RECEIPT AND OPENING OF BIDS: Sealed bids will be accepted at the City of Attleboro Purchasing Department, 77 Park Street, Attleboro, Massachusetts until the time indicated on the advertisement for bids, for the commodities, equipment or services designated in the specification and will be publicly opened and read by the Purchasing Department. If at any time of the scheduled bid opening, City Hall is closed due to uncontrolled events such as fire, snow, ice, wind, or building evacuation the bid opening will be postponed until 2:00 PM on the next normal business day. Bids will be accepted until that time. A Pre-bid site visit is (HIGHLY RECOMMENDED) to be held at 10:00 a.m. on Wednesday, March 7, Site visit will be located at Capron Park Zoo, 201 County Street, Attleboro, MA Attendees shall park at the site and meet at Zoo entrance. FORM OF BID: Bids shall be submitted on bid form provided. No change shall be made in the phraseology of the bid or in the item or items mentioned therein. Bid must contain the name and proper address of the bidding firm and must be signed by a responsible member of the firm with his signature and official title. Bids which are not complete, or contain any omissions, erasures, alterations, additions, or contain irregularities of any kind, may be rejected as informal. Bidding and work of this Contract shall be in accordance with and governed by M.G.L. Chapter 149. Page 1 of 9

SUBMISSION OF BIDS: (a) Bid envelopes must be sealed and addressed to: Carol Brown, Purchasing Administrator, Government Center, 77 Park Street, Attleboro, MA The outside of the envelope should contain the name and address of the bidder, date and hour of the opening and Exterior Renovations Tropical Rainforest Building at Capron Park Zoo which is being bid upon. (b) (c) (d) (e) (f) The Purchasing Department will decide when the specified time has arrived to open bids, and no bid received thereafter will be considered. Bids received after the opening will be returned unopened. Any bidder may withdraw his bid by written request at any time prior to the advertised time of opening. Telephonic bids, amendments, or withdrawals will not be accepted. Unless otherwise specified, no bid may be withdrawn for a period of forty-five (45) days from the date and time of the bid opening Saturdays, Sundays and Legal Holidays excluded. Negligence on the part of the bidder in preparing the bid confers no rights for the withdrawal of the bid after it has been opened. Bids received prior to the time of the opening will be securely kept unopened. No responsibility will be attached for the premature opening of a bid not properly addressed. Submission of a Bid shall be conclusive evidence that the Bidder has examined the Invitation for Bids and is familiar with all the conditions of the proposed Contract. Upon finding any omissions or discrepancy in this Invitation for Bids, each Bidder shall notify the City immediately so that any necessary addenda may be issued. Failure of a Bidder to investigate completely the Invitation for Bids and/or to be thoroughly familiar with this Invitation for Bids shall in no way relieve any such Bidder from any obligation with respect to the Bid. Changes, modifications or withdrawal of Bids shall be submitted in writing to the Purchasing Administrator prior to the deadline and shall be contained in a sealed envelope clearly marked, as appropriate, Correction, Modification or Withdrawal of Sealed Bid for Exterior Renovations Tropical Rainforest at Capron Park Zoo. No corrections, modifications, or withdrawal of Bids shall be permitted after Bids have been opened. The Successful Bidder who enters into a Contract with the City shall be responsible for obtaining at his/her/its own expense, all appropriate federal, state and local permits, licenses and approvals. PRICES: Bidders shall state the proposed price in the manner designated in the bid proposal package. In the event that there is a discrepancy between the unit prices and the extended totals, the unit prices will govern. In the event, there is a discrepancy between the price written in words and written in figures, the prices written in words shall govern. 2

"OR EQUAL" BIDDING: When the name of the manufacturer, a brand name, or a manufacturer s catalog number is issued as the bid standard in describing and item followed by Or Equal, this description is used to indicate quality, performance and other essential characteristics of the article required. If bidding on other that the make, model, brand or sample specified, but equal thereto, bidder shall so state by giving the manufacturer s name, catalog number and any other information necessary to prove that his intended substitution of a commodity is equal in all the essential respects to the bid standard. Bidder shall prove to the satisfaction of the Purchasing Department, that his designated substitute is equal to the bid standard; otherwise, his bid shall be declared NO BID insofar as the item in question is concerned. 6. ADDITIONAL INFORMATION: Wage Rates/Certified Payrolls Wages are subject to minimum wage rates determined by the Massachusetts Department of Labor and Industries pursuant to M.G.L., Sec. 26 to 27H. The schedule of wage rates applicable to this contract is included in the bidding documents. The rate per hour to be paid to mechanics, apprentices, teamsters, chauffeurs, and laborers employed on the Work shall not be less than the rate of wages in the attached Minimum Wage Rates as determined by the Commissioner of Labor and Industries. The schedule of prevailing wage rates will be updated annually for all public construction projects lasting longer than one (1) year. The contractor shall pay the prevailing wage rate set out in the applicable prevailing wage rate schedule. Increases in prevailing wage rates shall not be the basis for a change order. It is the responsibility of the contractor, before the bid opening, to request if necessary, any additional information on Prevailing Wage Rates for those trades people who may be employed for the proposed work under this contract. The City shall require copies of certified payroll to be submitted prior to the request for the monthly Application for payment. All certified payrolls should be forwarded to the Purchasing Office. Occupational Safety and Health Administration (OSHA) The Bidder shall certify that it can furnish labor in harmony with all other elements of labor employed or to be employed at the Project and that all labor at the Project site will have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least ten (10) hours in duration at the time that said employees begin work a the site. All OSHA10 cards are to be submitted with the first certified payroll. The Bidder shall also certify that it possesses the skill, ability and integrity necessary for the faithful performance of the work and that it is able to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the work. 7. INSURANCE REQUIREMENTS The City will require the Contractor to provide a Certificate of Insurance (Acord Form 25) written to include the following limits: General Liability Commercial Liability: General Aggregate - $2,000,000 Products Completed Operations Aggregate - $1,000,000 Personal Injury and Advertising Limit - $1,000,000 Each Occurrence - $1,000,000 3

