1 UNITED NATIONS United Nations Interim Administration Mission in Kosovo UNMIK NATIONS UNIES Mission d Administration Intérimaire des Nations Unies au Kosovo UNMIK/REG/2004/13 28 May 2004 REGULATION NO. 2004/13 AMENDING UNMIK REGULATION NO. 1999/3 ON THE ESTABLISHMENT OF CUSTOMS AND OTHER RELATED SERVICES IN KOSOVO The Special Representative of the Secretary-General, Pursuant to the authority given to him under United Nations Security Council resolution 1244 (1999) of 10 June 1999, Taking into account United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 1999/1 of 25 July 1999, as amended, on the Authority of the Interim Administration in Kosovo and the Customs Code of Kosovo (UNMIK Regulation No. 2004/1 of 30 January 2004), In conformity with section 8.1(c) and (f) of the Constitutional Framework for Provisional Self-Government in Kosovo (UNMIK Regulation No. 2001/9 of 15 May 2001), Having promulgated UNMIK Regulation No. 1999/3 of 21 August 1999, as amended, on the Establishment of the Customs and Other Related Services in Kosovo, Whereas section 1.1 of UNMIK Regulation No. 1999/3 provides that all goods of any type destined for Kosovo are subject to customs rate equal to ten percent (10%) for a transitional period, with the exception of the goods listed in Annex I thereof, Acting at the request of the Government and having consulted with the Economic and Fiscal Council, For the purpose of amending Annex I to UNMIK Regulation No. 1999/3 to revise the list of goods exempt from customs duty and to add lists of goods with a zero rate of customs duty, Hereby promulgates the following:

2 2 Section 1 Amendment As of the date on which the present Regulation enters into force, Annex I to UNMIK Regulation No. 1999/3 shall be replaced by the amended Annex I attached to the present Regulation. Section 2 Entry into Force The present Regulation shall enter into force on 7 June Harri Holkeri Special Representative of the Secretary-General

3 Annex I Part A List of Goods Exempt from Customs Duties Exports. Pharmaceutical products contained in a list of international non-proprietary names (INNS) published by the World Health Organization, and pharmaceutical intermediates used in the manufacture of pharmaceutical products which are covered by chemical abstract service registry number (CAS RN). Goods imported by UNMIK, KFOR, UNHCR, ICRC, Red Cross and Red Crescent Societies, and NGOs registered with UNMIK with public benefit status. Goods imported by foreign diplomatic and consular missions for their official use. Goods funded from the proceeds of grants made to UNMIK by governments, government agencies, governmental or non-governmental organizations, in support of humanitarian and reconstruction programmes and projects in Kosovo.

10 Civil aircraft and goods for use in civil aircraft 1.Relief from customs duty is provided for: - civil aircraft, - certain goods for use in civil aircraft and for incorporation therein in the course of their manufacture, repair, maintenance, rebuilding, modification or conversion, - ground flying-trainers and their parts, for civil use.
