3 INVITATION FOR BID Sealed bids for at South Bedford Street Median Improvements will be received by DPW/Engineering, Town Hall, 25 Center Street, Burlington, Massachusetts, until 10:00A.M., September 10, 2014 and will be publicly opened and read aloud at such time. Specifications, bid forms and prevailing wage schedules are available on the Engineering website site at: under the DPW Department s Projects and Programs link. Specifications and bid forms may be obtained at the DPW/Engineering, 25 Center Street, Burlington, Massachusetts, for a nonrefundable $50.00 reproduction cost. A bid bond of five (5) percent is required. Payment and performance bonds of 100% shall be required. This project is bid according to MGL 30-39M. Prevailing wage shall be paid per MGL 149 SECT D. 3

4 INSTRUCTIONS TO BIDDERS 1. Receipt and Opening of Bids The Town of Burlington, Massachusetts, herein called the Owner, acting by and through its Department of Public Works, will receive sealed bids endorsed as at South Bedford Street Median Improvements. Such bids addressed to the DPW/Engineering, Town Hall Annex, 25 Center Street, Burlington, MA 01803, will be received at the Office of the Engineering Division as specified in the Invitation for Bids at which time and place said bids will be publicly opened and read aloud. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified will not be considered. The bidder agrees that this bid shall be good and may not be withdrawn for a period of thirty (30) days, Saturdays, Sundays, and legal holidays excluded, after opening the bids. 2. Location and Work to be Done The Work is defined in the Scope of Work. The Contractor shall furnish all labor, services, materials, equipment, plant, machinery, apparatus, appliances, tools, supplies, and all other things necessary to do all work required for the completion of each item of the Work and as herein specified. The Work to be done and paid for under any item shall not be limited to the exact extent mentioned or described but shall include all incidental work necessary or customarily done for the completion of that item. 3. Preparation of Bid Each bid must be submitted on the prescribed form. All blank spaces for bid prices must be filled in, in ink or typewritten, in both words and figures. Each bid must be submitted in a sealed envelope bearing on the outside the name and address of the bidder and endorsed with the name of the project as specified in Receipt and Opening of Bids. If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as specified in Receipt and Opening of Bids. 5 If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as specified in Receipt and Opening of Bids. 4. Bid Opening Procedure The following list of requirements shall apply to each filed bid. Bids not meeting all the requirements for timeliness and security will be rejected without opening; bids not meeting signature and addenda requirements will be rejected prior to checking of bid amounts. Bids shall be filed at the place and before the time specified in Receipt and Opening of Bids. Properly executed bid security shall be placed in a sealed envelope and shall be attached to the outside of the envelope containing the bid. Bid signatures will be checked. The total dollar amount of each bid will be read, and the three apparent lowest bids will be selected for further consideration. These three apparent low bids will be read aloud for the benefit of the other bidders and the bid opening procedure will be closed. All those present at the bid opening may arrange a time to examine all bids after the bid opening and after the reading of the three apparent low bids. 5. Ability and Experience of Bidder No award will be made to any bidder who cannot satisfy the Owner that he has sufficient ability and experience in this class of work and sufficient capital and plant to enable him to complete the work successfully within the time named. The Owner s decision or judgment on these matters will be final, conclusive, and binding. Bidder shall have a minimum of five (5) years experience and have completed satisfactorily five (5) jobs within that time of similar size and scope. All Subcontractors shall have a minimum of five (5) years experience and have completed satisfactorily five (5) jobs within that time of similar size and scope. The Contractor must submit with his bid proposal a list of five (5) jobs which he has successfully completed, giving the name and the address of these projects so they can be investigated prior to the award of the contract. The Owner may make such investigations as he deems necessary, and the bidder shall furnish to the Owner, under oath if so required, all such information and data for this purpose as the Owner may request. 6. Condition of Work 5

6 Each bidder must familiarize himself fully with the conditions relating to the construction of the project and the employment of labor thereon. Failure to do so will not relieve a successful bidder of his obligation to furnish all material and labor necessary to carry out the provisions of his Contract. Insofar as possible the Contractor, in carrying out his work, must employ such methods or means as will not cause any interruption of or interference with the work of any other Contractor. 7. Addenda and Interpretations No interpretation of the meaning of the plans, specifications or other pre-bid documents will be made to any bidder orally. All information given to bidders other than by means of the plans, specifications, or by addenda, as described below, is given informally and shall not be used as the basis of a claim against the Owner. Every request for such interpretation should be in writing addressed to the DPW/Engineering, Department of Public Works, Town Hall Annex, 25 Center Street, Burlington, MA and to be given consideration must be received at least seven (7) days prior to the date fixed for the opening of bids. Any and all such interpretations and any supplemental instructions will be in the form of written addenda to the Contract Documents which, when issued, will be mailed by certified mail with return receipt requested to all prospective bidders (at the respective address furnished by them for such purposes), no later than five (5) days prior to the date fixed for the opening of bids. Failure of any bidder to receive any such addendum or interpretation shall not relieve such bidder from any obligation under this bid as submitted. All addenda so issued shall become part of the Contract Documents. 8. Laws and Regulations The bidder s attention is directed to the fact that all applicable State laws, municipal ordinances, and the rules and regulation of all authorities having jurisdiction over construction of the project shall apply to the Contract throughout, and they will be deemed to be included in the Contract the same as though herein written out in full. 9. Information Not Guaranteed All information given in the Contract Documents relating to subsurface and other conditions, natural phenomena, existing pipes, and other structures is from the best sources at present available to the Owner. All such information is furnished only for the information and convenience of bidders and is not guaranteed. It is agreed and understood that the Owner does not warrant or guarantee that the subsurface or other conditions, natural phenomena, existing pipes, or other structures encountered during construction will be the same as those indicated in the Contract Documents. If is further agreed and understood that no bidder or Contractor shall use or be entitled to use any of the information made available to him or obtained in any examination made by him in any 6

7 manner as a basis of or ground for any claim or demand against the Owner or the Engineer, arising from or by reason of any variance which may exist between the information made available and the actual subsurface or other structures actually encountered during the construction work, except as may otherwise be expressly provided for in the Contract Documents. 10. Bid Security Each bid must be accompanied by a BID BOND, CASH, or, CERTIFIED CHECK, payable to the Town, in the amount stated in INVITATION TO BID. Such checks will be returned to all except the three (3) lowest responsible and eligible bidders within five (5) days, Saturday, Sundays, and legal holidays excluded, after the opening of bids, and the remaining checks will be returned promptly after the Owner and the accepted bidder have executed the Contract, or if no notice of intent to award has been presented to the selected contractor within thirty (30) days, Saturdays, Sundays and holidays excluded, after the date of the opening of bids, upon demand of the bidder at any time thereafter. The said amount is fixed and agreed upon by and between the Contractor and the Owner because of the impracticability and extreme difficulty of fixing and ascertaining the actual damages the Owner would in such event sustain, and said amount is agreed to be the amount of damages which the Owner would sustain and said amount shall be retained from time to time by the Owner from current periodical estimates. 11. Right to Reject Bid The Owner reserves the right to waive any informality or reject any and all bids and alternate bids, should the Owner deem it to be in the public interest to do so. The Owner also reserves the right to reject the bid of any bidder that the Owner considers to be unqualified based on the criteria set forth in Article 5 herein. 12. Time for Completion The bidder shall agree to commence work and to fully complete the project within the time limit stated in SPECIAL CONDITIONS. 13. Comparison of Bids In the event that there is a discrepancy in FORM OF GENERAL BID between the lump sum or unit prices written in words and figures, the prices written in words will govern. 14. Rule for Award of Contract The Contract will be awarded to the lowest responsible and eligible bidder for the Total Price Bid pursuant to General Laws Chapter 30, Section 39M, as amended. Such a bidder shall possess the skill ability and integrity necessary for the faithful performance of the work, shall be 7

