2 INTRODUCTION The Sea Pines Property Owners Association (SPPOA) Architectural Review Board (ARB) has established the following criteria. The purpose of these criteria is to supplement the information provided in our covenants. These criteria do not address all the types of improvements that require ARB review and approval. Additionally, there are certain improvements that are not permitted by the Sea Pines Covenants and Restrictions. The ARB advises all Sea Pines Owners to review a copy of the Sea Pines Property Owner s Association Covenants and Restrictions prior to initiating any alteration to their home and/or property The ARB will accept submittals only from Sea Pines property owners, not from any third party such as a contractor. Approvals will be provided directly to the homeowner. Disapprovals will be sent to the Property Manager for appropriate action. ARB Architectural Criteria 5/16/16 Page 1 of 5

4 DAMAGE DEPOSIT FOR NEW CONSTRUCTION (May 2016) Prior to the ARB granting approval for any new home construction a refundable damage deposit of $2, will be deposited with the association in a non-interest bearing escrow account. This deposit must be made by the association s designated builder, made out to Sea Pines Property Owners Association. DAMAGE DEPOSIT FOR RENOVATIONS OR ADDITIONS (Nov 2008) Section of the Sea Pines Property Owner s Association Covenants and Restrictions requires that prior to obtaining a building permit for the construction of any renovation or addition, including the addition of a swimming pool, the Owner of the Lot shall post a refundable damage deposit with the Association in the amount of $1, The ARB shall for each application determine whether a deposit will be required. If a deposit is determined to be necessary the requirement will be included in the approval of each application. FENCES (Nov 2008) Fences including pool fences will be 48 inches in height, constructed of aluminum, finished in a bronze color with a maximum picket size of 1 inch square. No privacy fences will be allowed. Lots not fronting on a lake may extend the fence from the rear building foundation corner outward to within 30 inches of the side lot lines. The fence may extend to the rear within 18 inches of the rear property line. Lakefront lots may extend the fence from the rear building foundation corner outward 5 feet maximum and rearward from the back of the house not more than 16 feet. The layout of the fencing must be reviewed and approved by the ARB. FLAG ETIQUETTE (Nov 2008) The ARB encourages each property owner to exercise proper flag etiquette when displaying the flag. There are several good web sites regarding flag etiquette. One such web site is The American Legion, FLAG POLES HOUSE MOUNTED (REMOVABLE) A house mounted flag pole may be mounted on the front exterior of a house. The flag pole holder may be mounted no higher than 7-0 from the ground. The flag pole may be no longer than 8-0. The flag may be no larger than 4 ½ x 6. (Sep 2014) No ARB approval is required for house mounted, removable flag poles and flags as long as they meet this criteria.(nov 2008) FLAG POLES LAWN MOUNTED (REMOVABLE) A lawn mounted, removable flag pole may be mounted no further than 6-0 from the front of a house. The flag pole may be no higher than The flag may be no larger than 4 ½ x 6. The flag pole base must be anchored at ground level. (Sep 2014) No ARB approval is required for lawn mounted, removable flag poles and flags as long as they meet this criteria.(nov 2008) ARB Architectural Criteria 5/16/16 Page 1 of 5

5 FLAG POLES, PERMANENT The definition of a permanent flag pole is one that is either higher than 10-0, OR, further than 6-0 from the front of the house. (Nov 2008) A permanent flagpole shall not exceed 20 in height and the flag shall be no larger than 4 ½ by 6. The base must be anchored at ground level. (Sep 2014) Notwithstanding that a permanent flag pole can be removed from its base, any flag pole that is either higher than 10-0, OR further than 6-0 from the front of a house shall be deemed a Permanent flag pole. (Nov 2008) NOTE: The location of the flag pole must be reviewed and approved by the ARB prior to installation. (Nov 2008) HANDICAPPED ACCESS RAMP (Nov 2008) Florida Statutes provide that any lot owner may construct an access ramp if a resident or occupant of the lot has a medical necessity or disability that requires a ramp for egress and ingress. Any ramp must be as unobtrusive as possible. Plans for access ramps must be submitted in advance to the ARB for approval along with an affidavit from a physician attesting to the medical necessity or disability of the resident. HERBS AND VEGETABLES IN LANDSCAPE a. Herbs (Sep 2014) Both perennial and annual herbs may add beauty and usefulness to one s landscape. Specific plan, including location, for such landscape opportunities must be submitted and approved by the ARB. Raised beds using landscape timbers or rocks may be considered on a case-by-case basis. b. Vegetable Gardens (Sep 2014) While large scale gardening is not permitted, certain request may be approved by the ARB in keeping with the overall aesthetic aspects of our community. Specific locations of garden, size, type of plants, and other vegetation must be included in each Request for Approval. Garden plots may be permitted on side yards provided appropriate landscaping is also included to hide the site from the street and /or the ponds. The vegetable garden site must be cleared of dying/dead plants at the end of the growing season and left with a presentable appearance. Raised beds using landscape timbers or rocks will be considered on a case-by-case basis. The ARB reserves the right to approve/disapprove each request after review and each case will be considered on its own merits. ARB Architectural Criteria 5/16/16 Page 2 of 5

