3 1.0 GENERAL EXPLANATION. 1.1 Legal Requirements: The Cheshire East Council, as highway authority, are empowered to require that the owner/ occupier of any premise adjoining or having access to a public highway who habitually uses, or permits to be used, any grass verge or footway as an access point to his/her premises shall have a properly constructed crossing provided at his/her expense. The normal footpath or verge is not satisfactory to serve as a crossing point by vehicles. A properly constructed crossing is required and it will be necessary to excavate and replace the existing footway and/or verge for such purpose. After completion of the work in accordance with these conditions the Cheshire East Council will accept responsibility for all future maintenance of the crossing. 2.0 CONDITIONS AND PROCEDURE. 2.1 Planning Requirements: Where the proposed access is on a classified road the first step is to obtain planning permission for the access by applying to the Planning Department. This step precedes any approach to the highway authority. 4 2.3 Information Required on Initial Enquiry: The applicant should give:- i) Full name and postal address and whether he/she is the owner, occupier or developer; ii) iii) iv) Any other details necessary to locate the property; A sketch plan sufficient to show the required position and size of the proposed crossing; Details and reference numbers of any planning permissions there may be pertaining to the property or the access. 2.4 Approval and Arrangement for Quotation: A representative will visit the site and after consideration the applicant will be notified by the Engineering Service that:- i) The proposals are approved or ii) They are approved subject to modifications or iii) They are rejected. 2.5 Requirements for Applicant Wishing to Construct Crossing: The applicant may not carry out the work him/herself or have the work carried out on his/her behalf unless:- i) The application is in respect of a crossing and access which is part of a development for which planning permission has been granted under the Town and Country Planning Act 1962 and/ or; ii) The highway authority specifically authorises him/ her to execute the work in accordance with the plans approved by them and; iii) He/ she has submitted to the Area Maintenance Engineer the certificate of an insurance company showing that he/ she is fully insured for employers and public liability up to a value of 5,000,000 and that the policy contains a principals clause indemnifying the Cheshire East Council in respect of any claims arising from the execution of the works and; iv) He/ she fully complies with all the requirements of Chapter 8 of the Traffic Signs Manual for Safety at Roadworks and Other Temporary Situations and; v) He/ she complies with The New Roads and Street Works Act 1991 as if he/ she were the promoting authority.

5 2.6 CONSTRUCTION (DESIGN AND MANAGEMENT) REGULATIONS 1994 The Construction (Design and Management) [CDM] Regulations 1994 place new duties upon clients, client's agents (where appointed), designers and contractors to rethink their approach to health and safety so that it is taken into account and then co-ordinated and managed effectively throughout all stages of a construction project: from conception, design and planning through to the execution of works on site and subsequent maintenance and repair. In accordance with the CDM regulations, the Health and Safety Executive advises that where anyone wishes to work within the highway boundaries, and such work entails excavation of 100mm depth or greater, the person(s) responsible for the work shall serve notice on the various Statutory Undertakers, together with plans of the proposals, in order to determine the locations and depths of any apparatus within the proposed site. It is the responsibility of the promoter of the work to contact all the relevant Statutory Undertakers and to ensure that all replies have been received before work may commence. The Area Maintenance Engineer may require evidence of all replies before permission to commence may be given. A LIST OF STATUTORY UNDERTAKERS IS INCLUDED WITH THIS SPECIFICATION. 3.0 PUBLIC UTILITIES PLANT REQUIREMENTS. 3.1 Adjustment of Service Boxes: All boxes or manholes belonging to the Gas, Electricity, Water, Telecom, Cable, etc. companies or Councils must be properly refitted to be flush with the finished surface of the crossing and the applicant must communicate with the undertaking concerned to ensure that no cable or pipeline will be affected or require lowering and that all work is carried out to their satisfaction. The Area Maintenance Engineer will give information as to the responsible persons to be contacted. 3.2 Strength Requirements for Covers and Frames: Manhole covers and frames in vehicular crossings must comply with the strength requirements stated in BS497 (or as superseded by EN 124) for Grade B covers in domestic crossings and Grade A covers in commercial crossings. 4.0 CONSTRUCTION REQUIREMENTS. The following applies only to cases in which the applicant has satisfied the requirements of paragraphs 2.3 and 2.5 above and has been authorised in writing to execute the work. Consultation with Area Maintenance Engineer:

