4 I N S T R U C T I O N S T O B I D D E R S 1. DEFINITIONS: A. The definitions set forth in Section 1 of the General Conditions are applicable to the documents included under Bidding Requirements. B. Bidding Documents include the Bidding Requirements and the proposed Contract Documents. The proposed Contract Documents consist of the documents identified as Contract Documents in the Form of Agreement, except for Modifications. The Bidding Requirements are those documents identified as such in the proposed Project Manual. C. Addenda are written or graphic documents issued by the Architect prior to execution of the Contract which modify or interpret the Bidding Documents. They become part of the Contract Documents as noted in the Form of Agreement upon execution of the Contract. 2. BIDDER'S REPRESENTATIONS: A. By submitting a bid, the bidder represents that 1. Bidder has carefully studied and compared the Bidding Documents with each other. Bidder understands the Bidding Documents and the bid is fully in accordance with the requirements of those documents, 2. Bidder has thoroughly examined the site and any building located thereon, has become familiar with local conditions which might directly or indirectly affect the contract work, and has correlated its personal observations with the requirements of the proposed Contract Documents, and 3. Bid is based on the materials, equipment, and systems required by the Bidding Documents without exception. 3. BIDDING DOCUMENTS: A. Copies 1. Bidding Documents may be obtained at the time and place and for the deposit sum indicated in the Invitation To Bid 2. Bidding Documents will not be issued to other than the invited General Contractor Bidders. Partial sets of Bidding Documents will not be issued by Architect. 3. Bidders shall use complete sets of Bidding Documents in preparing bids and make certain that those submitting sub-bids to them have access to all portions of the documents that pertain to the work covered by sub-bid, including General Conditions, Supplementary Conditions, and Division 01. Bidder assumes full responsibility for errors or misinterpretations resulting from use of partial sets of Bidding Documents by itself or any sub-bidder. B. Interpretation Or Correction Of Bidding Documents 1. If any bidder, in his study of the Bidding Documents as described in Article 2 above, is in doubt as to the true meaning of any part of the proposed Contract Documents or finds errors, discrepancies, or omissions in them, he shall at once request interpretation or correction of those errors, discrepancies, and omissions by the Architect. 2. Request for such clarification shall be in writing and be received by Architect three working days minimum before scheduled bid opening. Architect will promptly correct or interpret the portion of the proposed Contract Documents in question by issuing an Addendum or Clarification Notice to all bidders. Corrections or interpretations made in any way other than by an Addendum or Clarification Notice have no validity and shall not be relied upon. 3. If errors, discrepancies, or omissions are discovered in the proposed Contract Documents less than three working days before bid opening, bidders shall prepare bids based on order of precedence given in General Conditions Article 3.1, Paragraph B, SubParagraphs 1 through 6. C. Substitutions And Equal Products 1. Generally speaking, substitutions for specified products and systems, as defined in the Uniform Commercial Code, are not acceptable. However, equal products may be approved upon compliance with Contract Document requirements. 2. The terms >Acceptable Manufacturers=, >Approved Manufacturers / Suppliers / Installers=, and >VMR (Value Managed Relationship) Manufacturers / Suppliers / Installers= are used throughout the Project Manual to differentiate among the options available to Contractor regarding specified products, manufacturers, and suppliers. See Section for options available regarding acceptance of equal products. 3. Base bid only on materials, equipment, systems, and suppliers specified in Project Manual unless a. Specified material, equipment, or system is listed under the heading >Acceptable 1 Instruction to Bidders

