1 REQUEST FOR PROPOSALS RFP# TITLE: PAINTING SERVICES ISSUSING AGENCY: TOWN OF WALLACE 316 East Murray Street Wallace, North Carolina ISSUE DATE: January 11, 2019 IMPORTANT NOTE: Indicate firm name and RFP number on the front of each sealed proposal envelope or package, along with the date for receipt of proposals specified below. Sealed proposals, subject to the terms and conditions made a part hereof will be received until 3:00 p.m. Friday, February 12, 2019 in the office of the Town of Wallace, Office of the Town Manager, Wallace, North Carolina for furnishing the services described herein. Bids opening conference will take place at 3:15 on February 12, 2019 in the Town Council Chambers. SEND ALL PROPOSALS DIRECTLY TO THE ADDRESS SHOWN BELOW. Bidders may hand deliver RFPs to the Manager s Office in the Wallace Town Hall, or if preferred, UPS and FedEx make daily deliveries to our office. If using any other delivery method, please allow ample time for delivery.

2 INTRODUCTION The Town of Wallace is issuing this Request for Proposals to obtain painting services in accordance with the specifications contained herein. The Town of Wallace reserves the right to award future painting services for buildings similar in size and structure to the successful offer at the proposal prices given for the address below most closely representing the size and structure. PROPERTY ADDRESS: Wallace Women s Club 216 Northeast Railroad Street (Commercial) Wallace, North Carolina *** THE TOWN OF WALLACE SHALL BE SOLELY RESPONSIBLE FOR DEALING WITH ANY ASBESTOS OR LEAD PAINT RESIDUES LOCATED ON OR IN THE BUILDING. Services to be Included: All services shall be performed in a professional manner. Wood Preparation: All wood preparation is to include fascia, windows, trim, handrails, siding, balconies, outside walls, and doors. Remove all windows screens & shutters and store safely to be reinstalled by the contractor upon completion of painting. All loose wood to be re-nailed including fascia, soffit, siding, trim and moldings. Removal of any dirt, dust, grime, oils, mildew, and loose paint by power washing or hand washing. Scraping and removing all loose or flaking paint. All bare wood to be painted using oil-based primer, and the final two coats using exterior latex paint, as provided hereafter. Remove old caulk that is loose or cracked. Caulking with silicone latex around doors and windows and small cracks. Large holes and cracks to be caulked using an exterior ten (10) year caulk. Caulk all joints. Removing and replacing all exterior wood that is rotten or defective to serve the purpose for which it was intended. Window Shutters. Bidders shall include in their proposals as an option that may be exercised by the Town, the cost to install new wood shutters in an appropriate size for each window located on the north, west and east side of the building. Cost to be provide on a per pair basis. Metal Preparation: All metal items are to be scraped, wire-brushed and sanded as to remove all rust. Areas of metal preparation will then be primed using a rust oxide industrial primer/oil-based primer with rust inhibiting components. Other areas to be painted will be painted with both latex