8 able to furnish labor that can work in harmony with all other elements of labor employed, or to be employed, in the work, and shall otherwise comply with all applicable provisions of law. Bidder shall execute formal agreement within ten (10) days of the Notice of Award. 15. Statutes Regulating Competitive Bidding Any bid that does not comply with the provisions of Massachusetts General Laws Chapter 30, Section 39M as amended, need not be accepted and the Owner may reject every such bid. 16. Wage Rates Prevailing Wage Rates as determined by the Commissioner of Department of Labor and Industries under the provision of the Massachusetts General Laws, Chapter 149, Section 26 to 27G, as amended, apply to this project. It is the responsibility of the contractor, before bid opening to request if necessary, any additional information on Prevailing Wage Rates for those trades people who may be employed for the proposed work under this contract. 17. Specifications All specifications and bid items shall reference and comply with Massachusetts Highway Departments Standard Specifications for Highway & Bridges latest revised edition unless otherwise noted. 18. Bid Items Not Guaranteed The successful bidder is not guaranteed all items or the total bid price under this contract. Bidders must understand that like items will be bid under other contracts specifically packaged as one complete project. The successful bidder has no right to similar items bid under other projects. The Town Engineer will specify where and when this contract will be applied to undertake a particular improvement 8

13 CONTRACTOR CERTIFICATION NONCOLLUSION I certify under penalties of perjury that this bid or proposal has been made and submitted under good faith and without collusion or fraud with any other person. 15 SPECIAL CONDITIONS 1. All work under this contract must comply with the most recent edition of the Town of Burlington Department of Public Works; Street Opening/Utility Connection Rules & Regulations. 2. Prior to the commencement of any work the Contractor will obtain a Street Opening permit from the DPW/Engineering Division. 3. At the end of each week the Contractor shall submit an itemized summary/quantities of items per street completed during the week. These quantities will be reviewed with the Engineer before the end of the day on Friday. 4. All certified payroll slips must be submitted as part of the pay requisition package for each individual pay requisition request, for each contractor and sub-contractor that has performed work under this contract, up to date of the current pay requisition before the pay requisition will be processed and paid. 5. The commencement date for the contract work shall be on or before October 6, 2014 and be substantially complete by November 20,2014 forty five (45) calendar days. No lane closures or traffic disruption will be allowed after November 20, The Contractor shall have a designated Project Manager, or a designated Foreman, in the field at all times while work is taking place. The Project Manager or designated Foreman shall have the authority to agree on quantities and items with the Engineer and have all decision making ability on behalf of the Contractor. This person shall also be responsible for the location/re-location of all traffic signs and traffic barrels as specified in the Traffic Management Plan or as directed by the Engineer. 7. The cost of the Police Detail Officer(s) will be paid for by the Town of Burlington. The responsibility to arrange the appropriate amount of Police Detail Officer(s) is the responsibility of the Contractor. The quantity will be determined by the Engineer and/or Town of Burlington Police Department. The contractor is responsible to arrange the Police Detail Officer(s) the night before the Officer(s) are needed and also responsible for the appropriate cancellation of the Officer(s) if the need should arise. The Town of Burlington Police Department requires two (2) hour notice for proper cancellation of a detail. Failure of the contractor to cancel the Officer(s) in the appropriate time will cause the Owner to back charge the Contractor for the charges incurred for each Officer(s). 8. Traffic Management under this contract must be considered at all times meaning the following points apply: 15

16 Two (2) way traffic must be maintained at all times. Contractor shall supply adequate cones, barrels etc. to adequately channelize traffic through the project site. Complete compliance with the Traffic Management Plan standards set forth in the Town of Burlington Department of Public Works Street Opening/Utility Connections Rules & Regulations Detours not included as part of the Traffic Management Plan will be allowed only upon written authorization from the Owner. The Contractor is responsible for supplying all necessary sign(s) and traffic barrels for the detour. 9. Curb line on sidewalk through Delta Island slightly different from that depicted on contract drawings. Contractor will need to field adjust paver layout to work with the revised curb line. 10. Approximately 180 SF of Unit Paver A will be installed on the median on the north-east side of the intersection. This median is not depicted on the contract drawings, although photograph with dimensions is provided in the appendix. 11. 17 GENERAL CONDITIONS ARTICLE 1 CONTRACT DOCUMENTS 1.1 DEFINITIONS THE CONTRACT DOCUMENTS The Contract Documents consist of the Owner-Contractor Agreement, the Conditions of the Contract (General, and other Conditions), the Drawings, the Specifications, all Addenda issued prior to and all Change Orders issued after execution of the Contract, and all applicable laws, ordinances and regulations. The Contract Documents include Bidding Documents such as the Advertisement or Invitation to Bid, the Instructions to Bidders, sample forms, the Contractor s Bid or portions of Addenda relating to any of these, or any other documents, specifically enumerated in the Owner-Contractor Agreement THE CONTRACT The Contract Documents form the Contract for Construction. This Contract represents the entire and integrated agreement between the parties hereto and supersedes all prior negotiations, representations, or agreements, either written or oral. The Contract may be amended or modified only by a written Change Order THE WORK The Work comprises the completed construction required by the Contract Documents and includes all labor necessary to produce such construction, and all materials and equipment incorporated in such construction THE PROJECT The project is the total construction of which the Work performed under the Contract Documents may be the whole or a part OR EQUAL The use of the words Or Equal following the name of any manufacturer, vendor or proprietary product shall be understood to mean that articles or materials may be substituted which, in the opinion of the Owner, are equal in quality, durability, appearance, strength, design and performance to the articles or materials named or described and will perform adequately in providing a first-class facility. When submitting shop drawing information on articles or materials which are being proposed as substitutes for specified items, the Contractor shall clearly identify them as such. If the articles or materials are accepted as equal to those on which dimensions on the drawings are based, any dimensional variance from those shown and/or specified shall be shown on the shop drawings prepared by the Contractor, illustrating the manner in which conformity to dimensions and design is to be obtained. All such drawings shall be subject to the approval of the Owner and the installation of the article shall not proceed without first obtaining said approval. 1.2 EXECUTION, CORRELATION AND INTENT By executing the Contract, the Contractor represents that he has visited the site, familiarized himself with the local conditions under which the Work is to be performed, and correlated his observations with the requirements of the Contract Documents The intent of the Contract Documents is to include all items necessary for the proper execution and completion of the Work. The Contract Documents are complementary, and what is required by any one shall be as binding as if required by all. Work not covered in the Contract Documents will not be required unless it is consistent therewith and is reasonably inferable there from as being necessary to produce the intended results. Words and abbreviations 17

18 which have well-known technical or trade meanings are used in the Contract Documents in accordance which such recognized meanings The Notice to Proceed will come in the form of a written letter to the Contractor. Once the written Notice to Proceed has been received by the Contractor, that date will be legal start date for work under the Contract. In the event of a failure to issue a Notice to Proceed written document specifying the commencement date, the preconstruction meeting date will serve as the Notice to Proceed date. 1.3 OWNERSHIP AND USE OF DOCUMENTS All Drawings, Specifications and copies thereof furnished by the Owner are and shall remain the Owner s property. They are to be used only with respect to this Project and are not to be used on any other project without prior written consent of the Owner. With the exception of one contract set for each party to the Contract, such documents are to be returned or suitably accounted for to the Owner at the completion of the Work. Submission or distribution to meet official regulatory requirements or for other purposes in connection with the Project is not to be construed as publication in derogation of any reserved rights. 18

