3 HOMEOWNERS ASSOCIATION APPROVAL NEEDED FOR THE FOLLOWING: [No structures, outside lighting, fences, hedges, walls, walks, docks, or planting shall be commenced, erected or maintained, nor shall any addition to or any change or alteration therein, be made until the plans and specifications showing the nature, purpose, kind, shape, height, materials, floor plans, color scheme and the location of such structure or work to be done shall have been submitted and approved in writing by the HOMEOWNERS ASSOCIATION.] SCREENING of EQUIPMENT It is required that air conditioner unit(s), irrigation pumps, pool pumps, heaters and any other such equipment must be screened from view. All types of screening must have HOMEOWNERS ASSOCIATION approval prior to installation. TENT/CANOPY Temporary use of a party tent/canopy is allowed with HOMEOWNERS ASSOCIATION approval. SWIMMING POOLS/SPA HOMEOWNERS ASSOCIATION approval is required. Above-ground pools are not allowed. PLAYGROUND EQUIPMENT Playground equipment that remains outside requires HOMEOWNERS ASSOCIATION approval. All playground equipment, swing sets, temporary sports equipment, including but not limited to skate ramps, hockey goals, horseshoes, bocce, croquet, badminton/volleyball equipment and the like shall be placed in the rear of the residence and must be screened from view with adequate landscaping in compliance with the requirements of the HOMEOWNERS ASSOCIATION so the equipment is not visible from the adjoining properties and roadway. GARAGE All homes shall have at a minimum a two-car fully enclosed side entry garage. HEIGHT No building shall exceed the height of two stories or thirty-five feet. ROOF Roof pitch shall be 6:12 for a one story roof and 5:12 for a second story roof. Acceptable roofing materials are cedar shakes, tile (barrel, s, and flat), and dimensional fiberglass shingles (Elk, Prestique Plus or Celotex Presidential) in darker colors-no arctic white or sandstone. There should be a two foot overhang unless deemed architecturally redeeming by the Homeowners Association; the soffit shall be stucco. If there is a covered patio, it shall be a trussed (pitched) patio, with a roof pitch to match the house. ADDITIONS Additions shall be designed so as to appear to be part of the original design of the structure. Accessory buildings and structures (such as freestanding garages, or cabanas or like structures) shall conform to the same color and material standards applicable to the principal building. The materials and color shall match that of the principal building. This rule does not apply to free standing play equipment less than eight feet in height. HOUSE COLORS All house colors need to be submitted to the HOMEOWNERS ASSOCIATION for approval. Check also: Village of Wellington Ordinance Development and Design Standards 9 2
4 MEADOW WOOD INTERIOR LOT PERIMETER FENCE WOODEN PICKET LOT PERIMETER FENCING (Interior Lots) Only the following types of perimeter fences are authorized on interior lots: White or Bronze Aluminum Picket Fence with top and bottom rails having picket 4" on center or 6" on center. Height may be 4' or 5'. White PVC/Vinyl Picket Fence with top and bottom rails having picket 4" on center or 6" on center. Height may be 4' or 5'. Wooden Picket Fence with top and bottom rails having pickets 5" on center. Height may be 4' or 5'. Wooden fence must be painted bronze color or natural pressure treated - free of mildew and mold. (Description on PAGE 7) Installing chain link fencing is discouraged but if installed specific requirements must be met: 1. At the time of installation there must be a 4 or 5 foot high exterior hedge hiding the entire chain link fence from view. 2. All gates must be of one of the above referenced fencing materials. 3. At no time should the chain link fencing be seen from any other property or roadway. SETBACKS Placement of fencing must be reviewed on an individual basis because of the different lot configurations. Basically, only back yards are to be fenced. Fencing on side yards adjacent to street must be set back in line with the house. Also, for consistency of standard interior Meadow Wood Lots, all spaced picket fencing must be set a minimum of 10 off the side property lines and may run on the rear property line. All setbacks are to include the hedge line. Landscaping on exterior portions of the fencing will be optional, except for chain link fencing. The exterior portion of all chain link fences must be landscaped. Hedges used in lieu of fencing shall meet with the same height, set back and pre-approval requirements as above. Hedges backing properties along Flying Cow Road and the C-1 Canal will not have a height requirement but must be maintained in a neat appearance so as not to create a nuisance to ones neighbors. 6 NUISANCES There shall not be erected, constructed, suffered, permitted, committed, maintained, used or operated on any of the land within Meadow Wood any nuisance of any kind or character. HOME DESIGN STANDARDS USE Only one residential dwelling unit may be built on any one lot. All lots are restricted to residential use. However one may maintain a home occupation upon the lot. A home occupation is allowed per the Village of Wellington Ordinance for certain residential businesses and all applicable licenses must be obtained. No lot as described in the Plat of Meadow Wood shall be subdivided into smaller tracts of land. Only one dwelling unit shall be constructed on the lot. APPROVAL All No structures, outside lighting, fences, hedges, walls, walks, docks or planting shall be commenced, erected or maintained, nor shall any addition to or any change or alteration therein, be made until the plans and specifications showing the nature, kind, shape, height, materials, floor plans, color scheme and the location of such structure or work to be done shall have been submitted and approved in writing by the HOMEOWNERS ASSOCIATION. The