1 OFFICIAL NOTICE TO BIDDERS BITUMINOUS STREET RESURFACING S. 12 th Street Alabama Ave. to Indiana Ave. Sheboygan Water Utility Project Number OWNER: The Sheboygan Water Utility, acting through its Commission, hereby gives notice that sealed Bids will be received for Bituminous Street Resurfacing in the City of Sheboygan, Wisconsin. The work consists of the final grading and rolling of the existing road base (2,500 SY) and the installation of approximately 600 Tons of Bituminous Asphalt Resurfacing for an existing residential street in Sheboygan, Wisconsin. Substantial completion for this work is November 7, TIME AND PLACE OF BID OPENING: Sealed Bids will be received from bidders until 11:00 A.M., Local Time, on Friday, October 10, 2014 in the office of the Water Utility, 72 Park Avenue, Sheboygan, Wisconsin, at which time and location, the Bids will be publicly opened and read aloud. BIDDING DOCUMENTS: The Bidding Documents may be examined and obtained at the Water Utility office, 72 Park Avenue, Sheboygan, WI, during normal business hours, 7:30 A.M. to 4:00 P.M., Monday through Thursday, and until 2:30 P.M. on Friday, starting Thursday, October 2, Bidding Documents can also be obtained by visiting our web site at sheboyganwater.org LEGAL PROVISIONS: The Contract letting shall be subject to the provisions of Sections 62.15, , and of the Wisconsin Statutes and to any Federal regulations that may be applicable. WAGE RATES: CONTRACTORS shall be required to pay not less than the prevailing wage rates on the Project as established by the State of Wisconsin Department of Workforce Development. Copies of these wage rates are on file in the office of the Water Utility and incorporated in the Contract Documents. BID REJECTION/ACCEPTANCE: OWNER reserves the right to reject any and all Bids, waive informalities in bidding or to accept the Bid or Bids, which best serve the interests of OWNER. 3 BITUMINOUS STREET RESURFACING S. 12 th Street Alabama Ave. to Indiana Ave. Sheboygan Water Utility Project Number SPECIFICATIONS FOR BITUMINOUS RESURFACING City of Sheboygan, WI GENERAL 1. Proposal Unless otherwise specified, the work under this contract shall be constructed in accordance with the State of Wisconsin Standard Specifications for Road and Bridge Construction, Edition 2013 and the Standard Specifications for Sewer and Water Construction in Wisconsin, Sixth Edition, December 22, 2003, with all addendums. The proposal calls for unit prices covering the resurfacing work included in the plans and specifications. The bid price shall include all labor, materials and equipment to do all work covered by the plans and specifications. 1. Material Type and Thickness BINDER COURSE The pavement shall be brought to grade by using binder courses, each course not to exceed two (2") inches in thickness. Binder shall conform to the State Highway Commission of Wisconsin, Standard Specifications for Highway and Structure Construction, 2013 Edition, Section Recycled Asphalt Recycled asphalt may be used in the binder course and surface course under this contract. It is the responsibility of the contractor to blend the material with new aggregates and bituminous mixture to meet the specifications for bituminous binder mixture. 3. Bitumen Payment for bitumen shall be included in the price of binder course. BRS-1

