2 This document serves as Addendum No.1 for the Invitation for Bid (IFB) for On Call Electrician. This Addendum forms part of the IFB and modifies the original document. Acknowledge the receipt of all addenda numbers issued on the BID SUBMISSION FORM. Failure to do so may subject the bidder to disqualification. The following changes and/or additions are to be made to the original Invitation for Bid dated March 25, 2015: Revised Bid Deadline: Delete reference to the Bid Deadline of Wednesday, April 8, 2015 at 11:00am. In its place insert the revised bid deadline of Thursday, April 9, 2015 at 11:00am. 2

4 LEGAL NOTICE: INVITATION FOR BID (IFB): ON CALL ELECTRICIAN The Town of Longmeadow is accepting sealed bids for an On Call electrician for one year of service. Bid documents may be obtained at the Longmeadow Purchasing Department at the following address: Town of Longmeadow, Attn: Chad Thompson- Procurement Manager, 735 Longmeadow Street, Suite 101, Longmeadow, MA (P: ). Bid documents may also be downloaded online through the Purchasing Department page of the town website: From the Purchasing Department page of the website select the link labeled Bid & RFP Finder to access bid documents. Bidders that access bid documents online are encouraged to register with the Longmeadow Purchasing Department to receive updates and addenda. Others are required to monitor the bid listing service prior to the bid deadline for additional information and issued addenda. Failure to acknowledge addenda may result in a bid rejection. All bids for On Call Electrician are subject to the provisions of MGL 149. All bidders shall comply with minimum wage rates as set forth under MGL Chapter 149, Sections 26 to 27H. Bids must be delivered to the Longmeadow Purchasing Department in a sealed envelope labeled IFB: ON CALL ELECTRICIAN and will be received until the bid deadline of 11:00am on Thursday, April 9, 2015 (Per Addendum No.1). All sealed bids shall contain complete contact information of the bidder on the exterior of the envelope. Late bids will be rejected. Following the bid deadline, bids received will be immediately opened in the Auditorium located in the same building. No bid deposit is required. The contract award will require no bonds. The Town of Longmeadow acting through the Town Manager, the Awarding Authority reserves the right to reject any or all bids, waive minor informalities and to award the contract in the best interest of the Town. 4

5 INVITATION FOR BID (IFB): ON CALL ELECTRICIAN TOWN OF LONGMEADOW, MASSACHUSETTS The Town of Longmeadow is soliciting bids for an on call electrician for the town and public school facilities. This will be a contract for on call services of a single electrician with compensation based on hourly rate service only. This will be an annual contract for a one year term. Inclusive in the hourly rate pricing, the electrician will supply their own standard electrician tools and supplies. The Town will not reimburse for wear or replacement of standard electrician tools and supplies. Any supply that will become part of the property of the Town (wire, etc) will be supplied by the Town to the Contractor at no charge for use by the on call electrician on the town s projects. SUBMISSION OF BIDS Sealed bids should be labeled IFB: On Call Electrician, and should be delivered to the Longmeadow Purchasing Department. Sealed bids will be accepted until the bid deadline of 11:00am on Thursday, April 9, Late bids will be rejected. Sealed bids should be delivered to the Longmeadow Purchasing Department at the following address: Town of Longmeadow Purchasing Department Attn: Chad Thompson, Procurement Manager 735 Longmeadow Street, Suite 101 Longmeadow, MA A public bid opening will immediately follow in the auditorium located in the same building as the Purchasing Department. All bidders shall comply with minimum wage rates as set forth under the provisions of M.G.L., Chapter 149, Sections 26 to 27H inclusive and agree to provide statements of compliance as required. All bid prices shall remain firm for (90) ninety days following the bid opening. 5

