Occurrence $ 2,000,000 Annual Aggregate b. Products/completed operations $ 1,000,000 Each Occurrence $ 2,000,000 Annual Aggregate c. Personal Injury $ 1,000,000 Each Occurrence $ 2,000,000 Annual Aggregate d. Policies shall include premises/operations, products, completed operations, independent contractors, owners and contractors protective, explosion, collapse, underground hazards, broad form contractual, personal injury with employment contractual exclusions deleted, and broad form property damage. e. If policies are written on a Commercial General Liability form, the General Aggregate shall be at least two times the each occurrence limit or be written on a per project basis. f. 18 would like to substitute any claims made liability policies, then these must be pre-approved in writing according to the terms and conditions they may impose. g. If policies are written for split limits, limits shall be equal for bodily injury and property damage liability. 3. Comprehensive Automobile Liability (including owned, hired, and non-owned vehicles), Combined Single Limit: a. Bodily Injury and Property Damage: $2,000,000 each accident b. If policies are written for split limits, limits shall be equal for bodily injury per person, bodily injury per accident and property damage. 4. Excess Liability Insurance: $4,000,000 over all underlying coverage lines 1.5 BEGINNING AND COMPLETION OF WORK A. It is anticipated that an Award of Purchase Order will be issued to the REBUILDER for the supply of specified services on or before May 25, B. REBUILDER shall prepare and furnish submittals for the services both with the Proposal, as described below, and also promptly following Award of Purchase Order as described further herein. The OWNER will return the marked shop drawings within 10 working days of their receipt. After the Award of the Purchase Order the REBUILDER shall schedule a presubmittal conference with the OWNER. Seven working days notice shall be provided prior to the anticipated date of the conference. The purpose of the meeting is to inform the REBUILDER of the information that the OWNER is expecting in the submittals and to familiarize the REBUILDER with the site, to minimize the possibility of submittal rejection. C. Upon completion of the submittal review process the OWNER S staff will disconnect and remove one unit from the Solids Processing Building and place it on the REBUILDER S vehicle for transport to the REBUILDER S facility. REBUILDER shall direct the loading of the unit and secure it for transport. Thereafter, the REBUILDER shall disassemble, renovate, reassemble using new parts as specified and ship the rebuilt unit to the OWNER S facility. The OWNER S staff will remove the unit from the transport vehicle and install it in the Solids Processing Building for initial operation by the REBUILDER S staff. The SUPPLIER shall then provide the OWNER installation certification and staff training for the equipment. 1.6 SUBMITTAL MATERIAL WITH PROPOSAL A. Proposals submitted without the information listed may be considered non-responsive and subject to rejection. B. 19 1. Make, model, weight and performance information of replacement components and motor assemblies as applicable with complete manufacturer s specifications, including material descriptions. 2. Warranty details. 3. List of exceptions to the Technical Specifications. C. The OWNER will award the purchase order for the rebuilding services to a qualified, experienced firm. Provide the following information with the proposal. 1. Experience record showing the proposer s experience in similar work with a minimum of (25) twenty-five rebuilt belt filter presses of which at least eight (8) must be 2-meter Winklepress units. 2. List and brief description for all of the rehabilitation work listed in Item 1 above with location, dates, contact names and addresses of owners. 3. Brief summary and description of equipment and facilities available to perform the work. 1.7 WARRANTY A. REBUILDER warrants and guarantees to OWNER that all services, rebuild components and materials will be in accordance with the Proposal Documents. The REBUILDER S standard warranty shall be modified as necessary to include all labor, materials and shipping necessary to correct or replace defective materials, workmanship or equipment for the listed periods of time. Labor to remove and replace items affected by covered defects shall be included. The warranty periods for each unit will commence on the date that the REBUILDER completes initial on-site operation and performance testing. SVWRF will issue a written acceptance when the specified services have been completed for each machine initiating the warranty periods. 1. Bearings shall be warranted for a period of five (5) years. 2. Steering valves shall be warranted for a period of five (5) years. 3. Rollers/drums shall be warranted for a period of five (5) years. 4. All other components (except wear parts) shall be warranted for a period of three (3) years. 20 SECTION REBUILDER SUBMITTALS PART 1 -- GENERAL 1.1 GENERAL A. Wherever submittals are required hereunder, all such submittals by the REBUILDER shall be submitted to the OWNER. 1.2 SUBMITTAL PROCEDURES A. OWNER reserves the right to modify the procedures and requirements for submittals, as necessary, to accomplish the specific purpose of each submittal. Direct inquiries to OWNER regarding the procedure, purpose, or extent of any submittal. B. Review, acceptance, or approval of substitutions, schedules, shop drawings, lists of materials, and procedures submitted or requested by SUPPLER shall not add to the Purchase Order amount, and additional costs which may result therefrom shall be solely the obligation of REBUILDER. C. OWNER is not precluded, by virtue of review, acceptance, or approval, from obtaining a credit for construction savings resulting from allowed concessions in the work or materials therefore. D. OWNER is not responsible to provide engineering or other services to protect REBUILDER from additional costs accruing from submittals. E. Submittals processed by OWNER do not become Proposal Documents and are not Change Orders; the purpose of submittal review is to establish a reporting procedure and is intended for REBUILDER s convenience in organizing the work and to permit OWNER to monitor REBUILDER s progress and understanding of the design. F. Delays caused by the need for resubmittal shall not constitute basis for claim. G. After checking and verifying all field measurements, make submittals to OWNER, in accordance with Section SHOP DRAWINGS. 