6 Article I General. Sec Title. This chapter shall be known as, referred to, or cited as, The Construction Code of the City of Superior, Douglas County, Wisconsin." Sec Content. This chapter provides certain minimum standards, provisions and requirements for safe and stable design, methods of construction, and uses of materials in dwellings, public buildings, places of employment and other buildings and structures within the city and the installation of electrical, plumbing, mechanical, heating, ventilating, air conditioning and other systems and equipment therein or associated with, hereafter erected, constructed, enlarged, altered, repaired, moved, converted to other uses, or demolished, and regulates the equipment, maintenance, use and occupancy of all such buildings and structures. The purpose of this chapter is to protect and foster the health, safety and well-being of persons occupying or using such buildings as well as the general public. Sec Interpretation. In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements and shall be liberally construed in favor of the city and shall not be deemed a limitation or repeal of any other power granted by state statutes. Sec Scope. (a) The provisions of this chapter shall apply to all buildings and structures within the city and the installation of electrical, plumbing, mechanical, heating, ventilating, air conditioning or other systems or equipment within or associated with these buildings or structures. (b) No work shall be performed on the building, structure, system or equipment specified in subsection (a) of this section except in full compliance with the provisions of this chapter and all other applicable local, state and federal regulations. Sec Abrogation and greater restrictions. This chapter is not intended to repeal, abrogate, annul, impair or interfere with any existing easements, covenants, deed restrictions, agreements, ordinances, rules, regulations or permits previously adopted or issued pursuant to laws. Wherever this chapter imposes greater restrictions, however, the provisions of this chapter shall govern. Sec Construction standards; codes adopted. The city adopts the following codes as minimum standards of construction for dwellings, public buildings, places of employment and other structures as specifically mentioned and also the installation of electrical, plumbing, mechanical, heating, ventilating, air conditioning and other systems and equipment associated with these structures or premises. The adoption of these codes recognizes the intent of the State of Wisconsin to provide for a uniformity of standards within the state. The adoption of these codes is required by the State of Wisconsin to provide for a transfer of jurisdiction allowing the city to administer and enforce these codes.

7 Certain other codes are administered and enforced directly by the State of Wisconsin, not the City of Superior. Examples of some of the other codes administered by the state are the Wisconsin State Boiler Code (SPS 341), the Wisconsin State Elevator Code (SPS 318), and the Wisconsin State Public Swimming Pool Code (SPS 390). The City of Superior and the State of Wisconsin recognize the need for different standards for different classification of structures. Therefore the following codes are adopted as they apply to separate types or classifications of structures or installations therein. (a) Uniform Dwelling Code Adopted. The administrative code provisions describing and defining regulations with respect to one (1) and two (2) family dwellings in Chapters SPS 320 through 325 of the Wisconsin Administrative code are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by an administrative code provision incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions or modification of the administrative code provisions incorporated herein are intended to be made part of this chapter to secure uniform statewide regulation of one (1) and two (2) family dwellings in this city. A copy of these administrative code provisions and any future amendments shall be kept on file in the office of the building inspector. (b) State Commercial Building Code Adopted. Chapters SPS , Wisconsin Administrative Code (Wisconsin State Commercial Building Code for multi-family dwellings, public buildings and places of employment) and Chapters SPS are hereby adopted and made a part of this chapter with respect to those classes of buildings to which this building code specifically applies. Any future amendments, revisions and modifications of said Chapters SPS and incorporated herein are intended to be made a part of this construction code. A copy of said Chapters SPS and and amendments thereto shall be kept on file in the office of the building inspector. (c) State Plumbing Code Adopted. The provisions and regulations of Chapters 101 and 145, Wisconsin Statutes, and Wisconsin Administrative Code Chapters SPS 325 & are hereby made a part of this chapter by reference and shall extend over and govern all plumbing installed, altered, repaired and presently existing in the city. Any further amendments, revisions and modifications of said Wisconsin Statutes and Wisconsin Administrative Code herein adopted are intended to be made part of this Chapter. A copy of these administrative code provisions and any future amendments shall be kept on file in the office of the building inspector. (d) State Electrical Code Adopted. Wisconsin Administrative Code Chapter SPS 316 is hereby adopted by reference and made a part of this Chapter and shall apply to the construction and inspection of: (1) New one (1) and two (2) family dwellings and additions or modifications to existing one (1) and two (2) family dwellings. (2) Subject to the exceptions set forth in Wisconsin Administrative Code Chapter SPS (2), SPS 316 shall apply to all buildings, structures and premises. (e) National Fuel Gas Code and Liquefied Petroleum Gas Code Adopted. The National Fuel Gas code NFPA 54 ANSI Z223.1 (2009 Edition), the Liquid Petroleum Gas Code NFPA 58 (2011 Edition), the documents listed in Chapter 2 of both codes, and any subsequent revisions to NFPA 54 and NFPA 58 and other listed documents are adopted and by reference made a part of this chapter as if fully set forth herein.

