1 NOTICE TO BIDDERS Sealed bids will be received by the City of Escanaba in the Council Chambers Room C101 of the Escanaba City Hall/Library Complex at 2:00 p.m., e.s.t., on March 14, MARKETPLACE DESIGN/BUILD PLAY STRUCTURE The bids will be publicly opened and read in Room C101 at City Hall, located at 410 Ludington Street, Escanaba, Michigan at said time and date. Bidder s proposals and/or specifications may be obtained from the office of the City Clerk, located at 410 Ludington Street, Escanaba, Michigan No bids will be considered unless the proposal form and/or specifications (furnished by the City of Escanaba, Michigan), are properly completed and enclosed in a sealed envelope marked: MARKETPLACE DESIGN/BUILD PLAY STRUCTURE In addition, the City of Escanaba, Michigan, will not consider any proposal which has not been received prior to the published time, date, and year of bid opening. (FAX transmittals will not be accepted.) A Certified Check, Cashier s Check, or Bidder s Bond, drawn payable, without condition, to the City of Escanaba, Michigan, in an amount not less than 10% of the bid, will be submitted with each proposal as a guarantee that if the bid is accepted, the bidder will furnish materials or services as stated in his or her proposal, he or she shall forfeit said deposit to the City of Escanaba, Michigan, as liquidated damages. The acceptance of the proposal will be contingent upon the bidder s acceptance. The City of Escanaba, Michigan, reserves the right to reject any or all bids, or any part thereof at its discretion, and to waive any irregularities in the bidding. The City of Escanaba, Michigan, may also split bids at its discretion. The City further reserves the right to negotiate directly with any and all bidders concerning any matter related to any bid. All City of Escanaba, Michigan, bids are prepared so as to afford all vendors the equal opportunity for fair and equitable competition. 2 SPECIFICATIONS for MARKETPLACE PARK AND PLAY STRUCTURE GENERAL SPECIFICATIONS 1. SCOPE OF WORK To provide a design and build for a public playground area which is of a universal accessible design to coincide with the newly constructed downtown Marketplace utilizing a 60 x 80 dimension area. Budget for this project not to exceed $85,000. The design, playground equipment, access pathways and surface, which must be of poured in place rubber, must conform to all ADA requirements. As defined by the Site Work Specifications, the location, color system/materials and supplies, park and play structure equipment, content of bid, safety surfacing and edging, furnishings, supervision and project completion must be clearly specified and detailed in the bid. The awarded bidder must provide four sets of the completed bid and drawings, along with a digital copy. 2. CONSTRUCTION SCHEDULE Please indicate completion date in proposal for the 2017 year. 3. BID SECURITY With this proposal, the Bidder shall furnish bid security in an amount not less than ten percent (10%) of the proposal as a guarantee that if the bid is accepted, the Bidder will furnish materials or services as stated in his/her proposal; as per specifications herein. Bid security shall be a certified check, cashier's check or bidder s bond drawn payable, without condition, to the City of Escanaba, Michigan. Bids may not be withdrawn within thirty (30) days after opening date without forfeiting bid security. Bid security of the successful Bidder will be retained by the City until satisfactory completion of the work. The design and build contractor will be required to furnish a performance bond upon notification of the acceptance of their proposal. The performance bond will be for 100% of the proposal amount. 4. EXAMINATION OF SITES AND BID DOCUMENTS Each Bidder shall visit the site and acquaint themselves with conditions relating to the work so that bidder may fully understand the difficulties and restrictions which may affect execution of work. Bidders shall also thoroughly examine the specifications. The submission of a proposal by the Bidder shall be taken as conclusive evidence of compliance with this requirement.

