1 ADDENDUM NO. 1 Denton Boulevard Paving HMM Project No CFWB Bid No. ITB December 27, 2012 This addendum forms a part of the Contract Documents and modifies the original Project Manual and Plans, dated December 2012, as noted below. Acknowledge receipt of this Addendum in the space provided on the Bid Form. Failure to do so may subject Bidder to disqualification. Changes to Sections/Plans noted shall be considered as changes to any other sections of the plans and specifications which might be affected by the change. I. Clarifications: 1. The Davis Bacon Act is applicable and enforceable. The 2012 County wage determination is attached. 2. Contractor Questions and Responses: Question: Spec. Sec Supplementary Special Conditions Page 1 of 2, Items #7 & #8 Warranty Period: Seems to be a conflict with the warranty start date. Item #7 indicates.from the date of final acceptance of the work. Item #8 reads..shall begin upon final payment to the Contractor. Which is correct? Response: Warranty Period shall begin upon final acceptance of the work. Question: Spec. Sec. FDEP Supplemental Conditions Page FDEP-5 (7 of 27) Article 10: Is this a Federal Cap Grant project? Response: No. This is not a Cap Grant Project. Question: Can you supply the street address for the delivery of 2,800 tons of limerock road base material to Okaloosa County Water and Sewer? Response: Location is to be determined, but it will be within two miles of the project. II. Project Manual: 1. Section Supplementary Special Conditions: Item 14. Shall be replaced with 14. The Contractor shall submit detailed Maintenance of Traffic Plan to the City, County and Engineer. The plan shall address detour routes and access to all residential and commercial properties. 2 school traffic and access shall be addressed in the Maintenance of Traffic Plan. The Contractor shall coordinate their Maintenance of Traffic Plan in concurrence with Okaloosa County Water and Sewer s Maintenance of Traffic Plan for the pavement patching. For the overlay, the Contractor shall provide their own Maintenance of Traffic Plan. 2. Section Scope of Services: Replace last paragraph of this section with the following: It is anticipated that the asphalt patching work will be completed in four (4) sections: One (1) south of Racetrack Road and three (3) north of Racetrack Road. Bidders shall anticipate and include in their bid price, four separate mobilizations for asphalt patching. Overlay of the entire pavement width will be completed in two mobilizations (one south of Racetrack Road and one north of Racetrack Road). Upon completion of the pavement overlay, all pavement markings shall be completed to match pre-construction conditions within the overlay limits. The Contractor shall also be responsible for adjustment of manhole and valve covers as required to match the completed pavement elevations. The Contractor will be required to coordinate closely with Okaloosa County Water and Sewer. 3. Section Measurement and Payment: Replace with Section Measurement and Payment provided herein. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the

The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union. Union Identifiers An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM /01/2011. The first four letters, PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable, i.e., Plumbers Local The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example. Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rate. Non-Union Identifiers Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA /13/2010. SU indicates the rates are not union rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date. Survey wage rates will remain in effect and will not change until a new survey is conducted. WAGE DETERMINATION APPEALS PROCESS 1.) Has there been an initial decision in the matter? This can be: * an existing published wage determination * a survey underlying a wage determination * a Wage and Hour Division letter setting forth a position on a wage determination matter * a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial

Page 4 of 4 8/8/2012 contact is not satisfactory, then the process described in 2.) and 3.) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Washington, DC ) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Washington, DC The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue. 3.) 7 SECTION 1000 MEASUREMENT AND PAYMENT PART 1 SCOPE OF THE WORK The scope of this section of the Contract Documents is to further define the items included in each Bid item in the Bid Proposal section of these Specifications. Payment will be made based on the specified items included in the description in this section for each bid item General All Contract Prices included in the Bid Proposal section will be full compensation for all labor, materials, tools, equipment, Taxes and incidentals necessary to complete the construction as shown on the drawings and/or as specified in the Contract Documents to be performed under this contract. Actual quantities of each item bid on a unit price basis will be determined upon completion of the construction in the manner set up for each item in this section of the specifications. Payment for all items listed in the Bid Form will constitute full compensation for all work shown and/or specified to be performed under this project Estimated Quantities The quantities shown are approximate and are given only as a basis of calculation upon which the award of the Contract is to be made. The Owner/Engineer does not assume any responsibility for the final quantities, nor shall the Contractor claim misunderstanding because of such estimate of quantities. Final payment will be made only for satisfactorily completed quantities of each item Work Outside Authorized Limits No payment will be made for work constructed outside the authorized limits of work Measurement Standards Unless otherwise specified for the particular items involved, all measurements of distance