5 Manufacturers=, and b. Request for use of equal product is submitted on a properly completed Equal Product Approval Request Form for Architect's approval seven days minimum prior to bid opening, and c. Approval for use of such equal product is secured by Addendum issued prior to the scheduled bid opening time. 4. Architect is only authorized to consider requests for approval of equal products to replace specified products in Sections where the heading >Acceptable Manufacturers= is used and statement, 'Equal as approved by Architect before bidding. See Section 01600' or 'Equal as approved by Architect before installation. See Section 01600,' appears. In Sections where the afore-mentioned statements do not appear and a different heading is used, Architect is authorized as Owner=s representative to decline consideration of requests for approval of equal products. Approvals of equal products in such Sections must be made by Owner and will generally be for subsequent Projects. 5. No approvals of equal products to replace specified material, equipment, systems, or manufacturers will be considered after 7 days prior to opening of bids. D. Addenda - Addenda will be sent to bidders and to locations where Bidding Documents are on file by U. S. Mail no later than 7 days prior to bid opening or by fax no later than 48 hours prior to bid opening. No Addenda will be issued less than 48 hours prior to bid opening. 4. BIDDING PROCEDURES: A. Form And Style Of Bids 1. Bids may be prepared on Contractor s standard from or letterhead. 2. Signatures shall be in longhand and executed by representative of bidder duly authorized to make contracts. 3. Bids shall bear no information other than that requested, and shall bear no other marks, erasures, writing, changes, or interlineations. B. Submission of Bids 1. Submit bid in opaque envelope containing only bid proposal. Envelopes shall be sealed, bear bidder's name, and be addressed as follows - BID FOR LDS ISLAND PARK ANNEX FURNACE If bid is sent by mail, enclose sealed envelope in separate mailing envelope with notation 'SEALED BID ENCLOSED' on face. 2. It is bidder's sole responsibility to see that its bid is received at specified time. Bids received after specified bid opening time will be returned to bidders unopened. 3. No oral, facsimile transmitted, telegraphic, or telephonic bids, modifications, or cancellations will be considered. C. Modification Or Withdrawal Of Bid 1. Bidder guarantees there shall be no revisions or withdrawal of bid amount for 45 days after bid opening. 2. Prior to bid opening, bidders may withdraw bid by written request or by reclaiming bid envelope. 5. CONSIDERATION OF BIDS: A. Opening Of Bids - See Invitation to Bid. B. Rejection of Bids - Owner reserves right to reject any or all bids and to waive any irregularity therein. C. Acceptance Of Bid 1. No bidder shall consider itself under contract after opening and reading of bids until Agreement is signed, and compliance therewith has been made. 2. Bidder's past performance, organization, subcontractor selection, equipment, and ability to perform and complete its contract in manner and within time specified, together with amount of bid, will be elements considered in award of contract. 6. FORM OF AGREEMENT BETWEEN OWNER AND CONTRACTOR: A. Form To Be Used - Agreement form will be similar to Owner's sample Form of Agreement included in Bidding Requirements. The work to be done under this specification includes the furnishing of all labor, and materials to install a new furnace and ductwork as specified and shown on the drawings. The furnace shall be supplied by the owner. It is the intent of these specifications that the work shall be complete and ready for operation before acceptance. END OF SCOPE OF WORK 1 Scope of Work

7 DIVISION 01 MAINTENANCE PROJECT AGREEMENT GENERAL REQUIREMENTS SUMMARY ADMINISTRATIVE REQUIREMENTS QUALITY REQUIREMENTS TEMPORARY FACILITIES AND CONTROLS PRODUCT REQUIREMENTS EXECUTION REQUIREMENTS PART 1 - GENERAL 1.1 SCOPE OF DIVISION 01 A. Provisions contained in Division 01 apply to Sections of Divisions 02 through 16 of Specifications. Instructions contained in Specifications are directed to Contractor. Unless specifically provided otherwise, obligations set forth in Contract Documents are obligations of Contractor. 1.2 WORK COVERED BY CONTRACT DOCUMENTS A. Contractor will furnish total labor, materials, equipment, and services necessary to perform the Work in accordance with Contract Documents. 1.3 WORK RESTRICTIONS A. During construction period, Contractor will have use of premises for construction operations. Contractor will ensure that Contractor, its employees, subcontractors and employees comply with following requirements: 1. Confine operations to areas within Contract limits shown on Drawings. Do not disturb portions of site beyond Contract limits. 2. Do not allow alcoholic beverages, illegal drugs, or persons under their influence on Project site. 3. Do not allow use of tobacco in any form on Project Site. 4. Do not allow work on Project site on Sundays except for emergency work. 5. Refrain from using profanity or being discourteous or uncivil to others on Project Site or while performing the Work. 6. Wear shirts with sleeves, wear shoes, and refrain from wearing immodest, offensive, or obnoxious clothing, while on Project Site. 7. Do not allow the playing of obnoxious and loud music on Project Site. Do not allow playing of any music within existing facilities. 8. Do not build fires on Project Site. 9. Reasonably accommodate use of existing facilities by Owner. 10. Do not allow weapons on Project Site, except those carried by law enforcement officers or other uniformed security personnel who have been retained by Owner or Contractor to provide security services. B. Comply with applicable laws and regulations. General Requirements 1 Division 01

