3 Nugent Asbestos Guidelines 1.0 Accountability and Responsibility 1.1 Chief Executive The Chief Executive has the overall responsibility for the control and execution of the policy, guidelines and Asbestos Management Plan. 1.2 The Director of Business Support The Director of Business Support is responsible for the everyday operation of the policy; this includes Maintaining the Asbestos Register, g regular inspections of asbestos in situ, and appropriate treatment where necessary, e risk assessment of any work that is planned where asbestos is present, in order to protect maintenance workers and others, Keeping appropriate records, g information to those who need it. 1.3 The Principal Property Services Officer The Principal Property Services Officer must ensure that any maintenance or capital schemes take account of the possibility of asbestos containing material by; g the Asbestos Register at the scheme concept stage, g information at the pre-contract stage in the pre-health and safety plans, e removal or encapsulation of any asbestos material by a licensed HSE approved contractor GUIDANCE: Asbestos Page 3 of 14 Jan07/ver01

4 1.4 All other Employees of Nugent All employees of Nugent must adhere to the policy, relevant guidelines and management plan at all times. Employees are required to notify their line manager if they have any problems in application of the policy, guidelines or management plan. Non-adherence to this Policy, guidelines and management plan, by any Employee of Nugent could be referred for disciplinary action. Formal disciplinary action would normally be considered only if the policy, procedure or management plan is deliberately disobeyed. 1.5 Contractors In the event of persons Contracted to Nugent to carry out work dealing with asbestos, not adhering to the Policy, guidelines or Management Plan notification may be made to the HSE. 2.1 Nature of the Risk Asbestos can produce very small dust particles (fibres), which are respirable if they become airborne (Respirable dust is airborne material which is capable of penetrating to the gas-exchange region of the lungs). Asbestosis or Fibrosis is the common illness that may occur from long-term exposure to respirable asbestos dust. Asbestos has been the subject of gradual voluntary and formal bans since 1969 for example;- e use of blue asbestos stopped almost completely in about 1970, e installation of sprayed asbestos coating decreased gradually from 1970 to 1980 and was subject to a legal ban from e installation of asbestos insulating board deceased sharply after 1980 and stopped completely in 1985 e use of asbestos paint and varnishes stopped in 1988 e installation of asbestos-containing decorative plasters was GUIDANCE: Asbestos Page 4 of 14 Jan07/ver01

5 legally banned in 1992, e installation of asbestos cement was prohibited in These dates are only provided as a guideline, as asbestos already in stock may have been used after these dates. See Appendix A for list of typical locations for the most common asbestos containing materials. See appendix B for assumed use of asbestos material in schools and UK commercial properties. 3.1 Records The following records must be maintained by the Principal Property Services Officer and kept in the Property Services Department: - Training s Register r clearance certificates s of Principal and Sub Contactors Care incident reports and follow up reports relating to asbestos incidents. list of licensed asbestos contractors used by Nugent, detailing work carried out by them on a contractor task basis. 4.0 Asbestos Removal Contractors Asbestos work undertaken for Nugent may only be carried out by contractors who are licensed by the Health and Safety Executive. Asbestos sub-contractors employed by Principal contractors on Nugent s behalf must be licensed with the Health and Safety Executive. It is the duty of the Principal Contractor to supervise the sub-contractors. All work where asbestos has been removed, disturbed or encapsulated will monitored by a UKAS (United kingdom Accreditation Service) accredited laboratory. 5.0 Health and Safety Executive Notification All work carried out within Nugent establishments with asbestos GUIDANCE: Asbestos Page 5 of 14 Jan07/ver01