4 4. Mixing and Laydown Equipment The contractor shall use an acceptable batch type asphalt plant that meets the requirements of Section 450 and related sections. All pavers, rollers and other laydown equipment shall meet the pertinent requirements of Section 450, 455, 460 and 465 of the Specifications. 5. Construction Methods Bituminous material shall be applied only during daylight hours and when the air temperature is 40 deg. F. or more, and when the surface of the previously prepared roadbed, base or existing surface is dry and free of loose dirt, dust or other foreign matter. It shall not be applied when the weather or roadbed conditions are unfavorable, or prior to impending rains when it appears probable that the material may be exposed to the rains during the penetration period. 6. Payment for Bituminous Material The contractor shall deliver to the City's representative a receipt for each truck load of bituminous material delivered to the job site, showing the type of material, weight, and location of placement. 1. Structures to be Adjusted ADJUST UTILITIES Present structures, such as manhole frames, are considered at the correct elevation. Adjustment of water stop boxes (all new boxes), if necessary, shall be incidental to the contract. 1. Time of Placement SURFACE COURSE It is the intent of these specifications that all binder courses on all project locations be completed before any surface course be placed at any project location, except that the contractor may employ a second full paving crew to place surface courses while the primary crew is placing the binder course. Asphalt surface courses shall be placed on locations only after underground utility work and curb and gutter repairs are completed. 2. Material Type and Thickness Surface course shall be 2" thick and shall conform to the Highway Commission of Wisconsin, Standard Specifications for Highway and Structure Construction, 2013 Edition, Section 460, using the mix design for the specified mix. 3. 5 Section F, items 3, 4, 5, and 6 shall also apply for Surface Course material and placement. 1. Description ASPHALTIC CONCRETE PAVEMENT, SUPERPAVE This work shall consist of designing, mixing, placing and compacting a Superpave asphaltic concrete pavement consisting of ½ nominal maximum size mixture for the single layer on the approved existing surface in accordance with the specifications and in reasonably close conformity with the lines, grades, thicknesses and typical cross sections shown on the plans or established by the engineer. The requirements of Section 460, Asphaltic Concrete Pavement and Section , Plant Mixed Asphaltic Bases, Surfaces and Pavements General Requirements, shall be applicable to this work, except as hereinafter otherwise stipulated. If any inconsistencies exist, the requirements of AASHTO MP2, Standard Specification for Superpave Volumetric Mix Design and AASHTO PP28, Standard Practice for Designing Superpave HMA shall govern. 2. Materials General: All materials used in this work shall conform to the requirements designated in Sections for the particular material specified, except as hereinafter otherwise or additionally stipulated. 3. Aggregates The aggregates shall meet the following properties: Characteristic Requirement Test Method Coarse Aggregate Angularity, % 75% one face Crushed Particles, (by count); min. 6 4. Aggregate Gradation Master Range The aggregates, including mineral filler when required, shall conform to the following gradation requirements. The gradation values listed are the extreme limits for design purposes. Production testing tolerances may allow mixture production values that exceed the aggregate master range. 5. Composition of Pavement Mixtures The asphaltic mixture shall be composed of a homogeneous mixture of coarse aggregate, fine aggregate and asphaltic material. The contractor shall submit, for each course and for the engineer s review, an asphaltic mixture design meeting all necessary criteria consistent with Section 460 of the Standard Specifications and shall be signed by a Certified Asphaltic Technician Level III. The Department will review the quality of the aggregate, the asphaltic mixture design and issue a report. The asphaltic mixture design shall be in effect until the contractor requests changes in writing and approved by the engineer. 8. Design Criteria The design criteria used for the design of the 12.5 mm nominal size mixture for the single layer shall be based on a 20 year design. ESAL count as specified in the table. BRS-4

Asphaltic Concrete Pavement, Superpave Density Density will be determined according to Subsection following the requirements for Asphaltic Concrete Pavement, Type E-1, E-3 or E Method of Measurement Asphaltic Concrete Pavement, Superpave will be measured by the ton in accordance with Subsection Asphaltic materials required for and incorporated into the mixture will be measured by the gallon or ton as delineated in Subsection Basis of Payment Asphaltic Concrete Pavement, Superpave will be paid for in accordance with Subsection following the requirements for Asphaltic Concrete Pavement, Type HMA. 8 Exhibit A SHEBOYGAN WATER UTILITY INSURANCE REQUIREMENTS (Revised June 2009) Before commencing the work, and as a condition precedent for payment, the Contractor (and any subcontractors used) shall purchase and maintain insurance, in conformance with the provisions contained in this Exhibit. This insurance will provide a defense and indemnify the Sheboygan Water Utility against any and all claims of any nature whatsoever, arising out of the Contractor s (and any subcontractors used) operations under this Agreement. This insurance shall apply regardless of whether the operations, actions, derelictions or failures to act, from which the claim arises, are attributable to the Contractor (and any subcontractors used), any of its consultants, officers, agents, employees, or anyone directly or indirectly employed by any of them, including anyone for whose acts any of the aforementioned may be liable by operation of statute, government regulation, or applicable case law. Proof of this insurance shall be provided to the Sheboygan Water Utility before the work commences, as set forth below. In no event shall the failure to provide this proof, prior to the commencement of the work, be deemed a waiver by the Sheboygan Water Utility of Contractor s (and any subcontractors used) insurance obligations set forth herein. In the event that the insurance company (ies) issuing the policy (ies) required by this exhibit deny coverage to the Sheboygan Water Utility, the Contractor (and any subcontractors used) will defend and indemnify the Sheboygan Water Utility at the Contractor s (and any subcontractors used) expense. MINIMUM LIMITS OF LIABILITY The Contractor (and any subcontractors used) must maintain the required insurance with a carrier rated A- or better by A. M. Best. The Contractor (and any subcontractors used) shall maintain at least the limits of liability as set forth below: Commercial General Liability Insurance $1,000,000 Each Occurrence Limit (Bodily Injury and Property Damage) $2,000,000 General Aggregate $2,000,000 Products/Completed Operations Aggregate $1,000,000 Personal and Advertising Injury Limit