6 The annual estimate of the On Call electrician is between $10,000 and $25,000 for the contract term which will be one year beginning on July 1, The actual need is unknown and may be greater or less. No bid deposit or bonding is required with bid participation or contract award. The contractor is required to be a licensed electrician and fully insured to meet the insurance requirements of the Town of Longmeadow. The Town of Longmeadow acting through the Town Manager, the Awarding Authority, reserves the right to reject any or all bids, waive minor informalities, and to award a contract in the best interest of the Town. QUESTIONS Bidder is to familiarize him/herself with all of the bid documents. Written responses will be mailed, ed or faxed to the bidder on record as having received the bid. No oral interpretations will be made to any bidder. Questions must be received no later than ninety six hours (four days) before the bid deadline. Responses to unanswered questions will be issued through addenda and will be posted online no later than end of day two days prior to the bid deadline. Addenda will also be posted to the online bid listing service linked through the Longmeadow Purchasing Department page of the Town website Bidders that access bid documents online are encouraged to register with the Purchasing Department to receive updates. Others are required to monitor bid postings online prior to the bid deadline for additional information and issued addenda. Failure to acknowledge addenda may result in a bid rejection. BID WITHDRAWAL/MODIFICATION A bidder may correct, modify, or withdraw a bid by written notice received by the Town prior to the date and time specified for the bid opening. Bid modifications must be submitted in a sealed envelope clearly labeled MODIFICATION NO.. Each bid modification must be numbered in sequence, and must reference the original Invitation for Bid. After the bid opening, a bidder may not change any provision of the bid in a manner prejudicial to the interests of the Town of Longmeadow or fair competition. Minor informalities will be waived or the bidder will be allowed to correct them. If a mistake is present and the intended bid is clearly evident on the face of the bid document, the mistake will be corrected to reflect the intended correct bid, and the bidder will be notified in writing, and the bidder may not withdraw the bid. A bidder may withdraw a bid if a 6

7 mistake is clearly evident on the face of the bid document, but the intended correct bid is not similarly evident. UNEXPECTED BID DELAYS If, at the time of the scheduled bid opening town offices are closed due to uncontrolled events such as fire, snow, ice, wind, building evacuation, or other extreme conditions, the bid opening will be postponed until the next normal business day at the exact time and location as published in the legal notice. PREVAILING WAGE RATES Prevailing Wage Rates as determined by the Commissioner of the Department of Labor and Workforce Development under the provisions of Massachusetts General Laws, Chapter 149, Section 26 to 27H, as amended, apply to this project. It is the responsibility of the Contractor to provide the Town with certified payrolls and to comply with all requirements of the above-cited statutes. The schedules of prevailing wage rates are included in the IFB document. GENERAL TERMS AND CONDITIONS A sample contract is provided for reference. The Contractor shall be responsible to the Town or any third party for any property damage or bodily injury caused by it, any of its subcontractors, employees or agents in the performance of, or as a result of, the work under this Agreement. The Contractor and any subcontractors used hereby certify that they are insured for workers compensation, property damage, personal and product liability. The Contractor and any subcontractor it uses shall purchase, furnish copies of, and maintain in full force and effect insurance policies in the amount of $1,000, aggregate. Protection of the Work and Owner s Property: The Contractor shall at all times safely guard the Owner s property from injury or loss in connection with this Agreement. The contractor shall at all times safely guard and protect their work and property, and that of adjacent property from damage. The Contractor shall replace or make good any such damage, loss or injury. The Contractor shall clean the work area and restore it to its original condition upon the completion of the work. The Contractor shall comply with all applicable OSHA, State and municipal regulations and requirements for services and facilities in the performance of all requirements of this contract. OSHA safety requirements and training certification shall be adhered to for all personnel working on Town property. CONTRACT AWARD A contract award will require the electrician to be a licensed electrician to Massachusetts standards. The contract Rule of Award will be based on the low bid hourly rate of a responsive and eligible bidder based on the Regular Time hourly rate multiplied by 4, and the Overtime hourly rate multiplied by 1. Actual compensation will be based on actually authorized and completed hours by the Contractor. The award of this contract will require at minimum the availability of one electrician per service call which is 7