8 (1) Application: The National Fuel Gas Code and the Liquefied Petroleum Gas Code are safety codes that shall apply to the installation of fuel gas piping systems to appliances, equipment and related accessories as listed within each code. (2) Gas Piping, appliances, equipment and related accessories: New fuel gas piping systems to appliances, equipment and related accessories shall conform to the minimum standards of the National Fuel Gas Code and/or the Liquefied Petroleum Gas Code as applicable, the minimum installation requirements of the manufacturer, other provisions of Superior Code of Ordinances and any other minimum codes and standards as may apply in each separate installation as applicable. New installations, alterations, additions, extensions, repairs or any other work involving fuel gas piping systems within the City of Superior shall conform to the most restrictive application of the above codes and standards. Any further amendments, revisions and modifications of said Wisconsin Statutes and Wisconsin Administrative Code herein adopted are intended to be made part of this Chapter. Sec Existing structures. The Wisconsin Uniform Dwelling Code shall also apply to buildings and conditions where: (1) An existing building to be occupied as a one (1) or two (2) family dwelling, which building was not previously so occupied. (2) An existing dwelling that is altered or repaired, when the cost of such alteration or repair during the life of the structure exceeds fifty percent (50%) of the equalized value of the structure, said value to be determined by the City Assessor. (3) Alterations, regardless of cost, made to an existing dwelling when deemed necessary in the opinion of the building inspector shall comply with the requirements of this chapter for new buildings. (4) Roof Coverings Whenever more than forty-five percent (45%) of the roof covering of a dwelling is replaced in any twelve (12) month period, all new roof covering shall be in conformity with applicable sections of this Chapter. (5) Any addition to any dwelling, regardless of cost, shall be made in conformity with applicable sections of this Chapter. Wisconsin Administrative Code standards shall be reasonably applied by the building inspector to the alterations and remodeling of existing one-family and two-family dwellings constructed before 1951, it being the intention to apply the safety and energy conservation standards of the above Administrative Code chapters to the alterations and remodeling of existing dwellings built before 1951 in those instances where such standards can be applied without unreasonable expense to the applicant. Sec Relationship to other regulations. This chapter shall not affect violations of any other ordinance, code or regulation committed prior to the effective date hereof, and any such violation shall be governed and shall continue to be punishable to the full extent of the law under the provisions of those ordinances, codes or regulations in effect at the time the violation was committed. The provisions of this chapter shall not be construed to prevent the enforcement of other ordinances or regulations of the city or of

9 the state which prescribe standards other than those provided herein. In case of conflicts among such regulations, the most restrictive standard shall apply. Sec Responsibility. This chapter shall be binding alike upon every owner of a building or structure and every person who is in charge of or is responsible for or who causes the design, construction, alteration or repair of any building or structure or related electrical, plumbing, heating, ventilating or air conditioning equipment in the city. Sec Workmanship. All work performed under the scope of this chapter involving the fabrication, preparation and installation of materials shall be conducted, executed and completed in a workmanlike manner so as to secure the results intended by the regulations prescribed herein. Sec Definitions. Definitions Within the Codes. The definitions listed in each specific code section or chapter of the Uniform Dwelling Code, The Wisconsin Commercial Building Code or other state codes, rules or regulations shall apply to each section where they are found. In case of conflicts among such definitions, the most restrictive shall apply. Other specific definitions are included below: (a) "Construction business" means a trade that installs, alters or repairs any building element, component, material or device that is regulated under the commercial building code, (chs. SPS and ), the uniform dwelling code, (chs. SPS 320 to 325), the electrical code, (ch. SPS 316), the plumbing code, (chs. SPS 