19 ARTICLE 2 ADMINISTRATION 2.1 ADMINISTRATION OF THE CONTRACT The designated representative of the Owner or its Engineer will visit the site at intervals appropriate to the stage of construction to familiarize himself generally with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Contract Documents. However, the Owner s Representative or Engineer will not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work The Owner shall at all times have access to the Work whenever it is in preparation and progress. The Contractor shall provide facilities for such access so the Owner may perform its functions under the Contract Documents Based on the Owner s observations and an elevation of the Contractor s Applications for Payment, the Owner will determine the amounts owing to the Contractor and will issue Certificates for Payment in such amounts, approved by the Town Engineer The Owner will render information necessary for the proper execution or progress of the Work within twenty (20) days of any request by the contractor or in accordance with any time limit agreed upon The Owner will have authority to reject Work which does not conform to the Contract Documents. Whenever, in his opinion, he considers it necessary or advisable for the implementation of the intent of the Contract Documents, he will have authority to require special inspection or testing of the Work whether or not such Work is then fabricated, installed or completed. Any such rejection of work shall not relieve the Contractor of the responsibility for maintaining protection of the Work and the Owner s property The Owner or its Engineer will review and approve or take other appropriate action upon Contractor s submittals such as Shop Drawings, Product Data and Samples, but only for conformance with the design concept of the Work and with the information given in the Contract Documents. Such action shall be taken with reasonable promptness so as to cause no delay. The Owner s approval of a specific item shall not indicate approval of an assembly of which the item is a component The Owner will conduct inspections to determine the date of Substantial Completion and Final Completion, will review written warranties and related documents required by the Contract and assembled by the Contractor, and will issue a final Certificate for Payment. 19

20 ARTICLE 3 OWNER 3.1 DEFINITION The Owner is the person or entity identified as such in the Owner-Contractor Agreement and is referred to throughout the Contract Documents as if singular in number and masculine in gender. The term Owner means the Owner or his authorized representative, which for this Project shall be the Town Engineer The Engineer for the Project shall be the Town of Burlington Engineering Division. 3.2 INFORMATION AND SERVICES REQUIRED OF THE OWNER The Owner shall, at the time of execution of the Agreement and any subsequent Change Orders, certify for the Contractor that financial arrangements have been made to fulfill the Owner s obligations under the Contract The Owner shall furnish all documents describing the work Except as provided in Subparagraph Owner shall secure and pay for necessary approvals, easements, assessments and charges required for the construction, use or occupancy of permanent structures or for permanent changes in existing facilities Information or services under the Owner s control shall be furnished by the Owner with reasonable promptness to avoid delay in the orderly progress of the Work The Owner will furnish the Contractor with three (3) copies of all Drawings and Specifications and revisions issued during the progress of the Work; all additional copies will be furnished upon request at the cost of reproduction The Owner, through its designated agent or Engineer, shall forward all instructions directly to the Contractor. 3.3 OWNER S RIGHT TO STOP THE WORK If the Contractor fails to correct defective Work as required by the Owner or fails to carry out the Work in accordance with the Contract Documents or if the Owner shall for any other reason so require, the Owner, by a written order signed personally or by an agent specifically so empowered by the Owner in writing, may order the Contractor to stop the Work, or any portion thereof, until the cause for such order has been eliminated or until further written notice from the Owner; however, this right of the Owner to stop the Work shall not give rise to any duty on the part of the Owner to exercise this right for the benefit of the Contractor or any other person or entity. The Contractor shall resume the Work after such stoppage promptly upon written notice to do so from the Owner. If 20

21 such stoppage is required through no fault of the Contractor, the Contract Time (and the dates for achieving Substantial Completion and Final Completion) shall be extended by a period equal to the period of the stoppage, and the Contractor shall be compensated for its reasonable and justifiable cost incurred as a result of such stoppage. 3.4 OWNER S RIGHT TO CARRY OUT THE WORK If the Contractor defaults or neglects to carry out the Work in accordance with the Contract Documents and fails within seven days after receipt of written notice from the Owner to commence and continue correction of such default or neglect with diligence and promptness, the Owner may, without prejudice to any other remedy he may have, perform such work or cause such work to be performed and/or make good such deficiencies. In such case an appropriate Change Order shall be issued deducting from the payments then or thereafter due the Contractor the cost of correcting such deficiencies, including compensation for additional services made necessary by such default, neglect or failure. If the payments then or thereafter due the Contractor are not sufficient to cover the amount, the Contractor shall pay the difference to the Owner. 3.5 OWNER S RIGHT TO TERMINATE CONTRACT The Town reserves the right to terminate this Contract at their discretion with thirty (30) with written notice to the contractor. In the event of Contract termination, all finished or unfinished work, or un-used material, already paid for under Contract prices, shall become the property of the Town of Burlington. 21

22 ARTICLE 4 CONTRACTOR 4.1 DEFINITION The Contractor is the person or entity identified as such in the Owner-Contractor Agreement and is referred to throughout the Contract Documents as if singular in number and masculine in gender. The term Contractor means the Contractor or his authorized representative. 4.2 REVIEW OF CONTRACT DOCUMENTS The Contractor shall carefully study and compare the Contract Documents and shall at once report to the Owner any error, inconsistency or omission he may discover. The Contractor shall not be liable to the Owner for any damage resulting from errors, inconsistencies or omissions in the Contract Documents which he discovers but shall be liable for damage to the extent he reasonably should have but failed to discover such errors, inconsistencies or omissions. The Contractor shall perform no portion of the Work at any time without Contract Documents or, where required, approved Shop Drawings, Product Data or Samples for such portion of the Work. 4.3 SUPERVISION AND CONSTRUCTION PROCEDURES The Contractor shall supervise and direct the Work, using his best skill and attention which shall not be less than such state of skill and attention generally rendered by the contracting profession for projects similar to the Project in scope, difficulty and location. The Contractor shall maintain adequate supervisory personnel at the Site during the performance of the Work. He shall be solely responsible for all construction means, methods, techniques, sequences and procedures and for coordinating all portions of the Work under the Contract The Contractor shall be responsible to the Owner for the acts and omissions of his employees, Subcontractors and their agents and employees, and other persons performing any of the Work under a contract with the Contractor. This obligation shall also extend to the presence on the Site of suppliers of materials or equipment, their employees, contractors, and agents engaged in the work The Contractor shall not be relieved from his obligations to perform the Work in accordance with the Contract Documents either by the activities or duties of the Owner in its administration of the Contract. 4.4 LABOR AND MATERIALS Unless otherwise provided in the Contract Documents, the Contractor shall provide and pay for all labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation, and other facilities and service necessary for the proper execution and completion of the Work, whether temporary or permanent and whether or not incorporated or to be incorporated in the Work The Contractor shall at all times enforce strict discipline and good order among his employees and shall not employ on the Work any unfit person or anyone not skilled in the task assigned to him including all persons on the Site controlled directly or indirectly by the Contractor. 22

23 4.5 WARRANTY The Contractor warrants to the Owner that all materials and equipment furnished under this Contract will be new and of recent manufacture unless otherwise permitted in writing by the Owner and that all Work will be of good quality, free from faults and defects and in conformance with the Contract Documents. All Work not conforming to these requirements, including substitutions not properly approved and authorized, may be considered defective and, promptly after written notification of non-conformance, shall be repaired or replaced by the Contractor with Work conforming to such requirements. If required by the Owner, the Contractor shall furnish satisfactory evidence as to the kind and quality of materials and equipment. 4.6 TAXES The Contractor shall pay all applicable sales, consumer, use and other similar taxes for the Work or portion thereof provided by the Contractor which are legally enacted at the time bids are received, whether or not yet effective. 4.7 PERMITS, FEES AND NOTICES Unless otherwise expressly provided in the SPECIAL CONDITIONS, the Contractor shall secure and pay for all permits and fees, licenses and inspections necessary for the proper execution and completion of the Work which are customarily secured after execution of the Contract and which are legally required at the time the bids are received, and the same shall at all times be the property of the Owner and shall be delivered to the Owner upon completion of the Project The Contractor shall give all notices and comply with all federal, state and local laws, ordinances, rules, regulations and lawful orders of any public authority bearing on the performance of the Work. The Contractor shall provide the Owner with reproductions of all permits, licenses and receipts for any fees paid. The Owner represents that it has disclosed to the Contractor all orders and requirements known to the Owner of any public authority particular to this Contract If the Contractor observes that any of the Contract Documents are at variance with applicable laws, statutes, codes and regulations in any respect, he shall promptly notify the Owner in writing, and any necessary changes shall be accomplished by appropriate Modification If the Contractor performs any Work which he knows or should know is contrary to such laws, ordinances, rules and regulations, and without such notice to the Owner, he shall assume full responsibility therefore and shall bear all costs attributable thereto. 4.8 SUPERINTENDENT The Contractor shall employ a competent superintendent and necessary assistants who shall be in attendance at the Project site at all times during the progress of the Work. The superintendent shall represent the Contractor and all communications given to the superintendent shall be as binding as if given to the Contractor. Important communications shall be confirmed in writing. Other communications shall be so confirmed on written request in each case. 23

