4 PROBLEMS The Big One Responsibility and Liability 1990 Act requires designers to design in accordance with the Building regulations and builders to build in accordance with the Building Regulations. Have these duties now changed? What is the liability of the Assigned Certifier?

5 PROBLEMS The Big One Responsibility and Liability An opinion has been sought by RIAI from Senior Counsel on liability and responsibility of architects, consultants, specialists and builders. ACEI is seeking a similar Opinion. These Opinions will be evaluated by ACEI and RIAI legal advisors and PI Insurers to inform policy.

6 PROBLEMS Will Clients Do This? 1. A building cannot be opened operated or occupied until a Completion Certificate has been submitted and validated by a local authority. This has implications for funding, insurance, licences etc and the problems I have mentioned. 2. Recent Building problems have made the public aware of building standards.

7 PROBLEMS Who Will Pay? Minister Hogan: buildings will cost more. Tom Parlon: builders will have to pay more to consultants for these services. Costs are not known, at this point. Current fee agreements will have to exclude Regulations work, Assigned Certifier etc.