381 to 387), or the public swimming pools and water attractions code, (ch. SPS 390). The term does not include the delivery of building supplies or materials, or the manufacture of a building product not on the building site. (b) Electrical Construction or Electrical Work means the installation of all equipment, wiring, material, fittings, devices, appliances, fixtures and apparatus used for the production, modification, regulation, control, distribution, utilization or safeguarding of electrical energy for mechanical, chemical, cosmetic, heating, lighting or similar purposes as covered by the scope of the Wisconsin State Electrical Code SPS 316 as adopted by the City of Superior. (c) HVAC means Heating, Ventilating, and Air Conditioning. HVAC work means the installation, conversion, alteration, extension or replacement of heating, ventilating and air conditioning systems and equipment including the controls for such equipment and the distribution system or ductwork. (d) Plumbing means and includes: (1) All piping, fixtures, appliances, equipment, devices and appurtenances in connection with the water supply, water distribution and drainage systems, including hot water storage tanks, water softeners and water heaters connected with such water and drainage systems and also includes the installation thereof. (2) The construction, connection or installation of any drain or waste piping system from the outside or proposed outside foundation walls of any building to the mains

10 or other sewage system terminal within bounds of, or beneath an area subject to easement for highway purposes, including private sewage systems, and the alteration of any such systems, drains or waste piping. (3) The water service piping from the outside or proposed outside foundation walls of any building to the main or other water utility service terminal within bounds of, or beneath an area subject to easement for highway purposes and its connections. (4) The water pressure system other than municipal systems as provided in Wisconsin State Statutes Chapter 281. (5) A plumbing and drainage system so designed and vent piping so installed as to keep the air within the system in free circulation and movement; to prevent with a margin of safety unequal air pressures of such force as might blow, siphon or affect trap seals, or retard the discharge from plumbing fixtures, or permit sewer air to escape into the building; to prohibit cross connection, contamination or pollution of the potable water supply and distribution systems; and to provide an adequate supply of water to properly serve, cleanse and operate all fixtures, equipment, appurtenances and appliances served by the plumbing system. Sec New methods and materials. (a) All materials, methods of construction and devices designed for use in buildings or structures covered by this chapter and not specifically mentioned in or permitted by this chapter shall not be so used until approved in writing by the State Department of Safety and Professional Services for use in buildings or structures covered by the Wisconsin State Building Code or the Uniform Dwelling Code, except sanitary appliances, which shall be approved in accordance with the state plumbing code chapter SPS 384 (b) Such materials, methods of construction and devices, when approved, must be installed or used in strict compliance with the manufacturer s specifications and any rules or conditions of use established by the State Department of Safety and Professional Services. The data, test and other evidence necessary to prove the merits of such material, method of construction or device shall be determined by the State Department of Safety and Professional Services. Sec Permits required. No person shall excavate for, erect or construct any building or structure whatever or add to, enlarge, move, improve, alter, extend, convert, repair, remove or demolish any building or structure or cause the same to be done or commence any electrical, plumbing, mechanical, heating, ventilation and air conditioning (HVAC) or other work covered by the scope of this chapter on any building or structure without first obtaining a permit therefore from the city building inspector. The types of construction or installations that are under special consideration or special regulation and not covered by the full scope of this code shall be determined by resolution of the common council and on file at the office of the City Clerk and Building Inspector. The chief building inspector shall provide a written list or description of construction projects commonly considered repair or maintenance not requiring a construction permit.