6 LANDSCAPING The ARB supports the Landscape Committee s recommendation that Sea Pines property owners follow the Florida Friendly Policy regarding landscaping. (Nov 2008) Homeowners must submit a landscape plan to the ARB prior to planting multiple landscape items. This submittal requirement is exclusive of replacements of like items. (Nov 2008) No changes shall be made to any limited common elements without ARB approval. (Nov 2008) No plantings in the ponds (JAN 2015) No plantings in the easement(s)/limited common area(s)*/drainage easements* No resident may introduce any vegetation of any kind within the ponds, waterways, conservation areas and overflow structures of any pond or waterway or anywhere on any Limited Common Area or Drainage Easement. Any plantings within the rear yard of a pond parcel must be approved in advance by the ARB, be aesthetically pleasing, with the type of plant, growing season, typical height and width of canopy at maturity, and the views of neighboring parcels considered. In addition, all plans and specifications shall be evaluated as to visual and acoustical privacy and as to the harmony of external design and location in relation to surrounding structures, topography, existing trees and other natural vegetation and as to specific conformance with architectural criteria which may be imposed from time to time by the Association. Due to the sensitive nature of the wet detention ponds, variances to the above will not be considered. *Owners having existing plantings within the limited common areas or drainage easements, prior to the criteria revision date shall not be required to remove such plantings. Prior plantings in the limited common areas or drainage easements may not be replaced if such plantings die. All debris shall be immediately removed. ARB Architectural Criteria 5/16/16 Page 3 of 5

7 OFFICES, HOME An owner may have a home office in his/her residence for the purpose of receiving mail, making and receiving phone calls, sending and receiving faxes, writing reports and correspondence. Receiving clients in one s home is prohibited. No approval by the ARB is required if the above conditions are complied with. It is the responsibility of the property owner to obtain all required permits from the County and the State. Owners are reminded that section 11.1 of the covenants prohibits a business being conducted from residence. PAINT COLORS, EXTERIOR STUCCO (Sep 2014) The following exterior paint colors for stucco body and trim have been approved by the ARB. Use of the approved colors required no further approval by the ARB. Colors other than those approved require ARB approval prior to application. These colors are Sherwin Williams color numbers. Alternate manufacturers equivalents may be substituted. Skate Board Ramps Skate Board Ramps that cannot be moved and stored when not in use will not be approved by the ARB. However, ramps that may be moved and stored when not in use may be approved. Such ramps require prior approval and must be moved to a position that is out-of-sight of the street or lake view at dusk or when otherwise not in use. The exits from such ramps must feed away from the street. Request for approval must include size, location, and general configuration of the ramp. b. Basketball Goals The ARB may approve permanently mounted basketball goals. Such goals must be positioned at a point in line with or behind the forward edge of the home (in relationship to the street). Basketball goals that are portable (meaning they can be moved when not in use) may be approved by the ARB. The use location of these goals must be approved prior to positioning. Backboard, net, and pole must be maintained in a good condition. Poles are to be solid earth tone or black and no court markings are permitted. ARB Architectural Criteria 5/16/16 Page 4 of 5

8 The location of portable basketball goals, when players are in the street to participate, is not permitted. c. Swing and Swing Sets Set are defined as containing any of the following: slide, ramp, bar, pole, or tent. The set must be constructed of wood and covered by a 10-year warranty on materials. No set of metal construction will be approved. The ARB must approve sets prior to placement in the homeowner s yard. The request must include location of set, dimensions, brochure highlighting the features of the set, and colors (natural colors). No side yard placement of the set will be approved except in unusual circumstances as determined by the ARB. Each request will be reviewed and approved/denied on its own merits. Playground equipment placement will not be approved in back yards of lake lots. d. Surf Boards, Kayaks, and other Individual Water Sports Equipment All individual water sports equipment must be stored out-of-sight of the street when not in use. SCREEN ENCLOSURES, POOL AND LANAI Pool screen enclosures and lanai enclosures will be bronze, black, or white in color with bronze or black screening.(sep 2014) The layout of the structure must be reviewed and approved by the ARB. (Nov 2008) SHEDS, STORAGE Storage sheds will not be approved by the ARB.(Nov 2008) SIGNS (Nov 2008) Our covenants restrict signs to only those approved by the ARB. The ARB has approved a House for Sale or a House for Rent sign. No further approval is required for a sign that complies with this approved design. Florida state statues provide the any owner may display a sign provided by a contractor for security services within 10 feet of any entrance to his home.