24 4.9 PROGRESS SCHEDULE The Contractor, immediately after being awarded the Contract, shall prepare and submit for the Owner s information an estimated progress schedule for the Work. The progress schedule shall be related to the entire Project to the extent required by the Contract Documents, and shall provide for expeditious and practicable execution of the Work. No work shall start without the Project schedule. The Contractor shall submit the project schedule five days prior to start the work DOCUMENTS AND SAMPLES AT THE SITE The Contractor shall maintain at the site for the Owner one record copy of all Drawings, Specifications, Addenda, Change Orders and other Modifications, and As-Built Drawings and Specifications in good order and marked currently to record all changes made during construction, and approved Shop Drawings, Product Data and Samples. These shall be available to the Owner upon completion of the Work SHOP DRAWINGS, PRODUCT DATA AND SAMPLES Shop Drawings are drawings, diagrams, schedules and other data specially prepared for the Work by the Contractor or any Subcontractor, manufacturer, supplier or distributor to illustrate some portion of the Work Product Data are illustrations, standard schedules, performance charts, instructions, brochures, diagrams and other information furnished by the Contractor to illustrate a material, product or system for some portion of the Work Samples are physical examples which illustrate materials, equipment or workmanship and establish standards by which the Work will be judged The Contractor shall review, approve and submit, with reasonable promptness and in such sequence as to cause no delay in the Work or in the work of the Owner or any separate contractor, all Shop Drawings, Product Data and Samples required by the Contract Documents By approving and submitting Shop Drawings, Product Data and Samples, the Contractor represents that he has determined and verified all material, field measurements, and field construction criteria related thereto, or will do so, and that he has checked and coordinated the information contained within such submittals with the requirements of the Work and of the Contract Documents The Contract shall not be relieved of responsibility for any deviation from the requirements or the Contract Documents by the Owner s approval of Shop Drawings, Product Data or Samples or the Engineer s approval of the same unless the Contractor has specifically informed the Owner or Engineer in writing of such deviation at the time of submission and the Owner or Engineer has given written approval to the specific deviation. The Contract shall not be relieved from responsibility from errors or omissions in the Shop Drawings, Product Data or Samples by the Owner s approval thereof. 24

25 The Contractor shall direct specific attention, in writing or on resubmitted Shop Drawings, Product Data or Samples, to revisions other than those requested by the Owner or its Engineer on previous submittals No portion of the Work requiring submission of a Shop Drawing, Product Data or Sample shall be commenced until the submittal has been approved by the Owner or Engineer. All such portions of the Work shall be in accordance with approved submittals USE OF SITE The Contractor shall confine operations at the site to areas permitted by law, ordinances, permits and the Contract Documents and shall not unreasonably encumber the site with any materials or equipment CUTTING AND PATCHING OF WORK The Contractor shall be responsible for all cutting, fitting or patching that may be required to complete the Work or to make its several parts fit together properly The Contractor shall not damage or endanger any portion of the Work or the work of the Owner or any separate contractors by cutting, patching or otherwise altering any work or by excavation. The Contractor shall not cut or otherwise alter the work of the Owner or any separate contractor except with the written consent of the Owner and of such separate contractor. The Contractor shall not unreasonably withhold from the Owner or any separate contractor his consent to cutting or otherwise altering the Work CLEANING UP The Contractor at all times shall keep the premises free from accumulation of waste materials or rubbish caused by his operations. At the completion of the Work he shall remove all his waste materials and rubbish from and about the Project in full compliance with all applicable laws and regulations as well as all his tools, construction equipment, machinery and surplus materials and the Project shall be thoroughly cleaned and ready for immediate occupancy by the Owner If the Contractor fails to clean up at the completion of the Work, the Owner may do so as provided in Paragraph 3.4 and the cost thereof shall be charged to the Contractor COMMUNICATIONS The Contract shall forward all communications to the Owner through its Town Engineer, Town Hall Annex, 25 Center Street, Burlington, MA The Contractor shall at all times have a designated representative in the field that is authorized to act on behalf and make decisions for the Contractor under this contract agreement ROYALTIES AND PATENTS

26 The Contractor shall pay all royalties and license fees. He shall defend all suits or claims for infringement of any patent rights and shall save the Owner harmless from loss on account thereof, except that the Owner shall be responsible for all such loss when a particular design, process or the product of a particular manufacturer or manufacturers is specified, but if the Contractor believes or has reason to believe that the design, process or product specified is an infringement of a patent, he shall be responsible for such loss unless he promptly gives such information to the Owner, and thereafter the Owner insists on the use of the design, process or products specified INDEMNIFICATION To the fullest extent permitted by law, the Contractor shall indemnify and hold harmless the Owner, the Engineer and their agents and employees from and against all claims, damages, losses and expenses, including but not limited to attorney s fees, arising out of or resulting from the performance of the Work, provided that any such claim, damage, loss or expense (1) is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property (other than the Work itself) including the loss of use resulting there from, and (2) is caused in whole or in part by any negligent act or omission of the Contractor, any Subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, regardless of whether or not it is caused in part by a party indemnified there under. Such obligation shall not be construed to negate, abridge, or otherwise reduce any other right or of indemnity which would otherwise exist as to any party or person described in this Paragraph In any and all claims against the Owner the Engineer or any of their agents or employees by any employee of the Contractor, any Subcontractor anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, the indemnification obligation under this Paragraph 4.17 shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for the Contractor or any Subcontractor under workers or workmen s compensation acts, disability benefit acts or other employee benefit acts The obligations of the Contractor under this paragraph 4.17 shall not extend to the liability of the Owner, the Engineer, their agents or employees, arising out of (1) the preparation or approval of maps, drawings, opinions, reports, surveys, change orders, designs or specifications, or (2) written directions or instructions given by the Owner, the Engineer, their agents or employees, provided they are the sole cause of the injury or damage. 26

28 ARTICLE 6 LIQUDATED DAMAGES 6.1 LIQUDATED DAMAGES If the Contractor shall neglect, fail or refuse to complete the work within the time herein specified, or any proper extension thereof granted by the Owner, then the Contractor does hereby agree, as a part consideration for the awarding of this Contract, to pay to Owner the amount of $ per day, not as a penalty but as liquidated damages for such breach of Contract as hereinafter set forth, for each and every calendar day that the Contract shall be in default after the time stipulated in the Contract for completing the work. 28

