1 SUMMARY OF TOWN PLANNING BY-LAWS The following guide outlines the general norms and basic requirements you need to know for town planning related projects. When submitting your request for a permit or an authorization certificate, you must supply all plans and documents describing in detail, the project you want to carry out. It is recommended to contact the Building Inspector or the Environment Inspector in order to make sure you have all the necessary information and documents required to obtain your permit or certificate. All requirements, as well as the costs of the various permits listed in this booklet are subject to change without notice. The metric system is preferred over the imperial system. Following receipt of all required documents, allow a minimum of 7 to 14 working days for the delivery of your permit, depending on the period of the year. We will call you when it is ready to be picked up. Certain zones, particularly in the centre of the village, are submitted to the Site planning & integration program. Project falling under this program must be submitted for approval to the Planning Advisory Committee who in turns makes recommendations to the Council. Consequently, further delays apply (a six weeks process). 3 Chapitre 1 1. NEW CONSTRUCTION When requesting a construction permit for a new house, one must provide the following documents: The filled-out application form, available on-line or at the municipal office A site plan prepared by a surveyor (showing the location of the future house & on-site markers) Construction plans, made to scale. The plans should bear mention that they are made according to the Quebec Building Code Chapter 1, Bâtiment & the Code national du bâtiment-canada 1995 modifié. The plans should be no smaller than 11" x 17". A soil test analysis & report made by a member of a professional order showing the possibility of installing a septic system and a plan showing its location, in conformity with provincial regulation Q-2, r.22. (See section 2 of this guide) A plan showing the layout of the entrance, parking area & tree cutting zone The driveway/culvert installation form, dated and signed. There is a $500 deposit (payable when the permits are ready) which will be refunded, if the work is completed, inspected by Public Works and meets the standards. Name of artesian well company if required. General standards for building location For a new construction, in most residential zones SET-BACKS FRONT 7.5 meters 24' 9" BACK 10 meters 32' 9" LATERAL 4.5 meters 14 9" WATERFRONT 20 m 66 ft For all types of construction bordering waterfront (lake or other body of water, with intermittent or regular flow), the minimum setback required is 20 meters (66 ft) from the high water mark. The protected zone bordering water is 15 meters (50 ft) deep from the high water mark must be kept in its natural state. 3

SEPTIC INSTALLATIONS To request a permit for the installation or modification of a septic system, one has to submit a completed application form (available at the town hall or on-line) for approval, along with the following documents: A soil test analysis and site-study report done by a member of a professional order (a technologist or engineer) attesting of the possibility to install septic system in conformity with provincial regulation Q-2, r.22. If only the tank is being replaced, without the changing the field, only a plan showing the location and required distances in line with provincial regulation Q-2, r.22, is necessary. Please note that the municipal by-law 436 & provincial government regulation Q-2, r.22 require that septic tanks be emptied every 2 years for full-time occupation and every 4 years for parttime occupation (cottages/secondary residences). Furthermore, citizens must submit a proof that their tank/cesspool has been emptied by a specialized company, to the town planning department; it can be a copy of the invoice or a written statement by their offices. 3. WELLS To request a permit for an artesian well (underground water capture), one has to submit a completed application form (available at the town hall or on-line) for approval, along with the following documents: A plan of the lot showing the proposed location of the well; The location of the existing or proposed septic system, as well as those on adjacent lots. 5

EXTENSIONS When requesting a construction permit for an extension, one must provide the completed application form (available on-line and at the municipal office) along with the following documents: A certificate of location or plan showing the existing building (on a lot identified as a legal Quebec cadaster), which would show the location of the addition in relation to it. In some cases, a new certificate of location of the project is required. The construction plans of the extension, made to scale, showing the 4 façades, the floors and a cross section of wall. The plans must bear the mention that they are in conformity with the Quebec Building Code (version 1995, modified) and show part of the existing building. The format of the plans must be at least 11" x 17". If the project increases the number of bedrooms, an evaluation of the septic installation s capacity is necessary. Standards See General standards for building location on page 3. 6
