2 RIVER GOOSE ESTATE PLAN SUBMISSION PROCEDURE 1) Two full sets of folded plans are to be submitted to Graeme Abernethy at the Sales Office of River Goose Estate 2) Plans may be in black and white and at a scale of either 1:100 or 1:50. 3) Plans must adhere to the following requirements: a) Plans must comply with the Architectural Guidelines b) Plans must include: i) Floor layouts ii) All elevations iii) Contour lines iv) Site plans illustrating boundary walls, perimeter fencing, driveways etc v) Critical dimensions of primary and secondary spaces are to be shown on the drawings vi) Finished floor levels to be shown in relation to actual ground levels vii) Wall plate heights and roof pitchers to be shown on sections viii) Area and coverage calculations to be shown ix) The placement and details of the septic tank are required 4) A Plan Submission Form must be completed and accompany each submission. 5) Submission fees are as follows: First submission: (this covers two full submissions) R1,500 Third and each subsequent submission: R750 Alterations to already approved plans: R750 Submission fees will be charged to your monthly levy account No submission will be considered by the RGAC unless the full submission fee has been received 6) Once your submission has been stamped and passed by the RGAC, the following is required by the umngeni Municipaliy: a) Four original stamped, signed copies of the approved plan, in colour, together with a letter from the RGAC, confirming the approval. This letter will be made available to you by the Committee, on approval of the plans. b) A submission fee is due to the Municipality and is calculated on the floor area of the building. To obtain this, you may contact their offices on ) Any alteration/amendment to an approved plan must be submitted to the RGAC, together with the relevant submission form and submission fee. 8) You may use a builder of your choice. The builder is required to sign a contract with the River Goose HOA prior to commencing construction on the property. The contract regulates how the contractor and his staff are required to conduct themselves while building on site on River Goose Estate. The document may be obtained from the River Goose HOA from the managing agents 9) The building contractor will be required to lodge a deposit with the HOA prior to commencing building on any erf. The building deposit will be refunded to the contractor on completion of the building, subject to the contractor having complied with the conditions of the Contractor s Agreement. 10) Information regarding the service connections may be obtained from the RG Estate Manager, Graeme Abernethy

Has a plan for Window Details on a scale of not less than 1:50 been included in the plans We, the undersigned, hereby undertake and accept that: The Building Committee's decision is final and binding and that the dwelling must be constructed in accordance with the approved building plans. All elevations must be included in the plans together with a site plan at a scale of 1:100. Contours should be shown on the site plan at an interval of no greater than 1 meter. That no building may commence until the plans have been approved. That the above details provided are correct. Should the registered owner wish to make any amendments during construction, prior to such amendments being made, amended buildings plans shall be submitted and approved prior to executing such changes on site. Any deviations built without approval may attract penalties or further action by the RGAC. In the event of any deviations being made to the building plans, then we acknowledge that the RCAC shall be entitled to stop building on the property until such time as the amended plans have been approved or, alternatively, the defect has been amended. 4 RIVER GOOSE ESTATE BUILDING PROCEDURE 1) After a homeowner has had their building plans approved by the RGAC and the owner wishes to commence building, he/she is required to contact the Home Owners Association to arrange a Site Handover Meeting prior to work on site commencing. 2) Before the handover, the owner shall be required to have the boundary pegs identified by a Land Surveyor and a certificate to this effect provided to the HOA 3) A Site Handover Form will be required to be completed prior to the commencement of construction 4) Your builder is required to sign a Builders contract with the RGE HOA prior to commencing construction on the property. The contract regulates how the contractor and his staff are required to conduct themselves while building on River Goose Estate.