11 Sec Violations reported or observed. It shall be the duty of all city council members, police officers and fire inspectors to report at once to the building inspector any building work which is being carried on without a valid permit posted on site. Sec Required utilities Sec (1) Residential Buildings. No building permit shall be issued for the construction of any residential building until sewer, water, grading and graveling are installed in the streets necessary to service the property for which the permit is required. Lots without municipal sewer available shall require a sanitary permit and zoning approval before a building permit is issued. Other utilities and improvements may be required by the city as specified in a sub-divider s agreement. In exceptional circumstances, the city council may authorize the issuance of a building permit prior to the completion of the improvements mentioned above. However, the occupancy permit shall not be issued until improvements are constructed, installed or connected, functioning and inspected. (2) Non-Residential Building. No building permit shall be issued for the construction of any non-residential building until contracts have been let for the installation of sewer, water, grading and graveling in the streets necessary to service the property for which the permit is requested. (3) Occupancy. No person shall occupy any new building without a certificate of occupancy. A certificate of occupancy shall not be issued until necessary utilities are connected, functioning and inspected to service the building. Sanitary construction site toilet facilities required. All contractors or other persons employing persons on construction sites shall provide adequate, sanitary toilet facilities for the employees. Sec Fee schedule. The fees referred to in Chapter 34 shall be established by resolution of the common council and shall be listed in a fee schedule available at the office of the City Clerk and Building Inspector. These fees may from time to time be modified by common council resolution. Fees shall be related to costs involved in handling permit applications, reviewing plans, conducting site inspections and administering the building inspection program. (a) Base Fees. At the time the application for a permit is filed, the applicant shall pay such fees as required pursuant to the fee schedule adopted by resolution of the city council and on file with the building inspector and the city clerk. (b) Failure to Obtain Permit. Failure to obtain a permit prior to commencement of work shall result in an additional fee pursuant to the fee schedule adopted by resolution of the city council and on file with the building inspector and city clerk. Sec Unsafe structures. The provisions of Chapter 104 Sections to will be invoked in regard to unsafe structures, systems and equipment.

12 Sec Sufficient notice for enforcement of building codes. For the purpose of facilitating enforcement of municipal and state building, plumbing, electrical, HVAC and other such codes, ordinances or statutes established for the protection of the health and safety of the occupants of buildings referred to elsewhere in this Code of Ordinances as construction codes, building codes or property maintenance and housing codes, the City of Superior does declare by this ordinance the following: (1) The owner of real estate subject to any of the above mentioned codes is required to record with the register of deeds a current listing of the owner s address and the name and address of any person empowered to receive service of process for the owner. Any changes of names or address in the recording shall be reported within 10 days of the change. This subsection does not apply to owner-occupied one and 2 family dwellings. (2) It shall be considered sufficient notice to an owner that a building inspector or code enforcement officer has found a violation of any applicable code, if the building inspector or code enforcement officer, after making an unsuccessful attempt of personal service during daytime hours at the latest address recorded with the register of deeds as that of the owner or agent of the owner, sends the notice by certified mail to the address noted and in addition posts a copy of the notice in a conspicuous place in or about the building where the violation exists. If the owner has not recorded under sub. (1) with the register of deeds a current address or name and address of a person empowered to receive service of process, then posting of a notice of violation on the premises and certified mailing of the notice to the last known address of the owner as well as to the address of the premises in violation is sufficient notice to the owner that a violation has been found. (3) When notice of a violation of a code section which is found by a building inspector or code enforcement officer is made according to sub. (2), such notice shall be effective notice to anyone having an interest in the premises, whether recorded or not, at the time of the giving of such notice; and shall be effective against any subsequent owner of the premises as long as the violation remains uncorrected and there exists a copy of the notice of violation in a public file maintained by building inspector or code enforcement officer. (4) An owner is required to give notice to any prospective purchaser that a notice has been issued concerning a building violation, where the condition giving rise to the notice of violation has not been corrected. Failure to provide such notice shall subject the owner to a fine not exceeding $500 for failure to so notify. The purchaser who has not received the required notice is granted the right to make any repairs necessary to bring the property up to the requirements of the local building code and to recover the reasonable cost of those repairs from the seller as stated in Wisconsin State Statute Sec to Sec Reserved.

