5 BOCW Act,1996, Section 44-Responsibility of Employers An employer shall be responsible for providing constant and adequate supervision of any building or other construction work in his establishment as to ensure compliance with the provisions of this Act relating to safety and for taking all practical steps necessary to prevent accidents. 5

6 Section 32(b) of Factories Act,1948 there shall, so far as is reasonably practicable, be provided and maintained safe means of access to every place at which any person is at any time required to work; 6

7 Section 32 (c) of Factories Act,1948 when any person has to work at a height from where he is likely to fall, provision shall be made, so far as is reasonably practicable, by fencing or otherwise, to ensure the safety of the person so working. Rule 42(6) of WB BOCW Rule,2004 Wherever building workers at a building or other construction work are exposed to the hazards of falling from height while emploed on such work, they shall be provided by the employer with adequate equipment or means for saving them from such hazards.such equipment or means shall be in accordance with the national standards Section 33 of Factories Act,1948 In every factory every fixed vessel, sump, tank, pit or opening in the ground or in a floor which, by reason of its depth, situation, construction or contents, is or may be a source of danger, shall be either securely covered or securely fenced. Rule 42(5) of WB BOCW Rule,2004 Every open side or opening into or through which a building worker may fall at a building or other construction work shall be covered or guarded suitably by the employer to prevent such fall except where free access is necessary by reason of the nature of the work 7

8 Rule 42(7) of WB BOCW Rule,2004 Wherever there is a possibility of falling any material, equipment or building worker at a construction site relating to a building or other construction work, adequate and suitable safety net shall be provided by employer in accordance with the national standards 8

11 DESCRIPTION The incident occurred when the helper after cleaning the concrete debris on the working platform was on the way to coming down to the ground. He fell down from a height of 39m approx. from a connecting walkway of Jump form of cooling tower under construction.