5 RIVER GOOSE ESTATE CONTRACTORS RULES AND REGULATIONS 1) Working hours are from 07h00 17h00; departure from Estate by 18h00 2) Workers may not leave or enter River Goose on foot 3) All contractor staff to disembark from the vehicle at security to be counted and for random searches to be carried out 4) All contractor staff will be required to produce and ID document, a copy of which will be retained on file, prior to entry on the Estate 5) Building contractors are responsible for any and all subcontractors that they employ. Any damage to common property done by the subcontractor will be for the building contractors account. 6) The building contractor and/or Home Owner is responsible for any deliveries made to the Estate and will be liable for any damage done to the common property by said delivery vehicle. 7) Workers may not leave the enclosed site area 8) Bonnox fence / weldmesh fence to be erected around the site and to be kept neat and tidy at all times. Fencing must not be removed until building is complete 9) New shade cloth to be used together with the fencing if the site is next to or near an established property 10) All necessary fencing and shade cloth to be put in place before any work or foundations are carried out on the site 11) Material store must have 4 sides and a roof, and must be able to lock 12) Material store must be kept clean and tidy 13) Refuse store must be 3m x 3m using 1.5m length shade cloth or alternatively 6 drums which are in a designated area. 14) No burning of refuse is permitted 15) Site toilet must be placed in a discreet area and must be cleaned on a weekly basis. Consideration is to be given to neighbours at all times. 16) All workers must use the toilets provided and not urinate outside and around the toilet. 17) Over weekends, long weekends and December shut down, all sites are to be left neat, clean and tidy. All shade cloth to be in place and no debris to be on verges and streets. 18) Any damage to verges, streets and property of the Estate will be deducted from the contractor deposit, or must be repaired to its original condition. 19) All drivers are to follow the road signs and keep to the 30km/h speed limit. FAILURE TO COMPLY WILL RESULT IN A FINE. 6 RIVER GOOSE ESTATE HOMEOWNERS' ASSOCIATION CONTRACTOR'S OBLIGATIONS AGREEMENT In respect of ERF RIVER GOOSE ESTATE 1. PARTIES 1.1. River Goose Home Owners Association ("the RGHOA") 1.2. ("the contractor") ("the owner") 2. RECORDAL 2.1 The contractor has been contracted to carry out building construction work on the property under the control of the RGHOA. 2.2 The contractor has accepted his mandate subject to the obligations in favour of the RGHOA as set out in this Agreement and the RGHOA Building Procedure document, a copy of which is annexed hereto. 3. AGREEMENT The contractor shall carry out the mandate to undertake building construction work on the property known as: Erf, situated at ( the property") 3.1 Construction Period Construction of any house, once commenced, shall be completed within 12 months, save with the consent in writing of the RGHOA Any improvements or construction work not completed within the said 12 month period shall be deemed to be a nuisance and the RGHA shall be entitled to remove such nuisance; charge the owner interest at 1% per month, or part thereof that the delay continues; or complete the work at the cost of the owner. 3.2 Compliance with Approved Building Plans The Contractor and Homeowner hereby agree that the house will be built in accordance with the building plans as approved by the River Goose Architectural Committee (RGAC). In the event of any deviations being made without specific consent from RGAC, then the RGHOA shall be entitled to give the owner notice to remedy the defect within a 14 day period, or such longer period as RGHOA may decide The Board of RGHOA shall be also be entitled to impose a fine on the home owner and/or the Contractor, which fine shall be determined by the Board but shall not exceed an amount of R1 000 per day and shall be payable from the termination of the notice period until such time as the deviations have been remedied to the satisfaction of RGAC

7 3.3. Construction Signs The contractor shall erect a construction sign in a form approved by the RGHOA The sign shall accommodate the builder's name, engineer's name, the architect's name, the erf number and if approved by the owner, the owner's name No other signs of contractors, sub-contractors, suppliers, financing companies or any other party, may be erected on the site. 3.4 Erosion Control The contractor shall install temporary construction entrances and shall ensure that erosion controls are put in place to limit erosion on the site Such erosion controls are to be approved by the RGHOA Litter Control The contractor shall control litter and wind blown litter by the following methods: Site fencing: Prior to commencing construction on site, a bonnox wire and green 80% shade cloth fence, of approximately 1.8m high, shall be erected. The fence shall have gum poles at an interval of not more than 5m and only one entrance with gates, which shall not exceed 5m in width. On completion of the house the fence shall be removed Clearing the site of litter and building scraps. The contractor shall clear the site at any stage, if the site is untidy. If the RGHOA is unhappy with the tidiness of the building site, after directing the contract to keep it neat and tidy, the contractor will be fined Placement of litter bins on site. The contractor shall ensure that sufficient litter-bins are placed on site for the use of construction workers Burning or burying of litter, rubbish or building material on site is prohibited. If this is found to be the case, the contractor will be required to rectify the situation to the satisfaction of the RGHOA. If this is not done, the contractor will be fined and all work on the site stopped until the issue has been rectified All building material, equipment and excavated soil must be contained within the fenced off boundary. 3.6 Work Hours Unless otherwise approved by the RGHOA, construction work shall be limited to the hours between 07h00 and 17h00, Mondays to Fridays Should there be any delay in pouring concrete, permission may be given, if requested, for an extra 30 minutes so as to be out of the gate by 18h No construction will be allowed on Saturdays, Sundays or Public Holidays without the special written consent of the RGHOA. 3.7 Behaviour All construction workers are expected to behave in a workmanlike manner. Behaviour shall not disturb other residents or activities on the Estate The contractor is also responsible for the behaviour of sub-contractors on the site and for ensuring they are properly supervised No workers may leave the building site at any time save in the exercise of their duties In the case of construction on more than one site, movement of personnel between sites is restricted to vehicles ie no pedestrian traffic No worker employed by the contractor shall be entitled to be on the site, other than during the hours provided in Clause 3.5, unless the prior written consent of the RGHOA is given. 3.8 Access to the Estate Care shall be taken when transporting materials to the site and the Estate speed restriction of 30kph must be adhered to. Should any of the road edging or any services on the property be damaged by said vehicles,