13 Article II Administration. Sec Chief Building Inspector, Appointment and Qualifications. (a) [Generally.] The position of Chief Building Inspector is hereby created as provided in State Statute (9). The Chief Building Inspector shall be appointed by the Human Resources Director and confirmed by the Common Council. The tenure of office shall be indefinite except as provided in sections and of the Superior Code Ordinances. The Chief Building Inspector shall assume administrative responsibility as an agent of the Wisconsin Department of Safety and Professional Services for the City of Superior to administer and enforce the Wisconsin Commercial Building Codes as provided in State Statutes (5)(b) and (3)(b) and (br) and Wisconsin Administrative Code SPS and SPS The Chief Building Inspector shall also assume administrative responsibility over the administration and enforcement of the Uniform Dwelling Code as provided in Wisconsin State Statute (1) and Wisconsin Administrative Code SPS The Chief Building Inspector shall assume administrative responsibility of the administration and enforcement of the City of Superior Municipal Ordinances Chapter 34 and Chapter 104. The Chief Building Inspector shall be certified as a Commercial Building Inspector and a UDC Construction Inspector as provided in Wisconsin Administrative Code SPS and (b) Appointment in absence. During temporary absence or disability of the Chief Building Inspector, the Human Resources Director shall designate a substitute to act in matters that require prompt official attention. (c) Qualifications. To be eligible for appointment, the Chief Building Inspector shall have had at least five years experience as a Profession Engineer, Architect or Superintendent of Building Construction. He shall be generally informed on the quality and strength of building materials, on the prevailing methods of building construction, on good practice in fire prevention, on the accepted requirements for safe exit facilities, and on the proper installation of plumbing, electric, wiring, HVAC and other installations for the safety, comfort and convenience of occupants. He shall be in good health, physically capable of making the necessary examinations and inspections of buildings in the course of construction. He shall not have any interest whatever, directly or indirectly, in the sale or manufacture of any material, process or device entering into or used in or in connection with building construction. (d) Duties. The Chief Building Inspector shall devote his whole time to the duties of his office. He shall receive applications required by this chapter, issue permits and furnish the prescribed certificates. He shall examine premises for which a permit has been issued and shall make all necessary inspections to see that the provisions of the law are complied with and that construction is carried on safely. He shall enforce all laws relating to construction, alteration, repair, removal, demolition, use and occupancy, location and maintenance of buildings, structures and the installation of electrical, mechanical, plumbing and HVAC systems and equipment installed or associated with these structures or premises, except as may be otherwise provided for. He shall, when requested by the mayor or City Council, or when the interests of the municipality so require, make investigations in connection with matters referred to in this chapter and chapter 104 and render written reports on same. For the purpose of enforcing compliance with law, to remove illegal or unsafe conditions, to secure the necessary safeguards during construction, or to require adequate exit facilities in existing buildings and structures, he shall issue such notices, orders and citations as may be necessary. All defects revealed upon inspection shall be reduced to writing and a copy thereof shall be given to the permit holder and owner.