29 SCOPE OF WORK The work under this Contract consists of the installation of concrete pavers and other incidental work in the median and delta islands at the intersection of Mall Road at South Bedford Street, in Burlington, Ma. All work done under this contract shall be in conformance with the Massachusetts Highway Department Standard Specifications for Highways and Bridges dated 1988, the Supplemental Specifications dated June 15, 2012, the Interim Supplemental Specifications dated June 14, 2013; the 2012 Construction Standard Details, the 1996 Construction and Traffic Standard Details (as relates to traffic standard details only); the current Manual on Uniform Traffic Control Devices with Massachusetts Amendments; the 1968 Standard Drawings for Traffic Signals and Highway Lighting; the latest edition of American Standard for Nursery Stock; the Plans and these Special Provisions. The General Conditions, Supplementary Conditions and Special Provisions shall take precedence over the General Requirements of Division I of the Standard Specifications. WORK SCHEDULE Working days are Monday through Friday from 7:00 A.M. to 5:00 P.M. Any work outside of these hours must be pre-approved by the Director of Public Works. PROTECTION OF UNDERGROUND FACILITIES The Contractor's attention is directed to the necessity of making his own investigation in order to assure that no damage to existing structures, drainage lines, traffic signal conduits, etcetera, will occur. The Contractor shall notify Massachusetts DIG SAFE and procure a Dig Safe Number for each location prior to disturbing existing ground in any way. The telephone number of the Dig Safe Call Center is DISPOSAL OF EXCESS MATERIAL Surplus materials obtained from any type of excavation, and all existing and other materials not required to be removed and stacked or needed for use on the project, as determined by the Engineer, shall become the property of the Contractor and disposed of subject to the regulations and requirements of local authorities governing the disposal of such materials, at no additional compensation. PUBLIC SAFETY AND CONVENIENCE The Contractor shall provide necessary access for fire apparatus and other emergency vehicles through the work zones to abutting properties at all times. Sweeping and cleaning of surfaces beyond the limits of the project required to clean up material caused by spillage or vehicular tracking during the various phases of the work shall be considered as incidental to the work being performed under the Contract and there will be no additional compensation. NOTICE TO OWNERS OF UTILITIES Written notice shall be given by the Contractor to all public service corporations or municipal and State officials owning or having charge of publicly or privately owned utilities at least one week in advance of the commencement of operations that will affect the utilities. The Contractor shall, at the same time, file a copy of such notice with the Engineer. 29

30 Before commencing work on service connections, the Contractor shall be responsible for contacting the Electric Company servicing the area to obtain construction requirements, standards, and to give adequate notice of commencement of work. "DIG-SAFE" Call Center: Telephone PROTECTION OF UTILITIES AND PROPERTY The Contractor, in constructing or installing facilities alongside or near sewers, drains, water or gas pipes, electric or telephone conduits, poles, sidewalks, walls, vaults or other structures shall sustain them securely in place. The Contractor shall coordinate with the officers and agents of the various utility companies and municipal departments to assure that the services of these structures are maintained. The Contractor shall also be responsible for the repair or replacement, at no additional cost to the Owner (Department), of any damage to such structures caused by construction operations. The Contractor is responsible to leave them in the same condition as they existed prior to commencement of the work. In case of damage to utilities, the Contractor shall promptly notify the utility owner and shall, if requested by the Engineer, furnish labor and equipment to work temporarily under the utility owner's direction. Pipes or other structures damaged by the operation of the Contractor may be repaired by the Department or by the utility owner which suffers the loss. The cost of such repairs shall be borne by the Contractor, without compensation therefor. If during construction there is an existing utility and/ or structure found to be in conflict with the proposed work under this Contract, the Contractor shall protect and maintain the services to the utilities and structures. The Engineer will, as soon as possible identify the utilities to be relocated or other such activities deemed suitable for resolution. If live service connections are to be interrupted by excavations of any kind, the Contractor shall not break the service until new services are provided. Abandoned services shall be plugged off or otherwise made secure. 32

33 Full compensation for furnishing all labor, materials, tools, equipment and incidentals for doing all the work involved in protecting or repairing property as specified in this Section, shall be considered included in the prices paid for the various Contract items of work and no additional compensation will be allowed therefor. WORK DONE BY OTHERS Relocation and/or resetting to new grades of all private utilities, including utility poles, made necessary by the construction of this project, will be accomplished by the respective utility companies. MATERIAL REMOVED AND STACKED The Contractor shall carefully remove, transport and stack all material that, in the opinion of the Engineer, is salvageable. The material shall be stacked at Town of Burlington Department of Public Works, One Great Meadow Road, Burlington. The Contractor shall coordinate with the Town of Burlington to schedule drop-off time and location. 33

34 ITEM Concrete Unit Pavers Type A SQUARE FOOT ITEM Concrete Unit Pavers Type B SQUARE FOOT The work under these items shall conform to the relevant provisions of Section 701 of the Standard Specifications and the following: These Items are for the construction of precast concrete unit paver pavements at the locations shown on the plans including, preparation of the base course, setting bed as detailed, furnishing and installing the precast concrete unit pavers and any additional work identified in this Special Provision. Submittals: The Contractor shall make the following Submittals, and shall not order any material until the Submittals are approved. Submittals shall include: MANUFACTURER'S PRODUCT DATA shall be submitted for the following items: Precast Concrete Unit Pavers. Sand for setting bed Polymeric Sand for joint filler Job mix formula for bituminous setting bed. Neoprene-modified asphalt adhesive Metal Edge Restraints Filter Fabric Test Reports: Test report of precast concrete unit pavers shall be submitted. Testing shall be done by an independent testing laboratory. Test procedures shall conform to ASTM C 67 methods, where applicable. All tests reports shall indicate, as a minimum, the following: Compressive strength, psi. Absorption, 5 hour submersion in cold water. Absorption, 24 hour submersion in cold water. Maximum saturation coefficient Initial rate of absorption (suction). Abrasion index. Freeze-thaw Efflorescence. SAMPLES: Precast Concrete Unit Pavers: Furnish not less than ten individual full sized precast concrete unit pavers of each size, type, and color as samples, showing the full range of variations expected in these characteristics. 35 MOCKUPS: Before installing pavers, Contractor shall construct 5 foot by 5 foot mock-up indicating each installation method and each paving pattern of unit pavers, to verify selections made under sample Submittals and to demonstrate aesthetic effects and qualities of materials and execution. Build mockups using all materials indicated for the completed Work, including full depth base courses and setting beds, edging, jointing materials. Build mockups in the location directed by the Engineer. The Contractor shall schedule mock-up panel construction so that the Engineer can review the sample a minimum of 30 days prior to installation of paving surfaces. Notify Engineer seven days in advance of dates and times when mockups will be constructed. Additional sample panels shall be required until panel is accepted by the Engineer. Final construction shall match approved samples. Mock-ups shall remain in place and be protected to serve as a reference standard for the work of unit paver paving until the completion of the paving. Do not proceed with paving until samples are reviewed and approved by Engineer. Demolish and remove mockups after final pavements have been installed and approved. Approved mockups may become part of the completed Work if authorized and approved by the Engineer. QUALITY ASSURANCE INSTALLER QUALIFICATIONS: An experienced installer who has completed unit paver installations similar in material, design, and whose work has resulted in construction with a record of successful in-service performance. SOURCE LIMITATIONS: Obtain each type of unit paver, joint material, and setting material from one source with resources to provide materials and products of consistent quality in appearance and physical properties. DELIVERY, STORAGE AND HANDLING: Protect unit pavers and aggregate during storage and construction against soiling or contamination from earth and other materials. Cover pavers with plastic or use other packaging materials that will prevent rust marks from steel strapping. MANUFACTURER: All manufacturers shall have a minimum of five (5) years in producing precast concrete unit pavers. Manufacturer shall submit a list at least three (3) sites within a one hundred (100) mile radius of where their product has been installed and has been in use for minimum of one (1) year. Weather Restrictions: Do not use frozen materials or materials mixed or coated with ice or frost. Do not build on frozen subgrade or setting beds. Remove and replace unit paver work damaged by frost or freezing. WEATHER LIMITATIONS FOR BITUMINOUS SETTING BED: Apply asphalt adhesive when ambient temperature is above 50 deg F and when temperature has not been below 35 deg F for 12 hours immediately before application. Do not apply when base is wet or contains excess moisture. Install bituminous setting bed only when atmospheric temperature is above 40 deg F and when base is dry. DELIVERY, STORAGE, AND HANDLING Precast Concrete Unit Pavers shall be carefully packed by the supplier for shipment. Pavers shall be stored off the ground and protected against staining and other damage. 35

