4 1. INTRODUCTION 1.1. PROJECT OBJECTIVES: The Rural Energy II Project (REII) aims at facilitating the Vietnamese Government to launch poverty elimination campaign in rural areas by providing key infrastructures such as power, accessibility to public services to improve life and production and business performance. The REII- the expansion shall continue supporting the Vietnamese Government to: - Develop a rural electrification strategy, specially focusing on power supply to mountainous and remote areas. - Rehabilitate, upgrade and expand the rural power system to satisfy power supply demand for the future socio-economic development. - Improve power supply reliability, reduce loss on power, and improve performance for production and business activities. - Re-consolidate the rural power grid system to improve reliability and power quality to be provided, including reduction of power loss due to technical or non-technical failure.- Expand 35kv and 22kv medium voltage grids to be able to supply additional power to households THE RURAL ENEGY II ADDITIONAL FINACING PHASE 4- LAI CHAU PROVINCE - Prevent overload of the local power grid for the subproject communes; - Reduce power losses, improve electricity quality; and provide stable power supply for living, production and business activities; - Meet the power supply demand of the subproject local communes for socio-economic development; - Contribute to Government poverty reduction programs in rural areas by providing basic infrastructures, particularly electricity; - Contributes to improve material and spiritual life of people in remote areas of northern provinces. And many social benefits. The Sub-project includes 03 components. namely: - New construction km medium voltage (35Kv) transmission lines. - Construction of 51 new substations with total capacity of 2,980.5 kva. - New construction km low voltage transmission lines and Rehabilitate 2,450 km low voltage transmission lines THANG LONG POWER DEVELOPMENT JOINT STOCK COMPANY 4

5 2. PROJECT DESCRIPTION 2.1. BRIEF DESCRIPTION ON NATURAL AND SOCIAL CONDITIONS OF LAI CHAU PROVINCES Lai Chau is an upland mountainous province, located in the geographical coordinates of 20050' 'north latitude, and ' ' East longitude. The north borders Yunnan province (China) with boundary of 310 km long; the southwest and northwest border on Pra Bang province and Phong Sa Li province relatively (People's Democratic Republic of Laos) the northeast borders Lao Cai province; and the southeast border Son La province. Lai Chau Province far from Hanoi capital about 500 km. The natural area of the province is 16,919 km 2, accounting for 5.14% of total natural area of the country. Improtant transportation routes of the province consist of National Road 279, National Road 6A, Amity Road No.12, 4D Road, Road 100, and airway. River systems including the network of rivers, streams, are rather dense, small and slope. Entire province has km of large and small rivers & streams, such as Song Da and Nam Na, Nam Muc, Nam Rom, Nam Ma, and Nam Khoai; the province has three major river systems, including large rivers such as Da river with 232 km long, Ma river with 58 km long, and Nam Hua river with 71 km long. Project is invested at 2 districts of Muong Te and Phong tho. They are 02 districts in the North of Lai Chau province. Population: According to investigation results carried out on 01/04/1999, Lai Chau province has 587,582 people. In which, social labour number of the whole province is 282,983 persons, accounting for 48.1% of the population. The province has 23 ethnic groups, is the largest one is Thai ethnic with 206,001 people, accounting for 35.05%; the other minority ethnic groups such as Mong ethnic with 170,460 people, accounting for 29.01%; Kinh ethnic with 99,094 people, accounting for 16.86%; Dao ethnic with 39,575 people, accounting for 6.73%; Kho Mu ethnic with 14,894 people, accounting for 2.53%; Ha Nhi ethnic with 14,314 people, accounting for 2.43%; Giay ethnic with 9,018 people, accounting for 1.53%; La Hu ethnic with 6,824 people, accounting for 1.16%; Lao ethnic with 6,613 people, accounting for 1.12% and other ethnic groups account for 3.58%. The project was implemented in area the 2 provinces Muong Te, and Phong Tho. Population is predominantly belonging to ethnic minority groups of Mong, Dao and Ha Nhi. Climate: General climate characteristics of line route are evaluated as under basically on the monsoon tropic climate. - Average air temperature in the year is about 23 o C. Maximum temperature can up to 40 o C, usually appears in May and the lowest temperature may down to 5 o C, usually appears in January. - The average humidity in the year is relatively high, from 85% to 92%. - Number of days of the year having lightning, thunder are 59.1 to 59.3 days. - The rainy season in this area usually lasts from May to September, the rains are most concentrated in the months June, July, and August (lunar calendar) with high rainfall, accounting for nearly 80% of annual rainfall. 