1 New Construction and Remodel Procedure Widgi DRC meets on the 1st & 3rd Tuesdays as needed. Preliminary Design Review (Required) 1. Submit Application Agreement and Designer/Builder Information forms. 2. Submit Preliminary Design Review Submission Form with required drawings. 3. Submit $1,000 new construction or $1.00/s.f. major remodel design review fee. 4. After DRC review, receive a Conditional Preliminary Design Approval Notice listing required modifications. 5. With minor home modifications: paint, landscape, decks, tree removals etc, send written request for changes to the DRC Chair. An will suffice. Final Design Review 1. Submit Final Approval Submission Form for New Construction and/or Remodel. 2. Submit Final Drawings and materials as required in the Design Standards, Rules and Guidelines. 3. String the new footprint and driveway on lot and mark trees that are to be removed. 4. Submit required refundable deposits; $1,500 for new construction or $500 for remodel by owner and $1,000 by contractor. 5. After DRC review, receive a Conditional Construction Approval Notice listing conditions of approval. Construction (only after Final Approval Notice is issued) 1. Obtain all required County Permits, City Sewer Annexation, power and water connections. 2. 2 APPENDIX B APPLICATION AGREEMENT FOR NEW CONSTRUCTION & REMODEL 1. I/We have read and understand the Widgi Creek Home Owners Association (WCHOA) CC&RS, BY LAWS, and DESIGN REVIEW STANDARDS in the July 2009 Widgi Creek Homeowner's Manual (WCHOM), this application with the included forms, the role and responsibilities of the Design Review Committee(DRC) and the DRC, review and approval process. 2. I/We agree that there shall be no deviations from the plans, specifications, and /or location approved by the DRC without prior written consent of the DRC. Any deviation from the approved application and any DRC conditions of approval shall be resubmitted for DRC approval prior to implementing such deviations. Modifications to the approved final design that are made by contractors, subcontractors, or owner builders will result in a fine of $ for each infraction/unapproved change. 3. I/We agree that approval by the DRC of any particular plans and specifications or designs shall not be construed as a waiver of the right of the DRC to disapprove such plans and specifications, or any elements or features thereof, in the event such plans are subsequently submitted for use in any other instance. 4. I/We agree that approval by the DRC shall in no way be construed as to pass judgment on the accuracy of the location, structural design, suitability of water flow drainage, location of utilities, or other qualities of the proposed construction. 5. I/We agree that approval of the DRC shall in no way be construed as to pass judgment on whether the proposed construction is in compliance with the applicable building and zoning codes of Deschutes county or the City of Bend. 6. I/We agree that it is my/our responsibility and obligation to; obtain all required building permits, locate utilities, easements, City and golf course setbacks, solar setbacks, and right-ofways; construct the improvements in a workmanlike manner in conformance with all applicable building and zoning codes of Deschutes County and the City of Bend Sewer Annexation. 7. I/We agree that no work on the proposed construction shall begin until I/We have received written final approval from the DRC. If work is begun prior to final approval or this application is disapproved wholly or in part I/We may be required to return the property to its former condition at my/our own expense. I/We may be required to pay all legal expenses incurred by the WCOA to enforce this agreement. 8. I/We agree that construction in accordance with approved plans, specifications, and DRC conditions of approval (if any) shall commence within 12 months of the date of the DRC approval letter. Otherwise, the approval by the DRC shall deem conclusively to have lapsed and

3 to have been withdrawn, and my/our deposit will be returned. I/We understand that a new application, fee, and deposit is required if I/We plan a new construction/remodel in the future. 9. I/We agree that exterior building construction in accordance with the approved plans and specifications, and DRC conditions of approval (if any) shall be completed with 12 months of the starting date. A daily fine of $ will be assessed for each working day (excluding Sundays) that this completion date is not met. 10. I/We agree any landscaping in accordance with the approved plans and specifications, and DRC conditions of approval (if any) be completed within sixty (60) days of new construction occupancy, or sixty (60)days from the date new landscaping is approved by the DRC. 11. I/We agree that members of the DRC or managing agent are authorized to enter upon my/our property to make one or more routine inspection(s). 12. I/We assume responsibility for any and all damages by the contractor/builder, his agents and subcontractors, and their agents to adjacent property, right-of-way or community property, or to my/our property. 5 APPENDIX D PRELIMINARY APPROVAL SUBMISSION FOR NEW CONSTRUCTION OR REMODEL Name Lot #_ Date PRELIMINARY DESIGN APPROVAL A written request is required for any new alteration of the exterior of a home, removal of trees, new paint color, tree removal etc. An would suffice. New Construction or a major model requires a Preliminary Approval Submission for new construction or Remodel. A major remodel includes the extending of living spaces, enlarging footprint of house or garage and material exterior changes, like windows. The purpose of the preliminary approval is to provide an opportunity for review of the proposed alteration and early detection of attributes of the alteration which may not conform to the DRC Design Standards, Rules and Guidelines, the aesthetic goals of development at Widgi Creek, or which may give specific concern to the DRC members. The preliminary process allows the owner and designer to receive DRC advice regarding standards interpretation or design changes which may be requested by the committee, before unnecessary time and money have been expended. The goal of the preliminary process is for the DRC to work with the owner to expedite easy approval of the final design. The DRC shall determine if the alteration is to be considered minor or major.. The preliminary design application will not be begin until all items below are fully provided by the owner or his agent. The preliminary design review will not begin until all items above are fully provided by the owner or agent. After scrutinizing the preliminary design as submitted, if modifications are required, the DRC will either discuss recommendations directly with the owner and/or designer, or issue a Conditional Preliminary Design Approval Notice. Preliminary approval by the DRC shall not be deemed as final approval of the design or construction, but as an indication of advice and recommendations by the DRC paving the way for Final Approval. Regardless of preliminary design approval, the final design approval must still be obtained before the design shall be considered fully approved (subject to conditions of the final Approval Notice), and before trees may be cut or construction may begin. drc complete appendices rev 7/9/13