shall be taken horizontally or vertically Area Measurements In the measurement of items to be paid for on the basis of area of finished work, the lengths and/or widths to be used in the calculations shall be the final dimensions measured along the surface of the completed work within the neat lines shown or designated Lump Sum Items Where payment for items is shown to be paid for on a lump sum basis, no separate payment will be made for any item of work required to complete the lump sum item. Lump sum bid items shall be complete, tested, and fully operable prior to request for final payment. The lump sum price bid for various items shall be compensation in full for furnishing all materials, labor, equipment, dewatering and incidentals necessary to install these items complete and operable in every detail and in accordance with these plans and specifications Unit Price Item Separate payment will be made for the items of work described herein and listed on the Bid Form. Any related work not specifically listed, but required for satisfactory completion of the work shall be considered to be included in the scope of the appropriate listed work items. 8 price bid for the various items shall be compensation in full for furnishing all materials, labor, equipment, and incidentals for the item in place, complete in every detail. There will be no direct payment for clearing, grubbing, excavation, bracing, dewatering, backfilling, clean-up, sheeting, shoring, restoration of property, testing or other items of work necessary for installation of the item Other Provisions No separate payment will be made for the following items and the cost of such work shall be included in the applicable pay items of work. Reduction in retainage shall not be requested by the Contractor or made by the Owner until as-built (record) drawings have been submitted to the Engineer and approved. Trench excavation, including necessary pavement removal, rock removal, and muck removal. Sheeting and shoring. Clearing, grubbing and grading. Removal and disposal of excess materials remaining after excavation. Dewatering and disposal of surplus water. Structural fill, backfill and grading. Testing and placing system in operation. Any material and equipment required to be installed and utilized for tests. Maintain the existing quality of service during construction. Appurtenant work as required for a complete and operable system. Operation and Maintenance manuals Application For Payment The Contractor shall submit an application for payment, no more frequent than monthly, to the Engineer for review and approval upon partial completion of the project before the Contractor will be compensated for the work performed during that period. The application shall invoice work completed as detailed in the Contractor s Proposal. Final payment in full will be made when work is completed to the satisfaction of the Owner, and the Engineer, when it has been shown that the Contractor has discharged all obligations of this Contract (Release of Liens) and when all punch list items have been corrected. Application for payment will be made on the form included in these Contract Documents. PART 2 NOT APPLICABLE PART 3 EXECUTION 3.01 Bid Item No. 1 Mobilization / Demobilization Payment for all work included under this bid item will be made at the lump sum price bid for mobilization and demobilization of all labor, equipment, materials, and appurtenances necessary for execution of the project. Mobilization shall include all items detailed in Article of the FDOT Standard Specification, latest edition. Also included, but not limited to, as part of this bid item is the cost for project performance indemnifications, photographs, schedules, coordination, and phasing and other miscellaneous items associated with the work. Payment for this bid item will be lump sum. Contractor shall include four (4) mobilizations/demobilizations for pavement patching and two (2) mobilization/demobilizations (one south of Racetrack Road and one north of Racetrack Road) for pavement overlay in their bid price. 9 be payable upon each mobilization/demobilization after all applicable documentation has been submitted to the Engineer Bid Item No. 2 Provide Limerock GAB Roadway Base Material to Okaloosa County Water and Sewer Payment for all work included under this bid item will be made at the unit price bid for the work covered by this item, and shall be full and complete compensation for supplying and delivering all materials required for the section of roadway included in this project. Modified Proctor (ASTM D1557) Density Tests for the supplied material shall be provided by the Contractor. Payment for this item shall include all required coordination and scheduling with Okaloosa County Water and Sewer. The unit price bid shall include Contractor s overhead and profit Bid Item No. 3 Pavement Patching Payment for all work included under this bid item will be made at the unit price bid for the work covered by this item, and shall be full and complete compensation for the entire work for the covered by this item. The work covered by this item includes all costs associated with initial structural course patching in accordance with the Contract Documents Bid Item No. 4 Overlay Roadway Payment for all work included under this bid item will be made at the unit price bid for the work covered by this item and shall be full and complete compensation for the entire work. The work covered by this item includes all costs associated with roadway overlay. This bid item shall include, but is not limited to labor, materials, equipment, milling, thermoplastic striping, adjustment of elevation of manhole and valve covers to and all other requirements to provide a fully functional 1-1/4 roadway overlay in accordance with the Contract Documents. This bid item also includes ten (10) foot transition sections to tie to existing pavement as indicated on the plans. Additionally, this bid item includues maintenance of traffic.