6 Thunderstorms can occur on any month of the year but mainly in summer on the afternoons from 1p.m to 6p.m, the months have the most thunderstorm are from May to September together with rainy period, duration of one thunderstorm: 1-2h, thunderstorm often appears accompanied with thunderbolt. The months from November to March is the period of operation of the northeast monsoon therefore usually less thunderstorm, only about 2-3 days in the month. Topography: Topography of Lai Chau province is very complex which is formed through many different tectonic phases, commonly folding and settlement. In general the region are gradually lowering from Vietnam - China border to the South and from the East to the West. Phong Tho district has mountainous terrain > 1,000 1,500; this region has very strong dissection with difficulty terrain, steep streams with many caves. Muong Te district has mountainous terrain > 1,500 m; with deep steep, mainly distributed in the Vietnam China Mountains. However, all the wire-lines go in hill areas, midlands without flooding during annual rainy season, so that it does not affect the project. Natural Resources: * Earth resources: Total of natural land area of the province is km2; mainly is red, light yellow soil types developed on sandy rock, clayey rock and limestone with rather tight structure. Agricultural land have used approximately 64,299.9 ha, of which 13, ha are crop fields, ha are miscellaneous garden, 5.978ha are grass fields for livestock, aquaculture water surface are 409ha. Forested land is hectares, the coverage is 31.3%, mostly is protective forests, including hectares of natural forests; artificial forest of ha. Specialized lands for use are approximately hectares, of which hectares are for transportation, construction lands are hectares, living lands are ha. Available bare hills likely to use are very large, about ha, including unused land is hectares and unused hilly land is approximately 524, hectares. * Rivers: river system in Lai Chau Province are distributed regularly with two main river systems: - Nam Mu River: flowing through Na Tam, Ban Bo is formed by four main streams: Nam Gie stream originates from top of Sapa, Na Da stream from the Lake Thau, Nam Dich stream from Khun Ha, Nam Mu stream from Ban Hon, these are spring heads of the Da River, mainly supply water for Ban Chat, Huoi Quang and Son La hydropower plants. - Nam So stream comes from Ta Leng to San Thang commune (Lai Chau town), Then Sin commune then mixes with Nam Na line. This is major water supply for urban areas of Lai Chau town and the neighboring communes. Because the terrain of district is relatively complex, the rivers have a steep slope so they are more likely to develop a small and medium-sized hydropower plants. According to survey, no wire-line of the project across rivers and streams. Column foundation do not build near river, stream banks. Column foundation is mainly built on public ground of hills and rice fields. Foundation construction on rice fields does not affect the canal systems and drainage. 7 * Mineral Resources: There are several kinds of Mineral resources: a rare earth minerals in Phong Tho district, black stone in Muong Lay are currently operated by mainly private; metal minerals such as iron, lead, stream gold ores, but the reserves are small; Na Sang coal mines are being exploited but at a small scale The 35kV line shall not go through/near any mineral area so that should not affect mining exploitation. * Forest Resources: Up to 2002, Lai Chau province has 553,650 hectares of forest, including 538,552 ha are natural forests, artificial forests are 15,098 ha PROJECT S SCOPE The subproject The rural enegy II project additional financing phase 4 Lai Chau province refers to the following: - Construction and rehabilitate of medium voltage, low voltage transmission lines and substations in 16 communes under 02 district Muong Te, Phong Tho in Lai Chau Province. Muong Te district (04 communes) : Xa Pa U; Mu Ca; Ka Lang va Thu Lu PRE-CONSTRUCTION AND WHILE-CONSTRUCTION ACTIVITIES AS SPECIFIED IN THE IMPLEMENTATION PROCEDURES - Site clearance method Site clearance covers mainly cutting trees off and clearing structures situated in pylon foundations, trees with height of over 4m and buildings available in the route. - Buildings in the route not affected should not be cleared. - Trees at pylon foundation positions are mainly crops (rice), tree (Eucalyptus, Mango, litchi, Acacia). Communal People s Committees and district People s Committees in the project area agree to implement compensation and site clearance as stipulated to ensure power construction and erection. If it is fallen in the harvest season of farmers, it is required to calculate to compensate trees on land for farmers in accordance with the average productivity. Trees with height of over 4m available in the route may be cut down before wiring. - Compensation is undertaken by power companies. Therefore, PCs of Lai Chau provinces should complete the land recovery procedures and grand land for construction so that site can be handed over to builders. - Camp construction: In order to ensure the storage of materials, plants and equipment and houses for workers, a temporary camp construction project is launched in each commune, including: + Indoor storage for cement, equipment, electrical materials and accessories: 30m2 x 1 commune = 30m2. + Outdoor storage with fence to protect transformers, medium voltage conductors, construction tools, beam, bracket and backstays: 10m2 x 01 commune = 100m2. 