4 Automobile Liability-For all owned, non-owned, hired and leased vehicles: Bodily Injury: Each Person/Each Accident - 1,000,000 Property Damage: Each Occurrence - $1,000,000 Excess Liability: Each Occurrence/Aggregate Umbrella Form $1,000,000 Workers Compensation - STATUTORY The above insurance policies shall also be subject to the following requirements: a) Each policy shall contain a thirty- (30) day written notice of cancellation, change or non-renewal to the City. b) Carriers must have an A.M. Best rating of A-VII or better c) Insurance Policy must cover the entire contract period. d) The description of operations/location/special items on certificate of insurance shall name the City of Attleboro as an additional insured for the purpose of this bid and shall be filed with the City s Purchasing Assistant prior to commencement of the contract. e) All premium cost shall be borne by the Contractor. 8. BID DEPOSIT In accordance with MGL Chapter 149 every bid shall be accompanied by a bid deposit in the form of a bid bond, a certified check or a treasurer s check issued by a responsible bank or trust company, payable to the awarding authority. The amount of such bid deposit shall be five percent (5%) of the value of the bid. 9. PAYMENT & PERFORMANCE BONDS Within ten (10) days of notification of contract awards, the successful Contractor will be required to submit a Labor and Materials Payment Bond in the amount of fifty percent (50%) of the contract amount to be held in the City s Purchasing Department until all work has been accepted by the City. This bond shall be renewable on a yearly basis if this contract is extended due to a contract extension provision. 10. BID SUBMITTALS Any bid being submitted shall include a signed certificate of non-collusion, signed Certificate of Compliance with State Tax Laws/Conflict of Interest/c, 151B/Non-Debarment certificate, the completed bid pricing form, and acceptance of any addenda to be considered as responsive and responsible. 11. MASSACHUSETTS SALES TAX: The City is exempt from the payment of Massachusetts Sales Tax. Tax identification number E FEDERAL EXCISE TAX: The City is exempt from the payment of any excises of federal transportation taxes. The price bid must be exclusive of taxes and will be so construed. 13. AWARD AND CONTRACT: A written Acceptance of Bid, mailed or furnished to the successful bidder will be followed by a contract. The City will award the contract to the lowest responsible and eligible Bidder within sixty (60) days, Saturdays, Sundays, and legal holidays excluded, after the opening of bids. The City reserves the right to waive minor informalities in or to reject any or all Bids if it be in the public interest to do so. 4

5 The City reserves the right to reject any bidder who has failed to pay any local taxes, fees, assessments, betterments, or any other municipal charge, unless the bidder has a pending abatement application or has entered into a payment agreement with the City s collector or treasurer. As used herein, the term "lowest responsible and eligible Bidder" shall mean the Bidder (1) whose bid is the lowest of those bidders possessing the skill, ability and integrity necessary for the faithful performance of the work; (2) who has met all the requirements of the invitation for bids; (3) who shall certify that he is able to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the work; (4) who, where the provisions of section eight B of chapter twenty-nine apply, shall have been determined to be qualified thereunder. Subsequent to the award and within ten (10) days, Saturday, Sundays and legal holidays excluded, after the prescribed forms are presented for signature, the successful Bidder shall execute and deliver to the City a contract in the form included in the Contract Documents in such number of counterparts as the City may require. In the event that the City receives low bids in identical amount from two or more responsive and responsible Bidders, the City shall select the successful Bidder by a blind selection process chosen by the City such as flipping a coin or drawing names from a hat. The low Bidders who are under consideration will be invited to attend and observe the selection process. 14. DELIVERY: All prices bid must be on the basis of FOB Delivery, Attleboro, MA. 15. WORKERS COMPENSATION INSURANCE: Within ten days of the notification of contract award the successful Contractor will provide evidence of the following insurance and Workers Compensation (per Statue): General Liability $1,000,000/3,000,000 Automobile Liability $1,000,000/3,000,000 Any firm providing services to or doing business with the City of Attleboro, Massachusetts shall adhere to the City s Affirmative Action Plan for Equal Employment. Said plan is on file with the City s Affirmative Action Officer. The City reserves the right to reject any or all proposals, to waive any informality in the proposals received and to accept the proposal deemed to be most favorable to the best interest of the City. 16. CHANGE ORDERS A change order may be issued in writing by the City of Attleboro for changes in the Work within the scope of the Contract, including but not limited to, changes in: (1) the Plans and Specifications; (2) the method or manner of performance of the Work; (3) the City of Attleboro-furnished facilities, equipment, materials, services, or Site; or (4) the schedule for performance of the Work. The Contractor shall immediately perform any change order work that is ordered in writing by the City. The City is not obligated to pay for change orders that are not approved in writing, and signed by the Mayor prior to the work being performed. 5

