3 BID ANNOUNCEMENT CONCRETE CURB CONSTRUCTION ON TWO DES PERES ROADS The City of Des Peres is soliciting bids from qualified contractors for installing new concrete curbs to form three islands on Des Peres Rd & Old Des Peres Rd. Bids will be accepted until 2:00 pm on Thursday, March 6, 2014 at which time they will be publicly opened and read aloud. No late bids will be considered. Bids should be submitted in duplicate in a sealed envelope clearly marked Concrete Curb Construction on Des Peres Roads. with the name of the bidder and with the date and time of the bid opening. 4 I. PROJECT DESCRIPTION A. INTENT It is the intention of the City to install 826 feet of new concrete curbs to form 3 new islands on two Des Peres Roads in the City of Des Peres. These new vertical curbs will form a center island in the existing pavements. B. SCOPE OF WORK Furnish all labor, equipment, materials, traffic control, etc. necessary to remove the existing pavement on two Des Peres roads and install 6 or 8 tall vertical curbs as shown on the plans 1. UNIT COSTS: While it is the City s intent to purchase all of the items provided in these specifications, the unit cost provided on the bid document shall be utilized in the event it becomes necessary to reduce or increase the quantity purchased. 2. PAYMENT: The City intends to make two (2) payments to the successful vendor on receipt of the invoices as outlined in the specifications 3. RESERVATION OF RIGHTS: The City reserves the right to reject any or all bids, to waive any technicalities in the bid process, to award any bid or portion of a bid which is deemed to be the most advantageous to the City of Des Peres and to make such investigations as are deemed necessary to determine the ability of the vendor to perform the services requested. II. GENERAL TERMS AND PROVISIONS 1. PRICES: All prices shall be F.O.B. destination at the various job sites. No other costs will be permitted the vendor beyond those stated in his bid. 2. WITHDRAWAL OF BIDS: Products and prices included in the bid may not be withdrawn for a period of thirty (30) days from the date of bid opening without consent of the City. 3. INSURANCE: A copy of the Contractor s Certificate of Insurance shall be attached. At least $2,000,000 worth of general aggregate insurance shall be provided and $1,000,000 worth of automobile liability insurance shall be provided. 4. BOND: A Performance Bond of one hundred percent (100%) shall be required of the successful bidder. A 10% bid bond shall be submitted with each bid. 5. WARRANTIES/GUARANTEE: All work shall be guaranteed for one year from the final payment date. 4

INTERPRETATION OF CONTRACT DOCUMENTS PRIOR TO BIDDING: Any person contemplating submission of a bid for items contained in this bid is in doubt regarding the true meaning of any part of the contract documents, he/she may submit to Denis Knock, , dknock@desperesmo.org., a request for an interpretation or correction thereof not later than 2:00 pm, Thursday, February 27, 2014 The person submitting the request will be responsible for its prompt delivery to the designer. Any interpretation or correction of the contract documents will be made by addendum and will be mailed or delivered to each bidder of record. 7. QUESTIONS REGARDING TECHNICAL SPECIFICATIONS: Any and all questions regarding the technical specifications shall be directed to Denis Knock, , dknock@desperesmo.org. Any material changes as a result of such questions shall be approved in writing and mailed or delivered to each bidder of record. 8. ERRORS AND OMISSIONS BY CITY: No vendor shall be permitted to use to his/her advantage any error or omission in this solicitation or specifications. If vendor shall have any questions or desires a clarification or interpretation regarding any of the items specified, the vendor shall request such clarification in writing and any such clarifications shall be made available to all vendors. 9. SUBMISSION OF BIDS: Bids must be submitted prior to 2 pm on March 6, 2014, at which time they will be publicly opened and read aloud. 6 SPECIFIC CONDITIONS & REQUIREMENTS A. TECHNIQUES 1. The existing pavements shall be sawed to at least 2/3 of their depths (estimated 8 ), and broken and removed from the 2 streets 2. New #5 8 long reinforcing rods shall be drilled and set into the existing concrete pavement 4 deep at 2 ft intervals. These rods shall be connected with a #4 top bar running continuously around the perimeter. 3. Six inch wide and 6 or 8 high vertical concrete curbs shall be formed and poured to create new islands (8 height to be used where asphalt overlay exists) 4. Concrete shall be six sack 4,000psi mix with Meramec sand & gravel. 5. Forms shall be stripped at appropriate times to allow proper final finishing. 