3 Painting: primary primer, and final coatings utilizing latex painting primer as an ingredient of the paint. Painting is to include application at manufacturers specifications using two (2) coats for maximum coverage unless otherwise specified. Paint to be applied with brushes only no spraying of any type unless approved in writing in advance by the owner, to cover the following: fascia, soffit, doors, siding, trim and decks. All paintwork shall be given at least a one-year warranty on materials and labor and will include the use of oil-based primer and paint on all metal items. Painting shall be done between the hours of 7:00 am and 6:00 pm on Monday through Saturday unless prior approval is given for extended hours on holidays and Sundays. Painting work shall be done in a manner that will create as little disturbance as possible for the residents and employees of the Town utilizing the building. The paint used must be a high quality and must be approved by the Town Council prior to startup of the painting. Sherman Williams Duration paint has been used in the past, and it or its equivalent is recommended. All materials specified and approved shall be delivered in manufacturer s sealed containers, with original labels intact defining the contents therein. The contractor must provide the Town Council a preliminary schedule of all work before undertaking a painting project. The contractor is responsible to coordinate changes in the schedule with the Town Manager to ensure that inconvenience to the facility is held to a minimum. The contractor shall exercise care in surface preparation and painting, to ensure that the workmanship is of the best quality, fully conforming to industry standards. Only skilled workers adequately supervised shall be allowed to work on painting projects. All materials are to be applied evenly and with the proper film thickness, in strict compliance with the manufacturer s directions and/or printed instructions. Work is to be accomplished under favorable weather conditions, best suited to the production of an acceptable finished product. All work shall be subject to the approval of the Town Manager or Town Council or a representative that they have previously approved. The contractor shall satisfactorily correct any work found in need of correction, due to improper preparation, painting, or workmanship, or because of the contractor s negligence prior to the final approval and payment. Paint Protection and Clean Up: All walks, floors, plants and/or shrubbery, or other surfaces and items not to be painted, shall be carefully protected whenever surface preparation, or painting is being performed. Drop cloths shall be used liberally wherever needed for this protection with special attention to vehicles. All painting related debris will be picked up and removed daily. The definition of debris includes, but is not limited to, paint cans, rags, and brushes. The ground below all work areas is to be covered with 6mil plastic, and all debris is to be contained and disposed of properly. All paint flakes and wood pieces are to be removed from common areas including, but not limited to, walkways, flower beds, and parking lots. Paint brushes and other painting tools are to be cleaned at a distance from flowerbeds, shrubbery,

4 trees, walkways, parking lots, and grassy areas. Painting Safety: All ladders are to be taken down daily and stored in a safe place away from any vehicular or pedestrian traffic areas. Wet paint signs and clearly marked areas shall be roped off whenever necessary. All unpainted areas are to be masked off or draped including shrubs, trees, blower beds, and any personal property. All workers are to take the appropriate precautions to prevent any injury to themselves, residents, and municipal employees. Painting Insurance: Contractors must provide evidence of Property Damage, Public Liability and Workman s Compensation Insurance and sign an Indemnification Agreement prior to commencement of any work. Notification: Any injury on the job must be reported to the Town Manager within twenty-four (24) hours from the time of the accident or injury. Any additional work uncovered during the normal painting process shall be reported immediately to the Town Manager or Town Council. This is to include, but is not limited to: rotted wood, damaged structural supports, roof leaks and damage (soffit and fascia). Other Painting Provisions: Bidding is to include the cost of labor, materials, insurance, and any related costs covering the scope of the work, unless otherwise specified, to complete the work in a satisfactory workmanlike manner. The contractor and a designated representative of the Town of Wallace will inspect all work as the work progresses. The contractor, prior to the final approval and final payment, shall satisfactorily correct any work found in need of correction, due to improper preparation, painting or workmanship, or because of the contractor s negligence. A requested payment schedule must be submitted and approved prior to the commencement of the work. A production work schedule is to be submitted with all cost estimates. All work is to be completed as soon as possible but no later than May 3, All discrepancies or omissions pertaining to work herein specified are to be corrected by the contractor prior to the final payment, or the retainer amount and completion date shall not occur until the omissions or discrepancies are corrected. The contractor shall exercise care in surface preparation and painting, to ensure that the workmanship is of the best quality, fully conforming to the lead laws and industry standards. Only skilled workers adequately supervised shall be allowed to work on this project.

Work is to be accomplished under favorable weather conditions, best suited to the production of an acceptable finished product. All work shall be subject to the approval of the Town Manager or Town Council or the designated representative prior to final payment. Any work found in need of correction shall be satisfactorily corrected prior to the final inspection and payment. Clean up: Daily, the contractor shall comply with the requirements of the EPA Lead Awareness program. Commencement and Completion of Work: The project shall begin no later than 30 days after the execution of a contract between the winning Bidder and the Town, or on such other date as agreed by both parties to the contract. The project shall begin with a meeting among Town officials and the winning Bidder. The project bids shall be opened at the Town Hall on February 12, 2019 at 3:00 pm. The bid award shall be made on or after February 14, A final conference with the contractor shall be held with the Town Manager prior to final payment. Change Orders: Any work to be completed at an additional cost above the agreed upon price and outside the agreed upon scope of work must be pre-approved in the form of a change order by the Town Manager or Town Council. Contract Awards: The Town of Wallace reserves the right to reject any or all proposals, or to accept the proposal that the Town deems to be in the best interest of the Town, regardless of lowest bid amount. The Town of Wallace reserves the right to request additional data or information or a presentation in support of written proposals. However, the Town may award a contract based on offers received, without additional submissions. Accordingly, the proposal should be submitted on the most favorable terms from all aspects, which the Bidder can submit. 1. References: Each proposal shall contain a minimum of three (3) references (names, title, address, and telephone number) of whom the Town my contact to verify services rendered or currently being provided. Public agency referrals are preferable. Proposals that do not contain a minimum of three (3) references, or proposals containing information that is subsequently proven false or materially incorrect, shall constitute grounds for either rejecting the RFP, or terminating any contract with the Contractor.