1. Submittals shall bear a stamp or specific written indication that REBUILDER has satisfied its responsibilities under the Proposal Documents with respect to the review of the submittal. 2. Data shown shall be complete with respect to quantities, dimensions, specified performance and design criteria, materials, and similar data to enable OWNER to review the information. H. Check submittals, and accompany with specific written indication that REBUILDER has satisfied requirements under the Proposal Documents with respect to review of submittals, and identify clearly as to material, REBUILDER, pertinent data such as catalog numbers and the intended use. I. Before submission of each submittal, determine and verify quantities, dimensions, specified performance criteria, installation requirements, materials, catalog numbers, REBUILDER SUBMITTALS BELT FILTER PRESS REHABILITATION PROJECT PAGE

21 and similar data with respect thereto; review and coordinate each submittal with other submittal requirements of the work, and the Proposal Documents. J. At the time of each submission, give OWNER specific written notice of each variation that the submittal may have from the requirements of the Proposal Documents; in addition, make specific notation on each shop drawing submitted to OWNER for review and approval of each such variation. K. OWNER s review will be only for conformance with the design concept of the project and for compliance with the information given in the Proposal Documents, not extending to means, methods, techniques, sequences, or procedures of construction (except where a specific means, method, technique, sequence, or procedure of construction is indicated in or required by the Proposal Documents) nor to safety precautions or programs incident thereto. The review of a separate item as such will not indicate review of the assembly in which the item functions. L. OWNER s review of submittals shall not relieve REBUILDER from responsibility for any variation from the requirements of the Proposal Documents unless REBUILDER has in writing called the OWNER s attention to each such variation at the time of submission, and OWNER has given written approval of each such variation by a specific written notation thereof incorporated in or accompanying the shop drawing or sample approval; nor will any approval by OWNER relieve REBUILDER from responsibility for errors or omissions in the shop drawings or from responsibility for having complied with the provisions herein. M. Where a shop drawing or sample is required by the Specifications, related work performed prior to OWNER s review and approval of the pertinent submission shall be the sole expense and responsibility of REBUILDER. 1.3 SHOP DRAWINGS A. Wherever called for in the Proposal Documents, or where required by the OWNER, the REBUILDER shall furnish to the OWNER for review, 1 electronic copy of each shop drawing submittal. The term "Shop Drawings" as used herein shall be understood to include detail design calculations, shop drawings, fabrication, and installation drawings, erection drawings, list, graphs, catalog sheets, data sheets, and similar items. Whenever the REBUILDER is required to submit design calculations as part of a submittal, such calculations shall bear the signature and seal of an engineer registered in the appropriate branch and in the state wherein the project is to be built, unless otherwise directed. B. Except as may otherwise be indicated herein, the OWNER will return an electronic copy of each submittal to the REBUILDER with its comments noted thereon, within 10 working days following their receipt by the OWNER. It is considered reasonable that the REBUILDER shall make a complete and acceptable submittal to the OWNER by the second submission of a submittal item. The OWNER reserves the right to withhold monies due to the REBUILDER to cover additional costs of the OWNER's review beyond the second submittal. C. If a submittal is returned to the REBUILDER marked "NO EXCEPTIONS TAKEN," formal revision and resubmission of said submittal will not be required. 22 D. If a submittal is returned to the REBUILDER marked "MAKE CORRECTIONS NOTED," formal revision and resubmission of said submittal will not be required. E. If a submittal is returned to the REBUILDER marked "AMEND-RESUBMIT," the REBUILDER shall revise said submittal and shall resubmit the required number of copies of said revised submittal to the OWNER. F. If a submittal is returned to the REBUILDER marked "REJECTED-RESUBMIT," the REBUILDER shall revise said submittal and shall resubmit the required number of copies of said revised submittal to the OWNER. G. Fabrication of an item shall be commenced only after the OWNER has reviewed the pertinent submittals and returned copies to the REBUILDER marked either "NO EXCEPTIONS TAKEN" or MAKE CORRECTIONS NOTED." Corrections indicated on submittals shall be considered as changes necessary to meet the requirements of the Proposal Documents and shall not be taken as the basis for changes to the proposal requirements. H. All REBUILDER shop drawings submittals shall be carefully reviewed by an authorized representative of the REBUILDER, prior to submission to the OWNER. Each submittal shall be dated, signed, and certified by the REBUILDER, as being correct and in strict conformance with the Proposal Documents. In the case of shop drawings, each sheet shall be so dated, signed, and certified. No consideration for review by the OWNER of any REBUILDER submittals will be made for any items that have not been so certified by the REBUILDER. All non-certified submittals will be returned to the REBUILDER without action taken by the OWNER, and any delays caused thereby shall be the total responsibility of the REBUILDER. I. The OWNER's review of REBUILDER shop drawings submittals shall not relieve the REBUILDER of the entire responsibility for the correctness of details and dimensions. The REBUILDER shall assume all responsibility and risk for any misfits due to any errors in REBUILDER submittals. The REBUILDER shall be responsible for the dimensions and the design of adequate connections and details. 