1 The Woodlands Township Shadowbend Park Playground Equipment Spring 2014 The Woodlands, TX SCOPE: To select a vendor for the supply and installation of play equipment at Shadowbend Park, located at 4995 Lake Woodlands Dr. The Woodlands, TX The Woodlands Township reserves the right to reject any or all Bids, including without limitation the rights to reject any or all nonconforming, non-responsive, unbalanced or conditional Bids and to reject the Bid of any Bidder if The Township believes that it would not be in the best interest of the Project to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by The Township. The Township also reserves the right to waive all informalities and defects in the bids and the bidding process not involving price, time of submittal or changes in the Work and to negotiate contract terms with the Successful Bidder. Discrepancies between the multiplication of units of Work and unit prices will be resolved in favor of the unit prices. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum. Discrepancies between words and figures will be resolved in favor of the words. In case of ambiguity or lack of clarity in stating the prices in the bid, The Township reserves the right to consider the most advantageous bid thereof or to reject the bid. By bidding, the bidder acknowledges and will adhere to all specifications as stated within this Request for Proposal packet. Prices shall be firm for 90 days from opening. Bidders should carefully examine the bid documents, specifications and other documents, visit the site of the work and fully inform themselves as to all conditions and matters which can in any way affect the work or the cost thereof. Should a bidder find discrepancies in or omissions from specifications, or other documents, or be in doubt as to their meaning, he should notify The Township at once and obtain clarification prior to submitting a bid. All blank spaces must be filled in with ink or typewritten, and the Proposal form must be fully completed and executed when submitted. All Bids must be made on the required BID TABULATION FORM. Bidder shall complete every space in the bidder s initials column with either a check mark to indicate the item being bid is exactly as specified or a description to indicate any deviation of item being bid from the specifications. Payment will be made by The Woodlands Township within thirty (30) calendar days after completion of project. Late submittals will be rejected without consideration. A conditional BID may be cause for rejection. There will be a No PRE-BID meeting; however a site visitation form shall be filled out and considered as part of the bid documents.

2 Any questions about the meaning, the intent or the specifications must be inquired by the Bidder in writing by February 11, all questions to Kelly Dietrich, Any and all questions will be responded to in the form of written addenda. All addenda that you receive shall become a part of the contract documents and shall be acknowledged and dated on the bottom of the Bid Tab Page. All addendums will be uploaded to the same location as the Request for Bid on the Buy Board website. A BID, including; the bid tabulation, references and acknowledgement of the general specifications in a sealed envelope or via to kdietrich@thewoodlandstownship-tx.gov must be received by The Woodlands Township, Parks and Recreation Department, 8203 Millennium Forest Dr., The Woodlands, TX no later than 12:00 noon on February 13, General Specifications and Acknowledgment Bidder shall complete every space in the bidder proposal column with either a check mark to indicate the item being bid is exactly as specified or a description to indicate any deviation of item being bid from the specifications. Item Description of Requirements Bidder s Initials 1 This project is for the supply and installation for playground improvements at Shadowbend Park in The Village of Cochran s Crossing. The playground must include equipment, swings, and climbing structures for children ages 2-5 and ages The playground area must fit within the borders as outlined on the Layout Plans L4.11 and L4.12. The equipment shall maximize play value, and be unique. The Woodlands Township is specifically seeking an overall design which is unique, creative, incorporates new trends and the overall theme of the park, and is in keeping with the natural environment. Bid prices shall be inclusive of all labor, materials, equipment, supplies, supervision, tools etc. This playground project is part of an overall park renovation and installation shall be coordinated with the Township and General Contractor, Hou-Scape. Insurance and Taxes 2 No taxes shall be included in the bid price since the Township is exempt from all sales tax. The Township will provide selected vendor applicable proof of sales tax exemption. 3 Contractor shall provide to The Township proper and verifiable insurance as outlined in the bid document. Project Timeline 4 Bid Due Date February 13, :00 NOON Bid Review Date February 14-17, 2014 (estimated) Award Contract February 21 (estimated) Playground Open no later than June 3, 2014 Project Budget 5 The project budget for equipment and installation is $82,425 inclusive of equipment, installation, fall surfacing and sub-surface drainage. Payment 6 Partial payment based on the percent complete less 10% retainage will be paid by The Woodlands Township within thirty (30) calendar days after the invoice is received based on the Accounts Payable calendar which will be provided to the successful contractor.

