FP/HP/DISP/35397/2018).-regarding 1. The Government of Himachal Pradesh, Forest Department vide their letter. Ft /2018 (FCA) dated (Pg /c) has submitted a fresh proposal to obtain prior approval of the Central Government, under Section-2 (ii) of the Forest (Conservation) Act, 1980 for diversion of ha. of forest land in favour of ADM- cum- Dy.DIR ADMN c/o ADM Office Bilaspur for the construction of proposed AIIMS at Kothipura, within the jurisdiction of Bilaspur Forest Division, District Bilaspur, State of Himachal Pradesh. 2. HP has issued FRA certificate vide his letter no. BLS- ADRA-1(855)/ dated (Pg.. 33/c) for diversion of ha. of forest land in favour of ADM- cum- Dy. DIR ADMN c/o ADM Office Bilaspur for the construction of proposed AIIMS at Kothipura, within the jurisdiction of Bilaspur Forest Division, District Bilaspur, State of Himachal Pradesh. Documentary evidences in support of settlements of rights under the Scheduled Tribe and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 may kindly be seen at page no /c. Other information related to this proposal has been submitted by the State Government of HP dated (i) The Deputy Commissioner, Bilaspur Government of Himachal Pradesh vide his letter BLS-ADRA-2 (12)/12-III dated it is also certified that there is no non-forest government land available in District Bilaspur as all government land or land over which govt. has proprietary rights, has been classified as forest land vide notification no. Ft (a)-1/52 dated 15 th January, 1952, issued by the Secretary to Chief Commissioner of the erstwhile Chief Commissioner s Province, Bilaspur. As such, no non-forest land is available for raising compensatory afforestation in lieu of the forest land proposed for the construction of AIIMS, District Bilaspur H.P. Consequently, Compensatory Afforestation has been proposed over the forest land. (ii) The component wise breakup of proposed AIIMS at Kothipura Bilaspur HP as follows: S.. Circulation / Set Back Area Total The above proposal was considered in Forest Advisory Committee (FAC) in its meeting held on FAC after through deliberation and discussion with dal Officer, Himachal Pradesh and APCCF (Central) RO, Dehradun made the following observations: (i) It is not clear why such a big area is required for the instant proposal; (ii) KML file of the proposed forest land be submitted; (iii) justification has been provided by the UA/State Govt. for the use of forest area for dumping site-1 (4.5 ha) and dumping site-2 (3.5 ha).

6 (iv) A technical person/officials conversant with the layout plan and specification of the proposal may attend the upcoming FAC meeting. 5. The above shortcoming were communicated to the State Government of Himachal Pradesh vide this Ministry s letter even number dated 02 nd January, 2019 (Pg. 292/c). w, the State Government of Himachal Pradesh vide his letter /2018 (FCA) dated 07 th has forwareded response to this Ministry s letter dated and the summary of the same is given as under: (i) It is submitted that the Government of India has decided to open one AIIMS in the State of HP under Pradhan Mantri Swasthya Suraksha Yojna (PMSSY) with the objective of correcting regional imbalances in the availability of affordable/ reliable tertiary healthcare services and also to augment facilities for quality medical education in the country for which a minimum land of 200 acres approximately has been required as per the communication dated of the Hon'ble Minister of Health and Family Welfare Government of India to the Chief Minister of Himachal Pradesh(copy enclosed). Since the proposed site has been found suitable and approved by the authorities and the State Govt. has already transferred bighas is 120 Acres of nonforest land which is 60% of the total land required for the said project. In order to meet the minimum possible land as required for the purpose State Govt. has no other option. It is further informed by the State Government of HP that the user agency proposed site is situated in the hilly terrain and a large size of land would be required for setting up of the proposed AIIMS at Bilaspur. Considering the difficult terrain and less `build ability' factor in the land, a large extent of land is left unusable due to the slopes and other factors.such areas will be, in any case used for plantation and development as green patches. (ii) The revised KWL file of the proposed forest land has been uploaded on the web portal. (iii) The user agency has submitted that majority of the non-forest land is existing on the hill side i.e. above the NH which is crossing the proposed site in the middle. Hence to develop dumping sites on this land would have been impractical as it would have been very difficult to carry the muck upward and develop the dumping sites besides to manage it scientifically without any future threat to the proposed AIIMS.Further remaining non-forest land which is existing below the NH is mainly flat and among the best land suitable for the construction activity hence the main structure of the Multispecialty Hospital is proposed on it and to develop a dumping site in the middle of the Campus in a slopy terrain would have been equally unscientific. Hence the dumping sites are proposed in the end of valley side corners of the Forest land. The non-forest land available at the sites were not suitable for this purpose on the basis of aforementioned reasons. Moreover the slope of the non-forest site is not suitable for a dumping site. A reclamation plan of the proposed dumping sites has been prepared and the land used for dumping sites will be reclaimed and used in manner to cause minimum degradation and will be re-developed by doing re-plantation, development of open space etc. (iv) The user agency has submitted that the next meeting will be attended by them along with technical experts who are involved in the site plan, design and construction of the proposed AIIMS

7 It is proposed that the proposal along with additional Information submitted by the State Government / user agency may be placed before the Forest Advisory Committee in its forthcoming meeting scheduled to be held on 15 th January, 2018 for its examination and appropriate recommendations. ****