HOMEOWNERS ASSOCIATION shall have the right to refuse approval of any plans and specifications or grading plans, which it determines, in its sole discretion, are not suitable or desirable in its sole discretion, for aesthetic or other reasons,. such consent shall not be unreasonably withheld; and iin so passing upon such plans, specifications and grading plans,, the Association shall in making its determination, have the right to take into consideration the suitability of the proposed building or other structure and the materials of which it is to be built, on the site upon which it is to be built and the area in which it is to be built. SIZE One story homes shall have a ground floor minimum of 2,200 square feet of air conditioned living area; One and a half and two story homes shall have a ground floor minimum of 1,400 square feet air conditioned living area with a minimum total square feet of air conditioned living area of 2,200 square feet. BASKETBALL GOALS All temporary and permanently installed basketball boards and hoops shall be subject to the following restrictions: A. Backboards and hoops may be mounted only to a freestanding pole adjacent to the driveway at side or rear of yard. B. Backboards and hoops shall not be mounted on a wall or roof of a building; C. The backboards and hoops shall be located no closer than thirty (30) feet to from the front property line, five (5) feet from the rear property line, and thirty (30) feet from the side-corner property line; D. Backboards and the poles on which they are mounted shall not exceed fourteen (14) feet in height measured from the grade level at the point on the front property line nearest to the pole; Freestanding poles and backboards shall not be painted or otherwise modified from the original manufactured finish or structure; all equipment shall be maintained in an as new condition FLAGPOLES Residential flagpoles shall be subject to the following regulations: A. Flag poles may be mounted in the ground, attached to a fascia or attached to a wall; B. No pole shall be closer than fifteen (15) feet to any property line; C. No flagpole shall be higher than twenty (20) feet at its highest point measured from grade level at the nearest point on a property line. D. No more than one flag shall be displayed per lot. E. All equipment shall be maintained in an as new condition. 1 10
7 LANDSCAPING REQUIREMENTS TREES A. Each lot shall have a minimum of 12 trees, at least 15 feet tall and 6 inches in diameter 3 feet above ground. B. The following trees are approved to be installed to meet the above requirements: Black Olive, Bottle Brush, Cypress, Laurel Oak, Live Oak, Mahogany, Orchid Tree, Queen Palm, Red Bay, Red Maple, Sabal Palm, Slash Pine, Tabebuia and Turkey Oak and others upon approval. Only 50 % of the tree requirement may be palms. Check with the Village of Wellington, for complete list. The approved tree list may be revised by State, Local or other Governmental agencies. C. No native tree shall be removed without the consent of the HOMEOWNERS ASSOCIATION. SHRUBS Each lot shall have at least 125 three gallon ornamental shrubs, twenty-four inches high. The following are prohibited plant species: Melaleuca, punk tree, Cajeput or paper tree - Melaleuca quinquenervia Brazilian pepper or Florida holly - Schinus teribinthifolius Australian pine - Casuarina spp. Earleaf acacia - Acacia auriculiformis Kudzu - Pueraria montana (P. lobata) Small-leaved climbing fern - Lygodium microphyllum Air potato vine - Dioscorea bulbifera Carrotwood - Cupaniopsis anacardiodes Schefflera - Schefflera actinophylla Check with the Village of Wellington, for complete list. From time to time types of shrubs may be added or deleted from this list. FENCES AND HEDGES MEADOW WOOD SUBDIVISION PERIMETER FENCING MAJOR THOROUGHFARE FENCING Per the attached map (PAGE 5), lots indicated with an X that back up to a main street will be allowed to install a major thoroughfare fence as described on PAGE 6. All major thoroughfare fences shall be set back three (3) feet from the rear and side property line to provide sufficient area for hedge planting. This fence is to be painted on both sides with Brunning Carriage House Solid Body Latex Stain, Dove Gray (or another brand of same color) or chain link as set forth under Lot Perimeter Fencing (PAGE 4) and landscaped as required by the HOMEOWNERS ASSOCIATION. DOCKS APPROVAL Prior to the construction of a dock the property owner must obtain approval from the Homeowners Association. Approval of the Village of Wellington approval must first be obtained. APPLICATION The following information shall be submitted when making application for approval to install a dock together with any additional information required to perform a complete review. A. A site plan illustrating compliance with the requirements contained herein and showing the lot, canal right of ways, all structures, canal water line and the proposed dock and associated decks and walkways. B. A cross section elevation which shows the dock in relationship to the slope. C. A landscape plan illustrating compliance with the standards contained herein. D. A drawing and specification sheet which details the materials, colors, and methods of construction. GENERAL REQUIREMENTS A. Structures placed upon the canals cannot extend into the water, but may be cantilevered over the water a maximum of three feet. B. The top of the dock and any portion of the deck may be a maximum of two feet above the normal high water level of 12 feet above mean sea level. C. A dock shall be constructed of wood. Docks of other material may be approved by the Homeowners Association. D. Docks shall be designed to be compatible with and harmonious with the surrounding elements, existing site conditions and adjacent properties. E. Homeowner is required to maintain property to the canal water-line, including regular lawn and other vegetation maintenance. 3 8