50m2. + Temporary buildings for workers during construction: 50m2 x 1 commune = + Indoor warehouse and temporary buildings are made from bamboo frame with fiberboard, its roofs are covered with fiberboard and roofing felt. Transporting materials and equipment to the site Different types of equipment and materials such as: Conductors and insulators are bought in Hanoi and transported by trucks to the route center of each project component (site storage). Goods are transported from Hanoi to the site storage as follows: + Protection switchgear, insulators and cables with small packing, scattered goods shall be transported to the site by trucks and manually unloaded. 12 + Conductors with bulk quantity shall be transported to the site by the less than 5 ton trucks and 5 ton cranes. + Centrifugal concrete pylon bought in the area or Hanoi shall be transported to the site by KMAT 7.5 ton truck, each shipment delivers 6 pylon sections, loaded by 5 ton cranes. Pylons are piled at the ending route and scattered transported to the site by combining the manual and mechanical method. + Other materials such as beam, backstay, accessories, etc from Hanoi shall be transported to the site by the 5-ton trucks and manually unloaded. + Cement bought in districts is transported by the 5-ton trucks and manually unloaded. + Sand and stone bought at the project s district, 20km distance, shall be transported by the 5-ton dump trucks and manually unloaded DIFFERENT TYPES OF CONSTRUCTION PLANTS AND EQUIPMENT Table 2.4. 15 3. LEGAL FRAMEWORK ON THE PROJECT S ENVIRONMENT IMPACT ASSESSMENT 3.1. LAWS AND REGULATIONS OF VIETNAM The Vietnamese Government promulgates some laws and regulations on environmental protection. Such documents include: - Legislation of the Socialist Republic of Vietnam (April 1992) specifies that the State-own enterprises, governmental agencies, cooperatives and national defense bodies must be responsible for fulfilling policies on environmental protection to ensure the proper use of natural resources and environmental protection. - Law on Environmental Protection approved by the National Assembly on 29 th November 2005 and valid since 1 st July 2006, superseding Law on Environmental Protection in 1993 which prescribes responsibilities of the central, locality, individuals and organizations in environment degrading prevention and protection and implements specific environmental protection functions. - Law on Forest Protection (1992) specifies on managing, protecting, developing and exploiting forest and preventing cutting trees downs and deforestation. - Law on Protection of People's Health (11 th July 1989): Rights and obligations of residents in health protection, guiding principles on health protection, sanitation education in people; conduct the standby measures; rehabilitate and clean living environment; ensure labor sanitation standards, food and foodstuff hygiene. - Decree No. 80/2006/ND-CP dated 9 th August 2005 of the Government of Vietnam on detail regulations and guidance on implementing some articles of revised Law on Environment in Decree No 21/2008/ND-CP dated 28 th February 2008 of the Government on amending and supplementing some articles of Decree No. 80/2006/ND-CP dated 9 th August Decree No. 81/2006/ND-CP dated 9 th August 2006 of the Government on sanctioning of administrative violations in the field of environmental protection. - Decree No. 106/2005/ND-CP dated 17 th August 2005 of the Government on detailing and guiding the implementation of a number of articles of the electricity Law on Protection of safety of high-voltage power grid works (amending and supplementing Decree No. 54/1999/ND-CP). - Decree No. 52/1999/ND-CP: Regulations on managing construction investment with amendments on environmental issues in construction management. Decree of Government No. 29/2011/ND-CP dated 18 April, 2006 regulating strategic environmental assessment, environmental impact assessment and environment protection commitment. ENVIRONMENT IMPACT ASSESSMENT 4.1. DETERMINATION OF THE PROJECT S POTENTIAL IMPACTS The Project shall pay an essential role in electrification and poverty elimination program in 16 communes of 02 districts in Lai Chau province. The Project also facilitates the industrialization and modernization policy promulgated by the Government and offers best