6. Joints shall be set in curbs to match under lying pavement (not to exceed 20 ) 7. Barricades or cones shall be set at 10 intervals to protect new curb installation 8. Road Construction Ahead & One Lane Ahead Road signs shall be kept in place when any work is being performed. All traffic must be able to use at least one lane of each road at a time. Complete closures are not allowed. 9. After the forms are stripped, all concrete spoils and debris must be removed from site. 10. Contractor may store equipment & park workman s vehicles at adjoining Lodge contingent upon 24 hour advance notice being provided. 11. Backfill will be done by others 12. On Old Des Peres Rd in addition to removing the concrete base and asphalt, a 12 wide strip of asphalt shall also be removed to allow the new 8 high curbs to rest directly on the old concrete street. (No asphalt patching required) 13. Any damages to the remaining concrete caused by the above work shall be repaired by Contractor at no extra cost. B. TIME LIMITS The work shall be scheduled and completed during the months of May or June and shall take no more than 20 calendar days. Work must take place in a continuous fashion. Extensions for poor weather may be allowed. Work shall be done on the west side of the street first beginning at the south end. C. PAYMENTS The contractor will receive one payment only when all work is satisfactory completed and inspected. All payment will be based upon the unit prices bid as measured upon completion. Lien Waivers, Affidavit of Compliance with the Minimum Wage Rate and certified copy of the payroll shall be submitted with the final invoice. D. GUARANTEE All work shall be guaranteed for at least one year from the final payment date. Any large cracks or depressions or surface scaling which occur during that time period shall be removed and replaced by the contractor at his expense. E. DEFAULT Should the contractor fail to perform the above-mentioned work in the specified time period or perform the work not in accordance with these specifications or perform said work in a poor quality manner, the City reserves the right to cancel the contract upon ten (10) days written notice, to take new bids, and to use the Performance Bond to pay others to satisfactorily complete said work. 6

7 F. COOPERATION The Contractor agrees to cooperate and work with the employees of Des Peres to complete this project in a safe, satisfactory manner. The contractor shall provide a superintendent at the job site at all times when work is being done. This person s name and phone number shall be provided to the City prior to beginning work. G. INDEMNIFICATION The contractor is solely responsible for all portions of this construction project. As such, he shall be responsible for all supervision, construction and safety. He shall hold the City harmless against all claims resulting from his actions on this project. H. CHANGES No extra payments will be allowed for any alterations, modifications, or other work not specifically listed in the contract unless agreed upon in writing by both the contractor and the City prior to the commencement of said work. I. WAGES Minimum wages to all workers shall be at least those as determined by the Missouri Department of Industrial Relations. Contract must provide an affidavit prior to receiving final payment. J. ALTERNATE In lieu of constructing 6 & 8 tall pin on curbs, the contractor shall install 18 wide, 7 thick curb and gutter with 6 by 6 vertical curbing. This work shall be bid per foot, and shall include any extra rock fill required and all reinforcing. (See detail) 7

12 CONCRETE CURB CONSTRUCTION CONTRACT WHEREAS hereinafter called the Contractor, has submitted a bid dated for Constructing Concrete Curbs on two Des Peres Roads for the City of Des Peres and, WHEREAS, the City of Des Peres hereby accepts said bid per Resolution No. Dated NOW THEREFORE, the Contractor and the City of Des Peres for mutual considerations stated Herein agree as follows: ARTICLE 1. SCOPE OF WORK The Contractor agrees to furnish all the labor, tools, materials, equipment, and incidentals necessary to complete the concrete curb construction as indicated in the attached specifications. ARTICLE 2. TIME OF COMPLETION The Contractor agrees to complete all work within 20 calendar days. Unless extensions are granted by the City for poor weather, a penalty of $ per day shall be charged to the Contractor for each day beyond this period. ARTICLE 3. ACCEPTANCE AND PAYMENT Upon successful completion of said work, the City agrees to pay said Contractor the price as determined in the attached bid on a basis of actual units satisfactorily completed, less any penalties or damages incurred, or partial payments made. ARTICLE 4. GUARANTEE The Contractor hereby expressly guarantees the aforesaid work as to workmanship and quality of materials used in connection therewith for a term of one year, after the date of final payment, and agrees to make all replacements which are deemed necessary by the City of Des Peres. 12

