1 Do Kim & Associates, LLC Consulting Structural Engineers Mr. Steve Korducki President & CEO Sunshine State Insurance Co. 475 West Town Place, Suite 210 St. Augustine, FL June 10, 2011 RE: Review of Proposed Draft OIR-B Uniform Mitigation Verification Inspection Form Dear Mr. Korducki, As requested, we have reviewed the draft proposed by Office of Insurance Regulation along with industry comments on the proposed draft provided to us by Sunshine State Insurance Company (Sunshine State). Outlined below is our assessment on the proposed changes and industry comments based on our experience and how they would affect insurance companies, and in particular, potential impact on companies similar to Sunshine State Insurance Company. Proposed changes by OIR: Change in footnote: changes validity of report from up to five years to for five years. Requires inspections to be valid for five years. Possible interpretation would be that insurance companies must accept report if less than five years old. Would that prevent insurance companies from requiring new or re-inspections? (NEUTRAL) *This verification form is valid for up to five (5) years provided no material changes have been made to the structure. OIR-B (Rev. XXXX 01/11) Adopted by Rule 69O Changes how hip roofs and flat roofs are defined. The proposed hip roof definition would add additional uncertainty as to how inspectors would determine roofs as hip roofs without adding underwriting or risk benefits to Sunshine State. One issue is what is defined as a major wall? Based on our experience, the proposed definition would add hardship by allowing more roofs to be defined as hip roof versus non-hip roof. This would increase the credits given without any associated reduction in risk for windstorm damage. (AGAINST) 5. Roof Geometry: What is the roof shape(s)? (Porches or carports that are attached only to the fascia or wall of the host structure and not structurally connected to the main roof system are not considered in the roof geometry determination.) A. Hip Roof Hip roof and has no gable end that exceeds 50% of a major wall length. Hip roof with no other roof shapes greater than 10% of the total building perimeter. B. Non-Hip Roof Any other roof shape or combination of roof shapes including hip, gable, gambrel, mansard and other roof shapes not including flat roofs. C. Flat Roof Flat roof shape in which 90% of the total roof area has a slope of less than 2:12. Flat roof shape greater than 100 square feet or 10% of the entire roof, whichever is greater. P.O. (SUPPORT) Qualified Inspector I hold an active license as a: (check one) Home inspector licensed under Section , Florida Statutes who has completed the statutory number of hours of hurricane mitigation training approved by the Construction Licensing Board and completion of a proficiency exam. Changes the language for inspector liability from acts to misconduct of employees. We do not feel that this is a material change effecting Sunshine State. (NEUTRAL) An individual or entity who knowingly or through gross negligence provides a false or fraudulent mitigation verification form is subject to investigation by the Florida Division of Insurance Fraud and may be subject to administrative action by the appropriate licensing agency or to criminal prosecution. (Section (4)-(7), Florida Statutes) The Qualified Inspector who certifies this form shall be directly liable for the misconduct acts of employees as if the authorized mitigation inspector personally performed the inspection. Adds new statement that communicates to homeowner that insurer may request additional information on mitigation features for underwriting purposes. We feel that this statement would provide greater flexibility to Sunshine State in cases where additional information is needed to confirm or clarify credits. (SUPPORT) Note: for underwriting purposes, your insurer may ask additional questions regarding your mitigated feature/s. Proposed changes by Bill York, Darius Grimes, Otis Black and others: Proposed alternate language adds four new data fields for type of roof covering that does not enhance the knowledge gathered for product performance. Insurers already collect roof covering type by other means and this would only duplicate that information. The material change incorporated into Box A would first require that the roofing product have a Miami-Dade NOA or a 2001 FBC product approval. This would not on its face require that these products meet or exceed the requirements of the 2001 FBC. The language Chapter 15 attachment specifications of the 2001 or later Florida Building Code is vague and obtuse. This language is somewhat contradictory. Products that have product approvals or NOA have specific attachment requirements as part of those approvals and are not referenced or specified in Chapter 15 attachment specifications. The language for asphalt shingles solely requires that they comply with ASTM D3161, D7158, or TAS 100/107. This would add hardship to Sunshine State and insurers by eliminating approximately half of Florida where homes in wind speed zones less than 110 mph would not have been required by the 2001 FBC to install asphalt/composite roof shingles complying with ASTM D3161 (enhance for 110mph) or ASTM D7158 (F, G or H). Homes with asphalt shingles installed and permitted under the 2001 FBC in areas less than 110 mph (interior half of Florida) would not be provided with this credit even though it would have met the 2001 FBC. (AGAINST) 1. Predominant Roof Covering: Permit Application Date: (mm/yyyy) or Date of Installation: (mm/yyyy) A. At a minimum meets the 2001 Florida Building Code or the 1994 South Florida Building Code and has a Miami-Dade NOA or FBC 2001 Product Approval listing demonstrating compliance with ASTM D 3161 (enhanced for 110MPH) OR ASTM D 7158 (F, G or H), OR FBC TAS and TAS , OR FMRC 4470 and/or 4471 (for metal roofs). Alternate Language: B. Does not meet the above minimum requirements. C. Unknown or undetermined. A. At a minimum any roof covering(s) must have a Miami-Dade NOA or FBC 2001 material product approval and meet the Chapter 15 attachment specifications of the 2001 or later Florida Building Code or the 1994 South Florida Building Code. Asphalt shingles must demonstrate compliance with ASTM D 3161 (enhanced for 110MPH) OR ASTM D 7158 (F, G or H), OR FBC TAS and TAS B. For slate, clay, or concrete tile roof coverings, wood shake roofs, rolled roofing, membrane roof, or built up roofing. C. For metal roofs, has a Miami-Dade NOA or FBC Product Approval that is/was current at the time of installation. D. One or more covering does not meet the above minimum requirements. E. No roof covering meets the above minimum requirements. F. Does not meet the above minimum requirements. G. Unknown or undetermined. Proposed alternate language breaks down specifically that minimum of 3 nails shall be present on the strap side of the truss/rafter and that minimum of 1 nail shall be present on the backside of the strap. This would provide a minimum of 4 total nails. This language adds some clarification on the current language which also states that 3 nails must be used to secure the strap to the truss/rafter and 1 nail on the back side. (NEUTRAL) Alternate Language for C and D: C. Single Wraps Metal Straps must be secured to every rafter/truss with a minimum of 4 nails, 3 nails on one side wrapping over and secured to the opposite side of the rafter/truss with a minimum of 1 nail. The Strap must be attached to the top plate of the wall frame or embedded in the bond beam in at least one place. D. Double Wraps Both Metal Straps must be secured to every rafter/truss with a minimum of 4 nails, 3 nails on one side wrapping over and secured to the opposite side of the rafter/truss with a minimum of 1 nail.. Each Strap must be attached to the top plate of the wall frame or embedded in the bond beam in at least one place. Proposed alternate language tries to clarify language that are not also means do not qualify. We believe that the proposed language could have a negative implied admission that standard underlayment or hot mopped felts are SWR but insurers will not qualify them. This language is not as strong as the current language. (AGAINST) 8. Secondary Water Resistance (SWR): (standard underlayments or hot mopped felts do not qualify as an are not SWR) P.O. Proposed changes by Jack Stumpff: Proposed changes to Opening Protection as submitted exempting garage doors from windborne debris impact resistance requirements would weaken the building envelop protection requirements. This would weaken requirements in Box A, B, and C under the Opening Protection to less than current Miami-Dade and Broward County requirements. This would have the effect of providing Hurricane Protection Level credits to homes that have Basic Protection Levels. This would basically remove higher performance levels for all exterior openings and make them equivalent to only Glazed Exterior Opening Protection (Basic Level). This would add hardship to Sunshine State by requiring the highest level of opening protection credits without the increased mitigation requirements under the current form. (AGAINST) 9. Opening Protection: What is the weakest form of wind borne debris protection installed on the structure? (Exterior openings include, but are not limited to: windows, doors, garage doors, skylights, etc. Product approval may be required for opening protection devices without proper rating identification.) A. All Exterior Openings (Glazed and Unglazed) All exterior openings, except garage doors, are fully protected at a minimum with impact resistant coverings, impact resistant doors and/or impact resistant window units that are listed as wind borne debris protection devices in the product approval system of the State of Florida or Miami-Dade County and meet the requirements of one of the following for Cyclic Pressure and Large Missile Impact. For the HVHZ, systems must have either a Miami-Dade NOA or FBC Approval marked For Use in the HVHZ. Miami-Dade County Notice of Acceptance (NOA) 201, 202 and 203. (Large Missile - 9 lb.) Florida Building Code Testing Application Standard (TAS) 201, 202 and 203. (Large Missile 9 lb.) American Society for Testing and Materials (ASTM) E 1886 and ASTM E (Large Missile 9 lb.) (Small Missile 2 grams) For Garage Doors Only: wind speed resistant (TAS 202 or ASTM E-330) but not impact resistant **** The comments and proposed changes submitted by Applied Research Associates, LLC (ARA) are on whole a significant re-write of the current form. The changes submitted by ARA are so dramatic and substantive from the current form that one would not be without basis by saying that it is a completely new form. The added complexity and underwriting work needed to process the ARA changes would be a significant hardship to Sunshine State and other insurers. A thorough analysis and assessment of ARA s changes should be conducted by the insurance industry to assess the benefit-cost to the insurers, homeowners, and industry professionals of the proposed changes.