opportunities for general socio-economic development to poor areas. When distribution wirelines are constructed, local persons tend to move to live near such wirelines. Local People s Committee shall prepare a specific plan to support the regional development. Such plans include road, residential areas, industrial and agricultural development, etc. Such district/commune or province shall divert the development as sketched in these plans. In addition to noticeable positive impacts, variety of adverse impacts may be posted on environment and local socio-economics. By using the Checklist of Environmental Test Data and Background Environment List as guided in the Guidelines, the environmental protection measures are applied for the Rural Energy Project. When the subproject is carried out, the wiring and excavation for pole foundations in rice field will have impacts on 488m2 of crops. 2) Do household have to displace? x - Total number of households affected by the project is 38 households, 130 people). They are ethnic minorities of Thai, Dao, Muong people. The project does not cause displacement of households 3) Effects on cultural, heritage, historical statue, pagoda and sensitive area - Construction stage x - During design phase, the project site had been considered and chosen carefully. There are not cultural heritage, historical statue, pagoda and sensitive area in the project area. 4. Impact to fauna & flora? x - The volume of affected plants is mainly rice and maize. - Therefore impacts to the flora of Lai Chau are not greate and do not affect the fauna of the province. 18 5. Soil erosion, sediment generation caused by digging or surface water turbidity? 6. Dirty & air pollution? x - Although terrain of the subproject areas is mainly mountainous with high landslide risk, foundation excavation would be carried out on a relatively flat area, and some short sections run along the low hills, so the erosion risk is not high - The construction time of pole foundation is short (about 1/2 day) and the construction would not be implemented in the rainy season. Each item will completely be done before the construction of another item, and thus erosion is expected to be small. x - Dust is generated from: - Earth excavation (especially in the dry season). - Because of vehicles to be used for transportation of materials and equipment. In line with with emissions are emitted by themselve. - Loading and unloading of materials and equipment from the truck will generate soil and granular sand on the air. - However the effect is negligible due to: - The affected communes by project are concentrated in rural areas, population density is relatively low. Average workload is not large in each commune. Construction time at each column location is only about 3-7 days. - Transport vehicles have been allowed for circulation by registry offices - Many transport activities of materials and equipment is done by manual methods so this effect can be minimized. Only cranes can create smoke and noise, but this effect can be minimized. 7. Noise and vibration? x - Noise and vibration are generated by operation of equipment, transportation of materials, transportation means, ground leveling, pole erection, and operation of power generator (if any). - The substations will be located on foot hills, far from residential areas, and hence noise and vibration during construction would not affect local communities. - Construction materials will be provided and transported to the construction sites by local suppliers. 19 - Base on above-mentioned reasons, impacts on increasing the noise and/or vibration at the subproject area are assessed as not significant and can be mitigated. 8. Soil, air or water pullution due to use harmful materials including PCBs. x - PCBs substance has been banned using for equipment, electrical materials long time ago. - The project shall not replace old transformers, electrical equipment. - Substances such as oil, chemicals emitted from vehicles and construction machinery is very small because the number of vehicles, construction machinery is not large and guaranteed about safety and meet the technical requirements that shall not impact to the environment. 9.Obstructing traffic? x - The rural traffic is sparse. Time for unloading materials and equipments would be short (about 1 hour). In addition, unloading of construction materials (e.g. sand, soil, stone etc.) is automatic by trucks. Therefore, impacts on the traffic such as traffic congestion would not be significant. - In addition, unloading and transportation of materials from storage to the construction site will be done by manual methods. This will help avoid traffic congestion on major communal roads 10. Damage roads and bridges? x - Most of inter-hamlet, inter-commune roads in project area are concreted, under good conditions. Material transportation activities with high frequency and big load shall damage or degrade the roads and bridges, however mainly happened at communes under greate construction work and the roads are poor quality. - Moreover, transportation of some materials by manual methods will contribute to restrain above mentioned impacts 11. Impact to environment from workercamps? x - There are about workers taking part in construction period, in which around 50% are local people to be hired for doing some manual jobs and they will comeback home after work, the remaining workers will live in construction camps and this will generate amount of daily waste water and wastes. 