6 requires a License; these are issued by the Health and Safety Executive. The issuing of a licence by the HSE will take fourteen days from the date of receipt of request. Nugent must ensure that any work requiring a licence is planned accordingly to take this into account. It is the Principal Property Services Officer s task to ensure that no work is undertaken on Asbestos that requires a license prior to the license being issued. A copy of the license must be displayed on the site, detailing the asbestos work areas along with all other statutory notices. 6.0 Containment Levels All asbestos removal work must be contained within defined areas and restrictions of access to these areas must be enforced at all times. Nugent Staff, service users, volunteers, children, must not enter these areas until clearance has been obtained from test results. Notification will be in writing from the Principal Property Services Officer indicating precise areas, which are no longer restricted. Where risk assessment has highlighted the need for restricted access because the area contains asbestos materials, Heads of establishments, departments or project leaders, must ensure that no one is allowed to enter. If necessary a physical barrier must be installed to ensure there are no unauthorised breaches into restricted areas. The appropriate signs, notices and instruction must be posted to ensure that all who may be affected are aware of the danger. 7.1 Safe Systems of Work All work involving asbestos must have a developed Safe Systems of Work prior to commencement. The Principal Contractor will provide the Safe Systems of Work. It will be the Principal Property Services Officer duty to ensure: - Nugent has two copies of the Safe System of Work, and that one of these copies is kept at the establishment where asbestos work is being carried for the duration of that work. 8 e Safe System of Work provided by the Principal Contractor includes in particular: details of the nature and duration of the work location of the place where the work is to be carried out the methods to be applied where the work involves the handling of asbestos or material containing asbestos the characteristics of the equipment to be used for protection and decontamination of those carrying out the work and the protection of other persons on or near the worksite. 8.0 The Asbestos Register The Asbestos Register is an individual database of all identified asbestos locations and those where there is reason to believe that asbestos-containing material is present in each establishment. The database must be updated not only from scheduled surveys but also upon identification of asbestos from other sources. The Asbestos Register should be consulted prior to any work being carried out. The key to elimination of the risk arising from asbestos is two-way communication. The Asbestos Register is designed to protect maintenance workers from exposure to asbestos. Where a maintenance worker suspects that asbestos may be present, they have a responsibility to alert the Principal Property Services Officer. Once confirmed the asbestos Register can be updated. 9.1 Risk Assessment All areas of known asbestos content will be risk assessed on at least a yearly basis dependant on the type of asbestos and its potential likelihood of becoming damaged; Nugent s Property Services section will be responsible for ensuring all establishments, departments and projects comply. Inspection of asbestos encapsulation areas must be carried out on at least a yearly basis or on a daily basis if work is carried out in that area with the potential to disturb the encapsulation. Licensed contractors must only undertake the encapsulation/reencapsulation of asbestos Air and Environmental Monitoring Only analysts accredited by UKAS (United kingdom Accreditation Service) will be employed to: y out asbestos air sampling t and analyse samples n of asbestos enclosures r work methods against the Safe System of Work All restricted areas with known asbestos contamination must be monitored on at least a yearly basis for air and environmental contamination. All reports indicating an increase in air or environmental contamination of an area must be addressed by immediate and appropriate action coordinated by the Principal Property Services Officer. 10 Reports must be held in the Asbestos Register against specified areas along with previous reports Asbestos Incidents All incidents involving Asbestos must be reported to both the Health and Safety Manager and the Principal Property Services Officer in line with Nugent s reporting procedures. A copy of the report will be kept in the Asbestos Register under the relevant area where the incident took place. If the incident has resulted in a major release of asbestos, immediate evacuation of the area must take place, confinement or restriction of access to the area if possible must be carried out and notification made to the following: - e manager in charge of the area e on call duty manager/director e Health and Safety Manager. l Property Services Officer. Under no circumstances must the area be compromised until a full investigation of the incident has been carried out and notification made to the relevant authorities Emergency Situations If an emergency situation arises notification must be made to the immediate manager responsible for that establishment, department or project. The Head of the establishment, department or project must contact the Principal Property Services Officer who will consult the Asbestos Register to ascertain the presence of asbestos in the area. The Head of establishment, department or project will take appropriate action necessary to contain the situation and notify appropriate Nugent personnel of the incident. The Head of establishment, department or project and the Duty on call Manager/Director will along with the following personnel develop a practical emergency plan: GUIDANCE: Asbestos Page 10 of 14 Jan07/ver01

11 h and safety Manager l Property Services Officer d Asbestos Contactor (if necessary) h and Safety Executive (if necessary) 14.0 Failure to Comply Every employee and volunteer has a duty under the Health and Safety at Work Act 1974 (s.7) to comply with the systems of work laid down in the Asbestos policy, procedures and management plan. If you do not subscribe to or support this policy, then you should, as a matter of urgency, inform your line manager.
