1 THE CORPORATION OF THE TOWNSHIP OF GEORGIAN BAY COUNCIL Minutes of the meeting held on Monday, June 18, 2001, at the Baxter Ward Community Centre, Port Severn, Ontario. MEMBERS PRESENT: Mayor M. Adoption of Agenda Be it resolved that the Council agenda dated June 18, 2001 be adopted as amended with the addition of Item 5 a) Baxter Parent Action Group C Minutes of Council Meeting of May 28 h, 2001 Minutes of Special Council Meeting of May 26 th, 2001 Be it resolved that the minutes of the Meeting of the Council of the Township of Georgian Bay dated May 28 th, 2001 be adopted as tabled and the minutes of the Special Council meeting of May 26, 2001 be adopted as tabled. Public Meeting Under the Planning Act to hear a Zoning Amendment a) BY-LAW (KMM Realco Inc) The Mayor noted procedure for the Public Meeting The Clerk outlined notice circulation The Planner reviewed the application The Clerk read one piece of correspondence from the District of Muskoka noting general conformance with some exceptions/requirements outlined Cluster housing definitions and various options were reviewed by the Planner Mr. Grigaitis, agent of the applicant, briefly spoke on the application and intent of the owner Be it resolved that a by-law be numbered By-law and read a first and second time. C Be it resolved that a by-law read a first and second time, numbered and entitled: BY-LAW (KMM Realco Inc) Being a By-law to amend Zoning By-law 91-19, as amended, with respect to Island 77 known as Keating Island, Gibson Ward, Township of Georgian Bay, District of Muskoka. Be read a third time and finally passed. C Committee of Adjustment Council adjourned temporarily at 10:15 a.m. to hold Committee of Adjustment deliberations Council reconvened at 11:20 a.m. 4. Delegations Council temporarily adjourned at 11:20 a.m. Council reconvened at 11:30 p.m. a) Port Severn Improvement Committee Re: Committee Goals & Objectives Mr. Higgs introduced Members of the Committee present Emphasis was placed on goals, objectives and growth The Committee requested direction from Council on their mandate and possible financial support

3 b) Baxter Parent Action Group Mr. Mike James provided a progress report of the Group and reviewed it s content and the steps the group have taken as well as the requested proposed resolutions The Clerk reviewed procedure which dictates that a resolution cannot be tabled today but must be brought forward to a future meeting Members wished further information c) Ms. Rosie Pech Re: Tsepelis Minor Variance Application Ms. Pech relayed her concerns regarding the Tsepelis Minor Variance Application 6. By-laws 1. BY-LAW Assumption of Beech Avenue Being a By-law to assume part of Beech Avenue as shown on Plan M-24 for public use. Planning Report A regarding Assumption of Beech Avenue Be it resolved that a by-law be numbered By-law and read a first and second time. C Be it resolved that a by-law read a first and second time, numbered and entitled: By-law Being a By-law to assume part of Beech Avenue as shown on Plan M- 24 for public use. Be read a third time and finally passed. C BY-LAW Temporary closing of Front Street Being a By-law to authorize the temporary closing of Front Street (MacTier) in the Township of Georgian Bay. CAO s Report A regarding Front Street Road Closing By-law Be it resolved that a by-law be numbered By-law and read a first and second time. C Be it resolved that a by-law read a first and second time, numbered and entitled:

4 By-law Being a By-law to authorize the temporary closing of Front Street (MacTier) in the Township of Georgian Bay. Be read a third time and finally passed. C BY-LAW Assumption of Bressette Drive Being a By-law to assume for public use the road known as Bressette Drive on Part of Plan 35R-16593, Baxter Ward, the Township of Georgian Bay, the District Municipality of Muskoka. It was noted that the portion of the road where the skateboard park is located will be closed Be it resolved that a by-law be numbered By-law and read a first and second time. C Be it resolved that a by-law read a first and second time, numbered and entitled: By-law Be read a third time and finally passed. C Be it resolved that the Council of the Township of Georgian Bay accept the recommendations of the Committee of the Whole meeting of May 29, 2001 with the deferral of Resolution COW C b) MacTier Development Committee Mayor Kennedy noted that no further meetings will be held until results of the SuperBuild Application are known

