1 May 17, 2012 RE: BID PACKAGE INSTRUCTIONS TO BIDDERS KPMG Denver Package Description: Interiorr Demolition Bid Package #: 01 Turner Construction Company invites your firm and team of subcontractors to bid the Interior Demolition Bid Package in accordance with the following instructions. Failure to follow these instructions will result in your bid being rejected. Turner Construction reserves the right to accept whichever bid proposals that, at our discretion, best suits the needs of the client and/or project. Turner Construction reserves the rights to reject any or all bid proposals. Turner Construction may also waive any informalities or irregularities in the bid proposals. Upon receipt of the bid proposals, Turner Construction may enter into discussions or negotiations with any or all bidders. Such discussions or negotiations shall not constitute a rejection of any bid proposal or a counteroffer. By submitting its bid, the bidder agrees that its bid proposal shall be irrevocable for a period of 90 days after the date of submission. By submitting its bid proposal, the bidder acknowledges that any subsequent Material or Subcontract Agreement shall not be formed until such time as the Turner Construction authorized representative signs and executes the Agreement, and that Turner Construction shall have no obligations to the prospective Supplier or Subcontractor until such time. None of the bid documents shall be considered contractual documents unless specifically referenced as such in the final executed Agreement between Turner Construction and the winning bidder. I. Bid Package Specifics The intent of this bid package Description. is to include all work necessary to complete the Bid Package Scope 1. Reference Documents (attached) a. These BID PACKAGE INSTRUCTIONS with attached BID RESPONSEE FORM as Transmitted to the Bidder by Turner Construction. Confirmation of receipt by bidder back to the Turner Construction Purchasing Team is required. b. 2 2. Turner Constructionn FTP Site: Drawings and Specifications for this Bid Package can be found on Turner s FTP site. All bidders will receive an ITB via allowing access to all documents. Link to the documents: or_demolition 3. SubGuard a. Bid bonds are not required. b. All contractual agreements will be subject to Turner s SubGuard Program. Individual Subcontractor Payment and Performance Bonds will not be required. 4. Alternate Pricing Requests See Project Exhibit A: Additional Provisions for specific instructions. 5. Basis of Award: The award of this package will occur as per the Schedulee of Award and Key Award Milestones noted in Item 7 below. Each package may be awarded differently depending on the Scope of Work and at the discretion of Turner Construction Company. 6. Schedule of Award and Key Award Milestones: a. Project Tax Considerations: This Subcontractor has included all requirements for project taxes as defined in Exhibit B: Project Standard Provisions. II. 5 16. Alternates as Requested: The following Alternates may be accepted by the Owner and Turner Construction at its sole discretion. The Alternates noted herein are not part of the Lump Sum Fixed Cost. Inasmuch as these alternates were anticipated from the inception of the project and were priced accordingly, alternates shall be all inclusive including but not limited to: overhead, profit, escalation, applicable insurances, permits, fees, licenses, labor, fringe benefits, supervision, materials, certifications, training, tools, equipment, hoisting, trucking, handling, fuel, oil, shipping, distribution, safety, drafting, protection of materials and finished work. Add Alternate No. 01 Subcontractor to provide a deductive alternate per the criteria outlined below: Provide an add alternate price for interior demolition of the 9 th Floor elevator lobby and common corridors around the building core. This is for breakout purposes only because this scope is funded by the Building Owner instead of the Tenant. The scope will be included in the bid award value.