3 Bid Evaluation 7 Evaluation of the proposals take into account the following considerations: A. Price and Schedule- 15% Project designed within the budget Ability to install playground within identified time frame History of working within established schedules B. Quality & Experience 30% Years of experience in community playground renovation and working with a General Contractor. In-house Installation capability IPEMA certification CPSI on staff and available for final inspections Demonstrated knowledge of new playground trends in park environments C. Project Approach 30% Uniqueness of specific playground within the area and Village Good use of space and theme Design creativity Number and variety of play components Impact on overall play value within the park Consistency with overall design and feel of the park D. Meeting Resident Needs 25% Degree to which residents input was incorporated into overall design Demonstrated knowledge of fitting the playground into the overall renovation design. 8 A site visit is required for this project and the form shall be submitted with this bid (attached). 9 This project may be approved as a turnkey project and/or equipment only or installation only. 10 State the number of calendar days for this project to be completed in the bid form. 11 Bidder is required to submit (3) references of previous projects of similar size and scope. Warranty 12 Include Playground Manufacturer warranty and any contactor warranties with bid submittal. 13 Provide maintenance and operations required for the proposed equipment with submittal. 14 Include expected life cycle of the proposed equipment with submittal. Approvals 15 An award of contract is subject to The Woodlands Township Board approval. Playground Design 16 As part of the overall park renovation, a Village-wide survey was facilitated to gain input on the desired park improvements. The overall theme of the park is natural woodlands which incorporates a theme of trees and wildlife in the new splash pad. The survey results as they related to the playground were: PLAYGROUNDS Within the many respondents who value the playgrounds highly, the following opinions

4 were voiced: - Over 75% want to improve seating, add swings and update both play areas At least 2/3 of residents want to add individual play components, a climbing rock and natural playscapes. Create a view corridor between the two play areas to connect the playgrounds. Contractors are expected to pay specific attention to these survey results and park theme in order to incorporate into the overall playground design, where possible. 17 The playground design must include play equipment, swings and climbing structures for children ages 2-5 and ages The playground area must fit with the play areas as outlined in the Layout Plans L4.11 and L Color selection will be at the sole discretion of The Woodlands Township. 20 Belt and bucket swings must be included in the overall design. 21 Upright posts should be a minimum for 5 diameter for equipment geared to ages 5 to 12 year olds. Upright posts should be a minimum for 3.5 diameter for equipment geared to ages 2-5 year olds. 22 Include a color rendering and site plan of proposed playground equipment shall be included in the proposal submittal. 23 The Layout Plan L4.11 and l4.12 along with the overall park renovation rendering are included with the bid documentation. Installation 24 Contractor shall provide all equipment, labor, trucks, and material necessary to perform the required service. No equipment, material or personnel shall be provided by The Township to Contractor. Standard of Conduct and Appearance 25 Contractor shall behave and operate in an environmentally sound and professional way, at all times. 26 Each employee will be identified by a company uniform (shirt, pants or cap) and vehicles will be clean and marked with company name. 27 Equipment must be well maintained and in good operating condition. 28 Contractor must ensure user s safety when performing services in and around all locations. The contractor shall be responsible for coordination of all work so as not to create any undue interruptions of the normal operation of the area and/or overall construction of the park. Contractor s Responsibility 29 Work shall be conducted between 7:00 a.m. and 7:00 p.m., Monday through Saturday. The Woodlands Township may direct specific times for certain work to be performed so as to not to interfere with the community, which would include Township holidays. All work shall be coordinated through The Woodlands Township and the General Contractor. 30 Contractor is fully responsible for ensuring that design and installation of all playground equipment meets all CPSC/ ASTM / ADA and any other standards as they relate to playgrounds. 31 Contractor shall provide to The Woodlands Township a letter from the playground manufacturer representative stating the equipment has been installed in accordance with State and Federal standards prior to final payment.