6 SCOPE OF WORK Project Description: Exterior Renovations of the Tropical Rainforest Building at Capron Park Zoo Due to the fact that lead paint is present on the outside of the building it cannot be power washed the building must be framed and sheathed to encapsulate the lead paint. Refinish exterior building using a Dryvit Outsulation Plus MD EIFS system including: fill voids in existing CMU surface with Dryvit basecoat and coat with AquaFlash and AquaFlash Mesh. Hairline cracks to be bridged with Dryvit Grid Tape and Backstop NT, moving cracks to be filled with caulk and Dryvit s AquaFlash and AquaFlash Mesh transition membrane. Install 1 ½ galvanized metal furring over the CMU. Fasten 5/8 glass mat faced sheathing meeting ASTM C1177 to framing per manufacturer s requirements with fasteners spaced not more than 8 o-c. Apply Dryvit Outsulation Plus MD system to the sheathing which includes: Backstop NT air and water barrier, adhesive, EPS 2 insulation, basecoat, mesh and finish. Hold system minimum 8 above softscape. Install per current, published manufacturer s instructions. Water tight, roof line flashing added to go under existing flashing and over Outsulation system, overlapping minimum 2 ½, color to match existing flashing. Blocking added behind fixtures, conduits encapsulated and vapor barrier paint applied to interior wall. The framing cavity to be sealed with insect screening. Finish color and texture chosen by Capron Park Zoo staff. Apply sealant in accordance with the manufacturer s requirements, at all material transitions, joints, etc. as required to properly weatherproof the building enclosure. General 1. Work may take place 7 days a week between 7:30 am and 5:00 pm 2. Construction will begin by as soon as weather permits and must be completed by May 31, Restroom facilities exist on site and may be utilized by contractor. 4. Smoking is not permitted at any time on Zoo property. 5. Zoo will be open for regular business during construction, contractor must maintain professional demeanor. 6. Premises must be broom clean at the end of each workday. 7. Permits and fees are the responsibility of the contractor. 8. All equipment necessary to perform renovation are the sole responsibility of the contractor. Zoo will provide the contractor access to power and clean water. 6

Bid price is for the required supply and installation of equipment as required in the specifications. An Awarding Authority must request an updated wage schedule from the Department of Labor Standards ( DLS ) if it has not opened bids or selected a contractor within 90 days of the date of issuance of the wage schedule. For CM AT RISK projects (bid pursuant to G.L. c.149a), the earlier of: (a) the execution date of the GMP Amendment, or (b) the bid for the first construction scope of work must be within 90-days of the wage schedule issuance date. The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149, 27. The wage schedule shall be made a part of the contract awarded for the project. The wage schedule must be posted in a conspicuous place at the work site for the life of the project in accordance with M.G.L. c The wages listed on the wage schedule must be paid to employees performing construction work on the project whether they are employed by the prime contractor, a filed sub-bidder, or any sub-contractor. All apprentices working on the project are required to be registered with the Massachusetts Department of Labor Standards, Division of Apprentice Standards (DLS/DAS). Apprentice must keep his/her apprentice identification card on his/her person during all work hours on the project. An apprentice registered with DAS may be paid the lower apprentice wage rate at the applicable step as provided on the prevailing wage schedule. Any apprentice not registered with DLS/DAS regardless of whether or not they are registered with any other federal, state, local, or private agency must be paid the journeyworker's rate for the trade. The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule. Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the contract was executed by the awarding authority and the general contractor. For multi-year CM AT RISK projects, awarding authority must request an annual update no later than two weeks before the anniversary date, determined as the earlier of: (a) the execution date of the GMP Amendment, or (b) the execution date of the first amendment to permit procurement of construction services. Contractors are required to obtain the wage schedules from awarding authorities, and to pay no less than these rates to covered workers. The annual update requirement is not applicable to 27F rental of equipment contracts. Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll reports and a Statement of Compliance directly to the awarding authority by mail or and keep them on file for three years. Each weekly payroll report must contain: the employee s name, address, occupational classification, hours worked, and wages paid. Do not submit weekly payroll reports to DLS.