9 Comprehensive Automobile Liability Insurance $1,000,000 Combined Single Limit Bodily Injury and Property Damage Workers' Compensation and Employers' Liability Insurance $100,000 Each Accident $100,000 Each Employee for Injury by Disease $500,000 Aggregate for Injury by Disease Additional Insured Status and Certificate of Insurance The Sheboygan Water Utility, along with their respective officers, agents and employees, shall be named as additional insureds for Operations and Products/Completed Operations on the Contractor s (and any subcontractors used) Commercial General Liability Policy, which must be primary and noncontributory with respect to the additional insureds. This insurance shall remain in effect as set forth below, in the Continuation of Coverage provision. It is expressly understood by the parties to this Contract that it is the intent of the parties that any insurance obtained by the Sheboygan Water Utility is deemed excess, non-contributory and not coprimary in relation to the coverage(s) procured by the Contractor (and any subcontractors used), any of its consultants, officers, agents, employees or anyone directly or indirectly employed by any of them, or by anyone for whose acts any of the aforementioned may be liable by operation of statute, government regulation or applicable case law. A Waiver of Subrogation Clause shall be added to the General Liability, Automobile and Workers Compensation policies in favor of Sheboygan Water Utility, and this clause shall apply to the Sheboygan Water Utility s officers, agents and employees, with respect to all projects during the policy term. Prior to commencement of work, Contractor (and any subcontractors used) shall submit a Certificate of Insurance in favor of Sheboygan Water Utility and an Additional Insured Endorsement (in form acceptable to Sheboygan Water Utility) as required hereunder. The Certificate shall provide for 30 days' notice to Sheboygan Water Utility for cancellation or any change in coverage.

10 NO LIMITATION ON LIABILITY In any and all claims against the additional insured by any employee of the Contractor (and any subcontractors used), anyone directly or indirectly employed by the Contractor (and any subcontractors used) or anyone for whose acts the Contractor (and any subcontractors used) may be liable, the indemnification obligation shall not be limited by any limitation on the amount or type of damages, compensation or benefits payable by or for the Contractor (and any subcontractors used) under workers' compensation acts, disability benefit acts or other employee benefit acts. CANCELLATION, RENEWAL AND MODIFICATION The Contractor (and any subcontractors used) shall maintain in effect all insurance coverages required under this Agreement at the Contractor s (and any subcontractors used) sole expense and with insurance companies acceptable to the Sheboygan Water Utility. The policies shall contain a provision that coverage will not be cancelled or not renewed until at least thirty (30) days prior written notice has been given to the Sheboygan Water Utility. Certificates of insurance showing required coverage to be in force must be delivered to the Sheboygan Water Utility prior to commencement of the Work. In the event the Contractor (and any subcontractors used) fails to obtain or maintain any insurance coverage required under this Agreement, the Sheboygan Water Utility may, at its sole discretion, purchase such coverage as desired for the Sheboygan Water Utility's benefit and charge the expense to the Contractor (and any subcontractors used), or, in the alternative, terminate this Agreement. CONTINUATION OF COVERAGE The Contractor (and any subcontractors used) shall continue to carry Completed Operations Liability Insurance for at least three years after either ninety- (90) days following Substantial Completion of the Work or final payment to the Sheboygan Water Utility, whichever is later. The Contractor (and any subcontractors used) shall furnish the Sheboygan Water Utility evidence of such insurance at final payment and in each successive year during which the insurance coverage must remain in effect.