5 32 Bidders should carefully examine the bid documents, specifications and other documents, visit the sites of the work and fully inform themselves as to all conditions and matters which can in any way affect the work or the cost thereof. Should a bidder find discrepancies in or omissions from specifications, or other documents, or be in doubt as to their meaning, he should notify The Township at once and obtain clarification prior to submitting a bid. 33 Contractor is responsible for repairing any damage to facilities, grounds or landscape that occurred as a result of the contractor performed work. 34 Each Contractor is responsible for locating all utilities prior to construction and providing written notification to owner prior to construction. 35 The General Contractor is responsible for maintaining perimeter safety fencing around the entire park renovation project; the playground is within the overall project area. The Playground installer cannot cause undue harm to the safety fencing and shall maintain a safe work environment. 36 Each Contractor is responsible for the legal disposal and cost of debris removal. 37 Contractor shall verify all field conditions and finish elevations with The Woodlands Township and General Contractor. 38 Prior to the start of installation, the Contractor shall stake the location of all elements for approval by The Woodlands Township. 39 Contractor shall install play equipment per manufacturer s installation instructions. Fall Surfacing 40 The existing play areas have fall surfacing which may be re-used. The adequacy of re-used materials and compliance with ASTM F will be the responsibility of the Contractor. 41 The fall surfacing shall be engineered wood fiber and shall be installed by the Contractor. The Contractor is responsible for providing The Woodlands Township a letter indicating the new fall surfacing meets the ASTM F a standard. 42 Fall surfacing shall be installed to meet all necessary standards and guidelines. Drainage 43 Contractor shall provide subsurface drainage, fabric barrier, and safety surfacing for the new play equipment. Drainage system shall consist of 4 perforated pipe with sock around perimeter of each play area. Sock pipe shall be covered with 6 washed gravel and filter fabric. Drainage pipe shall be installed as to maintain positive drainage. Drainage pipe shall day light an edge of play area (forest side) towards the drainage ditch, not towards the pool. Contractor shall cut pipe flush with bordering and set pipe in a sloped concrete headwall. Drainage system can be substituted with approved equal. 44 Due to the uncertainty of damage to the existing drainage system, bidder shall bid the drainage repairs as a price by linear foot. The unit price shall be noted on the bid form. Working in The Woodlands 45 Contractors shall understand that one of the main emphases of this community is the preservation of the natural existing environment-that is the trees, bushes, wildflowers and wildlife, and to enhance it by additional landscaping and the development of the lakes and open space. The houses are being built with the natural woodlands preserved surrounding them. No one can replace what nature has created, and to preserve this beauty The Woodlands Township expects contractor cooperation. No trees, shrubs or vegetation should be unnecessarily removed or damaged. No trash, lumber, etc. can be dumped in the woods. No vehicles, etc. can be parked except in designated areas

6 assigned by the superintendent. Value Engineering 46 Selected contractor will coordinate with The Woodlands Township a value engineering exercise to maintain probable cost within the established budget to insure project durability and quality. Communication 47 Contractor(s) are expected to be in daily contact ( , phone) and weekly meetings with appointed project manager for The Woodlands Township. Additional meetings may be required between contractors selected regarding project related issues. Compliance with laws 48 For this project, all contractor(s) and subcontractor(s) must pay the local general prevailing wages. This includes the rate for overtime work and legal holidays. Laborers or employees must be paid at or above the prevailing local wages. 49 Contractor shall use EPA approved materials and be prepared to provide MSDS sheets for any materials utilized during the project. 50 Traffic control, where and when needed, that meets the requirements of Montgomery County shall be provided as part of the project cost. 51 At Contractor's own cost and expense, Contractor shall comply with all laws, ordinances, rules, and regulations of the federal, state, local, American with Disabilities Act (Standards 2011) and OSHA authorities and departments relating to or affecting the work hereunder, and shall secure and obtain any and all permits, licenses, certifications and consents as may be necessary in connection therewith. User Safety 52 The park will be closed to the public during construction. Sub-contractors 53 All construction shall be performed by the approved contractor or sub-contractor. A list of sub-contractors shall be submitted with the bid. Please answer the following questions: 1. There shall be no right of subrogation against The Woodlands Township and this waiver of subrogation shall be endorsed upon the policies. Prior to the commencement of performance of the Work, Vendor shall furnish certificates which shall identify The Woodlands Township to The Woodlands Township in duplicate, evidencing compliance with all requirements herein. The limits of such insurance shall in no way be construed as limiting Vendor s obligation to completely defend, indemnify and hold harmless The Woodlands Township.