14 Sec Other Inspectors. (a) General The following inspector positions listed in (b) through (h) are not intended to indicate separate individuals. Rather it is intended to describe the range of inspector responsibilities and certifications that are necessary to complete the building inspection department. Inspectors may hold any combination of inspector certifications to fit the needs of the inspection department. In no case shall an inspector do plan review or inspections without Wisconsin Department of Safety and Professional Services certification for the plans to be reviewed or the work to be inspected. (b) Commercial Building Inspector. 1. The position of Commercial Building Inspector is authorized and established. The Commercial Building Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code of Ordinances. 2. The Commercial Building Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of structures, components of structures, and HVAC equipment. He shall be well versed in approved materials and methods of construction for safety to life and property and the laws and ordinances pertaining thereto. 3. The Commercial Building Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in construction supplies or materials, HVAC supplies or equipment, or carrying on the trade or work of a construction contractor or HVAC contractor within the City of Superior. 4. In all respects the City of Superior Commercial Building Inspector shall comply with the provisions of the Wisconsin Administrative Code Chapters SPS (c) UDC Construction Inspector. 1. The position of UDC Construction Inspector is authorized and established. The UDC Construction Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code of Ordinances. 2. The UDC Construction Inspector shall be a person who is skilled in the construction, planning, designing, superintending and inspection of one- or twofamily dwellings and their components. He shall be well versed in approved materials and methods of construction of one- and two-family dwellings for safety to life and property and the laws and ordinances pertaining there. 3. The UDC Construction Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in construction supplies, or carrying on the trade or work of a construction contractor within the City of Superior. 4. In all respects the City of Superior UDC Construction Inspector shall comply with the provisions of the Wisconsin Administrative Code Chapters SPS (1)(a) and (b) 1. (d) Commercial Electrical Inspector. 1. The position of Commercial Electrical Inspector is authorized and established. The Commercial Electrical Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code or Ordinances.

15 2. The Electrical Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of electrical wiring and equipment. He shall be well versed in approved methods of electrical construction for safety to life and property and the laws and ordinances pertaining thereto. 3. The Electrical Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in electrical supplies, fixtures or material, or carrying on the trade or work of an electrician within the City of Superior. 4. In all respects the City of Superior Electrical Inspector shall comply with the provisions of the Wisconsin Administrative Code Chapters SPS and (1)(a) and (b) 2; SPS 316 and SPS 324 (e) UDC Electrical Inspector. 1. The position of UDC Electrical Inspector is authorized and established. The UDC Electrical Inspector shall be appointed by the Human Resources Director in accordance with Chapter 42 or the Superior Municipal Code of Ordinances. 2. The UDC Electrical Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of electrical wiring and equipment within one- and two-family dwellings. He shall be well versed in approved methods of electrical construction for safety to life and property and the laws and ordinances pertaining thereto. 3. The UDC Electrical Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in electrical supplies, fixtures or materials, or carrying on the trade or work of an electrician within the City of Superior. 4. The Commercial Plumbing Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code of Ordinances. 2. The Commercial Plumbing Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of plumbing installations, fixtures and equipment. He shall be well versed in approved methods of plumbing installations, fixtures and equipment. The Commercial Plumbing Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in plumbing supplies, fixtures or materials, or carrying on the trade or work of a plumber within the City of Superior. 4. In all respects the City of Superior Commercial Plumbing Inspector shall comply with the provisions of Wisconsin State Statute 145 and the Wisconsin Administrative Code Chapters SPS and (b)4 and SPS (g) UDC Plumbing Inspector 1. The position of UDC Plumbing Inspector is authorized and established. The UDC Plumbing Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code of Ordinances.