36 Pavers damaged in any manner will be rejected and replaced with new material at no additional cost to the Owner. PROTECTION Finished surfaces adjacent to the precast concrete unit paving work shall be adequately protected from soiling, staining, and other damage during construction. MATERIALS PRECAST CONCRETE UNIT PAVERS: Precast Concrete Unit Paver-TYPE A/B shall be: Ideal Pavers, Boston Colonial Pavers Belgard, Holland Stone Techo-Bloc, Victorien or approved equal. The pavers shall meet or exceed North American industry standards, including the requirements of ASTM Specifications C for Solid Concrete Interlocking Paving Stones and C-979 Specification for Pigments for Integrally Colored Concrete. Size: Size shall be 4 inches by 8 inches by 2 3/8 inch thick Paver shall have a Natural Finish. Color: Red Test Properties: Compressive Strength 8500 psi minimum Water Absorption: 5% maximum POLYMERIC SAND FOR JOINTS: Joint filler material shall be a polymer-sand blend which does not re-soften when wet. Product shall not contain Portland cement. Provide PolySweep, by SEK Industries, or approved equal. Color shall be as selected by the Engineer from the manufacturer s standard color range. SAND SETTING-BED MATERIALS: Bedding Sand shall be clean, non-plastic, and free from deleterious or foreign matter. The sand shall be natural or manufactured from crushed rock. Grading of samples shall be done according to ASTM C136. The particles shall be sharp and conform to the grading requirements of ASTM C33 as shown below: Grading Requirements for Bedding Sand Sieve Size Percent Passing 36

37 3/8 in 100 No to 100 No to 100 No to 85 No to 60 No to 30 No to 10 BITUMINOUS SETTING-BED MATERIALS: BITUMINOUS SETTING BED: FINE AGGREGATE FOR SETTING BED: Fine aggregate to be used in the asphalt setting bed shall be clean, hard sand with durable particles and free from adherent coating, lumps of clay, alkali salts, and organic matter. Aggregate shall be uniformly graded from "coarse" to "fine" with 100 percent by weight passing the No. 4 sieve and shall meet the gradation requirements when tested in accordance with ASTM C 136. ASPHALT CEMENT: Asphalt cement to be used in the asphalt setting bed shall conform to ASTM D Viscosity grade shall be A.C. 10 or A.C. 20. BITUMINOUS SETTING-BED MIX: Mix bituminous setting-bed materials at an asphalt plant in approximate proportion, by weight, of 7 percent asphalt cement to 93 percent fine aggregate, unless otherwise indicated. Fine aggregate shall be dried and shall be combined with hot asphalt cement, and the mix shall be heated to approximately 300 degrees Fahrenheit at an asphalt plant. Each ton of material shall be apportioned by weight in the approximate ratio of 145 pounds asphalt to 1,855 pounds sand. The Contractor shall determine the exact proportions to produce the best possible mixture for construction of the asphalt setting bed to meet specified requirements. PRIMER FOR BASE: ASTM D 2028, cutback asphalt, grade as recommended by unit paver manufacturer. ASPHALT TACK COAT (NEOPRENE-MODIFIED ASPHALT ADHESIVE): Paving manufacturer's standard adhesive consisting of oxidized asphalt combined with 2 percent neoprene and 10 percent long-fibered mineral fibers containing no asbestos. BASE COURSE MATERIALS: DENSE GRADED CRUSHED STONE: Shall be in conformance with Section 402 of the Standard Specifications. CONCRETE BASE SLABS: Cast-in-place concrete base slab shall be 28-day compressive strength 4,000 psi, threequarter inch maximum size aggregate concrete conforming to the requirements of Section 901 CEMENT CONCRETE MASONRY of the Standard Specifications. Concrete shall be air-entrained 5 to 7 percent with a one inch to 3 inch slump. Placement of the concrete shall be in conformance with the Specifications for Items 701. and except: 1. Concrete shall not include fiber. 2. Concrete shall not include black lamp 3. Final finishing and brooming shall be as specified in this Special Provision. 37

38 The concrete base shall be poured to an elevation which allows for the setting bed and paver installation to result in the appropriate final elevation. REINFORCEMENT: All reinforcing steel and support devices shall be epoxy coated and shall conform to the requirements of AASHTO M31 Grade 60. METAL EDGE RESTRAINTS: Metal Edge Restraint shall be a heavy duty aluminum paver restraint system with 3/8 x 10 minimum steel spikes spaced at 12 inches on center, StructureEdge as manufactured by Permaloc Corporation, Holland Michigan, or approved equal. Finish shall be mill finish aluminum. Size shall be 3/16 by 2 1/4 min, top lip thickness

39 CONSTRUCTION METHODS INSTALLATION OF PAVERS - GENERAL: Do not use unit pavers with chips, cracks, voids, discolorations, and other defects that might be visible or cause staining in finished work. Mix pavers from several pallets or cubes, as they are placed, to produce uniform blend of colors and textures. Cut unit pavers with motor-driven masonry saw equipment to provide clean, sharp, unchipped edges. Cut units to provide pattern indicated and to fit adjoining work neatly. Use full units without cutting where possible. Hammer cutting is not acceptable. Joint Pattern shall be as indicated on the Drawings. Coursing shall be laid out so that at end conditions of paver panels, pavers will not have to be cut to a width less than 2 inches. Pavers shall be cut with a masonry saw. Minimum size of cut paver shall be half the width and length. No slivers will be accepted. Tolerances: Do not exceed 1/16-inch unit-to-unit offset from flush (lippage) For finished surface of paving finish surface shall not vary more than 1/8 inch in 24 inches and 1/4 inch in 10 feet from level, or indicated slope, as measured with a metal straight edge. AGGREGATE SETTING-BED PAVER APPLICATIONS: Excavation and installation of Gravel Borrow Base Course shall be in conformance with Section 150 of the Standard Specifications. Subgrade shall have been uniformly compacted to at least 95 percent of ASTM D 1557 laboratory density. Place Dense Graded Crushed Stone in conformance with Section 150 of the Standard Specifications and compact by tamping with plate vibrator and screed to depth required to allow setting of pavers. Place Metal Edge on compacted base. Where edging is required, edging shall be installed over the Base Course, not installed on top of the bedding layer. Spike rigid style edging using predrilled holes, with a maximum spacing of 12" between spikes. Spike placement may be placed through the back if needed. Connect additional sections of edging as needed Place sand setting bed course and screed to a thickness of 1 to 1-1/2 inches, taking care that moisture content remains constant and density is loose and constant until pavers are set and compacted. Lay the pavers in the pattern(s) as shown on the drawings. Maintain straight and uniform pattern lines. The pavers shall be hand placed paving units set with 1/16 inch joints. Mechanically vibrate pavers to uniform and true level to finish grade. Fill and sweep all joints with washed, clean concrete sand. Clean all paver surfaces. Vibrate pavers into setting bed course with a low-amplitude plate vibrator capable of a to 5000-lbf (16- to 22- kn) compaction force at 80 to 90 Hz. Perform at least three passes across paving with vibrator. Vibrate under the following conditions: After edge pavers are installed and there is a completed surface or before surface is exposed to rain. 39