14 The City of Des Peres in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 USC 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Federally-assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity submit bids in response to this invitation and will not be discriminated against on the grounds of gender, disability, race, color or national origin in consideration for an award. APPENDIX A: REQUIRED CONTRACT LANGUAGE During the performance of this contract, the contractor, for itself, its assignees and successors, in interest (hereinafter referred to as the contractor ) agrees as follows: 1. Compliance with Regulations: The contractor shall comply with Regulations relative to nondiscrimination in Federally-assisted programs of the Department of Transportation, Title 49, Code of Federal Regulations, Part 21, as they may be amended from time to time (hereinafter referred to as the Regulations), which are herein incorporated by reference and made part of this contract. Further, on any federal assisted contract, the Contractor and sub-contractor agree to comply with the Equal Employment Opportunity provisions cited in CFR 23, Subpart D-Construction Contract Equal Employment Opportunity Compliance Procedures, CFR 49 Non Discrimination in Federally-assisted Programs of the Department of Transportation Effectuation of Title VI of the Civil Rights Act of 1964, E.E and Title VII of the Civil Rights Act of Nondiscrimination: The contractor, with regard to the work performed by it during the contract, shall not discriminate on the grounds of race, color, sex, or national origin in the selection retention, and treatment of subcontractors, including procurements of materials in the discrimination prohibited by Section 21.5 of the Regulations, including employment practices when the contractor covers a program set for in Appendix B of the Regulations. 3. Solicitation for Subcontracts, Including Procurements of Materials and Equipment: In all solicitations either by competitive bidding or negotiation made by the contractor for work to be performed under a subcontract, including procurements of materials or leases of equipment, each potential subcontractor or supplier shall be notified by the contractor of the contractor s obligations under the contract and the Regulations relative to nondiscrimination on the grounds of race, color, or national origin. 4. Information and reports: The contractor shall provide all information and reports required by the Regulations, or directives issues pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the State Highway Department of the Federal Highway Administration to be pertinent to ascertain compliance with such Regulations or directives. Where any information required of a contractor is in the exclusive possession of another who fails or refuses to furnish this information, the contractor shall so certify to the State Highway Department or the Federal Highway Administration, as appropriate, and shall set forth what efforts it has made to obtain the information. 5. Sanctions for Noncompliance: In the event the contractor s noncompliance with the nondiscrimination provisions of this contract, the State Highway Department shall impose such contract sanctions as it or the Federal Highway Administration may determine to be appropriate, including, but not limited to: a. Withholding payments to the contractor under the contract until the contractor complies and/or b. Cancellation, termination or suspension of the contract, in whole or in part. 6. Incorporation of Provisions: The contractor shall include provisions of paragraphs (1) through (5) in every subcontract, including procurement of material and leases of equipment, unless exempt by the Regulations, or directives issued pursuant thereto. The contractor shall take such action with respect to any subcontract or procurement as the State Highway Department or the Federal Highway Administration may direct as a means of enforcing such provisions including sanctions for noncompliance: Provided, however, that, in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or supplier as a result of such direction, the contractor may request the State Highway Department to enter into such litigation to protect the interests of the State, and, in addition, the contractor may request the United States to enter into such litigation to protect the interests of the United States. 14