The UDC Plumbing Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of plumbing installations, fixtures and equipment within one- and two-family dwellings. He shall be well versed in approved methods of plumbing installations for safety to life and property and the laws and ordinances pertaining thereto. 3. The UDC Plumbing Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in plumbing supplies, fixtures or material or carrying on the trade or work of a plumber within the City of Superior. 4. In all respects the City of Superior UDC Plumbing Inspector shall comply with the provisions of Wisconsin State Statute 145 and the Wisconsin Administrative Code Chapters SPS (1)(a) and (b) 4 and SPS (h) UDC Heating, Ventilating and Air Conditioning Inspector. 1. The position of UDC HVAC Inspector is authorized and established. The UDC HVAC Inspector shall be appointed by the Human Resources Director in accordance with chapter 42 of the Superior Municipal Code of Ordinances. 2. The UDC HVAC Inspector shall be a person who is skilled in the installation, planning, designing, superintending and inspection of HVAC systems and equipment for one- or two-family dwellings. He shall be well versed in approved materials and methods of heating, ventilating and air conditioning one-and twofamily dwellings for safety to life and property and the laws and ordinances pertaining thereto. 3. The UDC HVAC Inspector shall not be interested as a partner or otherwise with any person or persons, or in any business dealing in HVAC equipment or supplies, or carrying on the trade or work of a HVAC contractor within the City of Superior. 4. In all respects the City of Superior UDC HVAC Inspector shall comply with the provisions of the Wisconsin Administrative Code Chapters SPS (1)(a) and (b) 3. Sec Other Code Enforcements Officers. Code enforcement officers shall be under the direct supervision of the Chief Building Inspector. Code enforcement officers shall have authority subject to supervision of the Chief Building Inspector to enforce the following chapters or chapter sections of the City of Superior Code of Ordinances in accord with the applicable provisions with in each chapter and Chapter 1. The Chief Building Inspector shall be the executive official in charge of and responsible for all activities of the City Building Inspection Department. All department inspectors, officers, technical assistants and employees shall report to the Chief Building Inspector who shall in turn report directly to the City Public Works Director as stated in Sec Sec City Building Inspector Defined. When used in this chapter, the term Building Inspector shall be liberally defined as the Chief Building Inspector and/or a Commercial or UDC Building Inspector, a Commercial or UDC Electrical Inspector, a Commercial or UDC Plumbing Inspector or an UDC HVAC Inspector and any duly appointed deputy or assistant officially authorized by the city to carry out the administrative and enforcement functions prescribed herein. A code enforcement officer may be liberally defined as a building inspector as the duly appointed deputy or assistant officially authorized by the chief building inspector and the city to carry out the administrative and enforcement functions prescribed within the Superior Code of Ordinance sections listed in Section Sec Qualifications A City Inspector described in this article shall possess the minimum qualifications specified in the job description created for the position and approved by the Public Works Director. City Inspectors shall be capable of supervising the construction of buildings and/or the mechanical systems within the buildings. City Inspectors shall hold the appropriate required Wisconsin Department of Safety and Professional Services inspector certifications, as mandated by state law, for commercial building or one- or two-family dwelling, and/or the inspection of electrical, plumbing, heating, ventilation, and air conditioning systems within these structures, as they are installed. City inspectors shall be capable of effectively enforcing the provisions of this chapter. Inspector certifications shall be kept valid through participating in accredited continuing education activities and timely renewal of certifications.

18 Sec Conflict of Interest Provisions No inspector, officer or employee shall be engaged in or directly or indirectly connected with the furnishing of labor, materials or appliances for the design, construction, alteration, or maintenance of any building or building system within the City of Superior, unless that person is the owner of such building, nor shall such inspector, officer or employee engage in any work which conflicts with his official duties or with the interests of the City of Superior. Sec Personal Liability Relief. No inspector, officer of employee charged with the administration and enforcement of this chapter or chapter 104, while acting on behalf of the City, shall thereby be rendered liable personally, and such inspector, officer or employee is hereby relieved of all personal liability for any damage occurring to persons or property as a result of any act required or permitted in the discharge of his or her official duties. Any suit initiated against any City inspector, officer or employee, because of an act performed by that person in the lawful discharge of his or her duties under the provisions of this chapter, shall be defended by the legal representative of the City until final termination of such proceedings. No inspector, officer or employee shall be liable for any costs in any action, suit or proceeding instituted in pursuance of the provisions of this chapter, and such employee, acting in good faith and without malice, shall be free of liability for acts performed under any of its provisions or by reason of any act or omission in the performance of his or her official duties in connection therewith. Sec to Sec Reserved