8 the Contractor shall be responsible for repairing such damage at the Contractors own cost. Should the Contractor not make good any damages the Home Owners Association must recover the cost from the plot owner Failure to take due care, or to adhere to the speed restriction may result in a driver being banned from access to the Estate and the construction site, or being fined R500 for each infringement All contractors and their labour, upon entering or exiting River Goose Estate, are required to comply with the procedures laid down by the RGHOA with respect to identification, vehicle and body searching All persons working for a contractor will be required to provide the following information prior to being allowed access into River Goose premises: Name and ID number, or name; passport number; work permit number; and home address The contractor is to notify the RGHOA office of the names and identity numbers of all sub-contractors working on site, with their dates of commencement and completion All contractors and their staff shall be bound by the security regulations at River Goose A maximum weight 10 tons per vehicle is permitted in and on the Estate roads. Should a vehicle exceed the maximum load, it will be required to discharge the delivery at a loading area in the proximity of the main gate and the contractor will then be required to remove the delivered construction material in part loads to the building site immediately. 3.9 Parking Construction vehicles shall not be parked in any area other than on the building site, or on the street way bordering the site Vehicles shall be parked with due consideration for users of the streets Storing of Construction Material and Site Offices All construction material will be stacked neatly within the site boundary fencing Toilet Facilities The contractor must provide adequate portable toilet facilities and rubbish bins for construction workers during the construction period. The location of such facilities must be placed so as to minimize offence to the owners of units on the property and must be enclosed in shade cloth Insurance The Contractor shall take out at its own expense public liability assurance for any claim for damages arising from the acts or omissions of it or its employees or agents The Contractor hereby indemnifies River Goose against payment of any such claim for damages Exterior Coatings The Contractor acknowledges the requirement to comply fully with the River Goose Architectural Guidelines with regard to exterior coatings and colours Final Clean Up At the conclusion of the construction work, the contractor shall restore all streets, ditches, drainage ways, including fine grading and seeding; ensure positive drainage with no standing water; clean the entire site of all construction debris; and remove all temporary fencing facilities, equipment and unused materials The RGHOA will give approval as to whether the final clean up has been completed to its satisfaction Water and Electricity Meters Both water meters and electricity meters must be installed prior to work starting on site.

9 Estate manager to confirm that both meters are installed and in working order before any construction starts RGHOA and the estate manager reserve the right to inspect said meters at any time to ensure that they are in working order. 4. BREACH In the event of the contractor being in breach of any obligations under this agreement, then the RGHOA shall be entitled to one or more of the following remedies: 4.1 Give written notification to the contractor to remedy the breach within 24 hours. 4.2 Close the contractor's access to the site until the breaches have been remedied; or 4.3 Insist on rectification of the breach at the cost of the contractor. 4.4 Should the contractor deviate in any way from the approved building plan, the contractor and the owner will be liable for a fine by the RGHOA and will be obliged to remove the part of the building that does not comply with the approved plan. 5. DEPOSITS 5.1 The contractor and homeowner are obliged to place a deposit of R5 000 each with the RGHOA, as security for any breach of this contract. 5.2 This deposit will be refunded in full, assuming no breach of contract has occurred, upon the satisfactory completion of the final clean-up 6. GENERAL 6.1 Non-Waiver No indulgence, which any party may give to the other party in terms of this Agreement, shall constitute a waiver by the former of any of its rights under this Agreement. 6.2 Variation No agreement varying, adding to, deleting from or cancelling this agreement and no waiver of any right under this agreement, shall be effective, unless reduced to writing and signed by or on behalf of the parties.
