ORDER NO. 14 In pursuance of Section 8 read with Section 4 of the Delimitation Act, 2002 (33 of 2002), and having regard to all other relevant Constitutional and statutory provisions in this regard, the Delimitation hereby determines ;- a) the total number of seats to be allocated to the State of Chhattisgarh in the House of the People as Eleven (11); b) of the total number of Eleven (11); seats so allocated to the State of Chhattisgarh in the House of the People, the number of seats to be reserved for the Scheduled Castes and Scheduled Tribes as One (1) and Three (3) respectively; c) the total number of seats to be assigned to the Legislative Assembly of the State of Chhattisgarh, as Ninety (90); and d) of the total number of ninety (90) seats so assigned to the Legislative Assembly of the State of Chhattisgarh, the number of seats to be reserved for the Scheduled Castes and the Scheduled Tribes as Ten (10) and Twenty Nine (29) respectively. N O T I F I C A T IO N In pursuance of sub-section (2) of Section 9 of the Delimitation Act, 2002 (33 of 2002), the Delimitation hereby publishes its proposals for the delimitation of Parliamentary and Assembly Constituencies in the State of Chhattisgarh, together with the dissenting proposals of the Associate Members, and specifies 29 th December, 2005 (Thursday) as the date on or after which the proposals will be further considered by it. 2. Any objections or suggestions in regard to these proposals should reach the Secretary, Delimitation, Nirvachan Sadan, Ashoka Road, New Delhi on or before the said date. (i) PROPOSALS The territorial constituencies into which the State of Chhattisgarh shall be divided for the purpose of elections to (a) the Legislative Assembly of the State, and (b) the House of the People, the extent of each such constituency and the constituencies in which the seats are reserved for the Scheduled Castes and Scheduled Tribes shall be as shown in the Table-A and Table-B respectively; (ii) (iii) Whereas the name of a constituency as shown in Table A or Table B is distinguished by the brackets and letters (SC), the seat in that constituency is reserved for the Scheduled Castes; and Where the name of a constituency as shown in Table-A or Table-B is distinguished by the brackets and letters (ST), the seat in that constituency is reserved for the Scheduled Tribes. Sirs, I have received the delimitation proposals formulated by the with regard to PC s as well as AC s. I am giving my comments and dissenting proposals separately for PC s and AC s. That in my opinion, the proposals with regard to seven PCs namely Sarguja (ST), Jashpur (ST), Janjgir-Korba, Bilaspur, Rajnandgaon, Durg & Bastar are acceptable and remaining four PC s namely Kanker, Raipur, Mahasamund and Raigarh (SC) requires some changes. That I am giving my dissenting proposals and justification with regard to aforesaid four PC s. That I have done this in such a manner that the reservation status as proposed by the remains unchanged, thus making it amply clear that my suggestions/dissenting proposals are actually supported by the parameters of the itself. That, in view of the guidelines framed by the in which parameters like administrative unit, accessibility, geographical compactness and uniform distribution of the population are the major criteria, the proposal of delimiting PC s has some discrepancies which I would like to highlight alongwith my dissenting proposals. 1. That since Chhattisgarh has 16 administrative district of which some are very small and some are very big and with the fact that every PC should have 8 AC s, hence it is possible that no PC should extend to more then 3 district. Whereas in the s proposal, Raigarh PC and Kanker PC has been proposed out of 4 districts. This will make the

18 process of election, counting and declaration much difficult. So keeping the above fact in mind my proposal limit every PC to three district of less. 2. That the itself mandated, that only up to 10% deviation is allowed with regard to average population of any PC. In the s proposal, Kanker PC has population of 21,18,294 i.e % more then the average 18,93,982. This has happened because of inclusion of 9 th AC in Kanker PC. It is easy to recall that in the deliberation with the, I along with other associate members have requested that 9 th AC should be included in those two PC s which has densier population so that the Geographical Sprawl may not be on higher side. Kanker PC is also thinly populated area, hence it is wiser to limit it to 8 AC only and 9 th AC should be included in Raipur PC. My enclosed proposal has done it in accordance of every parameter. 3. That it was also discussed that as far as possible if any district has more then 8 AC then its PC should not extend to more district. In the proposal of, Raipur PC has been proposed out of 3 district where as it could be limited to less, very easily. 4. That the Mahasamund PC in the proposal has been proposed in such a way that it is spread to around 300 KM, which is unnecessary. Moreover two AC s of Mahasamund district has been included in Raigarh PC, making it a PC spread into 4 districts. Though it looks compact in the appearance in the map, however one major geographical feature has not been considered. Barnawapara forest sanctuary and hills forms the natural boundry on the northern side of Mahasamund district. The entire area of Mahasamund district is connected towards Mahasamund by N.H.-6 rather with Raigarh area. Hence it is appropriate to keep all the AC s of Mahasamund district into Mahasamund PC. Hence new seats by the name of Saria in place of Lailunga and Balodabazar in place of Simga and with new formation of Raipur city seats emerges.