8 PART 2 - PRODUCTS - Not Used PART 3 - EXECUTION - Not Used A. Coordinate construction activities to ensure efficient and orderly installation of each part of the Work. Coordinate construction operations that are dependent upon each other for proper installation, connection, and operation. Coordinate construction activities to ensure that operations are carried out with consideration given to conservation of energy, water, and materials. A. Notify Owner immediately if asbestos-containing materials or other hazardous materials are encountered while performing the work. B. Submit to Owner permits, licenses, certifications, inspection reports, releases, jurisdictional settlements, notices, receipts for fee payments, judgments, and similar documents, correspondence, and records establishing compliance with standards and regulations bearing upon performance of the Work. C. Provide inspections, tests, and similar quality-control services specified in individual Specification Sections and/or required by governing authorities, except where Specifications specifically state that Owner or its consultants will perform such inspections. Cooperate with persons performing inspections, tests, and similar services and provide auxiliary services as reasonably requested. D. Upon completion of inspection, testing, sample-taking, and similar services, repair damaged construction and restore substrates and finishes. A. Owner will provide electric power for construction activities within limits available at existing facility. B. Exercise caution to avoid fire damage. Do not build fires on site. C. Permanent mechanical system may be operated upon following conditions: 1. Do not interfere with normal set-back temperature patterns except as approved by Project Manager. 2. Do not operate system when work causing airborne dust is occurring or when dust caused by such work is present without first installing temporary filtering system. D. Existing lighting system may be used by Contractor. E. Contractor will use existing water supply for construction purposes to the extent of existing facilities. F. Existing restroom facilities may be used by Contractor. Clean restrooms and portions of existing building used in accessing restrooms daily. If existing facilities are not usable, provide and maintain temporary sanitary toilet. G. Erect adequate barricades, warning signs, and lights necessary to protect persons from injury or harm. H. Contractor is responsible for the security of materials, tools, and equipment. Do not permit others to use building keys provided by Owner. Safeguard building and contents while work is being performed and secure building when work is finished for the day. I. Protect existing trees and plants. Remove and replace vegetation that dies or is damaged beyond repair due to construction activities. J. Provide temporary enclosures at exterior building openings for security and protection from weather, theft, and vandalism. Erect and maintain dust-proof partitions and enclosures as required to prevent spread of dust and fumes to occupied portions of building. K. Provide protection, operate temporary facilities, and conduct construction in ways and by methods that comply with environmental regulations and reduce possibility that air, waterways, and subsoil might be General Requirements 2 Division 01

9 contaminated or polluted, or that other undesirable effects might result. Avoid use of tools and equipment that produce harmful noise. Restrict use of noisemaking tools and equipment to hours that will minimize complaints from persons or firms near site. Protect work, materials, apparatus, and fixtures from injury due to weather, theft, and vandalism. A. Provide products that comply with Contract Documents, are undamaged, and, unless otherwise indicated, are new and unused at time of installation. Provide products complete with accessories, trim, finish, safety guards, and other devices and details needed for complete installation and for intended use and effect. B. Install items furnished by Owner or receive and store in safe condition items purchased directly by Owner according to requirements of Contract Documents. A. Design, furnish, and install all shoring, bracing, and sheathing as required for safety and for proper execution of the Work and, unless otherwise required, remove same when the Work is completed. B. Require installer of each major component to inspect both substrate and conditions under which Work is to be done. Notify Owner in writing of unsatisfactory conditions. Do not proceed until unsatisfactory conditions have been corrected. C. Provide attachment and connection devices and methods necessary for securing Work. Secure work true to line and level. Allow for expansion and building movement. D. Recheck measurements and dimensions before starting each installation. E. Where mounting heights are not shown, install individual components at standard mounting heights recognized within the industry or local codes for that application. Refer questionable mounting height decisions to Owner for final decision. F. Cover and protect furniture, equipment, and fixtures from soiling and damage when demolition work is performed in rooms and areas from which such items have not been removed. G. Progress Cleaning 1. Keep premises broom-clean during progress of the Work. During handling and installation; protect construction in progress and adjoining materials in place. Apply protective covering where required to ensure protection from soiling, damage, or deterioration until Substantial Completion. 2. Clean and maintain completed construction as frequently as necessary throughout construction period. 3. Remove waste materials and rubbish caused by employees, subcontractors, and contractors under separate contract with Owner and dispose of legally. H. Final Cleaning 1. Clean each surface or unit to condition expected in normal, commercial-building cleaning and maintenance program. Comply with manufacturer=s instructions. Remove all rubbish from under and about building and leave building clean and habitable. 2. In addition to general cleaning noted above, perform cleaning for all trades at completion of work in areas where construction activities have occurred. 3. If Contractor fails to clean up, Owner may do so and charge cost to Contractor. I. Completion Inspection 1. Upon 100 percent completion of Project, Contractor shall request a Substantial Completion Inspection. 2. Owner will conduct Substantial Completion Inspection in presence of Contractor and furnish list of items to be corrected. 3. Contractor will notify Owner in writing when items have been corrected. J. Warranties General Requirements 3 Division 01

10 1. When written guarantees beyond one year after substantial completion are required of any Section of the Work, Contractor will secure such guarantees and/or warranties properly addressed and signed and in favor of Owner. Include these documents in Meetinghouse Operations & Maintenance Manuals. 2. Delivery of guarantees and warranties will not relieve Contractor from any obligation assumed under any other provision of the Contract Documents. 11 DIVISION 02 GENERAL WORK SECTION CUTTING, PATCHING, PAINTING, REPAIRING A. The work under this section is to take care of any necessary cutting, patching, painting, or repairing of the existing building to restore it to original position after all work has been completed. SECTION INTERIOR WALLS A. All interior surfaces shall be cut as required to accommodate the new work. Patch and repaint as required to restore the structure to its original condition. SECTION EXTERIOR WALLS A. All exterior surfaces cut to accommodate the new work shall be patched and repaired to match the existing. Provide pipe sleeves as required. Patch and point up masonry work and make all openings weatherproof. General Work 5 Division 2