7 5. GARAGES AND PERMANENT CAR SHELTERS When requesting a permit for the construction of a garage or a permanent car shelter, one must submit the completed request form, available at the office or on-line, and the following documents: A certificate of location prepared by a surveyor (with on-site markers), showing the location of garage or permanent shelter on foundations, if the footprint is 25 m 2 or more; For garages of 25 m 2 and under; or for car shelters (without continuous foundations), the layout plan can be hand drawn (you can use a copy of your certificate of location as a reference) on which you ll indicate the following measurements: distance from the main building, from other buildings, and from the septic system, lot lines, lakes, river, wetland, etc. Construction plans, made to scale, showing the 4 sides, floors and a cross section of wall, for a garages. The plans must be bear the mention that they are made in accordance with the Quebec Building Code in force. The format of the plans must be at least 11" x 17". Standards The maximum size for a detached garage or permanent car shelter is 75m 2 (807 sq. ft.) and the maximum height is 5 metres (16 5 ). The maximum height is calculated at the roof s mid height. See drawing on page 4; exterior walls cannot exceed 3 meters (9 10 ); The minimum distance between a detached garage or car shelter and the house or other accessory building is 3 meters (9 10 ); The minimal setbacks are: from the front lot line: 7,5 meters (24 6 ); if located in the lateral or back yard: 2 m (6 6 ) from the lateral and back lines; The minimum setback for an attached garage is 7.5 m (24'6") from front lot line and minimum 4.5m (14' 9") from lateral lot line, if the construction is located in the front yard; The total footprint of accessory buildings cannot exceed 10% of the total area of a lot. Shelters/garages attached to the main building are considered an extension of said building and have to respect the same setback. (See section on extensions, page 6) 6. SHEDS & OTHER UTILITY BUILDINGS 7
8 When requesting a permit for the construction of a shed or utility building - of a footprint of 25 sq. m (269 sq. ft.) or less, one must provide the following documents along with the completed application form, which is available at municipal office or on-line: A drawing showing the proposed location of the new building in relation to the existing ones. Using a copy of your certificate of location as a reference, indicate the distances between buildings, lot lines, waterways (if it s the case) & locate the septic system; Plans of the building made to scale, showing all sides, floors and a cross section of wall, and choice of siding. The format of the plans must be preferably 11" x 17". Standards The maximum size for a shed/utility building is 25 m 2 (269 sq. ft.) The maximum height is 5 m (16 5 ). This measurement is taken at the roof s midheight. Exterior walls cannot exceed is 3 m (9 10 ) high. See drawing, page 4; In residential areas, these accessory buildings should be located in backyards or lateral yards. It is possible to build one in the front yard under certain conditions only. Please contact the inspector to inquire about these limitations; The minimum setback is 2 m (6'6") from lot lateral and rear lot lines; The minimum setback from any other building is 3 m; In residential sectors, the maximum footprint authorized for sheds and utility building is 10% of the lot s total surface area. 7. PERMIT FOR REPAIRS OR RENOVATIONS When requesting a permit for a renovation or repairs, one must provide the completed application form, available at municipal office or on-line, and the following documents: Detailed description of the work to be done, materials and 11 x 17 plans (if required) made in accordance with the Quebec Building Code, Chapter 1 and the National Building Code (1995 modifié); The permit is valid for one year from the date it is issued. All exterior finishing work as well as the landscaping must be completed within that time frame. 8
9 8. TREE CUTTING To request permission to cut trees, you must fill out a permit request, available at the town hall or online and provide the following details: Plan of the property showing the location where the trees will be cut with a landscaping or development plan if necessary. We recommend the trees be marked or ribboned when possible; Inspection of the tree(s) must be done prior to cutting. An assessment from a horticulturist may be required in rare cases. Specifics It is forbidden to cut trees measuring more than 10 cm (4 ) in diameter, measured at 1 m (3.3 ft.) from the ground, without an authorization; Obtaining a construction permit for buildings, including permits for the construction of infrastructures, such as driveways, wells, septic systems, authorizes automatically the necessary tree cutting to complete said work; Tree cutting must not exceed 40% of the total surface area of the lot or a maximum m FENCES, LOW WALLS & HEDGES When requesting a certificate of authorization for a fence or wall, one must provide the completed form, available at the office or on-line, and the following documents: A plan of the property (use your certificate of location for reference) showing where the fence/wall will be built; If the height varies in places, please indicate it; A description of the type of material used. Standards A fence may be installed along the back and lateral lines. Front yard fences/section must be installed 1 meter (3 3 ) inside the front lot line (the line separating the road s right of way and your lot line). The maximum height along the front line is 1 meter (3 3 ), and the maximum height along the lateral and back lot lines is 2 meters (6 6 ); No fences/walls can be installed with the 15 m from the high water mark. NOTE: There are exceptions for corner lots, please ask the building inspector. 9
