12 Past Earthquakes Prompted FEMA to Take Action FEMA (Federal Emergency Management Agency) spent almost 100 billion dollars in aid for the repairs to damage caused by 1989 and 1994 earthquakes % for non-structural damage Four agencies joined to initiate the National Earthquake Hazards Reduction Program (NEHRP): Federal Emergency Management Agency (FEMA). Date Published: January 13, Response and Recovery Directorate: Policy: All construction of new buildings that is eligible under the Public Assistance Program must use appropriate seismic design and construction standards and practices. 14 IBC 2000 PUBLISHED UBC, SBC, BOCA combined to create the International Code Council - ICC In 2000 the ICC published the International Building Code IBC 2000 Seismic requirements are based on the NEHRP provisions. 16 LET S DEFINE SOME CODE TERMS AUTHORITY HAVING JURISDICTION (AHJ): ASCE, The organization, political subdivision, office enforcing the building code. 17 LET S DEFINE SOME CODE TERMS CERTIFICATE OF COMPLIANCE (IBC, 1702):A certificate stating that materials and products meet specified standards or that work was done in compliance with approved construction documents. 18 LET S DEFINE SOME CODE TERMS SPECIAL SEISMIC CERTIFICATION ( ASCE 13.2): Designated, Active mechanical and electrical equipment that must remain operable shall be certified by the supplier based on approved shake table testing or experience data. 20 HELPFUL ISO TERMS CERTIFIED/REGISTERED(LISTED): Written assurance (certificate) by an independent external body; audited management system; verified conformance to a standard; records certification in client register. ACCREDITED IB: formal recognition by a accreditation body (IAS) that a certification body is competent to carry out certification in specified business sectors. Accreditation is like certification of the certification body, providing increased credibility. 21 Who is Responsible? RDP Legally responsible to follow the code as a minimum set of requirements or if the AHJ or owner has more stringent requirements. Include seismic criteria on construction documents Schedule equipment Ip and Designated Seismic Systems Include statement of special inspection requirements Review and approve certificate of compliance Design anchors, pipe, duct and raceway bracing and interrelation with equipment Seismic Source International

22 Who is Responsible? Manufacturer Legally responsible to follow the code as a minimum set of requirements or if the AHJ or owner has more stringent requirements. Test or analyze per code and reference standards Submit Certificate of compliance Label, including qualification agency and (accredited)i.b. Contractor Install per construction documents and mfg. instructions Maintain a Q.A. plan with procedures for exercising control over installation and maintaining records Seismic Source International

23 Who is Responsible? Special Inspector Special inspectors shall keep records of inspections, furnish inspection reports to the building official, and registered design professional in responsible charge. Reports shall indicate that work inspected was done in conformance to Label and approved construction documents. Discrepancies shall be brought to the immediate attention of the contractor for correction. Seismic Source International

24 Who is Responsible? Authority Having Jurisdiction - Approves the RDP construction documents, Equipment C.O.C., and special inspection report. Limited time and info dissemination has allowed engineers and contractors to ignore the requirements to install seismic qualified equipment. Most AHJ do not have the capacity or capability to verify agencies. AHJ has no legal responsibility if anything goes wrong. Seismic Source International

38 Reaction California Legislature Allows lawsuits if Uniform Building Code requirements, including earthquake standards, are violated. No property damage or personal injury needed. But, must give builder/designer a chance to cure defects before filing suit.