New Business a) Amalgamation Update District of Muskoka Memorandum regarding Township of Georgian Bay / Township of The Archipelago Amalgamation Proposal Clerk to report on costs to date spent on Georgian Bay / Archipelago initiative The Clerk reported that the total costs to date of the Georgian Bay / Archipelago Initiative is $39, b) Correspondence from the Township of Georgian Bay Public Library Board regarding membership of the MacTier Development Committee Noted and filed c) Tri-annual Newsletter Clerk to report

9 The Clerk noted that it would be, at best, late July, before tax bills are sent d) Correspondence from the District of Muskoka regarding establishment of a task force to examine aspects of property taxation in Muskoka Mayor Kennedy reviewed the background of the task force establishment Be it resolved that the Council of the Township of Georgian Bay appoint Mike Kennedy, John Birnbaum and Guy Crombie to the District of Muskoka Task Force on examination of aspects of property taxation in Muskoka. C e) Go Home Lake Marina Concerns Councillor Bowden reviewed the situation and noted that there are no options available from a municipal stand point with respect to fees charged by private enterprise f) CAO s Report A regarding Water Quality Monitoring Program Discussion took place on various testing programs and reporting standards Councillor Keall left the meeting at 1:15 p.m. Be it resolved that as per the recommendations of CAO s Report A, the Council of the Township of Georgian Bay acknowledge that the contributions of the District of Muskoka and the Greater Bay Area Foundation to the Foundation's 2001 water quality monitoring program are $15,000 and $3,000 respectively and confirm a Township contribution of $15,000 and to consider a further $6,000 pending agreement on the 2001 terms of reference; And further that the Township will enter into an agreement with the GBAF outlining the terms of the 2001 program; C Councillor Jackson requested a recorded vote Be it resolved that the Township of Georgian Bay will participate with the Greater Bay Area Foundation and the District of Muskoka or any other interested parties to work towards the development of a long range water quality monitoring program. 10 Councillor Sutcliffe Mayor Kennedy C x x 0 5 g) Correspondence from Roisin White regarding volunteer service Noted and filed g) Resolution regarding appointment of District of Muskoka Chair Be it resolved that the Council of the Township of Georgian Bay supports the election of the District Chairman as provided by the current District Municipality of Muskoka Act with the exception that the vote be taken by secret ballot. C h) CAO s Report A regarding Waste Management Task Force & Recommendations Councillor Jackson wished the resolution deferred until next meeting so that he could have a chance to communicate with members of the Task Force and District representatives Be it resolved that the Council of the Township of Georgian Bay adopt the attached waste management collection recommendations and appoint a Task Force comprised of The Georgian Bay South Taxpayers Task Force on Garbage and Councillor Jackson; And further that the mandate of the Task Force be to investigate implementation of the Task Force recommendations dated October 17, 2000, to liaise with Township and District staff throughout the monitoring period and to provide progress reports and recommendations to Committee of the Whole. DEFERRED C i) Previously deferred Planning Report A regarding Moose Deer Point First Nation Purchase Shore / Concession Road Allowance Members agreed to the passing of the resolution Moved by Jackson, Seconded by Sutcliffe Be it resolved that the Council of the Township of Georgian Bay authorize the processing of an application for the stopping up and closing and sale of the Shore and Concession Road Allowances for the Moose Deer Point First Nation subject to the 4 points contained in report A. C

11 k) Requests for Resolutions of Support City of Ottawa regarding Environmental Farm Plan Received for information only 8. Closed Session Closed Session to discuss personal matters, matters of litigation, and matters concerning the security of the property of the municipality. Moved by Jackson, Seconded by Sutcliffe Be it resolved that the Council of the Township of Georgian Bay move into Closed Session at 1:40 p.m. to discuss personal matters, matters of litigation, and matters concerning the security of the property of the municipality. C Moved by Sutcliffe, Seconded by Jackson Be it resolved that the Council of the Township of Georgian Bay rise from closed session at 2:15 p.m. with a report. C Moved by Sutcliffe, Seconded by Jackson Be it resolved that the Council of the Township of Georgian Bay adopt the attached Fire Chief position description. C Moved by Sutcliffe, Seconded by Jackson Be it resolved that the Council of the Township of Georgian Bay authorize the interview selection committee for the Fire Chief position to hire an individual prior to the July 8 th, 2001 meeting of Council. C Moved by Sutcliffe, Seconded by Jackson Be it resolved that the Corporation of the Township of Georgian Bay acknowledge and accept a taxation revenue loss of $ as a result of the addition of the Wahta Land Claim settlement lands to their existing reserve.