10 10. SWIMMING POOLS When requesting a certificate of authorization to set up a pool, one must provide the following documents along with the permit request form, which is available at the office or on-line: Plan of the property showing: the location of the pool, the fence, accessory building(s), access platform, filtration system and/or mechanical equipment, indicating the distances from property line and buildings; Plan of the fence indicating the type of material and height. The minimum height required for the fence/railing is 1,2 meters. If the property is on municipal water, an annual water tax will be added to the annual tax bill. Spas do not fall under this category (since they hold under liters). However, please check with the inspector to clear the projected location before installing it. Standards applicable In ground pools must be completely fenced in by a fence of at least 1.2 metres high (from the ground) to secure the perimeter; Above the ground pools with sides higher than 1.2 m, at all points from the ground, or pools that can be dismantled with a side of 1.4 m or more from the ground, at all points, do not need a fence all around them when the access to the pool is as described below: 1) The pool is against a platform (deck) where the pool access is prevented by a 1.2 m high railing and gate equipped with a locking device, with no more than a 4 inch distance between the rungs, in conformity with the by-law; 2) The pool is off a terrace, attached to the house, where the pool access is prevented by a 1.2 m high railing and gate equipped with a locking device, with no more than a 4 inch distance between the rungs, in conformity with the by-law 3) If a ladder is used, it must be equipped with an automatic lock once closed, to avoid easy access by children. All pools must be installed at 2 m of the following: 1) All lot lines and all buildings 2) All electrical or communication cable systems 3) Any element which can be climbed to give access to the pool Despite the above-mentioned, the heating and/or filtration systems must be installed at more than 1 meter of an above ground pool/or one that can be dismantled, unless installed under a structure which cannot be climbed on, to get to the pool. Hoses from the filter/heater have to be flexible and not permit climbing at 1 m from the pool s edge. Slopes, rows or trees, hedges, low walls and other natural elements are not considered as replacement for a fence, a wall or an enclosure; If the property is hooked up to a municipal water network, an annual tax will be imposed Pool must be located in lateral or back yards. It is possible to locate a pool in the front yard under certain conditions. Please consult the building inspector for details. 10
11 11. TEMPORARY WINTER CAR SHELTERS When there is a main building on a lot, the installation of a temporary car shelter for vehicles (single or double) is authorised within front, lateral or back yards, according to the following calendar: Temporary shelter From To Structure October 1 st May 15 th Tarp October 15 th May 1 st The car shelter can encroach within the front setback up to 0,3 m (1 pi) of the line, but no closer than 2 meters from the ditch (6 6 ) The maximal footprint is 30 m 2 (323 ) per unit and a max height of 2.5 m 12. SIGNS If you wish to install a new sign, replace or modify an existing one, the owner must obtain a certificate of authorization prior to installation. Considering the various restrictions regarding signage, please contact the town planning department to find out about the applicable requirements for your project and the paperwork to submit. 13. OTHER CERTIFICATES OF AUTHORISATION It is mandatory to obtain a certificate of authorization for the following: DEMOLITION (POOL/BUILDING) MOVING A CONSTRUCTION CHANGE OF USE OR VOCATION CERTIFICATE OF OCCUPANCY CULVERT INSTALLATION PRIVATE DOCK WORK WOTHING THE SHORELINE Considering the various provisions regarding these certificates, please contact the town planning department to find out about the applicable requirements for your project and the paperwork to submit. 11
12 14. OPEN-AIR FIRES Burning is allowed without a permit under the following conditions. These fires are subject to the provisions of By-law 474: In outdoor cooking devices such as BBQ, fireplaces and similar outdoor wood burning stoves designed for this purpose; In metal barrels or containers with a spark guard A camp fire intended to roast marshmallow, to keep mosquitos at bay or for a party, must be surrounded by non-combustible materials and not exceed 1 m 2 by 1/2 meter high; The following types of fires are authorized but require a permit and are subject to the provisions of By-law 474 which precedence over this summary: Only non-commercial or non-industrial burning is permitted, with aims to eliminate wood cutting remainders (branches, trees trunks, shrubs and other natural wood, following a clean-up; The residues to burn must be piled of maximum 2 m by 2 m on the same lot they were cleaned up without exceeding 1 m high. Only one fire can be burned at a time; It is strictly forbidden to burn construction materials and toxic materials; It is forbidden to burn the fallen trees or those cut on a vacant lot to be built. 12
