MINUTES OF THEJUNE 13, 2017 MEETING Chairman Casar declared the minutes of the June 13, 2017 meeting approved as presented by unanimous consent. Chairman Casar swore in those in attendance planning to speak before the commission. NEW BUSINESS PC A REQUEST TO REZONE 619 E MAIN ST, PARADISE UNITED CHURCH OF CHRIST FROM R-3 MEDIUM DENSITY URBAN RESIDENTIAL DISTRICT TO PGMI PARK, GOVERNMENTAL AND MAJOR INSTITUTIONAL DISTRICT EXISTING CONDITION The rezoning involves the following nine parcels: , , , , , , , and The parcels include the site of Paradise United Church of Christ as well as the surrounding parking lot and access drives. Churches, medical facilities and schools are conditionally permitted within an R-3 zoning district. Within a PGMI district, these facilities are a permitted use.

2 LOUISVILLE PLANNING COMMISSION AUGUST 15, 2017 PAGE 2 ZONING Parcel: R-3 North: R-3 South: R-3 East: R-3 West: B-4 BACKGROUND INFORMATION AND COMMENTS Under the Unified Development Code, churches are a conditionally permitted use within the R-3 Zoning District and are a permitted use within the PGMI District. The City of Louisville established the PGMI Park, Governmental, and Major Institutional District. The PGMI zoning classification and regulations are intended to accommodate parks, public buildings and other large institutional facilities along with their related uses, while ensuring that such uses are compatible with surrounding land uses. The PGMI District provides for electronic message boards (EMB s) to be permitted as a conditional use, subject to specific conditions and requirements. DISCUSSION In considering the rezoning of land within the city, there are several factors to examine. First, is there general support for the proposed zoning classification? Is it compatible with the environs, and supported by the trend of development and/or consistent with City plans and policies? Rezoning of the subject property to the PGMI District will have no effect on the existing land use or pattern of development. However, future changes to the property will be subject to review and approval in compliance with the Unified Development Code, including site plan review and approval by the planning commission for any significant changes. The church will be a permitted use, instead of a conditional use within the R-3 District. A further consideration in the rezoning of property involves whether the proposed rezoning furthers the public interest and not solely the interest of the applicant? In this regard the rezoning is in the public interest as being consistent with the intent and purpose of the PGMI District. While the PGMI District allows for the siting of an electronic message board (EMB), the signage requirements specific to EMB s are intended to mitigate impacts on the surrounding area. A third consideration concerns the availability of public services.

3 LOUISVILLE PLANNING COMMISSION AUGUST 15, 2017 PAGE 3 The subject property is currently served by city water and sewer services and the rezoning will have no effect on traffic or transportation facilities. STAFF RECOMMENDATION Staff finds the rezoning request from R-3 Medium Density Urban Residential to PGMI, along E. Main St., to be consistent with the intent and purpose of the PGMI District. It is however recommended that the Planning Commission discuss with the applicant the need to rezone parcels north of St. Louis Ct. The existing conditions would provide a buffer between zoning districts. Allen Gress was present and represented Paradise United Church of Christ along with the Pastor of the church, Dr. David Anderson. Mr. Gress provided commission members with history details, background information and missions of the church dating back from 1863 to present time. At the time the church was formed, there were no zoning classifications; therefore the church was grandfathered in as R-3 when zoning districts were established. There are no plans at this time for an electronic message board, but they want to be prepared and ready. Dr. Anderson spoke to commission members and feels it is in the best interest of the church to get the zoning issue fixed first, in preparation for an electronic message board. Director Marion discussed modifying the zone change request to only include parcels along E Main St. The remaining parcels, north of St Louis Ct., could then be used as a buffer to the surrounding neighborhood. After discussion, it was decided to continue the request as submitted. MEMBER BOLENDER MOVED, MEMBER CROXTON SECONDED, and the Motion carried to recommend approval for the zone change request as submitted and forward to City Council for consideration. The vote: All yea. PC RONALD VNUK, APPLICANT, 1809 W MAIN ST, CONDITIONAL USE PERMIT REQUEST FOR SERVICE AND REPAIR OF MACHINERY AND EQUIPMENT TO INCLUDE SERVICE/REPAIR GARAGE IN A B-5 GENERAL RETAIL, OFFICE AND MOTORIST SERVICES BUSINESS DISTRICT. ZONING & BACKGROUND INFORMATION Location is 1809 W Main St Property is zoned B-5 Conditional use permits require a hearing with all adjacent property owners notified

4 LOUISVILLE PLANNING COMMISSION AUGUST 15, 2017 PAGE 4 ISSUES TO CONSIDER BASIS OF DETERMINATION. The Planning Commission shall review the particular facts and circumstances of each proposed use against the following general standards as well as any specific standards pertinent to each use indicated herein. The applicant shall establish beyond reasonable doubt that each standard will be satisfied by the completion and operation of the proposed development such that the proposed use: (a) Will be designed, constructed, operated and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; (b) Will not be hazardous or disturbing to existing or future neighboring uses; (c) Will not be detrimental to property in the immediate vicinity or to the community as a whole; (d) Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal and schools; or that the persons or agencies responsible for the establishment of the proposed use shall be able to provide adequately any such service; (e) Will be in compliance with State, County and City regulations; (f) Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets or roads ACTION BY PLANNING COMMISSION. (a) Review by the Planning Commission. The Planning Commission shall review the proposed development, as presented on the submitted plans and specifications in terms of the standards established in this UDO. (b) Only upon conclusion of hearing procedures relative to a particular application and adequate review and study may the Planning Commission issue a Conditional Use Certificate. (c) Conditions Prescribed for Approval. (1) The Planning Commission may impose conditions and safeguards deemed necessary for the general welfare, for the protection of individual property rights, the protection of property values of the community, and for insuring that the intent and objectives of this Unified Development Ordinance will be observed. (2) The Planning Commission may seek expert advice on what conditions should be imposed on the particular operation to reasonably modify any injurious or offensive effects likely to result from such an operation. The cost of securing such expert assistance shall be borne by the applicant. (d) Such review by the Planning Commission shall be completed and made public within ninety-five (95) days of the date of submission

Mr. Vnuk explained to commission members that his business consists of rebuilding race car motors and engines. He currently works in Cleveland and is relocating to Louisville. He is the only employee and business hours are during the day. Mr. Vnuk stated he has no concerns with the guidelines described in the staff report. He will have minimal noise and odors and no outdoor storage materials. Nora Slater who resides at 116 California Ave was present and raised concerns regarding noise, mess and oil with the business. Mr. Vnuk assured Mrs. Slater none of these things will become a problem. MEMBER BOLENDER MOVED, MEMBER CROXTON SECONDED, and the Motion carried to approve a conditional use permit. The vote: All yea. OTHER BUSINESS Director Marion informed commission members of potential text amendments to the code regarding hotels and motels. The size, access and configuration details are a few items going to be discussed for modification. Having no further business the meeting was adjourned.