11 ACKNOWLEDGMENT OF REFERRAL OF THIS PROVISION TO CONTRACTOR S (AND ANY SUBCONTRACTORS USED) INSURANCE AGENT OR BROKER The Contractor (and any subcontractors used) represents that he has provided a copy of the Insurance Requirements to his insurance agent and/or broker, and that the Contractor (and any subcontractors used) has instructed the agent/broker to provide insurance in full compliance with the terms and conditions herein. Pay apprentices a percentage of the applicable journeyperson's hourly basic rate of pay and hourly fringe benefit contributions specified in this determination. Obtain the appropriate percentage from each apprentice s contract or indenture. Subjourney wage rates may be available for some of the trades or occupations indicated below with the exception of laborers, truck drivers and heavy equipment operators. Any employer interested in using a subjourney classification on this project MUST complete Form ERD and request the applicable wage rate from the Department of Workforce Development PRIOR to using the subjourney worker on this project.

A local governmental unit may post this document at the place normally used to post public notices if there is no common site on the project. This document MUST remain posted during the entire time any worker is employed on the project and MUST be physically incorporated into the specifications and all contracts and subcontracts. Box 8928, Madison, Wisconsin or call (608) The following statutory provisions apply to local governmental unit projects of public works and are set forth below pursuant to the requirements of s (8), Stats. s (1) (f) & s (1) (c) "PREVAILING HOURS OF LABOR" for any trade or occupation in any area means 10 hours per day and 40 hours per week and may not include any hours worked on a Saturday or Sunday or on any of the following holidays: 1. January The last Monday in May. 3. July The first Monday in September. 5. The 4th Thursday in November. 6. December The day before if January 1, July 4 or December 25 falls on a Saturday. 8. The day following if January 1, July 4 or December 25 falls on a Sunday. s (10) RECORDS; INSPECTION; ENFORCEMENT. (a) Each contractor, subcontractor, or contractor's or subcontractor's agent performing work on a project of public works that is subject to this section shall keep full and accurate records clearly indicating the name and trade or occupation of every person performing the work described in sub. (4) and an accurate record of the number of hours worked by each of those persons and the actual wages paid for the hours worked. s (11) LIABILITY AND PENALTIES. (a) 1. Any contractor, subcontractor, or contractor's or subcontractor's agent who fails to pay the prevailing wage rate determined by the department under sub. (3) or who pays less than 1.5 times the hourly basic rate of pay for all hours worked in excess of the prevailing hours of labor is liable to any affected employee in the amount of his or her unpaid wages or his or her unpaid overtime compensation and in an additional amount as liquidated damages as provided under subd. 2., 3., whichever is applicable. 2. If the department determines upon inspection under sub. (10) (b) or (c) that a contractor, subcontractor, or contractor's or subcontractor's agent has failed to pay the prevailing wage rate determined by the department under sub. (3) or has paid less than 1.5 times the hourly basic rate of pay for all hours worked in excess of the prevailing hours of labor, the department shall order the contractor to pay to any affected employee the amount of his or her unpaid wages or his or her unpaid overtime compensation and an additional amount equal to 100 percent of the amount of those unpaid wages or that unpaid overtime compensation as liquidated damages within a period specified by the department in the order. 3. In addition to or in lieu of recovering the liability specified in subd. 1. as provided in subd. 2., any employee for and in behalf of that employee and other employees similarly situated may commence an action to recover that liability in any court of competent jurisdiction. If the court finds that a contractor, subcontractor, or contractor's or subcontractor's agent has failed to pay the prevailing wage rate determined by the department under sub. (3) or has paid less than 1.5 times the hourly basic rate of pay for all hours worked in excess of the prevailing hours of labor, the court shall order the contractor, subcontractor, or agent to pay to any affected employee the amount of his or her unpaid wages or his or her unpaid overtime compensation and an additional amount equal to 100 percent of the amount of those unpaid wages or that unpaid overtime compensation as liquidated damages. 5. No employee may be a party plaintiff to an action under subd. 3. unless the employee consents in writing to become a party and the consent is filed in the court in which the action is brought. Notwithstanding s (1), the court shall, in addition to any judgment awarded to the plaintiff, allow reasonable attorney fees and costs to be paid by the defendant.

15 Determination No Page 3 of 20 BUILDING OR HEAVY CONSTRUCTION Includes sheltered enclosures with walk-in access for the purpose of housing persons, employees, machinery, equipment or supplies and non-sheltered work such as canals, dams, dikes, reservoirs, storage tanks, etc. A sheltered enclosure need not be "habitable" in order to be considered a building. The installation of machinery and/or equipment, both above and below grade level, does not change a project's character as a building. On-site grading, utility work and landscaping are included within this definition. Residential buildings of four (4) stories or less, agricultural buildings, parking lots and driveways are NOT included within this definition.