40 Before ending each day's work, fully compact installed concrete pavers to within 36 inches of the laying face. Cover open layers with nonstaining plastic sheets overlapped 48 inches on each side of the laying face to protect it from rain. Spread dry sand and fill joints immediately after vibrating pavers into leveling course. Vibrate pavers and add sand until joints are completely filled, then remove excess sand. After initial joint sand application is watered in and pavers are completely dry, a second application of sand shall be swept into the joints to fill any remaining voids. After all sand has been removed from the paver surface the joints shall be watered thoroughly. This process shall be repeated until all joints are filled. Clean all paver surfaces as needed. Do not allow traffic on installed pavers until sand has been vibrated into joints. Repeat joint-filling process 30 days later. BITUMINOUS SETTING-BED APPLICATIONS: CONCRETE BASE SLAB INSTALLATION: Concrete base slab shall be laid in accordance with the plans, details and sections. Concrete base course placement, testing, reinforcing and protection and form work shall be as specified in Section 901 CEMENT CONCRETE MASONRY, except as modified below. Concrete shall have a rollerbug float finish. No spray or curing compounds shall be used in construction of concrete base course. Place expansion joints at twenty feet on center or as otherwise directed on the Drawings. Joints shall reflect full depth through concrete base course. Concrete base shall be placed in one (1) course, to full depth, as detailed on the Plans. No traffic of any kind shall be allowed to pass over the newly installed surface until it has had time to set. Twentyfour (24) hours will be considered sufficient time for the pavement to set in most cases, but this period may be extended by the Engineer as required by weather or other reasons. All forms shall be joined neatly and tightly, shall be set true to line and grade, well staked and braced, and shall have uniform bearings throughout their length. All forms and stakes shall be removed before placing loam or backfill. Adequate protection shall be where temperatures of forty degrees F or lower occur during placing of concrete and during the early curing period. The minimum temperature of fresh concrete after placing and for the first three days shall be maintained above fifty-five degrees F. In addition to the above requirements, an additional three days of protection from freezing shall be maintained. Expansion joints shall be placed as indicated on the Detailed Drawings where pavement meets the curbing, structures, including light bases, hydrants, and where new pavement shall abut existing pavement as shown on the Plans. Install foam filler for expansion joints twenty feet on center and as indicated on the Plans. Joint alignment shall be straight and true. Expansion joints in concrete base course shall be aligned to match the required pattern of expansion joints in the finished pavement surface. After floating the concrete off to the desired elevation, apply a pattern to the surface using a rollerbug or similar tool that shall provide a roughened texture to the concrete without affecting the finish grade. Prior to installation of bituminous setting bed and setting pavers, the concrete base slab shall be cured for a minimum of six days. The surface shall be wetted or otherwise kept moist through the use of a polyethylene film or wetted burlap. The surface shall be protected from traffic or other disturbances during the curing period. 40

41 Contractor shall not begin installation of pavers until the Engineer has accepted finish grade of pavement base. Concrete base shall be inspected to insure that the finished grades are correct. If in the opinion of the Engineer finish grades are not correct, the Contractor shall vary the thickness of the stone dust setting bed for pavers as necessary to insure positive drainage of the finished surface. BITUMINOUS SETTING BED INSTALLATION: Concrete Base Preparation: Do any cleaning necessary to cement concrete base to provide a clean base surface, free from oil, grease, other impurities, or loose or friable particles. As indicated on the Drawings where pavers meet lawn areas, install metal paver edge as indicated on the Drawings and in accordance with manufacturer s recommendations. Apply primer to concrete slab immediately before placing setting bed. Prepare for setting-bed placement by locating 3/4-inch- (19-mm-) deep control bars approximately 11 feet (3.3 m) apart and parallel to one another, to serve as guides for striking board. Adjust bars to subgrades required for accurate setting of paving units to finished grades indicated. Place bituminous setting bed where indicated, in panels, by spreading bituminous material between control bars. Strike setting bed smooth, firm, even, and not less than 3/4 inch (19 mm) thick. Add fresh bituminous material to low, porous spots after each pass of striking board. After each panel is completed, advance first control bar to next position in readiness for striking adjacent panels. Carefully fill depressions that remain after removing depth-control bars. Roll setting bed with power roller to a nominal depth of 3/4 inch (19 mm) while still hot. Adjust thickness as necessary to allow accurate setting of unit pavers to finished grades indicated. A coating of two percent (2%) neoprene-modified asphalt adhesive shall be applied by mopping, squeezing, or troweling over the top surface of the bituminous setting bed. Adhesive shall be applied to provide a complete bond under all pavers. If it is trowelled, the trowel shall be serrated with serrations not to exceed 1/16". Proceed with setting of paving units only after adhesive is dry to the touch. PAVER INSTALLATION No pavers shall be laid in inclement weather or when the temperature is 36 degrees F., and dropping, nor shall any work be done on rising temperatures until the temperature reaches 32 degrees F. Frozen materials shall not be used. Place pavers carefully by hand in straight courses, maintaining accurate alignment and uniform top surface. Protect newly laid pavers with plywood panels on which workers can stand. Advance protective panels as work progresses, but maintain protection in areas subject to continued movement of materials and equipment to avoid creating depressions or disrupting alignment of pavers. If additional leveling of paving is required, and before treating joints, roll paving with power roller after sufficient heat has built up in the surface from several days of hot weather. Joint Treatment: Place unit pavers with hand-tight joints. Fill joints with sand by sweeping over paved surface until joints are filled. REPAIR, POINTING, CLEANING, AND PROTECTION: 41

42 Remove and replace unit pavers that are loose, chipped, broken, stained, or otherwise damaged or that do not match adjoining units as intended. Provide new units to match adjoining units and install in same manner as original units, with same joint treatment and with no evidence of replacement. Cleaning: Remove excess setting and jointing materials from exposed paver surfaces; wash and scrub clean. Do any repair or patching to pavements outside the project site damaged by work of the contract. All patching work required shall be in accordance with requirements for new construction. The complete paver surface shall be swept clean and washed down with water to provide a finished installation according to manufacturer s recommendations. Any stains that occur during construction shall be removed prior to acceptance at no cost to the Owner. Any damaged paving units found prior to project acceptance shall be removed. The paver replacement units shall match in color with adjacent units, at no additional cost to the Owner. MEASUREMENT AND PAYMENT: ITEM CONCRETE UNIT PAVERS TYPE A will be measured and paid for at the Contract unit price per SQUARE FOOT complete in place, which price shall include all labor, mockup, materials including but not limited to Precast Concrete Unit Pavers, Concrete Base Course, bituminous setting bed, joint Filler, expansion joint materials, metal edging, asphalt tack coat, and all equipment and incidental costs required to complete the work. ITEM CONCRETE UNIT PAVERS TYPE B will be measured and paid for at the Contract unit price per SQUARE FOOT complete in place, which price shall include all labor, materials including but not limited to Precast Concrete Unit Pavers, Dense Graded Crushed Stone Base Course, sand setting bed, joint Filler, expansion joint materials, metal edging, mockups, equipment and incidental costs required to complete the work. Gravel Borrow will be paid for separately under Item Gravel Borrow. 42

43 ITEM GRANITE TREAD PAVER - SALVAGED SQUARE FOOT ITEM GRANITE TREAD PAVERS - NEW SQUARE FOOT DESCRIPTION Work under this item shall conform to the relevant provisions of Section 501 of the Standard Specifications and the following: These Items are for the construction of Granite paving and related items as shown on the Contract Drawings and as listed below, including pick-up at the Burlington DPW yard on New Meadow Road and delivery to the site of Granite Tread Pavers Salvaged, cleaning of salvaged granite items, new granite items, preparation of base courses, setting beds, jointing, and any additional work identified in this Special Provision. Submittals At least thirty days prior to intended use, the Contractor shall provide the following samples and submittals in conformance with the requirements of the Standard Specifications and as stated herein. Submit the following for approval by the Engineer: Manufacturer s Literature Granite items granite source and species. Setting bed materials and Jointing material shall be submitted in accordance with the requirements of the Special Provisions for Item Concrete Unit Pavers Type A and Item Concrete Unit Pavers Type B Granite Cleaner material MATERIAL SAMPLES GRANITE: GRANITE TREAD PAVER NEW: Submit three 12 inch by 12 inch by ½ inch samples for three options for new granite to match Sloped Granite Edging-Salvaged. SPLIT FACE FINISH: Submit three 12 inch y 12 inch by 4 inch samples of approved granite species with both 12 inch by 12 inch faces split face finish. Samples for Setting bed materials and jointing material shall be submitted in accordance with the requirements of the Special Provisions for Item Concrete Unit Pavers Type A and Item Concrete Unit Pavers Type B TEST REPORTS 43