3 5. QUALIFICATION OF BIDDERS Bidder shall submit evidence and/or qualifications of the capability to construct such park and play structure along with previous project references with all contact information. Reference projects and project dates are to be submitted with the Bidder's Proposal. 6. INSURANCE The Contractor shall furnish proof of insurance, before the start of work, establishing minimum coverages as follows: Worker s Compensation Coverage A Statutory Coverage B $100,000 Comprehensive General Liability Per occurrence $1,000,000 General Aggregate $1,000,000 Products/completed operations General Aggregate $1,000,000 Comprehensive Automobile Liability Combined Single Limits $1,000,000 The City of Escanaba shall be named as additional insured on all certificates. All policies affording coverages required in this section shall further be endorsed to provide a ten (10) day notice to be delivered to the City before any coverages are either reduced or cancelled. 7. PAYMENTS Payments shall be made to the successful Bidder/Contractor estimated monthly with a 10% retainage. The 10% retainage will be held until thirty days after completion of the project. Stored materials will be paid for at actual cost, minus 10%. The City will retain the bid security deposit until the work is satisfactorily completed. The City reserves the right to withhold an equitable amount for items not completed or unsatisfactory. The successful bidder shall submit waivers of lien from his/her company, sub-contractor, certified payroll and all material suppliers before final payment. 8. TAXES The successful Bidder/Contractor shall pay all applicable state sales and use taxes if applicable for this project. 9. PROTECTION The successful Bidder/Contractor shall take adequate precautions to prevent existing walks, drives, lawns or landscaped areas and buildings from being damaged. Any damages shall be corrected at the Contractor's expense to the City's satisfaction.

4 10. GUARANTEE The successful Bidder/Contractor shall guarantee material and labor for a period of three years from the date of completion of work. 11. SAFETY REGULATIONS The successful Bidder/Contractor shall conform to the General Safety Rules and Regulations for the Construction Industry as prescribed by the Construction Safety Commission, Department of Labor, Bureau of Safety and Regulations, Lansing, Michigan and the Occupational Safety and Health Standards of the U.S. Department of Labor. 12. DISCREPANCIES In case of disagreement within the specifications, the better quality or greater quantity of work shall be estimated and the matter drawn to the attention of the City for discussion and/or adjustment. 13. 5 SITE WORK SPECIFICATIONS 1. LOCATION The park and play structure will coincide with the newly constructed Marketplace. The Marketplace is located at the northeast corner of Ludington Street and South 15 th Street. The park and play structure would be located on the southeast corner of such lot which is a 60 x 80 dimension. 2. COLOR SYSTEM/MATERIALS AND SUPPLIES Color scheme must compliment the newly constructed Marketplace which consists of blue and brown tones.

6 3. PARK AND PLAY STRUCTURE EQUIPMENT Park and play structure equipment is designed for five to twelve (5-12) year olds. As a minimum, the proposed park and play structure must include the following features, signage and equipment: Liberty swing must be accessible from pathway constructed Access pathways to the park and play structure with ADA requirements Three ADA compliant benches of recycled materials and accessible on cement surface An entrance arbor opening from the Marketplace Structure to the park and play structure with overhead signage Interactive activity displaying vegetables for educational purposes that ties in with the theme of the Farmer s Market using fruits and vegetables Example of interactive display: Example of park and play structure:

CONTENT OF BID All proposals must include a detailed design and site plan with use zone layouts, circulation pattern layouts for safe play and locations. Must include poured in place rubber matting and locations must be provided. Must include pictures and/or illustrations of each play component and/or structure. Must include color scheme per play component and/or structure. Must provide copies of all guarantees covering the equipment, safety surface and edging. Must provide an explanation of what the play component and/or structure will do. Must provide four sets of the completed bid with all drawings and must provide a digital copy. 5. SAFETY SURFACING AND EDGING Poured in place rubber surfacing must be installed under the play structure. Safety surface materials and installation must be provided upon completion. Edging access of a pathway must be provided, which could include a concrete sidewalk. Bidder will be responsible for any damage to sidewalk during installation. ADA accessibility is of great importance. All designs must incorporate all ADA Accessibility Guidelines for play areas. 6. FURNISHINGS The bidder will provide and deliver to the job site all specified playground equipment. The bidder will pay for all transportation costs and provide all the manpower necessary to load and unload equipment, materials and supplies. Bidder must fully construct the park and play structure to include all landscaping which incorporates a level, top soiled, seeded, mulched, etc. surface upon completion. 7. SUPERVISION The City assumes no responsibility in the supervision of the work involved in the execution of this bid beyond insuring all the plans and specifications are being properly interpreted. The supervision and checking will not relieve the contractor of any responsibility for the performance of his/her work in accordance with the plans and these specifications.

8 8. PROJECT COMPLETION The successful awarded bidder must construct during the 2017 season. A completion date is required to be listed.
