He stated that the technical qualifications of the Commission and the staff are on file with the City of Frederick and are made a part of each and every case before the Commission. He also noted that the Frederick City Historic Preservation Commission uses the Guidelines adopted by the Mayor and Board of Aldermen and the Secretary of the Interior s Standards for Rehabilitation published by the U. S. Department of the Interior, National Park Service, and these Guidelines are made a part of each and every case. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. I. Public Hearing Swearing In Do you solemnly swear or affirm that the responses given and statements made in this hearing before the Historic Preservation Commission will be the whole truth and nothing but the truth? If so, answer I do. II. Announcements There were no announcements from staff or Commissioners. 1

2 III. Approval of Minutes 1. April 14, 2016 Hearing/Workshop Minutes Scott Winnette moved to approve the April 14, 2016 hearing and workshop minutes as written. IV. HPC Business 2. Certification of the 2015 Report on Historic Preservation Property Tax Credits & Recommendation to the Director of Finance Scott Winnette moved to certify the Historic Preservation Commission tax credit applications and forward them to the Director of Finance. Carrie Albee V. Consent Items There were no consent items on the agenda. VI. Continuances 3. HPC S. Carroll Street TGEC Land, LLC Applicant requests a continuance to the May 12, 2016 hearing Heather Clark, agent Scott Winnette moved to continue this case to the May 12, 2016 hearing. VII. Cases to be Heard 4. HPC W. Patrick Street Tori Offices, LLC Modify storefront J. Chris Benjamin, agent Dan Lawton moved to approve the application to replace damaged granite tiles with new granite tiles, repoint the front façade and at the rear of the building install new 2

3 low profile frame glass windows in the former opening with the new frameless glass doors as submitted and on the front façade to approve the design shown on Sheet A2.1 with the final modification that the two center columns be reduced in width remaining aligned with the columns above in order that the sidelights on both storefront doors become equally sized and although this is not a precise adherence to the Guidelines this minor deviation will not be contrary to the purpose and intent of the Frederick Town Historic District with the condition that repointing should be completed using hand tools only with mortar that matches the color composition, texture and tooling of the existing mortar and final color selection submitted for staff approval and revised drawings submitted to staff for final approval. 5. Patrick Street Mack Brothers LLC Replace shutters Andy Mackintosh, agent Dan Lawton stated that in our Guidelines on page 51 Section E, Number 1 it clearly stated that shutters are included as character defining wood features and in Number 2 of the same section and page all wood elements should be repaired so he moved that in regards to the building at 264 W. Patrick Street that those shutters be retained and repaired per the Guidelines because these particular shutters have a lot of original character and are good representatives of the historic fabric in the historic district and they are your run of the mill shutter because they have a lot of detail, extra beading and slightly unusual thickness and when he inspected them they did not seem to be too rotten to repair by any means. Vote: 7 0 Carrie Albee stated that particularly regarding the existing shutters at 262 W. Patrick Street and the request to remove and replace the historic shutters on the second story, she moved to deny the application on the grounds that it is not consistent with the Guidelines which states character defining wood features include shutters and as the Chairman noted the specific language regarding historic shutters, that all shutters that are compatible with Section 3, 4 and 5 below should be retained, repaired and preserved. Shutters that are partially deteriorated must be repaired by the selective replacement of deteriorated pieces instead of replaced as noted on page 72 and based on the information provided by the applicant to date she did not find compelling evidence that the existing shutters cannot be repaired. 4 Rebecca Cybularz moved to approve the demolition of a portion of the roof over the section of the Union Mills Manufacturing factory that was built in 1900 subject to approval and a permit application for the replacement plan. Patrick Street 141 West Patrick LLC Modify stoop Michael Simons moved to deny the application because the proposed work is not consistent with the Guidelines for masonry treatment and those for porches and stoops. Market Apartments Install parking area and fencing Bruce Zavos, agent Michael Simons moved to approve the scope of work including referenced products and materials as well as drawings A-35, A-36 and A-37 dated April 18, HPC North Pointe HAFC Redesign lots and Michael Moran, agent Vote: Carrie Albee moved to approve the application with the following conditions: The first floor windows on the front of all units either equal the height of the second floor windows or are taller than second floor windows. Revised scale drawings are submitted to staff for approval prior to applying for a permit. She also moved to approve the solar panels as presented. Stephen Parnes 6 1, Scott Winnette opposed 13. Church Street Robert & Ruth Cassidy Replace garage doors Vote: Rebecca Cybularz moved to approve the application for metal doors on this noncontributing garage finding that the integrity of the streetscape will not be compromised, the integrity of any surrounding historic properties will not be compromised and the design integrity of the resource itself will not be compromised also it is not contrary to the purpose and intent of the Frederick Town Historic District Design Guidelines. Patrick Street 18 West Patrick LLC Install night depository box John Gilfrich, agent Carrie Albee moved to deny the application because it would be inconsistent with the original storefront, would cause damage to the buildings character and because the Guidelines specifically note that plastic cabinet signs will not be approved.