20 Therefore, this amount of waste water and waste is relative small (it is estimated about 30 liter of water and 1kg pf waste/person/day). - Need to apply mitigation measurements to prevent from pollution of surface water, loss hygene at surrounding. 12. Conflic between worker and local people? x - Social conflict can occur due to difference in income, culture and behavior. Most construction areas have ethnic minority people, and hence, social conflict may also be due to insufficient awareness of customs of the local people. However, most of the workers come from this region so there is no big difference in culture and way of living. - The subproject will make effort to recruit local workers, and the number of workers is very small compared with total local population. 13. Impact to cultivation? 14. Impacts because of non-compliance with labour safe rules? x - Lands affected by project are agricultural land for plating rice and corn. That s why construction of project obviously affect to cultivation and capacity of crops on occupied lands. - The affect can be minimized, due to: - Providing suitable compensation option. - Construction only carried out within 2 months at each construction location, after completion of construction temporarily occupied lands will be reinstated as previously. x - This impact can be considered as negligible because the workers are all trained about labour safety and fully equipped by safety uniform as well as means to ensure safety for wokers at site. - However labour safety shall be strictly supervised in order to avoid any unfortunately risks. 15. 21 16. Surinfection of electromagnetic field is higher than level stipulated in Vietnamese standards? X - The transmission lines shall be designed and constructed in accordance with applicable standards of power industry (in accordance with Vietnam applicable technical regulations, electromagnetic field (EMF) < 5 kv/m), wherein impacts from EMF and safety standards and operation safety have to be taken into due account. - Prior to operation, all safety indicators shall be tested and accepted by the project owner, contractor and operation entity therefore workers shall not be suffering from such EMF impacts. - In the phase of commissioning, the safety in power use of households of ethinic minorities who use electricity for the first time also needs to be paid attention to minimize the risk of electric shock. However, this impact is very little and avoidable if the people are trained well in safe power use. 17. Cutting trees X - There are some small impacts in clearing time which serve for ensure safety of operation as regulated. However cut-trees on the route are taken into account in construction stage. Clearing process only implemented for trees having height smaller than 3m far from wire-line. In route corrior, do not prohibit plating food crops with low height at around of postbase and must far from edge of pole foundation at least 0.5m. 18. Interference with radio communication, TV and other media? X - Not significantly impact because design process has followed to wire-line design codes. 19. Harmful to health and safety of community including electrical safety risks for people? X - Do not affect because residential houses are not allowed to build within electronic fiels affect. Loca people are warnned and educated about electric safety in areas where project passing. Operation methods, designs are strictly complied with requirements in order to ensure human safety. 20. Impact to water quality due to discharge domestic X - Do not impact because this is project for new wireline, hence there is no new accomodation for workers. 23 Temporarily and permanently occupied land The occupied land area of 16 communes, 02 districts in Lai Chau province is 1,053,428 m 2 and 11,122 m 2 of temporarily and permanently occupied agricultural and forestry land, respectively. On average, the permanently occupied land area per commune is approximately m 2 and the temporarily occupied land area is about 695 m 2. Therefore, it is possible to recognize the negligible impact of land occupancy by both MV wirelines and transformer station. Table 4.1.