3 Joint-Use 21 st Century Post-Secondary Education Center Design/Build Contractor RFP Bid # Respondents Questions and Description of Changes July 7, 2014 ADDENDUM NO. 2 The Following Changes, deletions, additions, and/or alterations in, on and to the RFP shall apply to proposals submitted for the project identified above. Careful Note of This Addendum shall be taken by all parties of interest so that the proper allowance may be made in all computations, estimates and contracts, and all Proposers affected shall be fully advised in the performance of the work which will be required of them. In Case of Conflict between the RFP and this Addendum, this Addendum shall govern. This Addendum supersedes all previous instructions pertaining to the items. Can you please clarify if it is to be in Part 2 Hard Costs or separate? Answer: Proposal Form and Agreement - Part 2 HARD COST: HARD COSTS: Replace (MAP minus Proposal Price and Contingency) with ((MAP minus Total Proposal Price) x 0.98) NOTE: DESIGN BUILDER S CONTINGENCY: Replace (2.0% X Hard Costs) with (Hard Costs x.02), DELETE This amount is included in the Hard Cost above. 5 Item 5 Re: Proposal Form Attachment 10 - Fee Question: Attachment 10 Is fee percentage only calculated on hard costs only? Example, no fee will be given on Pre-construction or Construction Services? Answer: The FEE Percentage (%) is not calculated on hard cost only, and represents the FEE for all services. Item 6 Re: Proposal Form Attachment 10 Clarification: Proposal Form, Page 2, Add the following: In its efforts to explore the best delivery method for this project the District realizes that the Fee structure will vary between different methods of construction and so asks the Proposers to provide the costs of Services and Fees to manage both types of construction methods in the revised Attachment 10 Proposal Form and Agreement. The intent of the selection process is to identify the Design-Build team with the qualifications, experience and best fit for collaboration with the Client. The Client will work with the selected Design-Build team to evaluate the most appropriate and beneficial method of construction for the project. Proposal Form, Page 3, PRICE has been revised to include values for Conventional Construction AND Construction Utilizing Pre-Engineered Systems. Please include values for both types of construction. Part 2 HARD COST This is the target price upon which to.. replace design with build the Project... REVISED Attachment 10 - PROPOSAL FORM AND AGREEMENT Attached Item 7 Re: California Code of Regulations (CBC) Edition Question: Please confirm the accuracy of listed Division 1 requirement in Spec Section REGULATORY REQUIREMENTS: 1.02 Regulatory requirements, Part A, 3 states California Code of Regulations (CBC), Title 24, 2010 Edition? Is this correct, or should the reference be updated to (CBC) 2013 Edition; in current use? Answer: Comply with the California Code of Regulations (CBC), Title 24, 2013 Edition. Division1, Section Regulatory Requirements: Replace California Code of Regulation (CBC), Title 24, 2010 with 2013 Edition. 6 Item 8 Re: California Code of Regulations (CBC) Edition Question: Please clarify the reference in Attachment 9, Agreement on page 5 of 167, item College means Irvine Valley College,. Answer: Replace Irvine Valley College with San Jose Evergreen Community College District. Item 9 Re: Single Page Design/Sketch Question: Paragraph a calls out for a single architectural drawing of a site plan only. Is it the intent that this site plan includes the building outline(s) as well? Answer: Confirmed, provide a single Site Plan which includes the building outline. Item 10 Re: Life Cycle Cost Question: The Life Cycle Costs referenced in Paragraph do not appear to be a part of the scoring methodology set forth in Paragraph 4.3. Please confirm or otherwise explain. Answer: Confirmed, the Life Cycle Cost is not a part of the scoring, however the information is required as part of the RFP. Item 11 Re: BIM Question: BIM is referenced in both Paragraphs c and c.ii. Please advise if one section may cross-reference the other. Answer: Yes, BIM information for Section c and c.ii may be cross referenced. Item 12 Re: Site Meeting Space Question: Attachment 14 Colocation on page 2 of 8. Are we to provide a trailer for a big room for all stakeholders? What is time expectation for team members in the big room? How many members from the District / CM will need to be accounted for in the space plan? Answer: A separate trailer is not required for a big room approach. The use of the contractors existing conference space OR a space provided by the Owner to be utilized, depending on the number of attendees. 