44 Submit independent laboratory test reports for granite. Include in test reports: Compressive strength 24-hour cold water absorption 5-hour boil absorption Saturation coefficient Initial rate of absorption SHOP DRAWINGS Submit complete Shop Drawings for the following: GRANITE TREAD PAVERS - NEW: Submit Shop Drawings showing sizes and finishes. MOCK UPS Mock-up: Before beginning primary work of this section, provide a mock-up of granite items as a component of mocks required under the work of Items and Provide mock-ups at locations and with orientation acceptable to Engineer. Obtain Engineer's acceptance of visual qualities. Protect and maintain acceptable mock-ups throughout the work of this section to serve as criteria for acceptance of this work. Unless authorized in advance by the Engineer to be made part of the final work, demolish and remove mock-ups from site at completion of work. Approval of mockups is for color, texture, and blending of stone; relationship of jointing colors to stone colors; and aesthetic qualities of workmanship. Approval of mockups is also for other material and construction qualities the Engineer specifically approves in writing. Approval of mockups does not constitute approval of deviations from the Contract Documents contained in mockups unless the Engineer specifically approves such deviations in writing. QUALITY ASSURANCE QUALIFICATIONS: Provide written documentation that the proposed stone fabricator and the proposed installer of granite items have each successfully completed granite work of the same detail and quality of the work indicated using the methods specified, in at least 5 locations within the last 5 years. Submit the name, location, owner, and Engineer s name and telephone number for approval. Source Limitations for Stone: Obtain all stone for the Items governed by these Special Provisions, regardless of finish, from one quarry with resources to provide materials of consistent quality in appearance and physical properties. TOLERANCES FOR STONEWORK For top faces and sides of newly fabricated granite elements, variation from true plane, or flat surfaces, determined by use of a 4 foot straightedge, applied in any direction on the surface shall not exceed 1/2 inch. DELIVERY, HANDLING, AND STORAGE Protect delivered granite and manufactured products of all types from wetting by rain or snow, and keep covered when not in use. 44

45 Granite pieces: Handle all materials carefully in transit and on the site so as to keep units and pieces whole, edges sharp and faces clean and undamaged. Do not dump granite pieces but deliver on pallets, handled individually or in suitable groups and properly stacked. Aggregates: Deliver, store and handle aggregate materials so as to prevent contamination with earth or foreign materials. Damaged material: Remove all damaged and contaminated materials from job site immediately, including materials in broken packages and packages bearing water marks or other evidence of damage, unless Engineer specifically authorizes correction and use on the project. PROTECTION OF WORK Staining: Prevent dirt and other contaminants from staining the face of granite to be left exposed. Remove such dirt or contaminants immediately. MATERIALS GRANITE Granite Tread Paver-Salvaged measure approximately between 6 x1 x4 and 4 x1 x4. The work under this item shall consist of picking up, transporting to the site and installing Salvaged Granite items currently stored at the City of Burlington s Storage Yard at 21 New Meadow Road, Burlington MA. The Contractor shall accept and hold entire responsibility for the removal, handling and transporting of the Salvaged Granite items from the City s storage yard to the project site. Any pieces damaged or lost either directly or indirectly as a result of the Contractor's operations shall be replaced by the Contractor at no additional cost to the City. Granite Tread Paver New: Granite for Granite Tread Paver New shall be a species of granite selected to match color, texture, and physical properties of existing Granite - Salvaged being used for re-set as linear paving slabs. The Contractor shall identify up to three granite options which have visually similar characteristics to the Salvaged granite treads. Granite shall be customized Granite Treads as manufactured by Swenson Granite, or approved equal. Granite Tread Pavers New shall measure between 1 wide by 2 thick, lengths as indicated on the Drawings. Finish shall be split face bottom, sawn edges, and sawn and thermal finish top face. Granite shall be free from seams, veins or striations. Grain shall be uniform throughout. Pieces that are not uniform will be rejected. When thermal-finished, granite texture and color shall have medium-sized white and gray flecks, and small-sized black flecks. Overall texture of granite to be fine to medium-grained. All granite shall be structural granite, Engineering Grade, hard, and durable. Granite shall be free from seams which impair its structural integrity, and shall be of smooth splitting character. Natural variations characteristic of the deposit will be permitted for granite pieces. Granite shall be supplied from an approved quarry. Test samples of granite shall conform to the following requirements: Abrasion: Absorption: Compressive strength: Modulus of rupture: 86.0 Ha 0.31% (average) 23,100 psi (average) 2,800 psi (average) 45

46 All stone materials shall have characteristics and physical requirements as defined by ASTM C119 and C615, and possess physical characteristics as specified under C615 (Table 1). FABRICATION: Fabricate stone to comply with sizes, shapes, and tolerances recommended by applicable stone association or, if none, by stone source, for faces, edges, and bottom. Comply with recommendations in NBGQA's "Specifications for Architectural Granite." Cut stone to produce pieces of thickness, size, and shape indicated, including details on Drawings, maintaining fabrication tolerances of applicable stone associations. Dress joints (bed and vertical) straight and at right angle to face unless otherwise indicated. All faces not otherwise indicated on the Drawings shall be cut at right angles to the plane of the top. Granite shall be cut accurately to required shapes and dimensions as shown on the plans. Arrises shall be cut sharp and true to square, and continuous with adjoining arrises. Where exposed, arrises shall be eased. CLEANING MATERIALS Provide chemical cleaning products by ProSoCo Inc. or approved equal. GRAVEL BORROW Gravel borrow for subbase shall be furnished and installed under Item

47 CONSTRUCTION METHODS GRANITE Clean all granite units before setting by scrubbing with fiber brushes followed by a thorough drenching with clear water. Use only mild cleaning compounds that contain no caustic or harsh fillers or abrasives. Drench granite with clear water just prior to setting. Every granite unit shall be set on a sand setting bed in conformance with the Special Provisions for Items and All pieces shall be set straight, plumb, and at elevations according to contract documents. Do not use pieces with chips, cracks, voids, stains, or other defects which might be visible in the finished work, or which might structurally impair the granite. REPAIR AND CLEANING OF GRANITE Remove and replace granite units which are broken, chipped, stained or otherwise damaged. Where directed, remove and replace units which do not match adjoining work. Provide new matching units, install as specified and point-up joints to eliminate evidence of replacement. Repoint defective and unsatisfactory joints to provide a neat, uniform appearance. Clean exposed surfaces by dry brushing at the end of each day's work. Comply with recommendations of NCMA TEK bulletin No.28. Remove and replace work that cannot be successfully cleaned. Demonstrate cleaning technique on sample panel and obtain Engineer's approval before beginning cleaning work. Do not use muriatic acid or other chemical cleaners without the written permission of the Engineer. Prior to final cleaning work, examine all face joints in new granite masonry to locate cracks, holes or other defects and point up all such defects and fill with mortar as specified herein. Where necessary, in the opinion of the Engineer, cut out defective joints in masonry, and replace with new materials, exercising extreme care to match original work. Final cleaning work shall be performed only when atmospheric temperature is above 40 degrees F. and rising. Use of wire brushes or other abrasive tools for cleaning will not be permitted. All cleaning operations shall proceed from the top down. Submit proposed cleaning procedures and cleaning materials to the Engineer for approval before commencing work. The Engineer reserves the right to request test cleaning of a selected 20 square foot segment of new masonry work. General cleaning shall not commence until such test area is approved by the Engineer. Perform final cleaning by scrubbing with stiff bristle fiber brushes and water. Rinse all surfaces thoroughly with clean water. Remove from the site and legally dispose of all cartons, rubbish and debris resulting from work under this Section not less often than once per week. Gravel Borrow 47

48 Gravel borrow for backfill shall be furnished and placed under work requirements of the Standard Specifications, as stated on the Drawings and as stated herein. COMPENSATION Gravel Borrow for base course and sub bases will be paid for separately under Item 151 Gravel Borrow. Item Granite Tread Paver-Salvaged, and ITEM Granite Tread Pavers New, will be paid for at the Contract unit price per SQUARE FOOT, complete in place, which prices shall include all labor, excavation, materials, equipment and incidental costs required to complete the work to the satisfaction of the Engineer. No separate payment will be made for setting bed, jointing, excavation, back filling but all costs in connection therewith shall be included in the Contract unit prices bid. 48