6 3. Optional Job Walk: The Town will conduct a site walk through and a pre-submission meeting on January 22, 2019 at 3:00 PM. Respondents are encouraged to participate in the site walk through and pre-submission meeting. 4. Inspection: All respondents are responsible for thoroughly examining the job site, specifications, and any available lead and asbestos survey reports. The Contractor shall be responsible for knowledge of all existing conditions and limitations, except for hidden or latent defects or conditions that may affect the job. The proposal price shall include a sufficient sum to cover all items that are required for the satisfactory completion of the job. Errors, omissions, and discrepancies shall be called to the attention of the Town Manager and clarified prior to the submission of a proposal. No respondent shall at any time after submission of a proposal make any claim or assertion that there was any misunderstanding or lack of information regarding the nature or amount of the work necessary for the satisfactory completion of the job, except for hidden or latent defects that are discovered, discussed, and agreed upon in writing by the parties to the contract during the work progress. 5. Execution of Proposal: The attached Execution of Proposal must be completed and included in the proposal. Proposals that do not contain this document will be considered non-responsive and rejected. 6. Fee Schedule: Each proposal shall contain a fee schedule indicating a separate cost for the removal of hazardous materials and, the painting. and the cost for a prevailing wage. Proposals that do not contain this information will be considered non-responsive and rejected. 7. Criteria for Selection: An evaluation team composed of Town Staff will review the proposals. All proposals that contain all the required documents and are received prior to the deadline date and time will be fully considered and rated by the evaluation team based on the following criteria: Qualifications and Experience of Personnel 25 Points Fee 30 Points Time Allocated to Services 30 Points Client References 15 Points 8. Proposal Rejection: The Town reserves the right to reject any or all proposals submitted and is not liable for pre-contractual expenses. Pre-contractual expenses are defined as expenses incurred by the offeror in: (a) preparing the proposal; (b) submitting that proposal to the Town; (c) negotiating with the Town in any manner related to this proposal; or (d) any other expenses incurred by offeror prior to date of award, if any, of the contract. 9. Acceptance and Notification: Following approval by the Town Council, the Town will notify the successful individual or firm of the award by either first class mail or , if an address is provided with the proposal of award and request the individual or firm to furnish the appropriate insurance certificates and a performance bond. The insurance certificates and performance bond must be submitted to the Town no later than five (5) business days after the notice of award. Failure to comply with this requirement may be cause for cancellation of the award.

The Town of Wallace reserves the unqualified right to reject all offers if determined in the Town s best interest.

8 RFP# COMPANY NAME: EXECUTION OF PROPOSAL By submitting this proposal, the potential contractor certifies the following: An authorized representative of the firm signs this proposal. It can obtain insurance certificates as required within 10 days after notice of award. The cost and availability of all labor, equipment, materials, and supplies associated with performing the services described herein have been determined and included in the proposed cost. All labor costs, direct and indirect, have been determined and included in the proposed cost. The offeror can and will provide the specified performance bond or alternate performance guarantee. The potential contractor has read and understands the conditions set forth in this RFP and agrees to them with no exceptions. The contractor has in effect $1,000, in general liability insurance and Workers Compensation on all employees. Therefore, in compliance with this Request for Proposal, and subject to all conditions here, the undersigned offers and agrees, if this proposal is accepted within 60 days from the date of the opening, to furnish the subject services at the cost on the Cost Proposal section of this document.