1.4 OWNER'S MANUAL A. The REBUILDER shall submit technical operation and maintenance information for each item of mechanical, electrical and instrumentation equipment in an organized manner in the OWNER'S MANUAL. It shall be written so that it can be used and understood by the OWNER'S operation and maintenance staff. B. The OWNER'S MANUAL shall be subdivided first by specification section number; second, by equipment item; and last, by "Part." "Parts" shall conform to the following (as applicable): 1. Part 1 - Equipment Summary: a. Summary: A summary table shall indicate the equipment name, equipment number, and process area in which the equipment is installed. b. Form: The OWNER will supply an Equipment Summary Form for each item of mechanical, electrical and instrumentation equipment in the WORK. 23 REBUILDER shall fill in the relevant information on the form and include it in Part Part 2 - Operational Procedures: a. Procedures: REBUILDER-recommended procedures on the following shall be included in Part 2: Installation Adjustment Startup Location of controls, special tools, equipment required, or related instrumentation needed for operation Operation procedures Load changes Calibration Shutdown Troubleshooting Disassembly Reassembly Realignment Testing to determine performance efficiency Tabulation of proper settings for all pressure relief valves, low and high pressure switches, and other protection devices List of all electrical relay settings including alarm and contact settings 3. Part 3 - Preventive Maintenance Procedures: a. Procedures: Preventive maintenance procedures shall include all REBUILDER-recommended procedures to be performed on a periodic basis, both by removing and replacing the equipment or component, and by leaving the equipment in place. b. Schedules: Recommended frequency of preventive maintenance procedures shall be included. Lubrication schedules, including lubricant SAE grade, type, and temperature ranges, shall be covered. 4. Part 4 - Parts List: a. Parts List: A complete parts list shall be furnished, including a generic description and REBUILDER's and original manufacturer s identification numbers for each part. Addresses and telephone numbers of the nearest REBUILDER and parts warehouse shall be included. b. Drawings: Cross-sectional or exploded view drawings shall accompany the parts list. 5. Part 5 - Wiring Diagrams: a. Diagrams: Part 5 shall include complete internal and connection wiring diagrams for electrical equipment items. 24 6. Part 6 - Shop Drawings: a. Drawings: This part shall include approved shop or fabrication drawings, complete with dimensions. 7. Part 7 - Safety: a. Procedures: This part describes the safety precautions to be taken when operating and maintaining the equipment or working near it. 8. Part 8 - Documentation: a. All equipment warranties, affidavits, and certifications required by the Technical Specifications shall be placed in this part. C. The REBUILDER shall furnish to the OWNER 5 identical OWNER'S MANUALS. Each set shall consist of one or more volumes, each of which shall be bound in a standard size, 3-ring, loose-leaf, vinyl plastic hard cover binder suitable for bookshelf storage. Binder ring size shall not exceed 2.5 inches. A table of contents indicating all equipment in the manuals shall be prepared. D. OWNER'S MANUALS shall be submitted in final form to the OWNER not later than the date of second rebuilt belt press shipment. The REBUILDER shall correct all discrepancies found by the OWNER in the technical manuals within 30 days from the date of written notification by the OWNER. E. Incomplete or unacceptable OWNER'S MANUALS when the second rebuilt belt press arrives on site shall constitute sufficient justification to withhold 5-percent of the total price of the equipment due to the REBUILDER until the OWNER S MANUAL is completed. 1.5 SPARE PARTS LIST A. The REBUILDER shall furnish to the OWNER 5 identical sets of spare parts information for all mechanical, electrical, and instrumentation equipment. The spare parts list shall include the current list price of each spare part. The spare parts list shall be limited to those spare parts which each REBUILDER recommends be maintained by the OWNER in inventory at the plant site. Each REBUILDER shall indicate the name, address, and telephone number of its nearest outlet of spare parts to facilitate the OWNER in ordering. The REBUILDER shall cross-reference all spare parts lists to the equipment numbers designated in the Proposal Documents and shall include the original manufacturer The spare parts lists shall be bound in standard size, 3-ring, loose-leaf, vinyl plastic hard cover binders suitable for bookshelf storage. Binder ring size shall not exceed 2.5 inches. 1.6 QUALITY CONTROL SUBMITTALS A. REBUILDER s Certification of Proper Installation: The REBUILDER shall provide certification stating the following: 1. 25 2. A REBUILDER s authorized representative has inspected the product or system. 3. The product or system has been serviced with the proper lubricants. 4. Applicable safety equipment has been properly installed. 5. Proper electrical and mechanical connections have been made. 6. Proper adjustments have been made and the product or system is ready for functional testing and operation.
