1 VILLE DE MONTRÉAL RÈGLEMENT RCG BY-LAW AUTHORIZING THE CONSTRUCTION AND OCCUPANCY FOR THE PURPOSES OF A CENTER FOR THE PROCESSING OF ORGANIC MATERIAL BY COMPOSTING IN A CLOSED BUILDING LOCATED ON THE NORTHEAST SIDE OF BOULEVARD MÉTROPOLIATAIN AND BOULEVARD SAINT-JEAN- BAPTISTE ON THE TERRITORY OF RIVIÈRE-DES-PRAIRIES POINTE-AUX- TREMBLES BOUROUGH In view of subparagraph (2) of section 89 and section of the Charter of Ville de Montréal (CQLR, chapter C-11.4); In view of paragraph (6) of section 19 of the Act respecting the exercise of certain municipal powers in certain urban agglomerations (CQLR, chapter E ); At its meeting of March 26, 2015, the urban agglomeration council enacts: CHAPTER I TERRITORY 1. This by-law applies to the territory corresponding to lot number , cadastre of Québec. Despite the first paragraph, article 6 applies to the territory corresponding to lot number , cadastre of Québec, as well as to the territory included in a 500 meter radius measured from the limits of the lot. CHAPTER II AUTHORIZATION 2. The construction and occupancy of a center for the processing of organic material by composting in a closed building is authorized under the conditions specified in this by-law. 3. For the purposes of article 2, a departure is authorized from articles 18, 26, 28, 29, 89, 90, 91, 95, 98, 101 (1), 103, 104, 109 (2), 138 at the line corresponding to équipement mécanique au sol ou en saillieˮ, 148, 183, 185, 231 and 325 of the Règlement de zonage de l arrondissement de Rivière-des-Prairies Pointe-aux-Trembles (RCA09-Z01) and to section 14 of chapter 2 of the Règlement sur les plans d implantation et d intégration architecturale (PIIA) de l arrondissement de Rivière-des-Prairies Pointe-aux-Trembles (RCA09-PIIA-001). 4. All other provisions consistent with those under this by-law still apply. RCG /1
2 5. The Règlement sur les dérogations mineures de l arrondissement de Rivière-des- Prairies Pointe-aux-Trembles (RCA ) applies to the provisions under this by-law. CHAPTER III CONDITIONS SECTION I USES 6. Subject to article 7, on the territory corresponding to lot , cadastre of Québec, as well as on the territory included in a 500 meter radius measured from the limits of the lot, uses provided for in the table of specifications of the Règlement de zonage de l arrondissement de Rivière-des-Prairies Pointe-aux-Trembles numéro RCA09-Z01 is authorized for each zone, except for residential group uses, commercial and service group uses, and uses classified as P.1, P.2 and P.3 of the Public and institutional group. 7. Use of a centre for the processing of organic material by composting in a closed buildingˮ is authorized on the territory corresponding to lot , cadastre of Québec. Furthermore, complimentary use of greenhouse agricultural or horticultural productionˮ is also authorized on the roof of the main building located on the territory corresponding to the lot referred to in the first paragraph. SECTION II HEIGHT AND BUILDABLE AREA 8. The maximum height of a building is 18 meters. Despite the first paragraph, a rooftop construction with a maximum height of 6 meters is authorized to house the complimentary use of greenhouse agricultural or horticultural productionˮ. 9. A building must have a front setback of at least 7.5 meters from Boulevard Métropolitain and from Boulevard Saint-Jean-Baptiste. 10. A building must have a minimal side and rear setback of 2 meters. 11. The site coverage must not exceed 70%. RCG /2
3 SECTION III CONSTRUCTION AND OCCUPANCY OF EXTERIOR SPACES 12. A minimum number of 10 parking spaces is required and a maximum number of 20 parking spaces is authorized. 13. No loading unit is required. 14. The installation of trickle filter equipment is authorized only in another yard. 15. Outdoor storage is not authorized except for the storage of trucks or their trailers under the conditions referred to in the second paragraph of article 325 of the Règlement de zonage de l arrondissement de Rivière-des-Prairies Pointe-aux-Trembles (RCA09-Z01). SECTION IV LANDSCAPING 16. An application for an authorization certificate or a landscaping, excavating or building permit must be accompanied by a landscape plan. 17. Landscaping including tree planting must be completed within 12 months following work completion. 18. Plants included in the landscaping covered by article 17 must be maintained in good condition, and replaced as needed, to preserve an overall healthy appearance. CHAPTER IV LAND USE, ARCHITECTURE AND DESIGN CRITERIA 19. Prior to issuing an authorization certificate or a building permit, work covered by this by-law must be approved in accordance with the following criteria: Objectives (1) promote the construction of a building that is functional, secure and well-built; (2) promote the design of spaces that are functional, secure and well-built; (3) prioritize an integrated approach to site development that connects the architecture to the landscape; (4) encourage concealing from the sight of any public thoroughfare the outdoor parking, loading and exterior storage areas as well as the equipment connected to the building; RCG /3
4 (5) consider the roof as a fifth facade that adds to the visual quality of the project and to sustainable development; (6) promote the building of a green roof, a roof with a high light-reflection index or a greenhouse on a significant part of the roof of the main building. Criteria (1) the building design and landscaping must favour integrating the measures used in the principles of sustainable development and must demonstrate a certain environmental performance; (2) the volumetry of the building must be integrated with its environment; (3) the landscaping and building architecture must contribute to the integration of the building within its context; (4) the project must tend to limit environmental impacts especially pertaining to sunlight, wind, noise, fumes as well as to vehicular traffic; (5) driveways and vehicular manœuvre lanes, outdoor storage areas as well as parking areas must demonstrate a high level of security and functionality; (6) material such as stone, brick, cement, glass, aluminum, architectural stainless steel or any other quality material must be valued as the material of choice for exterior coverings used on the main facade of the main building; (7) mechanical equipment must tend to blend in with the building; (8) roof coverings must favour a high light and heat reflection index, a partial vegetation canopy or structures that permit cultivation; (9) where appropriate, a greenhouse built on the roof of the building must harmonize with the latter and be adequately integrated with it; (10) fences should be dealt with in temperance as to their form, size, materials and color; (11) landscaping should tend to diminish the visual impact of parking, loading and outdoor storage areas as well as mechanical equipment, from the sight of public thoroughfares. CHAPTER V PENAL PROVISIONS 20. Every person who occupies or uses part of a lot, a lot, land or a construction, authorizes its occupancy or use, or erects or allows the erection of a construction, demolishes or RCG /4
5 allows a demolition, alters or allows an alteration contrary to this by-law or contravenes this by-law, is guilty of an offence and is liable to the penalty under article 33 of the Règlement de zonage de l arrondissement de Rivière-des-Prairies Pointe-aux-Trembles numéro RCA09-Z01.