9 The undersigned has reviewed the work outlined in the RFP and fully understands the scope of work required in this proposal, and acknowledges that his proposal includes the work of all trades within required scope of work in the Proposal, and agrees that this proposal, if accepted by the District, will be the basis for a contract with the District to enter into such a contract in accordance with the intent of the Contract Documents. The undersigned agrees to complete the work required within the time indicated, subject to liquidated damages as specified. The undersigned has notified the District of any discrepancies or omissions, or of any doubt about the meaning of any of the Contract Documents, and has contacted the District before proposal due date to verify the issuing of any clarifying Addenda. 10 PRICE Proposer shall complete this page following the instructions below. Part 1 PROPOSAL PRICE: This section will be used for scoring the RFP Proposal. The following fixed amounts are based on the total Maximum Allowable Price (MAP) for the Project, inclusive of all hard and soft costs, of $7,500,000. Conventional Construction A. Design and Preconstruction Services $ $ Includes, without limitation, all of the following: Architecture and engineering design work, and other Design-Builder s preconstruction services. B. Construction Services $ $ Includes all of the following: designer s construction administration, oversight, and other site based categories: site office expenses, including staff, materials and supplies; superintendent(s); assistant superintendent(s); project engineer(s); project manager(s); site based scheduler(s); site based drafting or detailing; scaffolding; on-site and off-site field trailer and storage rental and expenses; temporary site fencing; temporary site utilities, including gas, electric, sewer, water, telephone, telefax and copier equipment; site computer and data-processing personnel, equipment and software; federal, state or local business, income and franchise taxes; mobilization and demobilization; all of which must be included in Construction Services. C. Fee $ $ Includes Profit and all home office based categories including: home office expenses, including staff, materials and supplies; accounting; home office computer and dataprocessing personnel, equipment and software; legal; estimating; vehicles not dedicated solely to the performance of the Work; Bonds and Insurance. 11 Part 2 HARD COSTS: D. (MAP minus Total Proposal Price) x 0.98 $ $ Includes all monies available for trades work (CSI Div 2-48). All of this amount will be available for the purpose of open book pricing, estimating and procurement of underground and above ground trade s work for the Project including, without limitation, demolition and abatement, hoisting, rough and final clean up, storm water protection work. This is the target price upon which to build the Project and contains no funds for anything other than the elements of hard costs of construction. E. DESIGN BUILDER S CONTINGENCY: (Hard Cost x 0.02): $ $ TOTAL HARD COST: D+E $ $ TOTAL MAXIMUM ALLOWABLE PRICE (MAP): $ 7,500,000 $ 7,500,000 (Sum of Part 1 and Part 2) SPECIFIC EXCLUSIONS: List any parts of the District s Program not included in the Proposal. If none, enter the word, None below. PROPOSAL AGREEMENT It is understood and agreed that if written notice of the District s acceptance of this proposal is mailed, telegraphed, or delivered to the undersigned after the opening of the proposal, the undersigned will execute and deliver to the District a contract in accordance with the proposal as accepted, within five (5) working days after receipt of notification of award, and that the work under the Contract shall be commenced by the undersigned Design-Build Entity, if awarded the contract, on the date to be stated in a Notice to Proceed issued to the Design- Build Entity and shall be completed by the Design-Build Entity in the time specified in the contract documents. Design-Build Entity agrees to submit within 48 hours of request, a work plan reflecting the DBE s plan of action to staff and mobilize the scope of work proposed. 12 The Design-Build Entity agrees to submit within 48 hours of request, a unit price breakdown of substantial quantities as requested by the District. The undersigned acknowledges the fact that the District reserves the right to accept or reject any and all proposals, to waive any informality in receipt of this proposal, with or without cause or reason, and award the contracts on the basis stated in the instructions to proposers. The undersigned agrees that the information and representations provided herein are made under penalty of perjury.