6 4.1 Before any work is commenced the Area Maintenance Engineer must be consulted as to the type of crossing, its extent and position, any structural requirements, levels required and the type and quality of materials to be used, and all work must be carried out and completed in accordance with the approved plans and these requirements. The Area Maintenance Engineer may under special circumstances or where crossings are required for use by commercial vehicles vary the particulars contained in this document. Note that a vehicular crossing may need to be constructed as a carriageway; footway crossings are for occasional light traffic only. 4.2 Crossfall: The surface of the crossing should have a straight crossfall where practicable of 1 in 16 from the back of the footway to the back edge of the kerb with a maximum crossfall not exceeding 1 in 12. The centre line of the crossing shall coincide with the centre line of the gateway served by the crossing. The back of the crossing should be at the same level and/or gradient as the back of the footway either side of the crossing. 4.3 Adherence to Specification: The Specification for workmanship and materials given must be strictly adhered to and the assistance of the Area Maintenance Engineer should be sought if any doubt or difficulty arises. 4.4 Notification of Commencement of Works: The Area Maintenance Engineer MUST BE INFORMED at least 48 hours (i.e 2 working days) before commencement of any work so that supervision can be arranged. Failure to comply with this requirement may result in trial holes being dug at the expense of the applicant. 4.5 Safety Requirements: Any plant, equipment, excavation and material deposited must not form a dangerous obstruction in the carriageway or on the footway and protective fencing must be provided. Amber danger lamps and roadworks signs and guards must be provided and maintained at all times and a safe passage given to pedestrians. On completion the site must be left clean and tidy. 5.0 SPECIFICATION FOR CONSTRUCTION. 5.1 Foundations; After the bulk excavation is complete the formation must be trimmed to the correct surface profile and falls. Any soft spots must be excavated to reach firm ground and an approved fill used to regain sub-grade levels.

7 Foundation Materials; The following materials are approved for the construction of crossing foundations:- i) Type 1 granular sub base material (DoT specification clause 803). ii) Crusher run stone from an approved source. iii) Cement bound material Category 3 (CBM3) (DoT specification clause 1038). iv) Any other material approved in advance by the Area Maintenance Engineer. Thickness of Foundation Material; For normal domestic crossings the foundation material shall be spread and compacted in layers not exceeding 100mm using approved compaction plant giving not less than 1.0 tonne effective compacting force and finished to the correct profile line and level to a total thickness of 200mm. For commercial crossings this total thickness may be increased at the discretion of the Area Maintenance Engineer. 5.2 Kerbs and Edgings; Any existing kerbs and edgings deemed suitable for re-use by the Area Maintenance Engineer shall be taken up and stacked on site. New kerbs shall be hydraulically pressed 125mm x 255mm or 125mm x 150mm as required by the Area Maintenance Engineer and shall comply with BS340. Stone kerbs shall be as approved by the Area Maintenance Engineer. The kerbs shall be laid across the crossing to give a 25mm upstand and purpose made dropper kerbs shall be used to reduce the full kerb level on either side of the crossing. Standard kerbs laid flat may be allowed as dropped kerbs under special circumstances approved by the Area Maintenance Engineer. Radius kerbs shall be used for radii less than 12 metres. Edgings shall be precast concrete hydraulically pressed 200mm x 50mm or 150mm x 50mm with flat tops and shall be laid with their tops flush with the footway. Half edgings shall be used for radii less than 5m. 5.3 Setting Out; Kerbs and edgings must be properly set out to line and level using kerbing pins and string from either: - i) Pegs or pins given by the Engineer; ii) The position of existing or proposed kerbs, thresholds or other limiting features on the site. The whole crossing should be set out using pins spaced at not more than 5.0 metre intervals and the line adjusted to give smooth, good looking alignment. Crossfall shall be required across the footway and if a backfall is necessary suitable drainage will have to be provided to the satisfaction of the Engineer. 5.4 Laying Kerbs and Edgings:

8 Kerbs, channels and edgings are to be laid on a bed of ST1 mix concrete 150mm thick x 300mm wide (400mm in the case of standard kerbs to be laid on their side) and backed with ST1 mix concrete 150mm thick up to 50mm from kerb top. Edgings are to be laid by tamping each edging to line and level into a 100mm thick bed of ST1 mix concrete and then haunching on both sides with a 100mm thickness of concrete. All concrete to beds and backing haunches shall be compacted by tamping. 5.5 Basecourse for Bituminous Construction: The material used for basecourse shall be; Dense macadam basecourse with 20mm nominal sized aggregate to BS4987 part 1; 1993 (as amended): clause 6.5. Thickness of Basecourse Material: Bituminous basecourse shall be evenly spread and raked to the required profile and thickness and compacted with approved mechanical plant giving not less than 1.0 tonne effective compacting force with at least 6 or 8 passes giving a total compacted thickness of 60mm. 5.6 Wearing Course for Bituminous Construction: The material used for wearing course shall be either; Dense wearing course with 6mm nominal sized igneous aggregate to BS4987 part 1; 1993 (as amended): clause 7.5 Or Medium textured wearing course with 6mm nominal sized igneous aggregate to BS4987 part 1; 1993 (as amended): clause 7.6. Thickness of Wearing Course Material: Bituminous wearing course shall be evenly spread and raked to the required profile and thickness and compacted with approved mechanical plant giving not less than 1.0 tonne effective compacting force with at least 6 or 8 passes giving a total compacted thickness of 20mm N.B. All coated materials used in the construction of a vehicular crossing shall be sourced from a supplier who has been tested and approved by Cheshire East s Council's laboratory. All approved materials from each such supplier will have a certificate number, which will appear on each delivery ticket.