(b). Environmental impact due to route corridor clearance shall be minimized through compensation plan and recovery measures as specified in the on Compensation and Resettlement. Land occupied by the Project (including medium voltage wirelines and transformer station) does not affect great and important works (such as buildings and outlets) or auxiliary works (such as cattle sheds, fence walls, garden and playground). Trees which are higher than 4m shall be cut down, this impact is short term and negligible. ROW shall be planted with trees for general vegetation with height of less than 4m. The Project s Compensation and Resettlement Plan also specifies that contractors must return plane of temporarily occupied agricultural land lots to its origin status, which can cultivate for the land owners. The wirelines passing the agricultural land lots would cause no impact on lower cultivation Impacts on affected households The survey unveiled that the Project would affect three main groups of people, including farmers (majority, accounting for over 90% of total affected groups of people), trading and service groups and public servant groups in management agencies, companies THANG LONG POWER DEVELOPMENT JOINT STOCK COMPANY 24

25 and factories. Among these three groups, subsistence and income of farmer and business groups would be affected because a part of production land is recovered or business is suspended during construction. Whereas, the public servant group is free from this impact. Among households affected in terms of land, no household is required to resettle. The Project also affects 38 households (130 persons) of ethnic minorities such as Mong, Dao anf Ha Nhi. However, such impact is evaluated as negligible and temporary due to strict requirements on selecting route direction and technical solutions of the Project to minimize recovery of land, property, trees and crops of local persons. COMMUNITY CONSULTATION AND INFORMATION DISCLOSURE During preparing the Project (2010), following works were conducted: Activity 1: Understand and discuss with the local authority about wiring position Activity 2: Make a survey and statistics about impacts Activity 3: Organize meetings with affected households After finishing survey, the Consultant must notify the local persons and affected communes about the project s activities. Public notice form should be applied. Such notices must be provided to the local persons with following contents, especially in the project communes: - General information about Project title, the Project Owner, project scale, names of project districts and communes; - Possible impacts on environment due to project s activities; - Applied mitigation measures to minimize impacts on environment; - Project implementation plan - Place to receive the community s feedback on project-related environmental issues This activity was launched in October, 2011 in all project districts and communes. Following representatives of organizations were invited and involved in the community consultation meeting, concretely: Affected households; Fatherland Front Committee Women Association; Youth union; War Veteran Farmer association People s Committee; Other concerned agencies and mass organizations. Feedback received from the community consultation meetings was briefed as follows: In general, the majority concerns of the participants were their support for the project due to the project benefits. Environmental impacts were insignificant and would be within a small scope. Local authorities supported those proposed locations for substations. Compensation has been implemented satisfactorily. The construction of the project shall result in minimum impacts. During the construction, mitigation measures shall be taken to minimize impacts on trees, crops and existing public facilities in the project region. During the construction phase, a large number of workers working in the region but the contractor shall have to manage their workers and work with local authorities to ensure social security. 27 Once the construction is completed, the contractor shall rehabilitate the site and return the original landscape. The summary of meeting with local residents, minute of stakeholder consultation meeting and some photos about the meeting attached in Annex. All relevant issues as well as comments by the local residents have been taken into account by the supervising consultant and the project owner and shall include them in the design of the project and EMP implementation. Notify in public about community opinion collection regarding the project s main activities, preliminary emigration plan, on Environmental Impact Assessment in working hours in 2 months at following locations: 1) Provincial People s Committees; and 2) Communal People s Committees. Copies of EMP report in English and Vietnamese shall be submitted to Vietnam Development Information Center at 63 Ly Thai To, Hanoi for public announcement. ENVIRONMENTAL MANAGEMENT PLAN 6.1: The project s social impact management: Information and communication program: Basic information includes: a) Population survey and statistics include: - Name and number of people in a household. - Number, types and area of damaged houses - Number, types and area