Page 2 of 19 DECEMBER 2015 MEETING Add definition for trees Clarifying when tree credits are required as part of a development project Identifying when the tree code applies to projects Developing supporting handouts or guides for citizens

Page 3 of 19 TREE DEFINITION A self-supporting woody perennial plant characterized by one main trunk, or for certain species, multiple trunks, with a potential at maturity for a diameter-atbreast-height of at least two inches and a height of at least 10 feet.

Page 4 of 19 TREE CREDIT COMPLIANCE Language added to WMC (1) Tree removal on sites with no construction: Future Development. Any development triggering a construction permit on a singlefamily lot shall be required to comply with Chapter WMC. If tree removal under this section results in a site that falls below the minimum tree density, supplemental plantings meeting the requirements of WMC shall be required.

Page 5 of 19 WHEN THE TREE CODE APPLIES Language added to WMC (1): Unless otherwise exempted in WMC [Exemptions section], a development project requiring a construction permit or any proposal to remove trees subject to this chapter shall obtain a tree permit.

QUESTIONS Exhibit 11 Page 6 of 19

Page 7 of 19 TREE PERMITS Sites must have 40 or 60 tree credits per acre when a project is completed Tree credits are based on the size of the tree in tree diameter inches Credits are cumulative for the site Credits were adjusted for smaller trees

1) Emergency tree removal 2) Removal of trees less than 2" Is the project exempt? WMC ) Removal of nonsignificant trees, up to a combined diameter-at-breastheight of 40 inches or 10 tree credits Exhibit 11 Page 8 of 19 Yes No permit No Submit Tree Permit Is tree removal located within a critical area? WMC Yes 1) Tree must be hazard, nuisance or dead. 2)Compliance with tree density credits required No Is exterior construction, grading or other site work proposed? WMC (4) Yes Must meet tree density credit No 1) 2 trees removed without replacement 2) After 2, must replant at rate of 3:1 or meet tree density credit

Page 9 of 19 TREE REMOVAL ON SITES WITH NO CONSTRUCTION (Section 070) 1. Sites with No Construction. This section shall apply only to lots located within single-family residential zones (R-1 through R-8) where no exterior construction or other development activity is proposed. 2. Tree removal on single-family residential lots is permitted as follows: a) Up to two trees may be removed per annual basis with no replacement planting. b) Removal of more than two trees shall only be allowed for the purposes of tree thinning or removal of dead, nuisance, hazard trees. c) Tree removal shall require compliance with the minimum tree density or replacement at a rate of three trees per each removed tree. d) Thinning is defined as the selective removal of trees to improve health of remaining trees, and shall apply to existing trees planted less than seven feet oncenter or at the recommendation of an arborist.

Page 10 of 19 TREE REMOVAL ON SITES WITH NO CONSTRUCTION (Section 070) ALLOWED REMOVAL 1.25 acre property They want to remove 3 trees on the property One tree is considered a nuisance tree After the trees are removed, they counted that they have 90 tree credits (72 credits per acre) NOT PERMITTED REMOVAL 1.25 acre property They want to remove 6 trees on the property One tree is considered a nuisance tree After the trees are removed, they counted that they have 90 tree credits (72 credits per acre)

Page 11 of 19 TREE REMOVAL ON SITES WITH NO CONSTRUCTION (Section 070) ALLOWED REMOVAL 1.25 acre property They want to remove 10 trees on the property Eight trees are considered a hazard They replant 30 trees, at a rate of 3 trees per each removed tree No tree credit calculation is required ALLOWED REMOVAL 1.25 acre property They want to remove 4 trees on the property Trees are all healthy They agree to not remove any additional trees for 24 months

Page 12 of 19 TREE REMOVAL FOR SUBDIVISIONS (Section 080) Must meet tree credits/acre requirement Must also retain 10 percent of tree diameter inches for all existing healthy significant trees Applicants are able to pay into the tree fund for both requirements Subdivisions that abut arterial streets shall provide additional tree plantings at a rate of one tree per 25 feet in the street setback for the arterial.

Page 13 of 19 TREE REMOVAL IN CRITICAL AREAS Limited removal in critical areas Only hazard, nuisance or dead trees can be removed Priority is to create a snag, otherwise felled tree to remain in place No significant changes from existing code

Page 14 of 19 SUPPLEMENTAL PLANTINGS For all trees that are planted to meet tree density requirements Same mix of trees or those in the Plant Species List (to be updated) Minimum 2 inch caliper Spacing is required based on the Plant Species List Priority for planting locations Installation standards

Page 15 of 19 ALTERNATIVE COMPLIANCE (Section 110) Options to earn additional tree density credits for innovative or alternative approaches Criteria established to ensure increased environmental benefits, enhancement of natural areas, long-term tree health Activities include: Retention of specimen or heritage trees and tree groves earn an extra 10 percent Use of low-impact development earns 1 tree credit per 1,000 sf Infrastructure installation earns up to 25 percent per affected tree Planting 15 square feet of understory per tree earns an extra 15 percent

Page 17 of 19 ADMINISTRATION (Sections 010 through 040) Code applies to all tree removal, whether a permit is required or not Trees that are exempted under Section 030 do not require a permit Emergencies Nursery or tree farm Removal of trees less than 2 inches Removal of trees less than 6 inches, up to 40 inches a year Trees in right-of-way removed as part of a project are subject to WMC 2.24

Page 18 of 19 TREE PERMITS (Section 050) Previous code separated tree plans into 4 types Required submittal materials are included in section Tree permit application Site plan Replanting plan Arborist report All materials are required unless specifically waived during review
