1 Architectural Review Committee Report for Aug 19: ARC Meeting 4 August The HLR ARC held a meeting open to all POs on Saturday, 4 August. POs attending included: Eileen A (BOL Liaison to the RC), Joe A (ARC), George B, Jim B, Greg B, Bob H, and Lillian H. Thanks to all the PO for attending. The purpose of the meeting was to discuss and recommend changes to our architectural review procedures, guidelines and forms to remain in compliance with a new state law/statute that took effect on 2 Aug The state statute requires: 1. A board member must chair the design review body; 2. New rules on security deposits (if any) for new construction of the main residential unit or a rebuild of the main residential unit; and 3. Inspections and feedback on modifications for new construction of the main residential unit or a rebuild of the main residential unit. To read more, go to the following link: or Implementation of ARS The ARC recommends the following changes/updates to be compliant: -1- that the BOD Liaison now becomes the ARC Chair; -2- the following changes to our ARC Procedures (Encl 1); -3- the following changes to our ARC Guidelines (Encl 2); -4- the following changes to our Architectural Review Request (ARR) form (Encl 3). Encl 1: Recommended changes as a result of ARS : (changes in red) HLR POA Revised Procedures for Architectural Review Request Procedures: Aug 2012 All Architectural review requests (ARR) are to be forwarded to Cadden Management Group either by mail or (see for addresses) (for the ARR form go to ) Cadden will log in all requests and forward them to the Board; the Board will then the request to the Architectural Review Committee (ARC). Once the ARC has received the request they will review the documentation for completeness and accuracy. If the ARR packet/guideline (Tab A-1 below) is complete with all the needed information, the ARC will the Board of Directors notifying them of the submission and the 45 day clock will begin. If the application is not complete the property owner will be notified by the ARC and the 45 day clock will not begin until the documentation has been received by the committee and is deemed to be complete. If an ARR is received but there are questions as to compliance with the CC&Rs, the 45 day clock will not begin until the ARC has enough information to make a recommendation to the Board. The ARC will contact the property owner for clarification and notify the Board via of receipt.
2 If a request is not in compliance with the CC&Rs the property owner and the board will be notified. If a resolution cannot be reached between the ARC and the property owner, the Board will set/coordinate a date for a hearing between the PO, Board and ARC to discuss the request. Once a recommendation has been given to the Board by the ARC, it is the Board s responsibility to contact the property owner as to when their submission will be voted upon so the property owner can attend. (Per ARS the PO or rep/agent is allowed to attend the meeting where the final decision is made on the submission.) The Board will also post all requests (reviews) in abbreviated form on the HLR webpage in an effort to keep neighbors current as to what ARRs are in the process of being reviewed. Per ARS , if the plans are approved, HLR POA/Cadden will provide written acknowledgement that the approved plans, including approved amendments are approved. Per ARS , if the ARR is for new construction of the main residential structure or rebuilds of a main residential structure, the Association must provide at least two on-site formal reviews during construction for the purposes of determining compliance with the approved plan. The PO or rep/agent is allowed to attend both formal reviews. Due to time and distance involved in most building projects, it is the POs responsibility to coordinate the formal visits with the HLR Board at intervals when non-compliance concerns can be resolved most easily. A rebuild is defined as any modification that changes the footprint of the home, increases the square footage of the home or changes the architecture of the home. Per ARS , HLR POA must provide a written report within five days after the first formal review and 30 days after the second review, specifying any deficiencies, violations or unapproved variations (if any) from the approved plans as amended and that have come to the attention of the association. All ARRs will only be valid for two (2) years from the date of board approval. Any extensions to this will need to be requested in writing and an updated ARR must be submitted to Cadden. Once this has been accomplished the above listed procedures will apply. This two (2) year ruling applies to all ARRs submitted and approved after 13 Dec Neither the approval of plans/arr nor the approval of the actual construction by the association or the ARC constitutes a representation or warranty that the plans or construction comply with applicable governmental requirements or applicable engineering, design or safety standards ENCL 2: Recommended changes to HLR AR Guidelines as a result of ARS : Aug 2012 (changes in red) PRIOR TO CONSTRUCTION OR PLACEMENT OF ANY IMPROVEMENTS UPON YOUR LAND, PLEASE PROVIDE THE FOLLOWING THREE DOCUMENTS: I. CONSTRUCTION PLAN: a. DRAWING (ELEVATION) OF ANY STRUCTURES (SUCH AS: HOUSE, GARAGE, CARPORT, BARN, TACKROOM, GUESTHOUSE, OUTBUILDINGS): STYLE, SIZE, HEIGHT BUILDING MATERIALS AND COLORS (EARTHTONES) PATIOS AND/OR PORCHES (INCLUDE MATERIALS AND COLORS) ROOF DESIGN, MATERIALS AND COLORS
3 FOUNDATION MATERIALS AND COLORS WATER FEATURES (SUCH AS POOL, SPA, ETC.) b. SKETCH ANY FENCES, WALLS, CORRALS (SHOW MATERIALS & COLORS) c. LOCATION OF MECHANICAL AND ELECTRICAL EQUIPMENT (with size and height of solar and wind generators) AND METHOD OF SCREENING. Preferred location is defined in the Architectural Review Guidelines as avoid hills, rises, and ridgelines as much as possible to limit visibility from common areas and adjoining lots, utilize below grade locations when possible, and screen with native vegetation. d. LOCATION OF SERVICE YARDS AND/OR STORAGE AREAS AND METHOD OF SCREENING e. SKETCH OF ENTRY GATE (INCLUDE MATERIAL, SIZE, AND COLOR) II.