8 adequate staffing for on call service throughout the contract. It is mandatory that bidders submit their bid pricing for these two bid pricing categories as requested because conditional bid pricing will result in a bid rejection if the Rule of Award is not able to be specifically calculated. The Town reserves the right to request references from similar electrical work completed for other municipalities, schools, government or commercial projects so the Town of Longmeadow can confirm experience and determine if a bidder is responsible. At the discretion of the Town, any unfavorable references may be grounds for the Town of Longmeadow to reject a bid. In the event that there is a discrepancy in the interpretation of the IFB pricing, the written words shall prevail in clarifying hourly rate pricing and recalculating bid totals. SCOPE OF WORK: Should On-Call Service or repair be required, this work shall be performed as required by the Labor Rate as documented by the vendor on the Bid Submission Form. The labor rate for on-call service for Regular Time will be Monday through Friday, 7:00am through 3:30pm. The labor rate for on call service for Overtime will be billed at an hourly rate of service for service Monday through Friday from 3:30pm through 7:00am and all hours on Saturdays, Sundays and Holidays. Vendor must make call-back services available on a 24-hour a day, seven days a week basis. It is anticipated that a majority of the labor provided under this contract will result from planned scheduling during regular business hours. Inclusive in the hourly rate pricing, the electrician will supply their own standard electrician tools and supplies at no additional expense to the Town. The Town will not reimburse for wear or replacement of standard electrician tools and supplies. Any supply that will become part of the property of the Town (wire, etc) will be supplied by the Town to the Contractor at no charge for use by the on call electrician on the town s projects. The Town will only compensate the successful under contract award starting at the work time of arrival at the work site. The town will not reimburse or allow for additional expenses such as vehicle use expenses, fuel sir charges, mileage reimbursement, service charges, and other fees. This contract will require travel within the Town of Longmeadow to various schools and municipal buildings. 8

WALKER, II Secretary JEAN ZEILER Acting Director Awarding Authority: Town of Longmeadow Contract Number: Description of Work: ON CALL ELECTRICIAN City/Town: LONGMEADOW Job Location: LONGMEADOW, VARIOUS LOCATIONS Information about Prevailing Wage Schedules for Awarding Authorities and Contractors This wage schedule applies only to the specific project referenced at the top of this page and uniquely identified by the Wage Request Number on all pages of this schedule. An Awarding Authority must request an updated wage schedule from the Department of Labor Standards ( DLS ) if it has not opened bids or selected a contractor within 90 days of the date of issuance of the wage schedule. For CM AT RISK projects (bid pursuant to G.L. c.149a), the earlier of: (a) the execution date of the GMP Amendment, or (b) the bid for the first construction scope of work must be within 90-days of the wage schedule issuance date. The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149, 27. The wage schedule shall be made a part of the contract awarded for the project. The wage schedule must be posted in a conspicuous place at the work site for the life of the project in accordance with M.G.L. c The wages listed on the wage schedule must be paid to employees performing construction work on the project whether they are employed by the prime contractor, a filed sub-bidder, or any sub-contractor. All apprentices working on the project are required to be registered with the Massachusetts Division of Apprentice Standards (DAS). Apprentice must keep his/her apprentice identification card on his/her person during all work hours on the project. An apprentice registered with DAS may be paid the lower apprentice wage rate at the applicable step as provided on the prevailing wage schedule. If an apprentice rate is not listed on the prevailing wage schedule for the trade in which an apprentice is registered with the DAS, the apprentice must be paid the journeyworker's rate for the trade. The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule. Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the contract was executed by the awarding authority and the general contractor. For multi-year CM AT RISK projects, awarding authority must request an annual update no later than two weeks before the anniversary date, determined as the earlier of: (a) the execution date of the GMP Amendment, or (b) the execution date of the first amendment to permit procurement of construction services. Contractors are required to obtain the wage schedules from awarding authorities, and to pay no less than these rates to covered workers. The annual update requirement is not applicable to 27F rental of equipment contracts. Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll reports and a Statement of Compliance directly to the awarding authority by mail or and keep them on file for three years. Each weekly payroll report must contain: the employee s name, address, occupational classification, hours worked, and wages paid. Do not submit weekly payroll reports to DLS.