19 Article III Qualifications, certifications and license. Sec General (A) The licensing requirements of Wisconsin State Administrative Code Chapter SPS 305 is hereby recognized and the requirements or restrictions placed on individuals, partnerships, companies or others seeking to obtain a construction permit shall be followed. (B) Contractor business practices shall be regulated within the City of Superior and Wisconsin Administrative Code Chapter ATCP 110 and later revisions are adopted as minimum standards governing business relationships between home owners and contractors. Sec State licensed plumbers and plumbing contractors. State Statute License or registration required; exemptions. (1) (a) No person may engage in or work at plumbing in the state unless licensed to do so by the department. A master plumber may work as a journeyman. No person may act as a plumbing apprentice or pipe layer unless registered with the department. (b) No public utility shall engage in or perform plumbing unless exempted by sub. (4). (2) No person shall install plumbing unless at all times a licensed master plumber is in charge, who shall be responsible for proper installation. Licenses shall be issued only to individuals and no license shall be issued to or in the name of any firm or corporation. No such license shall be transferable. It is unlawful for any licensed master plumber to allow the use of his or her license, directly or indirectly, for the purpose of obtaining local permits for others or to allow the use of his or her license by others to install plumbing work. (3) Each member or employee of a partnership or limited liability company or each officer or employee of a corporation engaging in the business of superintending plumbing installations shall be required to apply for and obtain a master plumber s license before engaging in the work of superintending plumbing installations. (3m) No person may test the performance of cross connection control devices when the test is required by the department unless he or she is registered with the department as a cross connection control tester. (4) This section shall not apply to: (a) Plumbing work done by a property owner in a one family building owned and occupied by him or her as his or her home or farm building, except where such license is required by local ordinance. (b) Plumbing from the private water supply pump to and including the initial pressure tank and connection to an existing water distribution system, when installed by persons licensed under state statute chapter 280. (c) Installation of sewer and water service piping from the main to the property lot line, when installed by authorized municipal utility employees or sewer and water utility installers under a contract with a municipality.

20 (d) Making minor repairs to faucets, valves, pipes or appliances, repair or replacement of electrical or gas energy or other automatic valves or control devices or removing of stoppages in waste or drainage pipes. (e) Installation of sewer and water mains, when installed by sewer and water utility contractors and their employees. (f) Installation, repair or replacement of water service piping, from the property line to the meter, including meter installation, to service any building or structure or proposed building or structure when such installation, repair or replacement is accomplished by employees of a public municipal water utility, providing such utility regularly has engaged in such installation, repair or replacement for at least 5 years prior to January 1, State Statute Advertising restrictions. (1) No person offering plumbing services may do any of the following, unless the person is a licensed master plumber or employs a licensed master plumber: (a) Advertise as a plumbing contractor, master plumber or plumber. (b) Append his or her name to, or in connection with, the title plumbing contractor, master plumber or plumber. (c) Append his or her name to any other title or words that may tend to represent the person as a plumbing contractor, master plumber or plumber. (2) No person other than a licensed master plumber shall use or display the title Master Plumber or append his or her name to or in connection with such title or any other title or words which represent or may tend to represent him or her as a licensed master plumber. Every holder of a master plumber s license shall promptly notify the department of any change of his or her business address. (3) Any person who advertises as a master plumber through the use of printed material designed for public distribution shall include in the advertisement the number of his or her license as a master plumber. Any person who advertises as a plumbing contractor through the use of printed material designed for public distribution shall include in the advertisement the license number of the master plumber employed by the plumbing contractor. (4) Subsection (1) does not apply to any person who advertises as providing services for which no license is required under s , unless the person holds himself or herself out as providing services for which a license is required. SPS Plumbing. (1) (a) Except as provided under s (4), Stats., and pursuant to s , Stats., no person may install plumbing unless the person holds a license or registration issued by the department as a licensed master plumber, licensed master plumber restricted, licensed journeyman plumber, licensed journeyman plumber restricted, registered plumbing apprentice, registered plumbing learner restricted, registered utility contractor or registered pipelayer.