6 APPENDIX E WIDGI CREEK HOME OWNERS' ASSOCIATION CONDITIONAL PRELIMINARY DESIGN APPROVAL NOTICE (DRC-N-1a) Conditional preliminary approval is hereby granted by the DRC to the listed Widgi Creek homesite owner for design plans previously submitted for development of the lot described herein, subject to the conditions indicated. Preliminary approval does not constitute final or construction approval, nor does it guarantee that the final design and plans will be accepted by the DRC. Preliminary approval does indicate that subject to the conditions stated, and acceptance of the remaining requirements for final approval, the DRC has reviewed the preliminary plans and finds them to be substantially consistent with the design standards and goals of Widgi Creek, and further anticipates no major difficulties in approval of a final plan, and so long as that plan substantially adheres to what has been submitted along with all requirements, will the DRC consider final approval. Final approval shall not be considered to have been granted until the execution & delivery by the DRC, of a Conditional Construction Approval Notice to the owner. LOT # LOT OWNER : CONDITIONS OF PRELIMINARY APPROVAL Approval is subject to all applicable governmental restrictions, building codes and permits. Subsequent changes to the design or plan as previously submitted shall invalidate this preliminary approval. The preliminary approval is valid only for one year from the date of this notice, by which time application for final approval must have been submitted along with all requirements REQUIREMENTS FOR FINAL APPROVAL 1. Final design submittal form with $1000 Builder deposit and $1500 owner deposit. 2. Submit Final Site Plan, Floor Plans and Elevations. 3. Landscape Plan (can be deferred) No landscaping shall take place until approved by the DRC. 4. Exterior Materials Board including all exterior color samples and all exterior lighting proposed. 5. Accurate stringing of the lot for structure footprint, driveways and lot boundaries 6. Mark all trees to be removed with red ribbon. GOVERNMENTAL APPROVALS 1. Deschutes County Building Permit 2. Upon review of the design as submitted, the DRC will respond with approval of the design, or with an explanation of required modifications to the plan within 30 days of the date any fees, documents and application requirements were fully met. If the committee fully or substantively approves the design as submitted, the DRC will execute and deliver to the owner a Conditional Construction Approval Notice. 9 APPENDIX G CONDITIONAL CONSTRUCTION APPROVAL NOTICE (DRC-N-2a) The following Widgi Creek homesite owner is hereby granted approval from the Design Review Committee to proceed with construction on the lot indicated, strictly according to the plans and specifications previously submitted and approved, and subject to special provisions and/ or conditions indicated below: LOT # : LOT OWNER : _ BUILDER: CONDITIONS OF APPROVAL Approval is subject to all applicable governmental restrictions, building codes and permits. Construction must begin with 1 year of the approval date for approval to remain valid. Substantive changes in the design plans, construction details, construction materials, etc., require advance written approval of the Design Review Committee. Other Conditions: 1. Submit Builder's Information & Security Deposit($1000), & Owner's Security Deposit ($1500) 2. Submit Materials Color Board with exterior light fixtures. 3. The contractor must schedule a pre-construction meeting on site with the D.R.C. Chair. 4. A landscape plan is required and must be submitted and installed within 60 days of substantial completion of construction. 5. A double check valve is required on all irrigation. 6. A refuse dumpster and chemical toilet must be maintained on site during construction. 7. Adjacent lots must not be disturbed by any construction activity. 8. No fires are permitted 9. 10 APPENDIX H ( For Project Manager use only) FINAL APPROVAL - NEW OR REMODEL CHECK LIST Lot# NAME Application - Owner/Builder submits application for final approval with plans and materials as set forth below... _Owner Deposit for New Construction - In addition to the Application Fee submitted with the Preliminary Application, a refundable deposit of $1500 is required at the time of Final Approval. Owner Deposit for Major Remodel -(A major remodel extends the home's living space or garage, and/or involves material external changes eg windows.) A refundable deposit of $500 is required at the time of Final Approval. Builder Deposit: At Final Approval, builder signs necessary documents and gives the DRC a $1000 deposit check and proof of insurance. _Owner/Builder provides an accurate string layout on the lot of the boundaries, proposed structure and driveway and two car parking. All trees that are planned for removal are marked with Red Tape. _Materials/Exterior Colors Specifications and Samples Siding Color Roofing Color Paving Trim/Railings The C.A. reviews submitted materials for completeness and or required revisions. The Consulting Architect submits recommendations to DRC. The DRC reviews recommendations along with site layout and responds to the final submission approval with the CONDITIONAL CONSTRUCTION APPROVAL NOTICE (Appendix D) identifying any required modification. Prior to the start of construction the Owner/Builder verifies the obtainment of all Deschutes Cty Building Permits and other required governmental approvals. A Landscape Plan must be submitted and approved by the DRC and installed within 60 days from the date the home is ready for occupancy, weather permitting After completion of construction and landscape installation the Owner/ Builder can request DRC Final Approval and the return of the Security Deposits.