of damaged residential land lot - Number, types and area of affected agricultural land - Number and types of affected crops and trees - Affected business including architectural structures, land and other assets. - Affected profitable assets: percent of total affected assets - Quantity and classification of other fixed assets affected by each sub-project, and - Temporary damages for profitable assets b) Certain socio-economic survey of DPs: Age, gender, nation, qualification, occupation, income source and total income of whole household. c) Public news release at the Site regarding (a) bidding package, (b) contractor, (c) detailed construction plan and (d) hotline to solve claims on social and environmental issues. Public news release during project preparation through community consultancy meeting and mass media. Claim and compensation mechanism Claims and questions relating to any aspects of RP, including determination of unit price and quantity of lost assets shall be solved in accordance with following steps: Step 1: If any person claims about any issue of the resettlement and life recovery program, he may present directly or submit a written claim to authority persons of the commune. The CPC shall settle such questions within 15 working days since the claim is received. Step 2: If claimer is not satisfied with decisions in Step 1, his claim may be submitted to district People s Committee or CRC within 15 working days since the date of receiving the decision in step 1. The DPC or CRC shall make decision within 15 working days since the date of receiving the claim. Step 3: If the claimer is still dissatisfied with decision of the district authority, he may lodge the appeal to the PPC or the district CRC within 15 working days since the date of receiving decision of DPC or district CRC. Within 15 working days, PPC or PCRC shall decide such claim. Step 4: If he is still dissatisfied with decision released by the provincial authority, he may file the appeal to the district court within 15 working days since the date of receiving decision made by PPC or PCRC. DPs are completely exempted from administrative and legal fees and charges. Monitoring and evaluation system Power companies and concerned PMUs work closely with corresponding DPCs/CPCs at the management units and independent supervision unit to launch regular monitoring of Compensation and Resettlement Plan Performance. 33 recorded in the quarterly report to submit EVN, power companies and concerned provincial power companies. Internal inspection and monitoring include: - Verifying that basic information about DPs, evaluating lost or damaged assets, compensations, benefits of resettlement and life recovery are conducted in accordance with the regulations of the corresponding Policy Framework and RP. - Monitoring that RP is conducted as designed and approved. - Determining that financial resources to implement RP are provided to PMUs in due date with full quantity to fufill the objectives; Such resources are properly used by PMUs as prescribed in RP. - Archiving all claims and questions and ensuring that such claims are solved as scheduled. Independent supervision: Independent units or independent consultancy units employed by PCs under EVN shall conduct regular monitoring and external evaluation in addition to RP performance. Independent organizations may be schools, research institutions, NGOs or independent consultancy companies with professional staffs and Terms of Reference (TOR) accepted by World Bank. In order to verify information provided to internal control and supervision report of corresponding power companies, employed external supervisors shall visit sample, approximately 20% of affected households in the concerned province in 6 months since RP is conducted to: - Determine whether procedures on involvement of DPs, compensation work, Rights of recovering new life are conducted in accordance with policy framework or not; and - Evaluating whether objectives of policy framework on improving or at least ensuring living standards and income of DPs are satisfied or not. - Collecting quality criteria of socio-economic impacts on DPs when the Project is conducted. - Recommending amendments during RP performance in case it is possible to put forward principles and objectives of policy framewor. Local persons are encouraged to use the cut plants for useful purposes such as composting green manure or fertilizing. 13 Conflict between construction workers and local people - Local persons should be employed for simple construction works at most to avoid emigration phenomenon. - In case worker camps are situated near the communal center, the Employer should require the Contractor to provide fully and timely information about such construction worker groups to the Communal People's Committee of that area. By exchanging in an opened-hearted and bidirectional manner, the CPC and the Contractor can arrange proper accommodation for this worker group.
